New Delhi , the 5th March 1975
G.S.R. 141 (E) . In exercise of the powers conferred by sub- section (2) and (3) of section 3 of the Central Excises and Salt Act , 1944 ( 1 of 1944 ) and in supersession of the notification of the Government of India in the Ministry of Finance (Department of Revenue and Insurance ) No. 73 / 74- Central Excises , dated the 30th March , 1974, the Central Government hereby fixes for the internal combustion engines operated with diesel oil, other than marine diesel engines , chargeable with duty ad valorem under sub - item (ii ) of Item No. 29 of the First Schedule to the said Act and the horse power of which is specified in Column (2 ) of the Table below , the tariff value specified in the correspond- ing entry in column ( 3 ) of the said Table .

Explanation . For the purposes of this notification , the unit of horse power is the metric horse power equivalent to 4,500 metre kilogram per minute determines according to the Indian Standards Specifications 1600 to 1603 .

सा० का० ति ० 141 ( अ) .-केन्द्रीय उत्पाद शुल्क और नमक अधिनियम, 1944 ( 1944 का 1) की धारा 3 की उपधारा ( 2 ) और ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के वित्त मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना सं ० 73 / 74 - के ० उ ० शु ० , तारीख 30 माच , 1974 को श्रतिष्ठित करते हुए केन्द्रीय सरकार मैरिन डीजल इंजनों से भिन्न , डीजल तेल से प्रचिलित अन्तर्दहन इंजनों के लिए जिन पर उक्त अधिनियम की प्रथम अनुसूची की मद संख्या 29 की उपमद ( 11 ) के अधीन मूल्यानुसार शुल्क प्रभार्य है और जिनकी हार्सपावर नीचे की सारणी के स्तंभ ( 2 ) में विनिर्दिष्ट है , उक्त सारणी के स्तंभ ( 3 ) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट टैरिफ मूल्य एतद्वारा नियत करती है:-

स्पष्टीकरण. इस श्रधिसूचना के प्रयोजनों के लिए , हार्स पावर की ईकाई मीटरिक हार्स पावर हैं जो भारतीय मानके विशिष्टियों 1600 से 1603 के अनुसार अवधारित 4,500 मीटर कि० ग्रा० प्रति मिनट के समतुल्य हैं ।
