New Delhi , the 19th March 1975
S.O. 148 (E ) -In exercise of the powers conferred by Section 87 of the North- Eastern Areas (Reorganisation) Act , 1971 (81 of 1971 ) , I , Fakhruddin Ali Ahmed , President of India, hereby make the following Order , namely: -
1. (1) This Order may be called the North - Eastern Areas ( Removal of Difficulties) Order No. 3 .
(2) It shall come into force at once .
2. In this Order , unless the context otherwise requires ,
(a) "Act" means the North- Eastern Areas ( Reorganisation) Act , 1971 ( 81 of 1971 ) ;
(b) " Composite Board " means the Assam State Electricity Board , constituted for the composite State of Assam by the notification of the Government of Assam No. PDEL- 60/ 58 , dated the 27th May , 1958 , and referred to in clause (a) of sub - section ( 1 ) of section 53 of the North - Eastern Areas (Re- organisation) Act , 1971 .
3. Until the undertakings , assets , rights and liabilities of the Composite Board aro apportioned in accordance with the Provisions of sub - section (3 ) of section 53 of the

Act and until the employees of the Composite Board are transferred or re - employed in accordance with the provisions of sub - section ( 3 ) , read with sub - section (3 ) , of that section, such of the undertakings , assets , rights and nailities and employees as have not , under clause ( a ) of sub - section ( 4 ) of that section , been directed to be taken over by the new Boards constnuted respectively for the States of Assam and Meghalaya , snail be taken over by the Government of the Union Territory of Mizoram as specihed in the Schedule to this Order .
THE SCHEDULE
PART I
Financial assets and liabilities to be taken over by the Government of the Union Territory of Mizoram
( i) The power generating stations along with power transmission and distribution systems , projects under construction for the generation , transmission, distribution and uulisation of power , and power line carrier communication equipment , which are located in the Union Territory of Mizoram .
(ii ) Lands , buildings , plant and machinery , tools and equipments , stores , office furni- ture and equipment and fittings and stationcry , appurtenant or relatable to the installations and works referred to in paragraph (1) and vehicles which are in use in connection with or for the purposes of the said installations and works immediately before the date of this Order .
(iii) All rights , liabilities and obligations relating to , or arising out of , the installations and works referred to in paragraph ( i ) and existing immediately before the date of this Order.
( iv) Employces serving in connection with the installations and works referred to in paragraph (i ) , on the same terms and conditions of service as were applicable to them immediately before the date of this Order .
PART II
Financial assets and liabilities to be taken over by the Government of the Union Territory of Mizoram
A. Assets
(a) The following assets located within the Union territory of Mizoram:-
(i ) dues for electricity supplied and other dues ;
(ii ) special deposits ;
(iii) vehicles suspense , tools suspense , workshop suspense and the like;
(iv) cash in hand , cash at bank and cheques under realisation, in the Accounting Offices;
(b) loans and advances , investments of provident fund and retirement benefits con- tributions , in respect of the employees taken over by the Government of the Union Territory of Mizoram;
(c) one per cent of the cash in hand, balance with banks in deposit , current or call accounts , fixed deposits , loan redemption fund , investment in securities and any other advances and deposits to the credit of the offices of the Chairman , the Chief Engineer , the Chief Accounts Officer , the Chief Security Officer , the Public Relations Officer and the Design Officer ( Barapani ) of the Composite Board ;
(d) any assets not specified in (a) , (b ) and ( c) above which may accrue up to the date of dissolution of the Composite Board and attributable to the offices , workshops and installations located in the Union Territory of Mizoram.
B. Liabilities
(a) The following liabilities located within the Union territory of Mizoram:-
(i) consumers ' security and other deposits ;
(ii) loans from Rural Electrification Corporation;
(iii) consumers ' contributions for service connections ;
( iv) sundry creditors for supplies made and works done ;
(v) electricity duty;
(vi) accumulated depreciation ;
(b) provident fund and retirement benefita in respect of the employees taken over by the Government of the Union Territory of Mizoram;

(c) one per cent . of the following:-
(i) loans from the Government and the Life Insurance Corporation of India and the market borrowings by the issue of bonds ;
(ii) other loans ;
( iii) general reserve;
(iv) interest on loans and borrowings referred to in ( i) and ( ii) above;
(d) any liability not specified in (a) , (b) and (c) above but which may accrue up to he date of dissolution of the Composite Board and attributable to the offices , workshops nd installations located in the Union terriory of Mizoram .

आदेश

का० ग्रा० 148 ( अ ) पैं , फत्र द्दीन अली अहमद , भारत का राष्ट्रपति पूर्वोत्तर क्षेत्र ( पुनर्गठन ) अधिनियम 1971 ( 1971 का 61 ) की धारा 87 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करता हूं , अर्थात्:-
1. ( 1) इस श्रादेश का नाम पूर्वोत्तर क्षेत्र ( कठिनाइयों का निराकरण ) आदेश सं ० 3 है ।
( 2 ) यह तुरन्त प्रवृत्त होगा ।
2. इस आदेश में , जब तक कि सन्दर्भ मे अन्यथा अपेक्षित न हो,
(क) " ग्रधिनियम " मे पूर्वोत्तर क्षेत्र ( पुनर्गठन ) अधिनियम , 1971 ( 1971 का 31) अभिप्रेत है ;
(ख) " सम्मिश्र बोलें" से आसाम सरकार की अधिसूचना सं ० पी० डी० ई ० एल ० 60/58 तारीख 27 मई, 1958 द्वारा आसाम के सम्मिश्र राज्य के लिए गठित और सूर्वोत्तर क्षेत्र ( पुनर्गठन ) अधिनियम , 1971 की धारा 53 की उपधारा ( 1 ) के खण्ड ( क ) में निर्दिष्ट आसाम राज्य विद्युत् बोर्ड अभिप्रेत है ।
3 .. जब तक कि सम्मिश्र बोर्ड के उपक्रम , ग्रास्तियां , अधिकार और दायित्व , अधिनियम की धारा 53 की उप-धारा ( 3 ) के उपबन्धों के अनुसार प्रम जित नहीं किए जाते हैं और जब तक कि मम्मिश्र बोर्ड के कर्मचारी उस धारा की उप-धारा ( 5 ) के साथ पठित उप-धारा ( 3 ) के उप- बन्धोंके अनुसार स्थानान्तरित या पुननिजित नहीं किए जाते हैं , तब तक उनमें से ऐसे उपक्रम आस्तियां, अधिकार और दायित्व तथा कर्मचारी , जिनके कि उस धारा की उप - धारा ( 4 ) के खण्ड ( क ) के अधीन , क्रमशः आसाम और मेघालय राज्यों के लिए गठित नए बोर्डों द्वारा ग्रहण किए जाने के बारे में निदेश नहीं किया गया है , इस आदेश की अनुसूची में विनिर्दिष्टानुसार मिजोराम संघ राज्य क्षेत्र की सरकार द्वारा ग्रहण कर लिए जाएंगे ।

अनुसूची
भाग 1
मिजोराम संघ राज्यक्षेत्र की सरकार द्वारा प्रहण किए जाने वाले उपक्रम , प्रास्तिर्या, अधिकार और वायित्व तथा कर्मचारी
( i) विद्युत् पारेषण और वितरण पद्धतियों सहित विद्युत् उत्पादन केन्द्र , विद्युत् के उत्पादन , पारेषण, वितरण और उपयोजन के लिए सन्निर्माणाधीन परियोजनाएं और पावर लाइन वाहित्र संचार उपस्कर , जो मिजोराम संघ राज्य क्षेत्र में स्थित है ।
( ii) वे भूमियां, भवन, संयंत्र औ मशीनरी , औजार तथा उपस्कर , भण्डार, कार्यालय, फर्नीचर और उपस्कर तथा फिटिंगें और लेखन -सामग्री जो पैरा ( i ) में निदिष्ट प्रतिष्ठापनों और संकर्मों से अनुलग्न या सम्बन्धित हैं तथा यान , जो इस आदेश को तारोख से ठोक पहले उक्त प्रतिष्ठ। पनों और संकर्मों के सम्बन्ध में या उनके प्रयोजनों के लिए उपयोगरत हैं ।
( iii ) , पैरा ( i ) में निर्दिष्ट प्रतिष्ठापनों और संकर्मों से सम्बन्धित या उनसे उद्भूत होने बाले और इस आदेश को तारीख से ठीक पहले विद्यमान सभी अधिकार दायित्व और बाध्यताएं ।
( iv) पैरा ( i ) में निर्दिष्ट प्रतिष्ठापनों और संकर्मों के सम्बन्ध में सेवारत कर्मचारी, सेवा के उन्हों निबन्धनों और शर्तों पर , जो इस आदेश की तारीख से ठीक पहले उनको लागू थों ।
भाग 2
मिजोराम संघ राज्य क्षेत्र की सरकार द्वारा प्रहण को जाने बालों वित्तीय श्रस्तियां और बायित्व
क . श्रास्तियां
(क) मिजोराम संब राज्य क्षेत्र के भीतर स्थित निम्नलिखित आस्तियां:-- ( i ) प्रदत्त बिजली के प्राप्य और अन्य प्राप्य ;
( ii) विशेष निक्षेप ;
( iii) यान उचन्न, औजार उचन्त , कर्मशाला उचन्त , इत्यादि;
(iv) लेखा-कायलियों में हाथ रोकड़ , बैंक में की रोकड़ और वसूली के अधीन चैक ।
(ख) मिजोराम मंत्र राज्य-क्षेत्र की सरकार द्वारा ग्रहण किए गए कर्मचारियों की बाबत उधार और ऋण , भविष्य निधि के विनिधान तथा सेवा निवृत्ति प्रसुविधा अभिदाय ,
(ग ) सम्मिश्र बोर्ड के अध्यक्ष, मुख्य इंजीनियर , मुख्य लेखा अधिकारी, मध्य सुरक्षा श्रत्रिकारो , लोक सम्पर्क अधिकारी और डिजायन अधिकारी ( बारापानी) षेो कार्यालयों के जमाखाते में को हाथ रोकड़ , बैंकों में निक्षेप, चालू या मांगदेय खारों में अभोशेष , आवधिक निक्षेपों, उधार मोचन निधि, प्रतिभूतियों में विनिधान और किम्हों अन्य ऋणों भौर निक्षेपों का एक प्रतिशत ;

(घ) ऊपर ( क ) , ( ख ) और ( ग ) में विनिर्दिष्ट न की गई ऐसी कोई श्रस्तियां जो सम्मिश्र बोर्ड के विघटन की तारीख तक उद्भूत हों और जो मिजोराम संघ राज्य क्षेत्र में स्थित कार्यालयों , कर्मशालाओं और संस्थापनों से हुई मानी जा सकती हों ।
बायित्व
( क) मिजोराम संघ राज्यक्षेत्र के भीतर स्थित निम्नलिखित दायित्व:---
( i ) उपभोक्ताओं के प्रतिभूति और अन्य निक्षेप ;
( ii ) ग्राम विद्युतीकरण निगम से उधार ;
( iii ) सर्विस कनेक्शनों के लिए उपभोक्ताओं के अभिदाय ;
( iv ) किए गए प्रदायों और किए गए कार्यों के लिए फुटकर लेनदार
( v) विद्युत् शुल्क ;
( vi ) संचित अवक्षयण ;
(ख) मिजोराम मंघ राज्य क्षेत्र की सरकार द्वारा ग्रहण किए गए कर्मचारियों की बाबत भविष्य निधि ओर सेवानिवृत्ति प्रसुविधाएं ;
( ग) निम्नलिखित का एक प्रतिशत :--
( i) सरकार और भारतीय जोवन बोमा निगम से लिए गए उधार और बन्धपत्र जारी कर के बाजार से लिए गए कर्ज ;
( ii) अन्य उधार ;
( iii ) साधारण श्रारक्षिति :
( iv) ऊपर ( i ) और ( ii ) में निदिष्ट उश्रारों और कर्जों पर व्याज :
(ध ) ऐसा कोई दायित्व जो ऊपर ( क ) , ( ख ) और ( ग ) में विनिर्दिष्ट न किया गया हो , किन्तु जो सम्मिश्र बोर्ड के विवेटन को तारोख तक उद्भुत हैं। और जो मिजोराम संघ राज्यक्षेत्र में स्थित कार्यालयों, कर्मशालाओं और संस्थापनों के फलस्वरूप हुश्रा माना जा सकता हो ।
भाग 3
श्रवशिष्टीय उपक्रम , श्रास्तियों , अधिकार और वायित्व तथा कर्मचारो
ऊपर भाग 1 और 2 के अन्तर्गत न आने वाला कोई उपक्रम , श्रास्ति, अधिकार , दायित्व या कर्मचारी जिसका सम्बन्ध मिजोराम संघ राज्यक्षेत्र के भीतर स्थित कार्यालयों, कर्मशालाओं और प्रतिष्ठापनों से है ।

S.O. 149 (E)-In exercise of the powers conferred by clause ( a) of sub- section (4) of section 53 of the North -Eastern Areas ( Reorganisation ) Act , 1971 ( 81 of 1971 ) and in continuation of the Order of the Government of India in the Ministry of Energy, Department of Power , No. EL.JI.3 ( 11 ) / 73 , dated the 20th January , 1975 , read with the North -Eastern Areas ( Reorganisation) ( Removal of Difficulties ) Order No. 3 dated the 19th March , 1975 and subject to the provisions of sub - section ( 3 ) of the said section 53 , the Central Government hereby directs that the undertakings , assets , rights , liabilities and employees of the Assam State Electricity Board constituted for the composite State of THE GAZETTE OF INDIA EXTRAORDINARY

Assam by the Notification of the Government of Assam No. PDEL 60/58 , dated the 27th May , 1958 and referred to in clause ( a) of sub - section ( 1 ) of the said section 53 (hereinafter referred to as the composite State Electricity Board) , shall be taken over, with effect from the date of this Order , by the Assam State Electricity Board constituted by the Notification of the Government of Assam No. PEL- 134 / 74 , dated the 20th January , 1975 and the Meghalaya State Electricity Board constituted by the Notification of the Government of Meghalaya No. PEL - 304/ 74 , dated the 21st December , 1974, as specified in the Schedule hereto annexed .
THE SCHEDULE
PART I

(a) The following assets to be taken over on the basis of location , namely:-

Any undertaking , asset , right , liability or employce not covered by Part I above or Part I or Part II of the Schedule to the Order of the Government of India in the Ministry of Energy , Department of Power No. EL.II - 3 ( 11 ) / 73 , dated the 20th January, 1975 relating to the offices , works and installations located within the concerned State .

फा० श्र० 149 (श्र) . मुर्वोत्तर क्षेत्र ( पुनर्गठन ) अधिनियम , 1971 ( 1971 का 81 ) की धारा 53 को उपधारा ( 4 ) के खण्ड ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और पूर्वोतर क्षेत्र , ( पुनगंडन ) ( कठिनाइयों का निराकरण ) आदेश , 1975 के साथ पठित , भारत सरकार के ऊर्जा मंत्रालय , विद्युत विभाग के आदेश सं ० ई एल- II- 3 ( 11 ) / 73 , तारीख 20 जनवरी , 1975 के अनुक्रम में, तथा उक्त धारा 53 को उपधारा ( 3 ) के उपबन्धों के अधीन रहते हुए , केन्द्रीय सरकार निदेश देती है कि आसाम सरकार की अधिसूचना सं ० पी डी ई एल 60/58 , तारीख 27 मई, 1958 द्वारा आसाम के सम्मिश्र राज्य के लिए गठित और उक्त धारा 53 की उपधारा ( 1 ) के खण्ड ( क) में निर्दिष्ट आसाम राज्य विद्युत बोर्ड ( जिसे इसमें इसके पश्चात् सम्मिश्र राज्य विद्युत बोर्ड कहा गया है ) के उपक्रम , आस्तियां , अधिकार , दायित्व और कर्मचारी , इस आदेश को तारीख से, इम से उपाबद्ध अनुसूची में विनिर्दिष्टानुसार , श्रासाम सरकार की अधिसूचना सं ० पी ० ई एल 134/74, तारीख 20 जनवरी, 1975 द्वारा गठित आसाम राज्य विद्युत बोर्ड और मेघालय सरकार की अधिसूचना सं ० पी ई एल 304/74 , तारीख 21 दिसम्बर, 1974 द्वारा गठित मेघालय राज्य विद्युत् वोर्ड द्वारा ग्रहण कर लिए जाएंगे ।

क . श्रास्तियां
(क ) निम्नलिखित श्रास्तियां जो उनकी स्थिति के आधार पर ग्रहण की जाएंगी, अर्थात् : --
( i) प्रदत्त बिजली के प्राप्य तथा अन्य प्राप्य ;
( ii) विशेष निक्षेप ;
( iii ) यान उचन्त, औजार उचन्त, कर्मशाला उचन्त इत्यादि;
( iv) लेखाकार्यालय में हाथ - रोकड़ , बैंकों में की रोकड़ और वसूली के अधीन चैक ;

ग) निम्नलिखित श्रस्तियां श्रासाप्र राज्य विद्युत् बोर्ड और मेघालय राज्य विद्युत् बोर्ड द्वारा क्रमशः 66 प्रतिशत और 33 प्रतिशत के आधार पर ग्रहण की जाएंगी, अर्थात्
सम्मिश्र राज्य विद्युत् बोर्ड के अध्यक्ष , मुख्य इंजीनियर, मुख्य लेखा अधिकारी , मुख्य सुरक्षा अधिकारी , लोक सम्पर्क अधिकारी , डिजाइन अधिकारी ( बारापानी ) के कार्यालयों के जमाखाते में हाथ रोकड़ , बैंकों में निक्षेप, चालू या मांगदेय लेखाओं में अतिशेष , आवधिक निक्षेप , उधार मोचन निधि, प्रतिभूतियों में विनिधान और कोई अन्य ऋण और निक्षेप ।
(
घ) ऊपर ( क ) , (ख ) और ( ग) में विनिदिष्ट न की गई ऐसी कोई आस्तियों जो सम्मिश्र राज्य विद्युत् बोर्ड के विघटन की तारीख तक उद्भूत हों और जो सम्बद्ध राज्य में स्थित कार्यालयों , संकर्मों और प्रतिष्ठापनों से हुई मानी जा सकती हों ।
(ख) वायित्व
(क) निम्नलिखित दायित्व उनकी स्थिति के आधार पर ग्रहण किए जाएंगे अर्थात्: -
(i) उपभोक्ताओं के प्रतिभूति और अन्य निक्षेप ;
( ii ) ग्रामीण विद्युतीकरण निगम से उधार ;
( iii ) सर्विस कनेक्शन के लिए उपभोक्ताओं के अभिदाय ;
( iv) किए गए प्रदायों और किए गए कार्यों के फुटकर लेनदार ;
(V ) विद्युत् शुल्क ;
(vi ) संचित अवक्षयण ;
(ख ) सम्बद्ध बोर्ड द्वारा ग्रहण किए गए कर्मचारियों की बाबत भविष्य निधि और सेवानिवृत्ति प्रसुविधाएं ;
(ग ) निम्नलिखित श्रस्तियां आसाम राज्य विद्युत् बोर्ड और मेघालय राज्य विद्युत् बोर्ड द्वारा क्रमशः 66 प्रतिशत और 33 प्रतिशत के आधार पर ग्रहण की जाएंगी; अर्थात्:-

(घ ) ऐसा कोई दायित्व जो ऊपर ( क ) , ( ख ) और ( ग ) में विनिर्दिष्ट न किया गया हो किन्तु जो सम्मिश्र राज्य - विद्युत् बोर्ड के विघटन की तारीख तक उद्भूत हो जाए और ओ सम्बद्ध राज्य में स्थित कार्यालयों, संकों और प्रतिष्ठापनों से हुआ माना जा सकता हो ।
