S.O. 405 ( E ) . Whereas the Supreme Court has , in its judgment delivered on the 24th November 1971 on the Writ Petitions filed by the manufacturers of motor cars in regard to the selling prices of the cars manufactured by them, directed the Central Government to review the prices of the three makes of cars manufactured in the country every six months after taking into consideration of claims submitted by the manufacturers of the sald cars for increase in the prices of the cars manu- factured by them .
And whereas the Central Government has considered the claims submitted by the manufacturers of the said cars for increase in the prices of the said cars :
Now , therefore , in exercise of the powers conferred by Section 18 G of the Industries (Development and Regulation ) Act 1951 ( 65 of 1951 ) , the Central Government hereby makes the following order further to amend the Motor Cars (Distribution and Sale ) Control Order , 1959 , namely
1. (1) This Order may be called the Motor Cars ( Distribution and Sale) Control (Second Amendment ) Order 1974 .
(2) It shall come into force on the 1st day of July 1974 .

2. For Schedule I to the Motor Cars ( Distribution and Sale) Control Order , 1959 , the following Schedule shall be substituted , namely :

कां० भा० 405 ( प्र) यतःउच्चतम न्यायालय ने , मोटर कार के विनिर्माताओं द्वारा, अपने द्वारा विनिर्मित कारों की विक्रय कींमत के संबंध में की गई रिट याचिका पर , अपने 24 नवम्बर, 1971 को दिए गए निर्णय में केन्द्रीय सरकार को , देश में विनिर्मित तीन प्रकार की फारों की कीमत, उक्त कारों के विनिर्मिताओं द्वारा , उनके द्वारा विनिर्मित कारों की कीमत में वृद्धि के लिये प्रस्तुत किए गए वानों पर विचार करने के पश्चात् प्रत्येक घ्छः मास के पश्चात् पुर्विलोकन करने का आदेश दिया था ,
और यतः केन्द्रीय सरकार ने उक्त कारों के विनिर्माताओं द्वारा उक्त कारों की कीमत में , कृषिद्ध के लिये प्रस्तुत दायें पर विचार कर लिया है ।
अतः अब , केन्द्रीय सरकार उद्योग ( विकास ओर विनियमन ) अधिनियम , 1951 ( 1951 का 65) की धारा 18छ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , मोटर कार ( वितरण और विक्रय ) नियंत्रण भादेश , 1959 में और संशोधन करने के लिये निम्नलिखित आदेश करती है , अर्थातः-
1. ( 1 ) इस आदेश का नाम मोटर कार ( वितरण और विक्रय ) नियंत्रण (व्वितीय संशोधन) भादेश, 1974 है ।
( 2) यह । जुलाई, 1974 को प्रवृत्त होगा ।

2. मोटर कार ( बितरण और विक्रय ) नियंत्रण भादेश , 1959 की प्रथम अनुसूची के स्थान पर निम्नलिखित अनुसूची रखी जाएगी, अर्थात:-

स्पष्टीकरण--ऊपर विनिर्दिष्ट कीमों कारखानेद्वार पर की कीमतें है, जिनमें व्यवहारी का कमीशन म्मिलित है और उत्पाद शुल्क , केन्द्रीय विक्रय कर और स्थानीय कर , यदि कोई हो, और परिवहन प्रभार सम्मिलित नहीं है ? ये कीमतें 31 दिसम्बर, 1974 तक प्रवृत्त रहेगी । "
