NOTIFICATION
New Delhi , the 26th July 1974
G.S.R. 332 ( E ) . In exercise of the powers conferred by section 34 , read with sub - section ( 2 ) of section 6 , of the Coal Mines ( Nationalisation ) Act , 1973 ( 26 of 1973 ) , the Central Government hereby makes the following rules , namely :-
Short title and commencement .- ( 1 ) These rules may be called the Coal Mines (Intimation regarding Mortgage , Charges , Lien or other interests ) Rules , 1974 ,
( 2 ) They shall come into force on the date of their publication in the official Gazette .
2. Definitions . In these rules , unless the context otherwise requires ,- ( a ) " Act " means the Coal Mines ( Nationalisation ) Act , 1973 ( 26 of 1973 ) ;
(b ) " seciion " means a section of the Act ,
3. Time- limit for intimation - Every mortgagee of any property which has vested under the Act in the Central Government or a Government Company , and every person holding any charge , lien or other interest in or in relation to any such property , shall give intimation of such mortgage , charge , lien or other interest to the Commissioner within a period of thirty days from such date as may be specified by the Central Government under section 20 :
Provided that if the Commissioner is satisfled that the mortgagee or the person holding any charge , lien , or other interest was prevented by sufficient cause from giving the intimation within the said period of thirty days , he may, receive the Intimation within a further period of thirty days , but not thereafter .

4. Manner of intimation.- ( 1 ) Every intimation to be given to the Commis- sioner under rule 3 shall be in writing , addressed to the Commissioner , and shall contain the folowing particulars , namely :-
( a ) Name , description and full address of the mortgagee/ charge , lien or other interest holder ;
(b ) name , description and full address of the coal mine or a group of coal mines;
( c ) name and address of the owner / owners of the coal mine or a group of coal mines;
(d ) amount of claim ( in Indian currency )
( e) particulars of the mstrument , if any , by which the mortgage , charge , lien or other interest is secured , supported by an attested copy of the instrument ;
( f ) amount . if any already received , with particulars ;
( g ) any other particulars relevant to the claim;
( h ) relief clain.ed .
(2 ) Every intimation shall he duly signed and verified by the mortgagee , or the person holding the charge , lien or other interest or a duly authorised agent , ( 3) Intimations may be filled in the office of the Commissioner at Calcutta on all working days during oflice hours or may be sent to the Commissioner by registered post , with acknowledgement due .

सा ० का ० वि ० 332 ( अ) केन्द्रीय सरकार कोयला खान ( राष्ट्रीयकरण ) अधिनियम, 1973 ( 1973 का 26 ) की धारा 6 की उपधारा ( 2 ) के साथ गठित धारा 34 द्वारा प्रदत्त शक्तियां का प्रयोग करते हुए निम्नलिखित नियम बनाती है , अर्थात्: -
संक्षिप् न म ओर प्रारम्भ ( 1 ) इन नियमों का नाम कोयला खान ( बंधक , भार , धारणा- धिकार या अन्य हितों सम्बन्धी सूचना ) नियम , 1974 है ।
( 2) ये नियम राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं. इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,--
(क ) "अधिनियम" से कोयना खान ( राष्ट्रीयकरण ) अधिनियम, 1973 ( 1973 का 26) अभिश्रत है:
(ख ) "धारा " मे डप अधिनियम की धारा अभिप्रेन है ।
3. सूचना के लिए समय की परिसीमा-ऐमी सम्पत्ति का , जो केन्द्रीय सरकार या सरकारी कम्पनी में इस अधिनियम के अधीन निहित हो गई है , प्रत्येक बन्धकदार और ऐसी सम्पत्ति में या उसके सम्बन्ध में कोई भार, धारणाधिकार या अन्य हित धारण करने वाला प्रत्येक व्यक्ति , ऐसी तारीख से तोम दिन की श्रधि के अन्दर जो धारा 20 के अधीन केन्द्रीय सरकार द्वारा विनिर्दिष्ट की जाए , ऐसे बन्त्रक भार, धारण धिकार या एन्य हित की सूचना आयुक्त को देगा ;

परन्तु यदि आयुक्त का यह समाधान हो जाता है कि बन्धकदार या कोई भार, धारणाधिकार या अन्य हित धारण करने वाला व्यक्ति पर्याप्त कारणवण तीस दिनर्कः उक्त अवधि के अन्दर सूचना देने से निवारित किया गया था तो , वह तीस दिन की अतिरिक्त श्रवधि के अन्दर कोई ऐसी सूचना ग्रहण कर सकता है , किन्तु इसके पश्चात् नहीं ।
4. सूचना की रीति ( 1 ) नियम 3 के अधीन श्रायुक्त को दी जाने वाली प्रत्येक सूचना बिखित में आयुक्त को मम्बोधित की जाएगी और उसमें निम्नलिखित विशिष्टियां अन्र्तावष्ट होंगी, अर्थात् :-
(क) बन्धकदार/ भार , धारणाधिकार या अन्य हित के धारक का नाम , वर्णन , पूरा पता ;
(ख) कोयला खान या कोयला खानों के समूह का नाम, वर्णन और पूरा पता ;
(ग) कोयना खान य। कोयला खानों के समूह के स्वामी स्वामियों के नाम और पते ;
(घ) दावे की रकम ( भारतीय करेंसी में ) ;
(ङ) ऐसी लिखित की विशिष्टियां , यदि कोई हैं। , जिसके द्वारा बन्धक , भार , धारणाधिकार या अन्य हित प्रतिभृन किया गया है, उनके साथ लिखित की एक अनुप्रमाणित प्रतिलिपि भी भेजी जाए ;
(च) पहले प्राप्त की गई रकम, यदि कोई हो, और उमकी विशिष्टियां;
(छ) दावे से सुसंगत कोई अन्य विशिष्टियां ;
( ज) दावाक्कृन अनुतोष ।
( 2) प्रत्येक सूचना बन्धकदार या भार, धारणाधिकार या अन्य हित धारण करने वाले व्यक्ति या सम्यक् रूप से प्राधिकृत अभिकर्ता द्वारा सम्यक् रूप में हस्ताक्षरित और सत्यापित की जाएगी ।
( 3 ) सूचनाएं कलकत्ता स्थित आयुक्त के कार्यालय में सभी कार्य दिवसों पर कार्यालय समय के दौरान फाइल की जा सकेंगी या रसीदी रजिस्ट्री डाक द्वारा आयुक्त को भेजी जा सकेंगी ।
