NOTIFICATION
New Delhi , the 11th June 1974
G.S.R. 264 ( E ) . In exercise of the powers conferred by Section 75 of the Customs Act . 1962 ( 52 of 1962 ) and Section 37 of the Central Excises and Salt Act, 1944 ( 1 of 1944 ) , the Central Government hereby makes the following rules further to amend the Customs and Central Excise Duties Drawback Rules , 1971 . published with the notification of the Government of India in the Ministry of Finance (Department of Revenue and Insurance ) No. G.S.R. 1219 , dated the 25th August , 1971 at pages 825 to 831 of the Gazette of India Extraordinary Part II , Section 3. Sub - Section ( i ) , dated the 25th August , 1971 , namely : -
1. ( 1 ) These rules may be called the Customs and Central Excise Duties Draw- back (Amendment ) Rules , 1974 .
( 2 ) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 2 of the Customs and Central Excise Duties Drawhack Rules , 1971 (hereinafter referred to as the said rules ) : -
( a) in clause ( a ) ---
( i ) in sub - clause ( i ) , the brackets and letter " ( i ) " and the word " or " occurring at the end shall be omitted :

( 11 ) sub - clause ( in) shall be omitted;
(b ) in clause ( e ) , for the words " a Schedule " , the words " the Schedule " shall be substituted .
3. In rule 3 of the said rules--
(a) in sub - rule ( 1 ) , for the word and figures " Schedule II " , the words "The Schedule " shall be substituted;
(b ) in subrule ( 2 ) , clause ( f ) shall be omitted and clause ( g ) shall be re- lettered as clause ( f ) .
4. In the said rules , SCHEDULE 1 , shall be omitted .
5. In the said rules , in SCHEDULE II , for the heading " SCHEDULE II " , the heading " THE SCHEDULE " shall be substituted .

सा० फा ० नि० 264 (अ) -फेन्द्रीय सरकार , गीमा-णुःक प्रधिनियम, 1962 (1962 का 52 ) की धारा 75 और केन्द्रीय उत्पाद शुल्क और नमक अधिनियम, 1944 (1944 का 1) की धारा 37 द्वारा प्रदत्त शक्तियों का योग करते हुए , मीमा शुल्क और केन्द्रीय उत्पाद शुल्क वापसी नियम , 1971 , में जो भारत गरकार के वित्त मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना सं ० मा ० का ० नि ० 1219, नारीख 25 अगस्त , 1971 में भारत के राजपत्त्र, असाधारण- भाग 2-खण्ड - उप-खण्ड ( ⅰ ) , तारीख 25 अगस्त, 1971 के पृष्ठ 8.32 से 844 पर हिन्दी में प्रकाशित हुए , आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:--
1. ( 1 ) इन नियमों का नाम सीमा शुल्क और केन्द्रीय उत्पाद शुल्क धापसी (संशोधन ) नियम, 1974 है ।
( 2) ये राजपत्त्र में प्रकाशन की तारीख को प्रदत्त होंगे ।
2. सीमा शुल्क और केन्द्रीय उत्पाद शुल्क वापसी नियम , 1971 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) ; नियम 2 में,--
(क ) खण्ड ( क) में —
(i) उप-खण्ड ( i ) में, " ( i) " कोष्ठक और अक्षर तथा अन्न में आए हुए पाब्द "या" का लोप किया जाएगा ;
( ii ) उप-खण्ड ( ii ) का लोप किया जाएगा ।

3. उक्न नियमों के नियम 3 में-
( क) उप नियम ( 1 ) में " अनूसूची 2 " शब्द आर अंक के स्थान पर " अनुसूी " गब्द्र रखा जाएगा ;
(ख) उप नियम ( 2 ) में, खण्ड (च ) का लोप किया जाएगा और खण्ड ( छ ) को खण्ड (च ) के रूप में पुनराक्षरित किया जाएगा ।
4. उक्त नियमों में में अनुसुची I का लोप किया जाएगा ।
5. उक्त नियमों में, अनुसूची 2 में " अनुपुची 2 ' के स्थान पर " ग्रनुसूची" शीर्षक रखा जाएगा ।
