DISSENTING PROPOSALS

I

I. DISTRICT GURDASPUR

Constituencies No. I to n

The constituencies in thia district are proposed to be modified as in me enciosea statement • This is being suggested for the following reasons:—

(i)1 This district is situated on the international boundary. The border areas with Pakistan are proposed to be so adjusted while forming the constituencies so that as much area of the border Is put together in a constituency as possible. With this in view, it is proposed to carve out a border constituency namely Dhianpur, comprising of border areas of Batala and Gurdaspur Tahsils. This will have impact on all the other constituencies in €)atala Tajsil and adjoining constituencies in Gurdaspur tahsil.

(ii) The Qadian Constituency as proposed by the Commission runs on 3 sides of the proposed Batala Constituency. The modifications now proposed will make the shape of the new two constituencies viz. Batala and Fatehgarh more compact.

(Hi) Dhar area has always been tagged with Pathankot City in the Tpast, while formulating constituencies, but this time this has been separated from the town. The Dhar area is connected with Pathankot City intimately. Its development depends entirely on clos e contacts with the city.

Composition of assembly constituencies in Amritsar District

With reference to your letter No. 282/PB/75/101 dated 6-1-1975 regarding delimitation of parliamentary and assembly constituencies in the State of Punjab, I have the honour to give below my dissenting proposals in respect of assembly constituenices Nos. 16} 17, 18 and 19 of Amritsar district.

1. In proposed delimitations while the total seats have been increased by 13, Amritsar City'* representation has been reduced by enlarging areaB of existing constituencies and adding rural areas in two constituencies. The population of Amritsar City, Cantonment, Chheharta and other suburban areas comes to about 457, 688 and four urban constituencies should be made without adding any rural areas which should be as follows:—

2. CONSTITUENCY-WISE:

AMRITSAR CITY (North).—In the proposed delimitation proposals certain rural and sub- urban areas have been included. It is a purely urban constituency and inclusion of rural areas will adversely affect the interest of both ruralltics as well as unwieldy to make it a compact and more acceptable the following change should be made:—

Ward No. 6 and P.C. 45 should be excluded and wards N08. 25 and 32 be included. T hc total population after this change will be 114,120.

Details are ttiven below:—

I have Just seen a list of fuHni-lur district regarding assembly coi s'LirucncieH, i.e., Jullundur South (SC) and Kartarpur (SC). I find that Patwar Circles No. 54 Kallian Pura and 55 Malko ha,vc teen shown as part of the Jullu'idur South (SC) constituency. My suggestion is that these two pstwsr circles should be excluded from Jnllundur South (SC) constituency and included in the Kortarpur (SC) constituency and similarly Patwar Circles 50 Chitti and 51 Sun^rm be ex- cluded from the Kartarpur (SC) constituency end included in. the Jullundur (South) SC consti- tuency. By so doing, the area of hoth these constituencies will become compact and more con- tiguous.

KAPURTHALA DISTRICT

Proposal for delimitation of constituencies in Kapurthala district (Punjab)

The proposed constituencies of Kapurthala district except Phagwara do not conform to clause No. 9 (a) of the Delimitation Act 1972 as due regard has not been given to the Physical features, facilities of communications, and administrative and public convenience.

The proposed Bholath constituency has been carved out on one corner of the district in disregard to the above requirements. Bholath is a small village of no importance. All important offices are located at Kapurthala which is also a Sub-Divisional Headquarters. People of the area have to go to Kapurthala, the only nearest town for all type of governmental and com- mercial activities. Moreover, in the proposed constituency the communication facilities arc inadequate and all roads only lead to Kapurthala. Even the proposed Bholath consti- tuency ends in the close proximity of Kapurthalf- In order to fulfil the requirement of Section 9(a) with certain amendments this Bholath constituency can be easily re-named as Kapurthala East.

The attached table enumerating the area and population of the three constituencies, viz.' Sultanpurj Kapurthala (West) and Kapurthala (East) is sent herewith for acceptance "and publica- tion in the Gazette.

HOSHIARPUR DISTRICT

Mote on the propose! delimitation of thi Garshankar General and Mahilpur Reserve Cons~

tituen;ies in Hoshiarpur Ii'utrizt (Map attached) Punjab.

These two constituencies cover Garshankar Tehsil which is composed of two distinct geographical areas—the sub-montaneous area bordering on Kangra District ofHimachal Pra- desh and the plain area bordering on Jullundur District. The rough dividing line between the two areas as accepted by the State Government is the Balachaur-IIoshiarpur road which passes in the middle of it. Earlier the Garshankar General Constituency covered the entire Hill and sub-montancous area and small part of the plain of the Tehsil. Mahilpur Reserve covered the main portion of the plain of Garshankar and Iloshiarpur Tehsils.

Now in the new alignment proposed by the Election Commission a good part of the sub- montaneous area which was earlier in the Garshanka'r General Constituency (P. C.'s 24, 26,, 31, 32,33,34.1 35) 36, 37, 38, 39, 40 of the Mahilpur K.C. and P.C.'s 34, 40., 44 and 46 of the Tutumazara K. C.) have been transferred to the proposed Mahilpur Reserve Constituency.

In the proposed new set up now Mahilpur Reserve Constituency is covered partly by tha plain area and also by a substantial part of the sub-montaneous area. In Garshankar General while a good part would be Hill and sub-montaneous area, yet there would be some plain areas as well, such as P.C.'s 51, 52, 69, 70 of the Tutumazera K.C. and P. C.'s 71, 72, 73, 75, 77, 78 of the Garshankar, K.C.

The social and economic set up of the two areas and the problems faced by the people are different. Vast track in sub-montaneous area has almost no irrigation facilities. The soil is very poor. It is almost untouched by the green revolution. Hence the living standards of th< people are much lower than the plain area. Compared to this the plain area is prosperous.'It has good soil and assured irrigation. In the sub-montaneous area roads and transport facilities arc terribly lacking. There is no such problem in the plain area. The plain area is one of the most advanced in the State in the field of education. Educational facilities in the sub-montaneous area arc considerably- lacking. Same applies to the medical facilities.

It was in view of this situation that the state Govt. decided to pay special attention to the development of the sub-montaneous area, that is the area cast of the Balachaur Garshankar- Hoshiarpur-Dasuya-Mukarian Road dividing the • Hoshiarpur District. It also constituted a special sub-montaneous Area's Development Advisory Council to expedite the development of the area.

Wherever the sub-montaneotu areas arc vivisected and parts attached to constituency with the plain areas then generally there is a tendency on the part of the legislators to ignore the backward areas and mainly cater to the needs of the more strong and vocal people of the plains. Hence it is due to this thai in Hoshiarpur the people of the sub-montaneous areas have again and again demanded that the constituencies in these areas be so demarcated that the sub-monteneou" areas are constituted into separate seats.

In the proposal for Hoshiarpur the Election Commission has generally followed the principle Such proposed constituencies as Tanda and Sham Churasi are totally in the plain area; Balachaur, Hoshiarpur,, Gardhiwala, Mukarian lie mostly in the sub-montaneous tract. However, Mahilpur and Garshankar have been made into mixed constituencies, with Mahilpur being roughly 60% plain area and 40% sub-montaneous area and Garshankar 70% sub-montaneous and 30% plain area.

(I) This situation is not in the best interest of cither the people of the area or the legislators who would represent them. It is, therefore, proposed that the entire sub-montancous area east of the main road that is P. C.'s 24, 32, 33, 34, 3?J 36, 37, 39 and 40 of the Mahilpur K . C, P. C.'s 38,. 41, 44 and 46 of the Tutomazara K. C. be shifted to the Garshankar General Constituency and in lieu of that P. C.'s 51, 52, 69, 70 of the Tutomazera K.C. and P. C.'s 71, 72, 73, 75, 76, 77, 78 of the Garshankar K. C. be shifted to the Mahilpur Reserve Seat. Both the areas are contiguous to the respective seats. Both are served by the same main road that is the Garshankar-Hoshiarpur Road, On the asis of the above the total population of the Mahilpur Reserve Seat would be 1,13450 with 39, 410 Scheduled Caste population, that is 34.74% of the total. The Garshankar General Scat will have a total popluation of 1, 02, 462 with Scheduled Caste population of 30, 444, thut is 29.71%

(II) In case such a major adjustment were not possible then the Tutomazera K. C. be so divided that the maximum sub-montaneous area is linked with Garshankar General and the plain area with Mahilpur Reserve. On this basis the Patwar Circles 38, 41, 44, 46 of Tutomazera (Population 9,703 S. C. 3350) be added to Garshankar and Patwar Circles 51, 69, 70 of the same- K. C. (Population 10079 S. C. 3624) be shifted to Mahilpur Reserve. This will not only be in the general interest of the people as stated avbove, but will also increase the percentage of Scheduled Caste population in Mahilpur seat.

MEMORANDUM FOR THE CREATION OF A SEPARATE ASSEMBLY CONSTITUENCY FOR THE SUB-MONTANEOUS (KANDI) AREA OF HOSHIARPUR DISTRICT, PB.

During the past 3 years we have approached the Punjab Government on a number of occa- sions requesting them about the necessity of creating a separate assembly constituency for the sub-montancous (KANDI) area of Hoshiarpur district, Punjab. Unfortunately, no concrete propo- sals have ever been drawn-up and suitable recommendations made to the Delimitation Commission to correct the existing wrong demarcation of constituency boundaries which arc depriving* the Kandi area people of proper representation in the Punjab State Assembly. This is a social injustice in a democratic country.

One of the reasons why there is unrest in this part of the State is due to the fact that the Kandi area has been artificially divided and attached with S Assembly Constituencies, comprising mostly of plain areas with the result almost all the money earmarked for the sub-mountanou8 (KANDI) area is spent in the plain areas, leaving virtually nothing for the KANDI area.

Moreover, during the past 27 years, the Punjab Government has miserably failed in providing the bare and much-needed basic amenities to the people of Kandi area, while one- could witness so much development work taking place in the plain areas.

It would be in the best interest of the public as well as the State Government if our request to create a separate Assembly Constituency is given favourable consideration and the existing disparity removed without further delay.

We, therefore, propose thatKanungo Circle Datarpur, having a population of more than 60,545 should be named as a new constituency for the Kandi area of Hoshiarpur district This will cover half of the really affected Kandi area which is suffering very badly on this account. If need be, the 12 Paiwar Circles from Garbdiwala Kanmigo Circle and qny other Patwar Circles falling in the Kandi area may also be included in this proposed new constituency so that all the Kandi area could be brought under one Assembly Constituency.

It is further submitted that whole of the Kandi area is facing the same kind of problems and is compact homogenous unit geographically, linguistically, culturally and economically.

Under the circumstances, we would request your kind honour that due consideration may kindly be given to our above request.

It is proposed that constituencies Nos. 453 46 and 49—52 in Hoshiarpur district may be suggested as follows ;—

^Constituency Nos. 49 to 52.

Sham Chaurasi has already been re?tivtd in Hoshiarpur Tobsil as such 2nd constituency may not be reserved in that Tehsil.

(ii) These 4 constituencies as now being proposed, are carved CUT in such a way, so as to keep the Kandi area and the rest of the area separately, so as to enable the areas concerned to elect their own representatives.

DELIMITATION OF CONSTITUENCIES—1975

I have to make certain suggestions regarding the composition of constituencies m Fofhiar- pur district slightly at variance with the draft compoalt'on made by the Delimitation Coirm'fficn, a copy of which was sent by you to me on January 1,1975. The modifications proposed in Baia- chauTj Garshankar, Mahilpur, Dasuya and Talwara (Mukerian) Constiiuencfes ere g h tr In the attached statement which shows revised extent of each constituency, As for the KEEOHS (uf £csn d for the proposed changes, these are given below in respect of each constiiurr.ty.

44. Balachaur

The population of Balachur constituency as proposed by the Corrmifs'on is 103433 wh'ch is the lowest in Hoshiaxpui: dis ric1^. If my suggestion of including Pat-war circle 55 1? agreed to the population of this constituency will rise to 107652 which is roughly equal in number to the population of other two constituency in this sub-division. This Patwar circle is in Saroya block which is a part of Sahlba Kanungo. Moreover this Patwar circle is separated by one dcrp Khud from other villages of Garshankar K.C. The villages of Patwar circle 55 of the same clan as of the Balachaui constituency.

:546 THE GAZETTE OF INDIA EXTRAORDINARY [PART Il-r-

45. Garshankar

Patwar Circles 44 and 46 are nearer to Garehankar and should thcrtfore nmfcin in Gar- shankar constituency. P.Cs. 42 and 43 which are mar to Mahiipur constiiuency should be^ex- cluded from Garshankar constituency to make MahiJpur comtitucr.cy nion hcmigii-iut- ,'lhe Garshankar constituency as composed at present has become mweildly and geographically it is not a compact unit. A candidate has to pass through Mahilpur constituency in oidtr to rcr.eh a P.C. of Garshankar constituency which is a inconvenient arrangement.

46. Mahilpur (S.C.)

From the draft composition of Mahilpur constituency I have excluded Patwar circle 44 Tutu Mezsr and 46 Sodulla Pur Badhvan and in their place have included Pawi ar circle 42 and 43 from Garshankar constituency. In spite of these changes the population remains almost the same but the constituency becomes culturally and geographically more compact and easily accessible to all concerned.

51. Dasuya

Composition of Dasuya constituency as proposed by the Commission gives it a population • of 1,28,587 whereas according to the composition as given by me above, the population comes to 1,27,007 which is almost the same bul my proposal makes the constituency more comptcl putting people with the same cultural affinity in the same constituency.

Patwar circles 22, 23,24, 25,27 and 28 of Hajipur K.C. are only 5 to 7 miles from Dasuya and are therefore easily accessible to Dasuya, Moreover they are in Dasuya block and should naturally come in Dasuya constituency rather than in Mukerian constituency as contemplated by "the Commission.

52. Talwara

Against S. No. 52, Mukcrian has been made a constituency. I propose that ihe name of this constituency should be Talwara and should comprise of Talwara and Hajipur K.Cs. as detailed above. The population of this constituency remains almost The same.

It is also observed tl at the three reserved seats in Hoshiarpur district viz. Mahilpur, Sham- churasi and Garhdiwala are contiguous to each other. This puts the general voters of this huge area at a slight disadvantage as they cannot send a representative from amongst the "General'* voters. It would be more appropriate to stagger ihe reserved seats to give a fair chance to all areas. For example, I would suggest that Mahilpur which is a reserved scat since 1952 may now be made general so that this continuity is broken and in its place Garshankar may be made a re- served constituency. It was last so in 1952.

ROPAR DISTRICT

Declaration of Ropar or Morinda as Reserve instead of Kharar as proposed

It is subjnitttd a; fellow. :—

Amendment No, i.

According to the Draft proposals for Assembly Constituencies of Ropar district, the percent- age of Scheduled Caste population is a.i follows:—

-Nangal No. 65 • Anandpur No. 66 R^par No. 67 • Morinda No. 68 Kharar No. 69 •

16 12 % 20'19 % 26-26 % Z5-39 % 25-70 %

In the face of the above figures a^l the accepted principle of delimitation that constitue- ncies with larger Scheduled Caste population Will hi declared Reserve. Ropar with the highest,- percentage of Scheduled Caste population in the entire district should be made Reserve and not Kharar as has been done. The abovesuggtstion is made in the above background.

Amendment No. 2.

According to the draft prnpisals, the p >pn.ilation of proposed Morinda has been increased to 120762 from rhe existing 109016 (according to present delimitation) and the population of exist- ing Kharar constituency has been reduced from 1,30,465 to 1,04,708 by taking out 9 PC's of Mullanpur K. C. which at present are a part of Kharar constituency. As such proposed Morinda has b:cn male unusually big and proposed Kharar has been made unusually small. Hence to normalize this population gap it is sugg-sted that instead of taking out all the 9 P C's of Mullan- pur KG., only 4 K. C's i.e. 1, 2, 3, and 7 b- taken out and P. C's 8, 9, 10, 11, 14 of Mullanpur K. C. be retained in the proposed Kharar in the interest of fairness and justice.

Constituencies No, 65 to 69.

(1) Constituencies Nos. 65 to 67 are proposed to be modified as per list enclosed for the

reasons given below:—

(i) The population of Nangal Constituency as proposed by the Commission comes to

86,117 and of Anandpur Sahib 1,19,846. This population needs to be adjusted, (ii) Naya Nangal in 23-Kanchehra K. C. and Nangal Township in No. 1, Nangal Nikku

P, C. may be placed in one constituency viz. in Nangal.

To make up the population of Nongal constituency, P. Cs. 21 and 22 of Ropar K. C.

may be added to Anandpur Sahib Constituency.

A small portion of Ghanauli K. C. viz. P. Cs. 13—29 may be added to No. 67 consti- tuency alongwith rest of the Ropar K. C. This will make the population of the two constituencies within prescribed limits. No. 66-Anandpur Sahib Constituency may be named as Anandpur Sahib-Ropar.

No. 67 constituency will then include the portion of Nangal K. C. excluded from Anandpur Sahib Constituency and exclude P. Cs. 21 and 22 of Ropar K. C. proposed to be added to Anandpur Sahib Constituency. As Ropar will go out of this constituency, this may be named as Chamkaur Sahib. This constituency will have 29-04% S.Cs. and may thus be reserved for S. Cs. instead of 69-Kharar.

It is suggested that;—

1. The proposals do not take into consideration the fact that on average a parlia- mentary constituency is to include a population of about 10,42,000. The Ropar parliamentary constituency as proposed has more than 10,70,000 population whereas Hoshiatpur constituency has a population of only 10,20,000. This disparity can be rectified by having the Assembly con- stituency Nos. 65 and 66 a bit larger than the other constituencies in the district. My proposals enclosed herewith reduce the disparity to mifce their population figures 10,52,000 in Ropar con- stitiisacy and 10,38,000 in Hoshiarpur constituency.

2. Assembly constituency No. 65 Nangal is shown to be covering a population of 1,07,473 but, in fact, according to the corrected figures (vide the errata slip) has only a population of 86,117 though the average in the district is about 1,10,000 (precisely 1,09,800). The disparity is even more than the permissible 10%. So, we have to include P. C. No. 1 Nangal Nikku of Anand- pur Sahib K. C. as a whole in this constituency. By this change the entire population of Nangal Town would come into the same constituency.

3. As a consequential amendment to the Assembly constituency No. 66 Anandpur Sahib, and to make it of proper size, the P. Cs. 21 Khawaspura and 22 Ropar of Ropar K. C. have to be includej in it and taken out of 67-Ropar constituency, which now would be better to be named as Chamkaur Sahib constituency.

4. In order to make up the loss of P. Cs. Nos. 21-Khawaspura and 22-Ropar, we have to include in constituency N o. 67-Ropar (or Chamkaur Sahib) also the P. Cs. Nos. 70-Bamnara, 7i-Kainaur, 72-Saheri, 79-Kalaran, 81-Khant and 83 Pan) Koha of Morinda K. C. in addition to the 9 P. Cs. already proposed in the proposals.

SEC. 3(ii)] THE GAZETTE OF INDIA EXTRAORDINARY 551

5. Morinda constituency, as proposed in the proposals is too long. It runs from the border of district Ludhiana to the bordrr of Haryana, towards the north of the Punjab and Haryann High Court. It does not have any regard for geographical and physical features and linca of communication. One has to pass through Kharar while going from Morinda to Mullanpur K. C. The public inconvenience has also been ignored. Thus it is against the letter and spirit of Section 9 of the De-Limirarion Act. This defect can be rectified by re-constituting 69-Kharar consti- tuency, so as to contain K. Cs. Mullanpur and Manauli and half of Kharar K. C, as shown in the enclosed proposals. Consequently 68-Morinda constituency will consist of Kurali K. C. and the remainder of Kharar K. C. and Morinda K. C. [excluding the P. Cs. which are required to be added to 67 Chamkaur Sahib, (Ropar constituency.]

XXI

I enclose a Performs showing revised demarcation of some of the constituencies in Patiala District for consideration of the Commission as detailed below:—.

70'BcmuT.

Lalru K. C. is geographically and administratively a part of Dera Bass! Sub Tehsil and Dera Bassi Block. Even in all previous Delimitations sience 1952) Lalru K. C. and Dera Bass! K.C. have been put together in the same Assembly Constituency. Even in present Punjab Assem- bly Constituency, the Lalru K. C. and Dera Bassi K. C. form part of same Constituency namely Banur Constituency. In the Commission's proposals, Lalru K.C, excludirg Lalru P.C. has been proposed as part of 72-Ghanaur constituency, whereas Dera Bassi K.C. and Banur K.C. have been grouped together In proposed Banur constituency. The Lalru K. C. has no direct means of communication with other parts of proposed 72-GbanBur constituency, although on map it looks to be contiguous area. The river of Gtaggar divides Lalru K.C. and Mardanpur K.C. horizon- tally and no part of these K.Cs. is contiguous except through river bed. There is no bridge in this area. Iffrom the proposed Ghanaur constituency, one has to go to any place in Lalru K.C. which has now been included In Ghanaur constituency, one has to go by road via Ambala city In Haryana by travelling eight miles in Haryana territory. While Dera Bass! K.C. and Lalru K.C. are a compact Block falling on both sides on Ambala-Ralka national highway. So it is in the fitness of the things that Banur constituency should be re-d"narcaied as proposed above and consequential changes may be made in the proposed other constituencies suggested by me.

7 l-Rajpura-

The Commission has proposed Rtjpura constituency consistlrg of Rsjpura K.C. erd peit of Raipur K. C. in Patiala Tehsil. The proposed Rajpurn constituency hen been mede urneceK- sarily lengthy. It starts from the municipal limits of Patiala city and reaches near Banur i.e. a distance of about 22 miles in length and a width of only 4 miles. The changed demarcation of this constituency, as shown by me In the enclosed profonoa make it more compact and physically convenient to everybody.

72-Ghanaur.

My suggestions for Banur and Rajpura constituencies will take out Lahu K.C. frcm this proposed constituency and part of Raipur K.C. from Rajpura constituency proposed by the Com- mission. Raipur K.C. in Patiala TchBil which is more contiguous and well connected with Ghanaur

5 56 THE GAZETTE OF INDIA EXTRAORDINARY [PART II—

K G. b: i 1-1 i ( :l \T Q u n ir cimituency as in all the previous delimitations uptil now,Ghanaur K.C. BTii Raipur K.C. have formed part of one and the same constituency. So it Is desirable that Ghanaur K.C and Raipur K.C. should form part of one constituency, as it will ensure con- tinuity and compactness of the area. The Ghanaur Constituency as now proposed by the Com- mission Is lengthy and not compact and divided by Ghaggar river which has no bridge in the area. Piiyjical feature conditions have bren totally Ignored by the commission while making this pro- P3"'. So I strongly suggest that Lalru K.C. be included in Banur constituency and excluded fron p-jpDiei G ' m ut condtu:ncy and instead of Lalru K . C, Raipur K.C. be Included In It.

73 -Dakala.

At the Comiilsalon's proposed Dikate constituency has a population of 125689, It Is desirable to reduce its population by excluding P.C's 72,73,74 of Raipur K.C, from it. These P.Cs- may bo Included in th" Ghansur constituency as proposed by me while discussing Ghanaur constituency above. 74~$amana.

Ifmy suggestions regiriing demarcation of Ghmaur constituency are accepted then Ghanaur constituency will have lesser percentage of scheduled caste population and the Samana consti- tuency as proposed by the Commission will hive higher concentration arid percentgc of Sch-duled Caste population. So I suggest that Samma may be midc a reserved constituency for the Scheduled Castes.

9- SANGRUB, DISTRICT

The draft proposals sent by yox hiv; not tak;n into consideration certain physical features of the three abDVc named constituencies while ^delimitating them. Minor, changes ate required to stabilise the said three constituencies.

I suggest the following changes:— 1. ThatP.Cs- i i) 12, 13 of Mahal Kala K.C- and P.Cs. 18, 22, 23 of Bamala K.C. should go to BhadaUi S.Cs. constituency and P.C. 60, 61, 62, 64 and 65 of Tapa K.C. should go to Dhjnaula constituency and P.Gs. 49, 51 and 47 of D'.iMaula K.C should go to Bamala Assembly constituency.

By this 'arrangement Dhanaula proper would b:come a part of Bamala A^sernbly constituencyy- Therefore this constituency should be renamed as Tapa instead of Dhanaula.

DEVINDER SINGH GARCHA, M.P. Associate Member, Delimitation Commission.

XXIII

It is requested that constituencies in this district miy be adjusted as in the enclosed statement for the following reasons:—

(i) Saigrur and B^wtfiigirh towiis arc closely connected and may be kept in one consti- tuency.

(ii) Dhanaula and Barnala toun are closely connected and may be kept in one constituency, (iii) A rural constituency may be provided by combining areas of Bhavanigarh and Dirba

Composition of Assembly Constituencies in Sangrur District

With reference to your letter No. 282/Pb/75/iOi dated 6-1-75, regarding dcHniitatkn cf parliamentary and assembly constituencies in the State of Punjab, I have the honour to give qelow my dissenting proposalsin respect of Assembly Constitucrcics in Sargrur District,

1. 8j-Barnata Constituency.

Barnala Constituency formerly compresed of the Whole of Barnala K. C. excepting Patwar Circles 29 and 30-until apjpulation o t ^i and the Whole of Mahal Kalon K. C. excepting Patwar Circle t t, 12 & 13 With a population 0^8316. It also included tWo Patwar Circles Not,. 3 ard 3 A of Ahmedgarh K.G. With a population of 4752. The total population of Barnala constituency was 1,40,047.

NoW the Barnala constituency is being formed only on a population of 1,10,704 while the adjoining Shcrpur constituency has a population of 1,23,000. I'D keep a balance and equal dis- tribution of population it is desirable thatPatWar Circles 54 and 55 of K. C. Sherpur which is contiguous to Barnala constituency and having a population of 6428 be excluded from Sherpur constituency and be included in Barnala constituency. Thus the population of Barnala consti- tuency Will become 1,17,132 and that of Sherpur constituency Will also be about 1,17,000.

That incasetheaV>ve-mentionedtWo PatWar Circles cannot be included in Barnala eonstito tuency then Patwar Circle 72 in KG. Circle Barnala, as will be revealed from a cursory look a1 the mip be added to Barn alaconstifuency .This PatWar circle has apopulation of 2527 and is connec- ted by roai only with Barnala. Its grain market, banks, court etc. are all at Barnala. So ihc inhabi- tents ofthis village have to go to Barnala for all their needs. There Is no justification for keeping this Patwar circle in Sherpur constituency.

Tt is, th;r;f:>r:, prayed thac small modifications, as prayed above, may kindly be made in the Barnala constituency.

2. %6-Sangrur Constituency.

Sangrur Constituency is formed on a much smaller population that Bha.wanigarh consti- tuency and it is most desirable that some Patwar circles of BhaWanigarh K. C. which are contig- uous to Sherpur constituency be added to it.

PatWar Circles 1 and 2A and (B), Patwar Circles 10 and 57 are such circles which can very conveniently be added to the Sangrur constituency to equalise the population of these two adjoining constitu;ncies. Formerly Patwar Circle 57 was a part of Sangrur K. C. and was only recently transferred to BhaWanigarh K- C. PatWar Circles 1 and 2 are also very conveniently situated fcr being aided to Sangrur constituency and with the inclusion of these PatWar Circles in Sargiur constitunncy there will be better distribution of population. These Patwar circles Were formerly part of Sangrur Assembly Constituency.

It h,tli-r::f->re,prayedthatinth- puSlic interest PatWarclrclesNos.57,1, 2,andicof K.C Bha vaiigarh may kindly b: aided to Sangrur constituency.

io-FEROZEPUR DISTRICT

PUNJAB ASSEMBLY CONSTITUENCY NO. 91—ABHOR.

We understand that some people with "political motivation" are trying to get the above constituency converted into a "Reserved" constituency. This Would naturally mean "down grading" of this Important constituency.

It looks that efforts are being made to act some P.Cs included in this constituency, fo* instance, Nog. 47, 61 and 62 on the pica that the villages of these are "semi towns" and ere the suburbs of Abhoa Town. This is entirely mischevious and incorrect. As a matter of fact that these villages have always been in Fazilka constituency and have been in the Jurisdiction of Khuian Sarwar Police Station. By no stretch of imagination these villages can be termed as "mini towns" and or suburbs of Abhoar.

Wefmther learn thit th-:sc p-oph—with selfish personal ends in view— want to get P.C. No. 52 excluded from Abalm coisituency— notwithstanding the fact that these villages have been in the constituency ever since its formation.

Another plea such advocates advance is that Malaut-a Tehsil town ond Faridkot 9 district, town—have been made "reserved constituencies"—then why not Abohar?

Permit us to state that Abohar has been and continues to be the "biggest"cotfon market in the whole of India. Abohar has b^en one of the most important "commercial centre" of tbe country and dominates the whole of the area in matters of nnance} industrial development and political movements too,

Malaut is a small Mandi—Insignificant—as compared to Ahohar. And Faridkot was a "dying town" and raised to 0 district station to save it from extinction.

Abohar has a papulation of about 100,000 souls (one lak)at present, and it has almost all the leading Banks—.staffed by seniormost Executives—.doing busiresB worth crores of rupees.

We, therefore, request you that this constituency should be allowed to remain as it is and hould not be reserved at alltor the best interest and development of this border town.

SADHU RAM M.P, XXVII Associate Member.

We beg to sutc as under :—

I. that while proposing tbe constituencies of Zira Sub Division and Ferozepur Sub Divi- sion, in District Ferozepur, following facts have not been kept into consideration :—

(j) that this area is situated on the border o* Pakistan and the natural boundary of river Satluj end Bess divides it from a foreign country.

(ii) that the people residing within the boundary limit of about ten miles are backward and they have no permanent source of their living. They arc always afraid of foreign attach. They are quite right in apprehending such an attack because there have been three or four such attacks in the last 9 or 10 years. Aa such the people of this boundary limit ere very poor. Apart from this, this boundary limit has not been properly developed even by the Governments. As this area has not been properly and effectively represented by any person belonging to this area no industry is fixed in this area.

(iii) this area of about ten miles from the border is also effected by floods. This factor has also added to the economic backwardnrss of the people of this sres,

(iv) that people residing within the area of 10/I2 miles belt mostly belong to either back- ward classes or those, who have been migrated from Pakistan to India at the time of partition. On these grounds there have been consistert demands of these people that they should be given proper representation in the Legislative Assembly.

As the abave mentioned facts have not been considered while proposing the constituencies, proposals already made are eroneous and do not justify the genuine claims of the various types of

Eersons residing in this ilaqa- As you will kindly see that Feiozepiu Cantt. and Ferozepur City as been combined in one constituency and thereby the rural area and the urban areas have been competely separated from each other. Rural area is dominated by Sikhs whereas Urban arc" is completely dominated by Hindus, Such demarcation would not certainly give a secular out look. Apait from this the principle of geographical continuity has not been kept in mind while

SEC. 3(il)l THE GAZETTE OF INDIA EXTRAORDINARY 563

demarcating the constituencies in Fcrozepur and Zira Sub Divisions, such as if P.C. 24 of Feroze, pur K.C. there are entirely independent two notified Municipal Committees i.e. of Fcrozepur City and also of Tankanwali. The distance between these two Municipal Committees is about two miles whereas the distance of Municipal Committee TanfcanWali with that of Ferozepur Cantt. h hardly two furlongs. Sentimentally and emotionally people of Tankanwali are more attached with the Cantonment than that of Ferozepur Municipal Committeej but as they fell in one P.C. that has resulted in keeping these two in one Constituency. However, without going into details we are of the definite view that overall changes are bound to be made so that the principles of geographical contiguity, the emotional and social feelings of the people and also fot maintaining the secular outlook in the area will have to b: nv?t. While keeping these things in view we have attached herewith our suggestion for delimiting the constituencies in Zira and Ferozepur Sub Divi- sions In District Ferozepur.

Therefore, we will request the Commission that these fundamental points should be kept in mind while delimiting the constituencies of this area. We hope that this demand of the people of Sub-Divisions Zira and Ferozepur will be fully respected and they will be accorded full justice in future by delimiting the constituencies of this area as per proposal mede by us.

1. Lambi In Mukatsar Tahsil 2. Malout 3. Faridkor In Faridkot Tahsil.

A . o r i i ng to a;c^pted principles, one scat should be reserved in one Tehsil and no two re- served seats should bs contiguous. In the present proposals of the Commission, Lambi and Malout r^serv^d seats ar.: coni.ig.nu? and a? stated earlier no reserved seat has been demarcated inM)g*tehiil. It is, th^fore, suggested thatin Mukatsarone of the ttfo reserved seats namely La.nbi aid Malout should b; declared as general seat and the other made a reserved seat. ASSEMBLY CONSTITUENCIES

APPEAL AGAINST THE PROPOSAL OF DELIMITATION COMMITTED MAKING 116 BUDHLADA ASSEMBLY CONSTITUENCY OF DISTRICT

BHATINDA, PUNJAB A RESERVED CONSTITUENCY

In Punjab the Work of delimitation of constituencies Is going on. The number of assembly in the State is proposed to be increased to 117 instead of 104. In the district of Bhatinda ihcrc were 8 assembly constituencies but notf one Assembly scat has been increased thus taking the number to be 9 for the forthcoming General Election.

2. That the petitioners have come to know from the proposed recommendation for the delimitation of the Assembly constituencies that 116 Bhudhlada General constituency has been proposed to be reserved for scheduled castes.

3. That only two constituencies have to be kept reserved for scheduled castes in Bhatinda district. Last time Nathana (112) and Faridkot were the two reserved constituencies. Now Faridkot has been formed a separate district and hence another constituency is to be reserved for the scheduled castes and surprisingly enough Budhlada has been proposed to be made a re- served constituency although it would be clear from the following schedule that the Budhlada constituency stands at number 3 in *-he percentage of the schedule castes in the district:—

SC popu- lation

4. Nathaiia (112) contains the highest percentage of scheduled castes which comes to t>e 29-32 percent and pakka Kalian (110) has 27-65 per cent whereas Budhlada has 47-37 percent of the scheduled castes of the total population. Keeping in view these facts and figures Nathana and Pakba-Kalan should be declared to be the Reserved constituencies in district Bhatinda.

5. That moreover Budhlada constituency has been the reserved constituency from 1953 to 1967- Keeping this fact also ln view the Budhlada constituency should not be made reserved and instead som; other constituency having approximately the same number of schdulcd castes votes be kept reserved.

6. That as W.mld be clear from the schedule given in para- No. 3 above Budhlada consti- tuency has the highest p3p-.i1ation as compared to ahy other constituency In the district which is 120683 Whereas In constituencies No. Tio, 113, 114 and 117 the population in each of these cinstita-ncies varies between IOOOQO and noooo. ItWouldbein the fitness of things If PatWar G'.rclc No. 36 HakamWalaof BudhlaiaK-C. should be excluded from the Budhlada constituency and aided to Sardulgarh ( T : 7) constituency which geographically falls in Sardulgarh consti- tuency. It would result an equal distribution of votes in both the constituencies which you find as under!—

Present population if P.C. No. 36 is excluded from Budhlada and added to Surdulgarh the number of population.

1. Budhada 2. Sardulgarh

120683 110876

116609 ii495°

If this contention of the petitioners is accepted then both Budhlada and Sardulgarh cons- tituencies Would have about 26 percent of the scheduled castes population .

G >nstitu2ncy has never been a reserved constituency and hence it should be made a reserved constituency instead of Budhlada which had been a reserved constituency for fifteen years in the past.

7. M >rcover C!iavik= has been created a new constituency and it can be made a reserved constituency after making the adjustment of population with the adjoining constituencies.

8. That the petitioners have come to understand that 112-Nathana and 1 10-Pakka-Kalan which have the high at pjrecntage of scheduled castes population have not been kept reserved because both fall in the same ?ub-Divlsion otherwise in normal circumstances these two consti- tuencies Would have been kept reserved as they have the highest number of the schedule castes population. But to our great surprise this principle is being applied to the district Bhatinda only and the same principle has not applied in other district. Some instances are being quoted below.

ASSEMBLY CONSTITUENCIES

Delimitation of constituencies in Bhatinda District.

I enclose a Proforma suggesting certain changes in the demarcation of the following consti- tuencies in Bhatinda District, as circulated in your letter No. 282/PB/75/101 dated 6th January, 1975:—

1. no-Pacca Kalan. 2. in-Bhatinda. 3. ir2-Nathana. 4. 117-Sardulgarh. 5. 115-Mansa,

These changes have been suggested with a view to cut short excessive distances between the two extreme points of constituencies, to make the constituencies more compact and homoge- neouB and to bring people of one cultural affinity in one constituency. Geographical considerations have also been kept in view while suggesting these modifications. For example in constituency 117-Sardulgarh, PC.-60 in Mansa KC is 50 KMs. away from Sardulgarh and only 7 KMs from Mansa. So it should right be included in Manaa Constituency and taken out from Sardulgarh. The same observations apply in the changes proposed in other constituencies as shown in the attached proforma.

C )M J3 S[ TI ON 07 PHILLAUR (RESERVED) PARLIAMENTARY CONSTITUENCY

I W nU Hk1; to bring to your kind notice that I came to know that Sardar Balbir Singh, Mi- nister, G->v;rnment of Punjab has raised objection about the Inclusion of Jullundur Cantt. As- s~m'>ly C > ncitu:ncy in Paillaur Parliamentry (Reserved) Constituency. In this regard I utould like to inform you that jullundur Cantt. Constituency is very near and three side adjacent to Phillaur Parliamentary (Reserved) Constituency. The percentage of Scheduled Caste population in Tulluiidur Cantt. is 32-71 but whereas the Scheduled Caste population in BHOLATH is 1 < -22 only From the very beginning the BHOLATH is in Jullundur Parliamentary Consti- tu-ncy only. The distance from Phillaur to Bholath is nearly 135 mi l e s-

I have already represented With 9 Associated Members of Delimitation Commission, India about Tanda and Mahalpur Constituencies vide my letter dated the 29Th Janumy, 1975 tub- mittcd to you in the Commission meeting held on the 18th February, 1975 ar>d a copy of the same is enclosed herewith for your ready reference.

Under the circumstances explained above, I request you to kindly consider all he above factG and include Jullundur Cantt. Assembly Constituency in Phillaur Parliemtrmiy (Reserved) Cent- tituency.

COMPOSITION OF PHILLAUR (RESERVED) PARLIAMENTARY CONSTITUENCY Regarding the composition of the PHILLAUR (S.C.) Parliamentary Constituency, I am 10 say that the TANDA Assembly Constituency No. 50 has been included in my Constituency in piacc of MAHALPUK (S,C.) Assembly Constituency Nu. 40 which is not at all contiguous and compact. Because, landa Constituency is away from PHILLAUJK about 120 K,M. whereas MAHALUPUR Constituency was only 50 K.M. far away from PHILLAUR. Moreover, the percentage of Scheduled Caste population/Voters is less in TANDA i.e., 23.93 per cem than MAHALUPUR whicJi is 35.72 per cent.

Therefore, I request you to please let the PHILLAUR Constituency remain as it wr^ and do not put T A N DA Assembly Constituency in replacement of MAHALPUR Cons1 tituency.

We, associate members of delimitation committee, Punjab have collectively considered the draft proposals sent to us by the Commission regarding the Lok Sabha Constituencies of Patiala and Sangrur, Kopar and Ludhiana. We are of this opinion that in view of blatant incongruities in the draft proposals, certain amendments need being made in their delimitation.

!

1. Kumkalan Assembly Constituency of Ludhiana District consist basically of the suburban areas, of Ludhiana city. It touches and occasionally corrodes the municipal limits of Ludhiana city. But, for electoral purposes, it has been given over to Ropar Parliamentary Constituency. To undo this great injustice to the electorate of this cons- tituency it is essential that it should come back to Ludhiana Parliamentary Constituency and a fringe areas of Ludhiana namely, Raikot should be taken out which could be accommodated in Sangrur Parliamentary Constituency. Sangrur in its own turn should yield, Malerkotla Assembly constituency to Ropav Parliamentary Constituency to make up its loss of Kumkalan,

2. Patiala Parliamentary Constituency in the draft proposals has been extended on to Hhawaniirarh Assembly constituency whereas, much closer areas of Patiala District like Nabha havt been given over to Ropar constituency. In all good reason, Bhawanigarh Assembly Constituency should go to Sangrur and Nabha from Parliamentary constituency should come to Patiala. In order to make up the loss of Nabha to Ropar constituency, Dhuri Assembly constituency from Sangrur should go to Ropar.

Summed up, this proposal boils down to the following;

"Ropar constituency should loss Kumkalan and Nabha Assembly constituency and gain in their lieu Dhuri and Malerkotla Assembly constituencies. Patiala Parliamentary constituency should cede Bhawanigarh and gain Nabha. Sangrur Parliamentary cons- tituency for its loss of Dhuri and Malerkotla should get Raikot and Bhawanigarh Assembly constituencies."

Further we are firmly of the opinion that Ropar Parliamentary constituency should not be thrown 'general' but should remain reserved for the scheduled castes as the scheduled caste population in this constituency is much higher than Sangrur. We have separately submitted a representation to this effect.

  3. • Jr. ort'er to bring ab> .it better compactness, I suggest that the changed composition of this seat as proposed by me may be accepted. It is also suggested tint P.Cs. 8, 10, 11 and 12 in Samrala constituency may be included in K ' H T II ciistituency and taken out from Samrala. These P.Cs. arc contiguous and nearer to Khanna. Scheduled caste Seats Samrala, Kutn Kalan, and Dakha seats have been declared reserved by the Commission Samrala and Kum Kalan are continuous and should, therefore, be staggered. It dots not seem proper to lomiiit a \uge block of population in two contiguous constituencies p.s rrserved rca's. One of them i.e. Samrala may be declared General.
