the No. DRAWBACK / PN - 40 / 75.-Under rule 4 of the Customs and Central Excise Duties Drawback Rules , 1971 ( Notification No. 52/ F No. 602/ 2 / 70 - DBK , published in Gazette of India , Extraordinary , dated the 25th August , 1971 ) , the Central Government hereby makes the following amendments in the Table published in the Public Notice No. DRAWBACK / PN - 1 , dated the 15th October, 1975-
For sub - serial No. 1927 and 1929 and the entries relating thereto , the following shall be substituted:--

सं ० प्रतिश्रवायगो/पी० एम०-4075 सीमाशुल्क तथा केन्द्रीय उत्पादनशुल्क प्रतिश्रदायगी नियमावली , 1971 ( भारत के राजपत्र श्रमाधारण , दिनाक 25 अगस्त, 1971 में प्रकाशित अधिसूचना स ० 52/फा ० स ० 602/2/70 -प्र० प्र ० ) के नियम 4 के अधीन , केन्द्रीय सरकार सार्बजनिक सूचना स ० प्रतिश्रदायगी/ पी ० एन ० । दिनाक 15 अक्तूबर , 1971 में प्रकाशित मारणी में एतद्वारा , निम्नलिखित सशोधन करती है--

लेन्स ग्लेयर ग्लास सहित या उसके बिना किसी भी रूप मे सेचुलोस एसिटेट प्लास्टिक से बने चश्मे के फेम/चश्में और धूप के चश्मे , चाहे वे निम्नलिखित मे सामग्री से किसी मे युक्त हो अथवा नही-कब्जे, रिबट/ शील्ड ज्वाइट पाश्यो पर तार , रोल्ड/ गोल्ड फिल्ड/ सोने का मुलम्मा किया हुआ तार और/ अथवा संघटक, एत्युमिनियम के ऐनोडी- कृत पार्श्व , नोज पैड , टिप श्रादि ।
परन्तु यह तब , जब कि सीमाशुल्क समाहर्ता को यह इतमीनान हो जाय कि निर्यात किये गये चण्मे चश्मो के फ्रेम , पुरुषो तथा महिलाओ के नाप के वास्तविक चश्में के फ्रेम/ चश्मे अथवा धूप के प्चश्में है ।
सभी अन्य चश्मो के प्लास्टिक फ्रेम/चश्मे/ 295 रु० ( केवल दो रुपये और पचानवे 1929
पैसे) प्रति किलोग्राम ।
धूप के चश्मे, जो श्रन्यव निर्दिष्ट नही ने ।
यह सार्वजनिक सूचना नवम्बर 1974 के प्रथम दिन से लागू हुई समझी जायगी ।

No. 602 /2 / 70 - DBK , published in the Gazette of India , Extraordinary , dated the 25th August , 1971 ) , the Central Govern- ment hereby makes the following amendments in the Table published in the Public Notico No. DRAWBACK / PN - 1 , dated the 15th October , 1971 :-

NorF . ( 1 ) The rates of drawback in respect of Sub - Serial No. 4615 and 4616 are in- clusive of packing materials.
(2) The rates of drawback on 'Down rod for electric ceiling fans' or 'Blades for electric ceiling fans ' having weight other than the weight specified against sub - serial Nos . 4615 and 4616 will be proportionately higher or lower than the rates indicated against respective sub - serial numbers according to the weight ascertained .
This Public Notice shall be deemed to have come into force on the 1st day of Novem ber , 1974 .

नोट.-- ( 1) उपक्रम सं ० 4615 तथा 4616 के संबंध में प्रतिश्रदायगी की दरों में पैकिग सामग्री भी शामिल है ।

( 2 ) 'छत के विद्युत पखो के लिए नीचे की ओर मुडी हुई छड़े अथवा छत के विद्युन पखो के ब्लेड' के लिए जिनका भार - उपक्रम स ० 4615 तथा 4616 के सामन उल्लिखित भार में भिन्न हा , प्रतिअदायगी की दरे निश्चित किये गय भार वा अनुसार अलग अलग उपक्रम मख्याओ के सामने अकित दरो से आनुपातिक रूप में उच्चतर अथवा निम्नतर होगी ।
यह सार्वजनिक सूचना नवम्बर , 1974 के प्रथम दिन मे लागू हुर्द समझी जायगी ।

(a) fitted with imported three speed hubs
Rs . 15 25 (Ruper fifteen and parse twenty five oniva per bicycle plus the amount of im- port duty paid on the imported 3 speed hubs as de- termined with re- ference to the rele- vant Bill ( s) of Entry on a ' lurst In First Out ' basis .
Provided that the manufacturer / exporter produces evidence to the satisfaction of the Collector of Customs regarding import and duty incidence in respect of an adequate number of 2 speed hubs to cover the export of S.L.R Bicycles fitted with 3 speed hubs and provided further that the imported 3 speed hubs in respect of which such evidence 15 produced , have not been-
(i ) similarly co- related to and accounted for against any other previous exporta- tion; and
( 11) previously re -exported as such or in any other form , whether under claim for drawback or otherwise .
NOTE . The above rate is exclusive of drawback on packing materials , if any , which may be claimed separately under the appropriate ' all industry' nates .
(b) Other than these fitted with three speed hubs , whether exported in assembled or S.K.D. or C.K. D. condition .
Rs . 15 25 ( Rupees fifteen and paise twenty five only per Bicycle ( ex- clusive of drawback on packing material which may be claimed separately under appropriate 'all industry' rates of draw bck ) .
This Public Notice shall be deemed to have come into force on the 1st day of November 1974 .

सं ० प्रतिश्रवायगी/ पी ० एन०-42/ 75.--सीमाशुल्क तथा केन्द्रीय उत्पादनशुल्क प्रतिअदायगी नियमावली, 1971 ( भारत के राजपत्र , असाधारण दिनांक 25 अगस्त , 1971 में प्रकाशित अधिसूचना सं ० 52 / फा ० सं ० 602/ 2/ 70 -प्र ० अ ०) के नियम 4 के अधीन, केन्द्रीय सरकार सार्वजनिक सूचना सं ० प्रति अदागी/ पी ० एन ० 1 , दिनांक 15 अक्तूबर, 1971 में प्रकाशित सारणी में एतद्वारा निम्नलिखित संशोधन करती है ,-

( क) श्रायात किये गये 3 स्पीड हबों से युक्त ।
15.25 रुपये ( केबल पन्द्रह रुपये और पच्चीस पैसे ) प्रति बाइसिकल; तथा " पहले आओ पहले जाओ" आधार पर संगत आगम- पत्त्र के अनुसार यथानिर्धारित श्रायात- शुल्क की रकम जो , आयात किये गये स्पीड हबों पर अदा की गयी ।
परन्तु यह तब , जब कि निर्माता/ निर्यातकर्ता 3 स्पीड हबों से युक्त स्पोट् लाइट रोडस्टर बाइसिकलों के निर्यात को समाविष्ट करने के निमित्त 3 स्पीड हबों की पर्याप्त संख्या के आयात एवं शुल्क के भार के संबंध में सीमाशुल्क समाहर्ता के समाधान के लिये साक्ष्य प्रस्तुत करता हो और इसके अतिरिक्त यह भी कि आयात किये गये 3 स्पीड हबों को , जिनके बारे में ऐसा साक्ष्य प्रस्तुत किया गया है ,
( i ) किसी अन्य पूर्ववर्ती निर्यात से वैसे ही सह- सम्बद्ध नहीं किया गया है और उसके लिये हिसाब में नहीं लिया गया है, तथा
( ii) प्रति श्रदायगी के दावे सहित अथवा अन्यथा उसी रूप में अथवा किसी अन्य रूप में पहले पुर्नानर्यात नहीं किया गया है ।
टिप्पणीः-उपर्युक्त दर में , पैकिंग सामग्रियों पर दी जाने वाली प्रतिअदायगी , यदि कोई हो, शामिल नहीं है , जिसका दावा समुचित 'सर्व उद्योग ' दर के अधीन अलग से किया जा सकता है ।
( ख ) 3 स्पीड हबों से युक्त बाइसिकल से भिन्न, चाहे उनका निर्यात संयोजित अथवा एस ० के ० डी ० अथवा सी ० के ० डी ० स्थिति में किया गया हो ।
15.25 रुपये ( केवल पन्द्रह रुपये पच्चीस पैसे ) प्रति बाइसिकल ( जिसमें पैकिंग , सामग्री पर प्रतिश्रदायगी शामिल नहीं हैं जिसका दावा प्रतिश्रदायगी की समुचित ' सर्व उद्योग ' दरों के अधीन अलग से किया जा सकता है ) ।
यह सार्वजनिक सूचना नवम्बर, 1974 के प्रथम दिन से लागू हुई समझी जायगी ।
