Dissenting Proposals
I
LOK SABHA CONSTITUENCIES
Ratangiri District is divided into two Lok Sabha Constituencies i.e. (1) Rajapur Consti- tuency consisting of Six Vidhansabha Constituencies of South Ratangiri (2) Ratangiri Lok Sabha Constituency consisting of Six Vidhansabha Constituencies of the Northern part of Ratangiri District and Mahad of Kulaba District.
VIDHANSABHA CONSTITUENCIES
So far there were 13 Vidhansabha seats allotted to our district. Now that number is reduced to 11 and further this deduction is made from only Rajapur Parliamentary Constituency and, which we feel principally is unfair. As such it is- suggested that one Vidhansabha Constituency from each of the two Loksabha Constituency should be dropped in order to ensure the proper and just balance. Based on the Principals of population balance, Geographical Contiguity, transport facilities and Social connections the following delimitation is proposed of the Vidhan- eabha Constituencies in Ratangiri District.

Present draft proposal of Delimitation Comr,
I. Rajapur Constituency
Rajapur Constituency Rajapur Tahasil 161493
I6I493 35443
Rajapur Tahasil Bhambcd R.I.C of Lanja Tahasil —
161493
196936
Reasons—Rajapur Tahsil geographically spans from sea coast to the hilly and in- accessible ranges of shadvi. Addition of equally inaccessible region of Bhambed RIC will render this constituency most inconvenient for communication. Considering this point it is suggested that Bhambcd RIC should not be included in it.. Besides the population of Rajapur is ade- quate to constitute one constituency.

The following minor modification? in the proposed constituencies in District Thana Maha- rashtra, are suggested:— i. (56I AMRERNATH
In Ambcrnath Assembly constituency the exclusion of Dombivali Municipality contra- vences the basic principles laid down for the formationn.
Dombivali Municipality is part and parcel of Thafcurli Revenue circle . So it will be more- natural to include the Dombivali Municipality in Ambcrnath Assembly Constituency. In between Dombivali and Kalyan there is a Thakurli Railway Station and all other villages of Thakurli revenue circle
Dombivali Municipality, which is proposed to be included in Kalyan Assembly is not conti- guous to Kalyna Municipal Limits. Moreover all the villages in Thakurli revenue circle are- having shopping facilities in Dombivali Municipal area. All the I.D.C. Industrial area which has been developed in Thakurli revenue circle mainly because Dombivali being a railway station Moreover Dombivali Municipallimitsaic surrounded all round by the villages of the Thakurli revenue circle. On the grounds mentioned above, the Dombivali Municipality should be in- cluded in the Ambernath Assembly constituency.
94-299 87,081 Ulhasnagar Tahsil Population excluding Badlapur RIC Thakurli1 RIC including Dombivali Municipal limits
1,81,380
As Dombivali Municipal area is included in Ambernath Constituency, further changes are consequential.
2. (57) KALYAN
In proposed Kalyan Assembly constituency the inclusion of Dombivali Municipality is contrevening the principles laid down. Kalyan and Dombivali are not closed connected' as Thakurli re v cnue clrcle and other villages in Thakirli revenue circle. For instance Chola Grampanchayat and Thakurh Grampanchayat are situated between these two townships. Moreover Kalyan and Dombivali are having no business relations whatsoever except railway line. There is no means of communications by road directly. On these basic principles Dombivali Municipality should be excluded from Kalyan Assembly consti- tuency. Our proposal for Kalyan Assembly constituency is as follows:
99*547 19477 41,706 Kalyan Municipality J . . . . .. Kalyan RIC ShahadRIC
1,60,730
3. (58) MURBAD
In the proposed Murbad constituency, the Vasind revenue circle in Shahpur tahsil is against the basic principles. Vasind revenue circle is far away from Murbad. Moreover there is no direct road connecting to these villages in Vasind revenue circle. The villages in Vasind revenue circle have no economic, social and cultural relations. Whatsoever, with the villages in Murbad tahsil, there will be lot of inconveience to arrange the election compaign from Murbad in Vasind revenue circle. Comparatively the inclusion of Badlapur revenue circle in Ulhasnagar tahsil will be in mo" c consonence with the principles laid down. This Badlapur revenue circle was already in old Kalyan tahsil prior to the Division into Kalyan and Ulhasnagar tahsils. Moreover this Badlapur revenue circle was part pf Mu'bad Assembly constituency from 1952 Therefore it will be in interest of justice to include Badlapur revenue circle in Ulhasnagar tehsil.
99=585 12,869 Our proposal is as follows:— Murbad tahsil . . . . . . . . . .. NadgaonRIC
13,702 22,272 Titwala RIC Badlapur RIC in Ulhasnagar

Vashind RIC from Shahapur Tahsil which has been excluded from Murbad Constituency for the reason that it has no direct means of communications to Murbad should be included in Shahapur Constituency. The other reason for keeping Vaishnd RIC in Shahapur Constituency ia that the Shahapur Constituency is reserved for S.T. In Vashind RIC the S.T. population is to the extent of 20.77%. So it would be in the interest of the S.T. population to keep the R.I.C. in its own Tahsil.

Proposed changes In Pechora, Chalisagaon, Jalgaon, Bhuiaval, Chopada in Edlabad

Reasons
Pachora and Chalisgaon are Municipal Cities and are independent Head Quarters of T ahsil. The departments and offices such as revenue, Block Development Agriculture, B&C, Irri galion Power etc. offices are located at Tahsil i.e. at Pachora and Chalisgaon. These are also big Mar- keting Places of Tahsil. The voters usually come to Tahsil for marketing and at the same time if they have got any difficulty and grievances. They try to solve these difficulties through their representatives (MLA) as the representative usually stay at Tahsil. If the representative has to look after more than one Tahsil it goes very difficult for him to keep the contact of both Tuh- sils. Waghali RIC is from Chalisgaon Tahsil. It is included in Pachora Constituency on the ground of Population. However the population of Pachora Tahsil is 1,49,422 and the popula- on of Chalisgaon Tahsil is 2,or,r94 including Waghali RIC. So on the basis of population if we
SEC. 3(11)] THE GAZETTE OF INDIA EXTRAORDINARY 1593v "'
frame Pachora Tahsil and Chalisgaon Tahsil as independent Assembly constituency it will be more convenient to the voters as Waghali RIC is very close and near to Chalisgaon Tahsil. Even on the ground of Population Chalisgaon Constituency will not be bigger or Pachora Constituency will not be smaller aa the Honourable Election Commissioner has proposed the Constituencies having the population more than 2 lakhs and in some cases less than 1 lakh fifty thousand. For Exam nit:

Moreover the balances of percentage of S.C. and S.T. population will not be disturbed by accepting the above changes in the constituency. Similarly on the ground of population, dis- tance, convenience and compactness of Constituency, it is desirable and just to have Pachora Tahsil and Chalisgaon Tahsil as independent Assembly Constituencies.

Reasons
Jalgaon District has been allotted Twelve Assembly Constituencies divided them into two Lok Sabha Constituencies such as 17-Jalgaon Parliamentary Constituency includes 95-Jalgaon, 97- Jamner, 98-Bhusaval, 99-Yawal, 100-Ravcr and 101-Edlabad, the population being 10,32,396, i6-Erando! Parliamentary Constituency included 90-Chalisgaon, 91-Parola, 92-Amalner, 93- Chopada, 94-ErBndole and 96-Pachora population being 10,90,725.
93-Chopada Assembly Constituency includes Kanalada RIC which is from Jalgaon Tahsil while Chopada Tahsil formsi the part of 16-Erandol Parliamentary Constituency and 95-JalgaOE Assembly Constituency forms the part of 17-Jalgaon Parliamentary Constituency. So instead oi
SEC 3(11)] THE GAZETTE OF INDIA EXTRAORDINARY 1595Keeping Kanalda RIC in Chopada Assembly Constituency it will be more logical, proper and con- venient to keep Kanalda RIC in Jalgaon Assembly Constituency. If we accept the change the population of these two Parliamentary Constituencies will be as follows :— 10-Erondol Parlia- mentary Constituency 1,056,167 and 17-Jalgaon Parliamentary Constituency 10,56,954 as the popu- lation of SC and ST is less in these constituencies. The balance and the percentage of SC and ST population will not be disturbed.
Considering the facilities available to the voters such as communications, transport, distance compactness etc. it is more convenient and proper to exclude Kanalda RIC from 93-Chopada As- sembly Constituency. There is a big Tapti River between Chopada Tahsil and Kanalda RIC of Jalgaon Tahsil which has no bridging facilities. The Candidate of Chopada Constituency will have to go from the Chopada to Jalgaon and then to come Kanalda for propaganda. The distance by road from Chopada to Jalgaon is about 40 to 50 miles and from Jalgaon to Kanalda is about 5 to 20 miles. This will create a big hardship in election campaign. If we exclude the Kanalda RIC from 93-Chopada Assembly Constituency the population of this Constituency will be 1,54,294 as shown above. This population is sufficient so as to frame 93-Chopada Assembly Constituency of Chopada Tahsil only.
Now considering the above proposal we will have to include Kanaldi RIC in 95-Jalgaoii Assembly Constituency thereby the population of 95-Jalgaon Assembly Constituency will be 2,34,423. This population will be more for one constituency. To minimise this we will have to exclude Jalgaon Rural from 95-Jalgaon Constituency and to include it in 98-Bhusaval Assembly Constituency (at present 98-Bhusaval Assembly Consitucncy consists of this area only). This change will effect in making 95-Jalgaon Assembly Constituency of 1,83, 651 and 98-Bhusaval Assembly Constituency of 2,09,674 suppose if we feel that the population of 98-Bhusaval Constituency is more than the fix norms then in that case we can exclude Goregaon RIC from 98-Bhusaval Assembly Constituency and include it in 101-Edlabad Assembly Constituency thereby the population of 98-Bhusaval Assembly Constituency will be, 1,95,574 and 101-Edlabad Assembly Constituency be 1,73,670 without disturbing the balance and percentage of SC and ST population.
I discussed the proposed Constituencies with the workers and the Voters of my district and after discussions they have given the above proposals. I also discussed the changes with the Honoura- able Members of DELIMITATION COMMISSION of our State. They have no objections in accepting these changes by the Honourable Election Commission. I therefore humbly request to the Delimitation Commisson to accept the above proposals.

I wish to suggest the following changes in 119-Melghat Assembly Constituency for con- sideration.
Commission's proposal Changes suggested
1. Melghat Tahsil
1. Mclghat Tahsil
2. Paratwada Municipality and Paratwada RIC 2. Include villages specified in the list attached, in Achalpur Tahsil.
3. Delete the villages as per hst attached.
4. Delete Paratwada Municipality in Achalpur
Tahsil.
The changes suggested arc with a view to make the Constituency more contiguous and compact. There are more tribals and hence it is a Scheduled Tribe Constituency. T'w villages suggested to be included have more Scheduled Tribes population and villages suggested to bo deleted have more non-Tribals.

I propose the following amendment, to constituencies 170, 173, 175 for the reasons given below:—
Nanded Tahsil comprises of 4 R.I. Ca. Kandhar „ „ „ 4 „ Biloll „ „ „ „ 5 „
As proposed both Nanded Tehsil and Biloli Tahsil get a separate constituency. But Kan- dhar Tahsil, even though it comprises of 4 R.I.C.s is not given a separate seat. It is not just- flable to divide a Tahsil having four R.I.Cs. to divide in two parts. It will be more natural and in the interest of justice and equity that each Tahsil as far as possible should get a separate neat and this has been done in so many cases even though the population in a small Tahsil is less than the average population for a seat in the District.
SBC. 300] THB GAZETIfc OF INDIA EXntAOWMNAJHT i; ,Therefore it will be most natural and justifiable and in the interest of justice and equity to provide a separate scat for Kandhar Tahail comprising of three R.I.Cs. of Kandhar Tahsil and some part of adjoining R,I.C, from an adjoining Tahsil.

It is proposed that some villages from Malshiras R.I.C. should be included in Sangola Constituency. Some of these villages have irrigation facilities. The entire 'Sangola TahsiT is scarcity affected area and very much backward in all respect. So if some villages are to be included in 'Sangola Constituency", those villages should be as far as possible having the same problems as that of the people from Sangola Tahsil.
So I proposed that the following villages from 'Sangola Constituency' should be excluded
and should be included in 'Malshiras Constituency'

1596/16 THE GAZETTE OF INDIA EXTRAORDINARY [PART II—In case of Khnnapur tahsil when it is possible to form a separate Constituency by combi- ning 3 RIC out of 4 thereof, it would not be justifiable to divide this tahsil into two slices each containing 2 RICs just to attach them to said two separatr Constituencies.
This proposal for a separate Vite Assembly Constituency may therefore, please be accepted. The consequential change in the Atpadi Constiiuency would be to include one separate R IC therein instead of Vite RIC.
This [can be done only by including Savalaj RIC of Tasgaon :ahsil in Atpadi Constituency.
One more point also needs careful consideration in this case. And that is, whether it is absolutely, essential to Join the two RICs, vie; Wangi RIC and Kadepur RIC in Khanapur tahsil to Bhilawadl RIC of Tasgaon tahsil, when Bhilawadi RIC it not connected by_ direct roads to Wangi andKadpur RICs and also not having any trade and commercial transactions and relations arising therefrom with the Wangi and Kadepur RICs of Ka Khanapur tahsil.
In view of the said grounds the amended proposals may kindly be accepted.

It is proposed to make slight changes in 268-Shirala Constituency n and 269 Walva Consti- tuency in Sangli District.
As the Shirala Tahsil has got less than required population for a constituency, the com- mission has proposed to take out Yelur R.I.C. from Waive Tahsil and include the same to Shirala Tahsil.
From 1962, five villages viz. Kasegaoh, Wategaon, Shene, Surul, and Zarde from Yelur R.I.C. were in Walva constituency and seven villages viz. Gotkhindi, Bhadkimbe, Bahadurwadi, Kanegaon, Koregaon, Tandulwadi, Malewadi from Ashta R.I.C. were in Shirala constituency. It is proposed to keep the same villages in the respective constituencies. By proposing this change, there will not be material change in the population of these two constituccies. The villages which were in S Waive constituency are unwilling to go to Shirala constituency and terefore slight changes as follows are proposed in- Shirala and Walva on constitueocies.
(I) Following five villages froih Yelur RIC of Waive Tahsil may please be 'include in Walva constituency :
(1) Kasegaon (2) Wategaon (3) Shene (4) Surut (5) Ozarade
(I) Following sefen villages from Ashta R. I. C. of walva Tahsi, may pliase be cxluded from Walva constituency and incldcd on Shirals Constituency.

48-7-1974,
1 propone the following amendments to 277, 278, 279 280, 281, 284, 285 constituencies in
v olhtipur District.
Reasons for Amendments
KnlJiapur and Karvir—(i) 6 Election Wards viz; No. 1 to 4, 24 and 30 having population of
the Kolhapur Municipal Corporation, should be included in the Kolhapur Constttuen y instead of the Karvir Constituency as proposed originally,
A, B, C, and D wards of the Kolhapur City comprise 'Old* Kolhapur which is a compact and
thickly populated pan of the present kolhapur City.
Kolhapur.—(2)—7 Election Wards viz., No. 39 to 45 of the Kolhapur Municipal Corporation may please be included in theJCaiw Constituency. The saiH Election Wards of the Kolhapur Municipal Corporation are situated in the extended parts of the Kolhapur City and included in the 'E' Ward thereof.
It is thereforej proposed that these wards may please be included in the Karvir Cons-
tituency.
These 7 wards have population which should be deducted from the population uf
which has been proposed to be included in the Kolhapur Constituency.
I59&/IW T HE GAZETTE OF INDIA EXTRAORDINARY [PART II—It may be pointed out here that the areas included in the said 6 municipal election wards were included in the Kolhapur City Constituency even in the last two elections, Assembly viz., 1967 and 1972, on account of the above mentioned reason. This inclusion of diese 6 Municipal election wards in the Kolhapur Constituency may therefore, be continued as before.
The effect of the above 3 amendments would be as follows :—
Kolhapur Constituency Karvir Constituency
Population Population
(3) Instead of the inclusion of the Kolhapur Rural in Karvir Constituency, Kolhapur Rural part may please be included in the Vadgaon (or Ilatkunangale) Reserved Constituency for the following reasons—
1. It has very high percentage of the Scheduled Castes, viz.3 18-09.
2. It is adjoining to both the Hutkanangalc and Vadgaon circles having highest and high
percentage of Scheduled Caste population viz. 18-21% and 16 • 15%
3. These areaB together forms a compact part of the Kolhapur District which has nt 17- 48 pergent of the Scheduled Caste population the highest percentage in any of the pro- posed constituencies.
The non-inclusion of the Karvir Rural in the Karvir Constituency would have the effect of 30, 415 population.
CB) Thus in view of the above amendments thtKarvir Constituency will have the following population :—
Original proposal Deduction of the population 6 Municipal election Wards viz ; Nos. 1 to 4) 24; and 30 in the Old City. Addition of the population of 7 Municipal Election Wards viz. 39 to 45 in the extended part of the City, Deduction of the population of Kolhapur Rural viz. 30,415.
(A) In view of the above amendments the Kolhapur Constituency will have the following population—
According to original proposal. Addition of the population of 6 Municipal Election Wards viz. 1 to 4, 24 and 30, in the Old City. Deduction of the population of 7 Municipal Election Wards viz. 39 to 45 in the extended part of the City.

47 Kolhapur—2) For the last two elections 1967 and 1971 the Shirol, Ichalkaranji (then Ilatkanangale') and Vadc;aon (SC) were not joined to Kolhapur Parliamentary Constituency.
(il Kolhapur Parliamentary Constituency for the last two general elections, viz. 1967 and 1071, comprised the following Assembly Constituencies :—
1. Kolhapur, 2. Karvir, 1. Kagni, 4. Gadhinglai, 5. Chandg;id and 6. Sawantwadi. Instead of the Sawantw.idi Assembly Constituency, the newly formed Sangrul Assembly Constituency, which is mostly a part of the Karvir taluka, may please be included now in this Kolhapur Parliamentary Constituency.
In view of the above grounds the Kolhapur Parliamentary Constituency should comprise the following Assembly Constituencies—
Kolhapur Karvir Sangrul Kagal Gadhingla] and Chandgad (284) (285) (282) (286) (287) (288)
48. Ichalkaranji Parliamentary Constituency
If the Kolhapur Parliamentary Constituency as proposed above is accepted then the remaining Parliamentary Constituency, viz. Ichalkaranji, would comprise the following Assembly Constituencies :—
Shirol Ichalkaranji Vadgaon(SC) Shahuwadi Panhala and Radhanaori (277) (278) (279) (280) (281) (283)
This was the Parliamentary Constituency for the last two elections, viz. 1967 and 1971 under the name 'Hatkanagalc'.
The above proposals for the formation of two Parliamentary Constituencies may, therefore, be accepted.

SCHEDULED TRIBES CONSTITUENCIES
In Maharashtra Stite there are 17 scheduled tribes Assembly Constituencies pro- posed by the Delimitation Commission. In Vidarbha region, Amravati District and Chandrapur District have got on; and tu9 seats respectively. The existing seat of Rale- gaon Constituency in Yeotmal district is deleted by the Commission. We propose one seat for Yeotmal District. We hfivc proposed a change in Ralegaon and Kclapur Constituencies in Yeotmal District by other- draft signed by me. According to that proposed changed Ralegaon Constituency owns a S.T. population of 62864 i.e. 32.89% while in Kelapur the scheduled tribe population is 50692 i.e. 30.69%. There is a sche- dule area in the Yeotmal Districr and as such Yeotmal District has higher rate of po- pulation of scheduled tribes. Relegaon may have a less percentage than Nandurbar Constituency in Dhulia District which is at No. 17 in Scheduled Tribes' list but I propose Ralegaon should be scheduled tribe Constituency even though it may be number 18. Out of 17 Constituencies given in the proposal, any one constituency can be dele- ted for Ralegaon and thus present position of Ralegaon as Scheduled Tribe Constituency be maintained.

SCHEDULED CASTE CONSTITUENCIES
In whole of Maharashtra 17 Assembly seats are allotted 10 scheduled castes.
But those seats are concentrated more in Marathwada region and according to the pro- posal of Delimitation Commission Marathwada region gels 6 Assembly Constituencies and two Parliamentary Cinilitucncics. We want to sproad out those 17 scheduled castes seats region-wise as follows:—
3 4 2 2 6
1. Vidarbha Region 2. Marathwada 3. Greater Bombay 4. Bombay Division 5. Poona Division
In BombBy proper new name 30-Ambedkar-nagar Constituency (Chauls) should be scheduled caste constituency and second one should be 35-Dharav iConstituency (Matunga). In Bombay Division Dewalali in Nasik District and Chalisgaon in Jalgaon District should be the scheduled Caste Constituencies, which are also proposed by the Deli- mitation Commission. Vidarbha area at present is having three scheduled caste Consti- tuencies. One Constituency i.e. North Nagpur in Nagpur Corporation Area should be scheduled caste reseved Constituency. No. 114-Washim Constituency in Akola District, should also be scheduled caste Constituency and No. 143-Bhandara Constituency in Bhandara District should also be scheduled caste Constituency instead of No. 145- Tirora Constituency. 174-Degloor, the proposed scheuled caste constituency in Nanded District should remain as proposed. 176-Gangakhcd in Parbhani District should remain scheduled caste constituency as proposed. 205-Her in Osmanabad District should also be scheduled caste constituency as proposed. 207-KaUam in Osmanabad District should remain as scheduled caste Constituency as proposed.
These arc the four following Constituencies in Poona Division which we propose as scheduled caste Constituencies.
, . . North Sholapur
. Man in Satara District. . Jath in Sangli District
No. 218 . No. 259 . No. 276 No. 279
Wadgaon in Kolhapur District
These four are the proposed scheduled caste constituencies by the Commission. In Ahmcdnagar District we propose No. 228 Shrigonda in place of No. 227 Karjat as scheduled caste constituency and according to our proposed change of the Ahmednagar District, Shrigonda has got more percentage of scheduled caste population than that of Karjat Constituency. In Poona District we propose 248-Parvart as scheduled caste constituency in place of 255-Baramati and according to our proposed change which we have given Parvati has got higher percentage of scheduled caste of population. Thus according to our proposal each Cor- poration Area in Maharashtra State gets one scheduled caste scat which is necessary.
3EC. 3(11)] THE GAZETTE OF INDIA EXTRAORDINARY 1596/25Schedule Caste Parliamentary Constituencies in Maharashtra State
At present there are 3 seats and seats proposed by Commission arc also three, riz. 36 Osmanabad, 38 Pandharpur and 34 Bhir. 36 Osmanabad and 34 Bhir both hese seats are in Marathwada region. Our proposal is that 34 Bhir should be made tencral and in its place ifi Buldhana existing Reserved in Vidarbha region should be •eserved so that Vidarbha, Marathwada and Western Maharashtra Region get one seat :ach and this way seats are allotted region-wise.

And that is, whether the Vite RIC of Khanapur tahsil should be joined to Atpadi Utahsil and thereby detached from the two RICs of the same tihsil viz; Wangi and Kadepur RICs. In this connection it may be pointed here one important fact that Vite town 18 the head- quarter of Khanapur tahsil. Vile Town has its Municipality, a College, a Judicial Court, Tahsildar's offlce3 Police Sub- Inspector's Office, Industrial Estate having Powerloom units etc. VitcK is also a good trade and commerce centre having good transport links. If Vite RIC of Khanapur tahflil is not detached from the two RICs of the same tahsil viz; Wangi and Kadepur, it would be possible to form a separate Assembly Constituency, if one adj- oining RICs, vie; Visapur, is joined, to it. Thus the all sided importance of Vite would be conveniently maintained If such a Consti- tuency is delimited. The second point, in this respect may please be taken into consideration. That Is, whether it is desirable, properand justifiable to divide the Khanapur tahsil having 4 RICs and include vts 2 RICs in one Constituency, viz; Atpadi and the remaining 2 RICs in another Constituency viz; Bhiawadi. Ge trally the entity of a tahsil is maintained cither fully or substantially as far as possible whi elirniting an Assembly Constituency. ↩
