CENTRAL EXCISES
New Delhi , the 20th June 1974
G.S.R. 276 ( E ) . In exercise of the powers conferred by sub - rule ( 1 ) of rule 8 of the Central Excise Rules , 1944 , the Central Government hereby exempts fertilisers of the description specified in column ( 2 ) of the Table below and falling under Item No. 14HH of the First Schedule to the Central Excises and Salt Act, 1944 ( 1 of 1944) from so much of the duty of excise leviable thereon as is equivalent to the duty calculated on the value specified in the corresponding entries in column ( 3 ) of the said Table .

2. The exemption contained in this notifleation shall apply only to a manufac- Lurer who , before clearing the fertillser specified in column ( 2 ) of the Table , under- takes to credit the amount specifled in the corresponding entry in column ( 3 ) of the sald Table into the Fertiliser Pool Equalisation Fund in accordance with the direc- tions issued by the Central Government , and produces , within sixty days of the date of clearance of the said fertiliser , sufficient proof to the satisfaction of the proper officer that the amount has been so credited.
3. Nothing contained in this notification shall apply to any of the fertilisers specified in the said Table , which is imported into India .

सा० का ० नि ० 276 ( अ ) केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क नियम, 1944 के नियम 8 के उपनियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , एतद्वारा केन्द्रीय उत्पाद शुल्क और नमक अधिनियम , 1944 ( 1944 का 1 ) की प्रथम अनुसूची के मद सं ० 14 जंज के अधीन सम्मिलित तथा नीचे की सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट वर्णन के उर्वरकों की. उन पर उग्रहणीय उसने उत्पा दन शुल्क में जो, उक्त सारणी के स्तम्भ ( 3 ) में तत्स्थानी प्रविष्टि में विनिदिष्ट मूल्य पर संगणित शुल्क के समतुल्य हो , छूट देनी है

2. इस अधिसूचना में सम्मिलित छूट केवल उस विनिर्माता को लागू होगी जो , सारणी के स्तम्भ, ( 2 ) में विनिर्दिष्ट उर्वरक को साफ करने से पूर्व , उक्त मारणी के स्तम्भ ( 3 ) में तत्स्थानी प्रविष्टि में विनिर्दिष्ट रकम उर्वरक पूल समानान्तरण निधि में जमा करने के लिए केन्द्रीय सरकार 1301 SEC. 3 ( 1 ) ]

द्वारा जारी किए गए निवेशों के अनुसार वचनबद्ध होता है तथा उक्त उर्वरक को साफ करने की तारीख में साठ दिन के भीतर उचिन अधिकारी के ममाधानप्रद रूप में इस बात का यथेष्ट प्रमाण प्रस्तुत करता है कि रकम उस प्रकार जमा कर दी गई है ।
3. इस अधिसूचना की कोई बात उक्त सारणी में विनिर्दिष्ट उर्वरकों में से ऐसे किसी उर्वरक को लागू नहीं होगी जो भारत में आायात की जाती है ।
