New Delhi , the 20th March 1975
G.S.R. 154 (E) .-Whereas a draft of certain rules further to amend the Tea Rules , 1954 was published , as required by sub - section ( 1 ) of section 49 of the Tea Act , 1953 (29 of 1953 ) at pages 87 and 88 of the Gazette of India Part II Section ( 3 ) Sub - Section ( i ) , dated the 29th January 1975 with the notification of the Government of India in the Ministry of Commerce No. G.S.R. 21 ( E ) , dated the 29th January , 1975 inviting objections and suggestions from all persons likely to be affected thereby within a period of thirty days from the date of the Official Gazette containing the said notification was made available to the public;
And, whereas , the said Gazette was made available to the public on the 29th January , 1975;
And, whereas , the objections and suggestions received from the public have been con- sidered by the Central Government;
Now, therefore , in exercise of the powers conferred by section 49 of the aforesaid Act, the Central Government hereby makes the following rules further to amend the Tea Rules , 1954 namely :-
1. (1) These rules may be called the Tea (Amendment ) Rules , 1975 .
(2) Thev shall come into force on the date of their publication in the Official Gazette .

2. In the Tea Rules , 1954 , in sub- rule ( 1 ) of rule 4 ,
(i) for clauses (c) , (d) and (e) the following clauses shall respectively be substituted, namely:-
"(c) eight persons representing owners of tea estates and gardens and growers of tea;
(d) five persons representing persons employed on tea estates and gardens;
(c) two persons representing dealers including both exporters and internal traderm of tea;" .
(ii) for clause (h) , the following shall be substituted , namely :-
"(h) two persons representing other interests . "

सा०का० नि ० 154 ( प ) यतः चाय नियम 1954 में और आगे संशोधन करने के लिए कतिपय नियमों का प्रारूप चाय अधिनियम 1953 ( 1953 का 29 ) की धारा 49 की उपधारा ( 1 ) द्वारा यथाश्रपेक्षित , भारत के राजपत्र भाग 2 , खण्ड 3 उपखण्ड ( i ) तारीख 29 जनवरी , 1975 में पृष्ठ 87 और 88 पर , भारत सरकार के वाणिज्य मन्त्रालय की अधिसूचना संख्या सा० का ०नि ० 21 - ई तारीख 29 जनवरी , 1975 के साथ उसे अन्र्तावष्ट करने वाले राजपत्त की तारीख से तीस दिन की कालावधि, के भीतर उससे प्रभावित होने वाले सभी व्यक्तियों से श्राक्षेप और सुभाष मांगते हुए प्रकाशित किया गया था और उक्त सूचना जनता को उपलब्ध कराई गई थी ।
और यतः उक्त राजपत्न 29 जनवरी , 1975 को जनता को उपलब्ध कराया गया था ।
गया है । और यतः जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार द्वारा विचार कर लिया
अतः अब उक्त अधिनियम की धारा 49 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार चाय नियम 1954 में और आगे संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्ः
1. ( 1 ) इन नियमों का नाम चाय संशोधन नियम 1975 है ।
( 2) वे राजपक्ष में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. चाय नियम 1954 में , नियम 4 के उपनियम ( 1 ) में,-
( i ) खण्ड ( ग ) , ( घ ) तथा ( ङ ) के स्थान पर क्रमशः निम्नलिखित रखा जाएगा , अर्थात्ः- " ( ग ) चाय एस्टेट तथा बागानों के स्वामियों और चाय उगाने वालों का प्रति- निधित्व करने वाले आठ व्यक्ति;
" ( घ) चाय एस्टेट तथा बागानों में नियोजित व्यक्तियों का प्रतिनिधित्व करने वाण पांच व्यक्ति;

(ङ) व्यापारियों का , जिनमें चाय के निर्यातक तथा आन्तरिक व्यापारी दोनों सम्मिलित हैं , प्रतिनिधित्व करने वाले दो व्यक्ति; " ।
( ii ) खण्ड ( ज ) के स्थान पर , निम्नलिखित रखा जाएगा , अर्थात्ः-- " (ज ) अन्य हितों का प्रतिनिधित्व करने वाले दो व्यक्ति । "
