S.O. 62 (E ) . In exercise of the powers conferred by sub - section ( 1 ) of section 15 of the Forward Contracts ( Regulation ) Act , 1952 (74 of 1952) , the Central Government hereby rescinds the notification of the Government of India in the late Ministry of Com- merce and Industry , S.R.O. 241. dated the 25th January , 1955 .

S.O. 63 (E ).In exercise of the powers conferred by section 17 , read with section 16 . of the Forward Contracts (Regulation ) , Act , 1952 , (74 of 1952) , the Central Government hereby declares that no person shall , save with the permission of the Central Government, enter into any forward contract for the sale or purchase of any of the goods specified in the Schedule below in any place in India and ( fixes , under clause (a) of the said section 16 , the rate prevailing at the time at which the forward ( market in the said goods closed on the date of this notification , or , if there was no trading on that day , on the last preceding date of trading , as the rate at which any such forward contract entered into on or before the date of this notification and remaining to be performed after the s'ald date shall be deemed to be closed .

का० श्रा ० 63 (अ).-- केन्द्रीय सरकार अग्रिम संविदा ( विनियमन ) अधिनियम , 1952 ( 1952का 74 ) की धारा 16 के साथ पठित धारा 17 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये घोषणा करती है कि कोई व्यक्ति केन्द्रीय सरकार की अनुज्ञा के बिना भारत के किसी स्थान पर नीचे की अनुसूची में विनिर्दिष्ट किसी भी वस्तु के विक्रयया क्रय के लिये कोई अग्रिम संविदा नहीं करेगा और उक्त धारा 16 के खंड ( क ) के अधीन उस दर की जो उस समय जिस समय इस अधिसूचना की तारीख को उक्त वस्तुओं का वायदा बाजार बंद हुआ था या यदि उस दिन कोई व्यापार नहीं हुआ था तो व्यापार की अन्तिम पूर्ववर्ती तारीख को विद्यमान थी ऐसी दर के रूप में नियत करती है जिस दर पर कोई ऐसी अग्रिम संविदा बंद की गई समझी जायगी जो इस अधिसूचना की तारीख को या उसके पूर्व की गई थी और उक्त तारीख के पश्चात जिसका पालन किया जाना था ।

S.O. 64 (E) . Whereas forward contracts for the sale or purchase of the goods specified In the Schedule below in any place in India have been prohibited by the notification of Government of India, in the Ministry of Industry and Civil Supplies S.O. No. 63 (E ) dated the 1 February , 1975.
And whereas the Central Government is of opinion that in the interest of the trade and in the public interest , it is expedient to regulate and control non- transferable specific delivery contracts in respect of the said goods;
Now, therefore , in exercise of the powers conferred by sub -section (3 ) of section / 18 of the Fordward Contracts (Regulation) Act , 1952 , (74 of 1952 ) , the Central Government THE GAZETTE OF INDIA EXTRAORDINARY

hereby declares that the provisions of sub sections ( 1 ) and ( 2) of section 17 of the said Act shall apply to non - transferable specific delivery contracts in respect of the said goods in the whole of India .

फा० मा ० 64 ( प्र ) .--यतः भारत में किसी स्थान पर नीचे की अनुसूची में विनिर्दिष्ट वस्तुओं के विक्रय या क्रय के लिये अग्रिम संधिदायें भारत सरकार के उद्योग और नागरिक पूर्ति मंत्रालय की अधिसूचना संख्या का ० आ० 63 ( श्र ) तारीख 1 फरवरी 1975 द्वारा प्रतिषिद्ध कर दी गई हैं ;
और यत . केन्द्रीय सरकार की राय है कि व्यापार के हित में और लोक हित में उक्त वस्तों की बाबत अनन्तरणीय विनिर्दिष्ट परिदान संविदाओं को विनियमित और नियंत्रित करना समीचीन है ;
अतः अब केन्द्रीय , सरकार , अग्रिम संविदा ( विनियमन ) अधिनियम , 1952 ( 1952 का 74) की धारा 18 की उपधारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये , घोषणा करती है कि उक्त अधि- नियम की धारा 17 की उपधारा ( 1 ) और ( 2 ) के उपबंध उक्त वस्तुओं की बाबत अनन्तरणीय विनि- विष्ट परिदान संविदाओं को सम्पूर्ण भारत में लागू होंगे ।

S.O. 65 (E ) . In exercise of the powers conferred by sub - section ( 1 ) of section 17 of the Forward contracts ( Regulation ) Act , 1952 , ( 74 of 1952) as applied to non - transferable specific delivery contracts in respect of goods mentioned in the Schedule below , by the notification of the Government of India in the Ministry of Industry and Civil Supplies S.O. No. 64 ( E ) , dated the 1st February , 75 , the Central Government hereby declares that no person shall , save with the permission of the Central Government , enter into any non -transferable specific delivery contract for the sale or purchase of the said goods in the whole of India except the following classes of such contracts :
( i ) Any non - transferable specific delivery contract for the sale or purchase of the said goods which is performed wholly by actual tendering of goods and the payment of the full price therefor ; and ( ii ) any non - transferable specific delivery contract for the sale or purchase of the said goods under which actual tendering of goods becomes im- possible or unlawful owing to circumstances over which the contracting parties have no control .

का० प्रा० 65 ( म) .-केन्द्रीय सरकार, भारत सरकार के उद्योग और नागरिक पूर्ति मंत्रालय की अधिसूचना सं ० का ० श्रा ० 64 ( श्र ) तारीख 1 फरवरी, 1975 द्वारा नीचे की अनुसूची में उल्लिखित वस्तुओं की बाबत अनन्तरणीय विनिर्दिष्ट परिदान संविदाओं को यथा लागू अग्रिम संविदा (विनियमन ) अधिनियम , 1952 ( 1952 का 74 ) की धारा 17 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रभोग करते हुये, घोषणा करती है कि कोई व्यक्ति , केन्द्रीय सरकार की अनुआ के बिना, उक्त वस्तुओं के विक्रय या क्रय के लिये कोई अनन्तरणीय विनिर्दिष्ट परिदान संविदा , ऐसी संविदाओं के निम्नलिखित वर्गों को छोड़कर, सम्पूर्ण भारत में नहीं करेगा:-
( 1 ) उक्त वस्तुओं के विक्रय या क्रय के लिये कोई ऐसी अनन्तरणीय विनिर्दिष्ट परिदान संविदा , जिसका पूर्णतः पालन , माल वस्तुतः निविदत करके और उनकी पूरी कीमत का संदाय करके किया जाता हो ; और
( ii ) उक्त वस्तुओं के विक्रय या क्रय के लिये कोई ऐसी अनन्तरगोग विनिर्दिष्ट परिदान संविदा, जिसके अधीन माल का वस्तुत निविदान ऐसी परिस्थितियों के कारण असंभव या विधि- विरूद्ध हो जाता है , जिन पर संविदाकारी पक्षकारों का कोई नियंत्रण न हो ।

S.O. 66( E) . Whereas forward contracts for the sale or purchase of castor oil in any place in India have been prohibited by the notification of the Government of India , in the late Ministry of Commerce and Industry No. S.R.O. 242 , dated the 25th January , 1955;
And whereas the Central Government is of opinion that in the inrest of the trade and in the public interest , it is expedient to regulate and control non -transferable specific delivery contracts in respect of castor oil ;
Now, therefore , in exercise of the powers conferred by sub- section (3 ) of section 18 of the Forward Contracts ( Regulation ) Act , 1952, ( 74 of 1952 ) , the Central Government hereby declares that the provisions of sub - sections ( 1 ) and ( 2) of section 17 of the ca Act shall apply to non - transferable specific delivery contracts in respect of castor oil in the whole of India.

का० प्रा० 66 ( श्र ) . यतः भारत में किसी स्थान पर एरण्ड के तेल के विक्रय या क्रय के लिये अग्रिम संविदायें, भारत सरकार के भूनपूर्व वाणिज्य और उद्योग मंत्रालय की अधिसूचना संख्या का० नि ० ग्रा० 242 , तारीच 25 नवरी , 1 55 द्वारा प्रतिषिद्ध कर दी गई ;
और यतः केन्द्रीय रकार की राय है कि व्याण के हित में और लोक हित में एरण्ड के तेल की बावत अनन्तरणोय विनिर्दिष्ट परिदान संविदाओं को विनिर्याप्त और नियंत्रित करना समीचीन है ;

अतः बंब , केन्द्रीय सरकार , अग्रिम संविदा ( विनियम। अर्धाियम, 1.52 ( 1:52 का 74) की धारा 18 की उपधारा ( 3 ) द्वा । प्रदत्त शक्तियों का प्रयो करते हुये , घोषणा करत है कि उक्त अधिनिय की धारा 17 की उपधारा ( 1 ) और ( 2 ) के उपबंध एरण्ड तेल का बाबत श्रनन्तरणीय विनिश्ष्टि परिदान मंदाओं को पूर्ण भा' त में लागू होंगे ।

S.O. 67 (E ) . In exercise of the powers conferred by sub - section ( 1 ) of section 17 of the Forward Contracts ( Regulation) Act , 1952 , ( 74 of 1952 ) , as applied to non - transfer- able specific delivery contracts in respect of castor oil by the notification of the Govern- ment of India in the Ministry of Industry and Civil Supplies S.O. No. 66 ( E) , dated the 1st February , 75 , the Central Government hereby declares that no person shall , with the permission of the Central Government , enter into any non - transferable specific delivery contracts for the sale or purchase of castor oil in the whole of India except the following classes of such contracts namely: -- save
( i) Any non - transferable specific delivery contract for the sale or purchase of castor oil which is performed wholly by actual tendering of such oil and the payment of full price therefor , and ( ii ) any non - transferable specific delivery contract for the sale or purchase of castor oil under which actual tendering of oil becomes impossible or unlawful owing to circumstances over which the contracting parties have no control .

का० प्रा० 67 ( थ) .--केन्द्रीय सरकार , भारत सरकार के उद्योग और नागरिक पूर्ति मंत्रालय की अधिसूचना संख्या का ० श्रा ० 66 ( श्र ) तारीख 1 फरवरी , 1975 द्वारा एरण्ड तेल की बाबत अनन्तर- णीय विनिर्दिष्ट परिदान संविदाओं को यथा लागू अग्रिम संविदा ( विनियमन ) अधिनियम , 1952 ( 1952 का 74 ) की धारा 17 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये , घोषणा करती है कि कोई व्यक्ति , केन्द्रीय सरकार की अनुझा के बिना , एरण्ड तेल के विक्रय या क्रय के लिये कोई अनन्तरणीय विनिर्दिष्ट परिदान संविदा , ऐसी संविदाश्रों के निम्ननिखित वर्गों को छोड़कर , सम्पूर्ण भारत में नहीं करेगाः--
( i ) एरण्ड तेल के विक्रय या क्रय के लिये कोई ऐसी अनन्तरणीय विनिर्दिष्ट परिधान संविदा , जिसका पूर्णतः पालन , ऐसे तेल के वस्तुतः निविदत करके और उनकी पूरी कीमत का संदाय करके किया जाता हो , और
( ii ) एरण्ड तेल के विक्रय या क्रय के लिये कोई ऐसी अनन्तरणीय विनिर्दिष्ट परिदान संविदा जिसके अधीन तेल का वस्तुतः निविदान ऐसी परिस्थितियों के कारण असंभव या विधि - विरूद्ध हो जाता है, जिन पर संविदाकारी पक्षकारों का कोई नियंत्रण न हो ।
