8.O. 387 ( E ). Whereas the Central Government is of opinion that it is necessary 10 appoint a Commission of Inquiry for the purpose of making an inquiry into a definite matter of public importance, to wit , the communal disturbances that occurred in the area falling within the jurisdiction of the Sadar Bazar Police Station , Delhi , on the 5th day of May , 1974 .
Now , therefore , in exercise of the powers conferred by section 3 of the Com- missions of Inquiry Act , 1952 ( 60 of 1952 ) , the Central Government hereby appoints Shri R. Prasad , formerly Secretary to the Government of India , as one- man Com- mission of Inquiry .
(1 ) The terms of reference of the Commission shall be as follows : - - (a) to inquire into the causes and course of the disturbances which took place in the area falling within the jurisdiction of the Sadar Bazar Police Station , Delhi , and the areas adjoining it , on 5th May, 1974;
( b ) to inquire into the adequacy of the administrative measures taken to prevent and to deal with the said disturbances: ( c ) to recommend measures which may be adopted to prevent the recurrence of such disturbances in the special conditions of the Sadar Bazar Jocality; and
( d) to consider such other matters as may be found relevant in the course of the inquiry .

( ii ) The Commission will be expected to complete its inquiry and submit its tinal reportto the Central Governmenternment within four months from the date of this notification
2. And , whereas the (' entral Government is of opinion having regard to the nature of the inquiry to be made by the Commission and other circumstances of the case , that all the provisions of sub - section ( 2 ) , sub - section ( 3 ) , sub -section (4 ) and sub - section ( 5 ) of section 5 of the Commissions of Inquiry Act , 1952 ( 60 of 1952) should be made applicable to the Commission , the Central Government hereby directs , in exercise of the powers conferred by sub - section ( 1 ) , of the said section 5 , that all the provisions of sub - section ( 2 ) , sub - section ( 3 ) , sub - section ( 4 ) and sub -section ( 5 ) of that section shall apply to the Commission .

का० प्रा ० 387 ( प्र) यत. केन्द्रीय सरकार की राय है कि सार्वजनिक महम्व के निश्चित मामले में , अर्थात्-साम्प्रदायिक उपद्रव जो मई , 1974 के पांचवे दिन सदर बाजार पुलिम स्टेशन, दिल्ली की अधिकारिता वाले क्षेत्र में षटिन हुए , जाच करने के प्रयोजनार्थ जाच कमीशन नियुक्त करना आवश्यक है ;
अन जाच कमीशन अधिनियम , 1952 ( 1952 का 60 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार , श्री श्रार ० प्रसाद , भारत सरकार, पे पूर्वतर सचिव को एफ्ल व्यक्ति जांच कमीशन एप्तद्वारा नियुक्त करती है ।
( i ) कमीशन के निदश की शर्ते निम्नलिखित हैं--
(क) उपद्रवो के , जो 5 मई, 1974 को सदर बाजार पुलिस स्टेशन दिल्ली की अधिकारिता वाले क्षेत्र में और उमर्ग लग हुए क्षेत्रों में हुए, कारण और अनुक्रम की आच करना;
(ख) उक्त उपद्रवो का सव्यवहार करने और निवारित करने का लिए गए प्रशासनिक उपायो की पर्याप्तता की जांच करना ,
(ग) उन उपायो की सिफारिण करना जो सदर बाजार स्थल की विशेष दशाम्रों में ऐसे उपद्रवों के आवर्तन को निवारित करने के लिए अगीकृत किए जाए ;
( १) ऐसे अन्य मामलों पर विचार करना जो जाच के अनुक्रम में सुपगत हो ।
( ii ) कमीवान में इस अधिसूचना की तारीख से चार माह के भीतर अपनी जाच पूरी करने और केन्द्रीय सरकार को अपनी रिपोर्ट भेजने की प्रत्याशा की जाएगी ।

2. और यतः केन्द्रीय सरकार की, कमीशन के द्वारा की जाने वाली जांच के स्वरूप और मामले की अन्य परिस्थितियों को ध्यान में रखते हुए राय है कि जांच कमीशन अधिनियम , 1952 (1952 का 60) की धारा 5 की उपधारा ( 2 ) , उपधारा ( ३ ) , उपधारा ( 4 ) और उपधारा ( 5) के उपबंध कमीशन को लागू किए जाए , अतः केन्द्रीय सरकार , उक्त धारा 5 की उधारा ( 1 ) के द्वारा प्रवत प्राश्तियों का प्रयोग करते हुए एतद्धारा निवेश देती है कि उस धारा को उपधारा ( 2) , उपधारा ( ३ ) , उपधारा ( 4 ) श्रऔर उपधारा ( 5 ) के समस्त उपबंध कमीशन को लागू होगे ।
