New Delhi , the 25th June 1974
G.S.R. 284 ( E ) /IDRA/30/1/74.-Whereas certain draft rules further to amend the Registration and Licensing of Industrial Undertakings Rules 1952 , were publisherl as required by sub - section ( 1 ) of section 30 of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) , at pages 767-69 of the Gazette of India , Extra- ordinary, part II , Section 3 , Sub-- section ( i ) , dated the 5th April , 1974 , under the notification of the Government of India in the Ministry of Industrial Development . No. G.S.R. 173 ( E ) / IDRA / 39 / 1 / 674 / 6 , dated the 5th April 1974 , inviting objections or suggestions from all persons likely to be affected thereby before the 6th May . 1974;
And whereas the said Gazette was made available to the public on the 15th April , 1974 ;
And whereas no objections or suggestions have been received by the Central Government on the said draft .
Now, therefore , in exercise of the powers conferred by section 30 of the Indus tries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) the Central Government hereby makes the following rules further to amend the Registration and Licensing of Industrial Undertakings Rules , 1952 , namely : --
1. These rules may be called the Registration and Licensing of Industrial Under- takings (Third Amendment ) Rules, 1974 .

2. They shall come into force on the date of their publication in the Official Gazette.
3. In the Regulation and Licensing of Industrial Undertakings Rules , 1952- (1) in Form A, -
( 1 ) in paragraph 1 , after clause ( c ) , the following clause shall be inserted . namely:-
"(d) industrial undertakings producing on 7th February , 1974 , or at any time during the twelve months preceding that date , any articles relatableable to the industries added to the First Schedule by the Industries (Development and Regulation ) Amendment Act . 1973 , " .
( ii ) in paragraph 2 , tor the words , figures and letters " or 1st March , 1967 " , the figures , letters and words , 1st March 1957 , or 7th February 1974 " shall be substituted;
( 2) in Form B ,--
( 1 ) in paragraph 1 , after clause ( c ) , the following clause shall be inserted, namely: --
' ( d ) industrial undertakings which had taken effective steps as (defined in rule 2 ( ii ) of these rules , on or before the 7th February , 1974 , for the production of articles relatable to the industries added to the First Schedule by the Industries ( Development and Regulation ) Amendment Act , 1973. " .
( 11 ) in paragraph 2 , for the words , figures and letters " or 1st March , 1957 " , the figures , letters and words , " 1st March , 1957 , or 7th February , 1974" shall be substituted ,

सा० का ० नि ० 284 ( अ ) / आई ० डी० आर ० ए ० / 30/ 1 / 74.-यतः औद्योगिक उपक्रमों का रजिस्ट्रीकरण और अनुज्ञापन नियम , 1952 में और संशोधन करने के लिए कतिपय प्रारूप नियम, उद्योग (विकाम और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 30 की उपधारा ( 1 ) द्वारा यथापेक्षित भारत सरकार के श्रौद्योगिक विकास मंत्रालय की अधिसूचना सं ० सा ० का ० नि० 173 ( ह ) /आठ डी आर 1/39/1/674/6 , तारीख 5 अप्रैल , 1974 के अधीन भारत के राजपत्त्र असाधारण, भाग 2 , खण्ड 3 , उपखण्ड ( ⅰ ) , तारीख 5 अप्रैल, 1974 के पृष्ठ 767-69 पर प्रकाशित किए गए थे जिनमें उन सभी व्यक्तियों में 6 मई, 1974 में पूर्व आक्षेप या सुझाव मांगे गए थे जिनका उनसे प्रभाषित होना सम्भव था:
श्रऔर यप्तः उक्न राजपत्र जनना को 15 अप्रैल , 1971 को उपलभ्य करा दिया गया था ।
श्रऔरयन. उक्त प्राम्य पर केन्द्रीय मरकार द्वारा कोई श्राक्षेप या सुझाव प्राप्त नहीं किए गए हैं ;
अतः , अब केन्द्रीय सरकार , उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ). की धारा 30 द्वारा प्रदत्त णक्तियों का प्रयोग करते हुए , श्रौद्योगिक उपक्रमों का रजिष्ट्रीकारण और अनुशापन नियम, 1952 में औरसंशोधन करने के लिए निम्नलिखित नियम, बनाती है, अर्थात्--
1. इन नियमो का नाम औद्योगिक उपक्रमों का रजिस्ट्रीकरण और अनुशापन ( संशोधन) मियम, 1974 है ।
2 ये राजपत्त्र में प्रकाशन की नारीख को प्रवृत्त होंगे ।

3. श्रौद्योगिक उपक्रमों का रजिस्ट्रीकरण और अनुज्ञापन नियम, 1952 में,--
( 1 ) प्ररूप (क) में,---
( i) पैरा 1 में, खण्ड ( ग ) के पञ्चात् निम्नलिखित खण्ड प्रन्तःस्थापित किया जाएगर , अर्थात्:-
" ( घ ) 7 फरवरी , 1974 को या उम तारीख में पूर्ववर्ती 12 मास के दौरान किसी समय उद्योग ( विकास और सियसन) संशोधन अधिनियम, 1973 द्वारा प्रथम अम्सूची में जोड़े गए उद्योगों से सम्बन्धित फिन्हीं वस्तुनों का उत्पावन करने बायें औद्योगिक उपक्रम" ;
( ii ) पैरा 2 में . "या पहली मार्च, 1957 " शब्दों, अंकों और प्रक्षरों के स्थान पर, " पहली मार्च , 1957 या 7 फरवरी , 1974" अंक , अक्षर और शब्द रखे जाएंगे ;
(2 ) प्ररूप (ख) में,--
( i) पैरा 1 में खण्ड ( ग ) के पश्चात्निम्नलिखित खण्ड अन्तःस्थापित किया जाएगा, अर्थात्ः- "( ध) ऐसे औद्योगिक उपक्रम जिन्होने उद्योग ( विकास और विनियमन ) संशोधन अधिनियम, 1973 द्वारा प्रथम अनुसूची में जोड़े गए उद्योगों से सम्बन्धित वस्तुओं के उत्पादन के लिए 7 फरवरी , 1974 को या उससे पूर्व इन नियमों के नियम 2 ( ii ) में यथापरिभाषित प्रभावशाली कदम उठाए हो । " ;
(ii) पैरा 2 में, "या पहली मार्च , 1957 " शब्दो, अंको और अक्षरों के स्थान पर , " पहली मार्च. 1957 या 7 फरवरी , 1974 " अंक , अक्षर और शब्द रखे जाएंगे ।

अवधारण करने में भारत सरकार के वित्त मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना सं ० 47/ 72--केन्द्रीय उत्पाद शुल्क , तारीख 17 मार्च , 1972 के उपबन्धों के अधीन की गई मोटर यानों के टायरों के निकासी मूल्य को गणना में लिया जाएगा ।

Provided that such exemption shall apply only in relation to the first clearance of the tyres of the description specified in column ( 1 ) of the said Table for home consumption during any financial year upto a total value of fifty lakhs of rupees ; Provided further that in determining under the preceding proviso the total value of fifty lakhs of rupees for the period commencing on the 1st April , 1973 and ending with the 31st March , 1974 , the value of clearances of tyres for motor vehicles effected under the provisions of the notification of the Government of India in the Ministry of Finance ( Department of Revenue and Insurance ) No. 47 / 72 - Central Excises , dated the 17th March , 1972 shall be taken into account ,

सा ० का ० नि ० 16 (अ) -केन्द्रीय सरकार, केन्द्रीय उत्पाद शुल्क नियम , 1944 के नियम 8 के उपनियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के विस मंत्रालय ( राजस्व ग्रोर श्रीमा विभाग ) को अधिसूचना म ० 47/ 72--केन्द्रीय उत्पाद शुल्क , तारीख 17 मार्च , 1972 को अधिक्रान्त करते हुए , इसमे उपाबद्ध सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट वर्णन के टायरों के , जो केन्द्रीय उत्पाद शुल्क और नमक अधिनियम , 1944 ( 1944 का 1 ) की प्रथम अनुसूची की मद में ० 16 की उपमद ( 1 ) के अन्तर्गत आते हैं , मम्बन्ध में उन पर उदग्रहणीय उतने उत्पाद शुल्क से छूट देती है , जितना उक्त सारणी के क्रमशः स्तम्भ ( 2 ) में विनिदिष्ट शुल्क से अधिक है ग्रौर यह छूट उक्न सारणी के स्तम्भ ( 3 ) में वर्णिन शनों के अधीन होगी ।

यदि गृह उपभोग के लिए, वित्तीय वर्ष के दौरान विनिर्माता द्वारा निकामी किए गए मोटर यान टायरों का कुल मूल्य दो करोड़ रुपये से अधिक न रहा हो ।
मोटर यानों के लिए टायर, मित्राय उनके जो भारत मरकार के वित्त मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना में ० 6 / 74--केन्द्रीय उत्पाद-शुल्क, तारीख 18 जनवरी, 1974 में उपाबद्ध मारणी में चालीस प्रतिशन मूल्यातुमार विनिर्दिष्ट हैं ।
परन्तु यह छूट गृह उपभोग के लिए किसी वित्तीय वर्ष के दौरान पचास लाख रुपये तक के कुल मूल्य के उक्त सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट वर्णन के टायरों की प्रथम निकामी के मम्बन्ध में ही लागू होगी :
परन्तु यहऔर भी कि पहली अप्रैल , 1973 को आरम्भ होने वाली और 31 मार्च, 1974 को ममाप्त होने वाली अवधि के लिए पिछले परन्तुक के अधीन पचास लाख रुपये के कुल मूल्य या
