New Delhi , the 25th March 1975
G.S.R. 161 (E) . In exercise of the powers conferred by sub - section ( 1 ) of section 3 of the All India Services Act , 1951 ( 61 of 1951 ) , the Central Government , after consultation with the Governments of the States concerned , hereby makes the following rules further to amend the All India Services (Joint Cadre) Rules , 1972 namely:-
19751 ) These rules may be called the All-India Services ( Joint Cadre ) Amendment Rules ,
(2) They shall come into force on the date of their publication in the Official Gazette .
2. ( 1 ) In the All India Services ( Joint Cadre) Rules , 1972 :-
( i ) After sub - rule (2) of rule 6 , the following sub- rule shall be added , namely :-
"3. The rules shown in Schedule III to these rules shall , in respect of a Joint Cadre of the Indian Forest Service in relation to which an agreement has been arrived at under sub - rule ( 3) of rule 8 of the Indian Forest Service (Recruitment) Rules , 1966 , for the purpose of dividing the vacancies to be filled by promotion of members of the State Forest Service of any of the constituent States serving in connection with the affairs of the constituent States be amended in the manner indicated therein" ;

(ii) after Schedule II and the entries thereunder , the lonowing Schedule shall be inserted , namely:-
SCHEDULE III

1. The Indian Forest Service ( Cadre ) Kules , 1966 .
After Rule 11 , the following rule shall be inserted , namely:-
" 11. A authority to exercise certain powers in respect of members of the Service serving in connection with the affairs of the States constituling of Joini Cudre. The powers of the State Government under rule 9 , in relation to the members of the Service serving in connection with the affairs of any of the constituent States shallbe exercised by the Government of that Stato" .
2. The Indian Forest Service (Appointment by Promotion ) Regulations , 1966 .
(a) After sub - regulation (2) of regulation 5 , the following sub- regulation shall be insorted , namely :-
"(2A) Notwithstanding anything contained in sub - regulations ( 1) and ( 2 ) , the list referred to in sub - regulation ( 1) shall be prepared separately in respect of each State Forest Service . The number of members of the State Forest Service included in each such part of the list shall not be more than twice the number of substantive vacancies anticipated in the course of the period of twelve months , commencing from the date of the preparation of the list , in the posts available for them , under rule 9 of the Recruiment Rules , or 10 per cent of the senior posts shown against item 1 of the Cadre in the Schedule to the Indian Forest Service (Fixation of Cadre Strength) Regulations , 1966 ( hereinafter referred to as the Cadre Schedule) under the Government of constituent State concerned and the senior posis shown against the item 2 of the Cadre Schedule notionally reckoned against that State , whichever is greater .
"Explanation , The number of senior posts shown against item 2 of the Cadre Schedule of the Joint Cadre divided in the proportion of the number of posts under the Government of each of the constituent States shown against item 1 of the Cadre Schedule shall be nationally reckoned against cach of the Constituent States for the purpose of this sub - regulation" .
(b) In regulation 8 , the following Explanation shall be added at the end , namely: --
"Explanation . Where a Select List is prepared in the case of Joint Cadre under sub - regulation (2A) of regulation 5 , the appontinent of a member of me State Forest Service whose name appears in the Serect List snail be muc omy to a post under the Government of the constituent state concroung the State Forest Service to which the member belongs and in making bucu appointment , the constituent State concorned snan follow the order in which the names appear in that part of the Select List .
Provided that where administrative exigencies so require a member of the State Forest Service wno is not next in order in inat part of the Select Last may, subject to the provisions of rule 9 of the Cadre Rules , be appointed to a Caure post if the State Government is satisned-
(1) that the vacancy is not likely to last for more than three months ; or
(in) that there is no suitable Cadre Officer available for filling the vacancy" .
(c) After sub - regulation ( 1 ) of regulation 9 , the following proviso shall be added, namely:-
"Provised that the appointment of members of the State Forest Service shall be made in accordance with the agreement arrived at under sub - rule (3 ) of rule 8 of the Recruitment Rules in the order in which the names of the members of the State Forest Service occur in the relevant part of the Select List for the time being in force" .
3. The Indian Forest Service (Regulation of Seniority ) Rules , 1968
(a) At the end of Explanation 4 of the proviso , in clause (c) of sub- rule (2) of rule 3 , the following proviso shall be added , namely:
"Provided also that the certificate shall be given by the Government of the constituent State and the number of officers in respect of whom the certi- ficate is given shall not exceed one half of the maximunt permissible SEC. 8 (1) 1 THE GAZETTE OF INDIA EXTRAORDINARY

strength of the relevant part of the Select List under sub -regulation (2A) of regulation 5 of the Indian Forest Service (Appointment by Promotion) Regulations, 1966 and for every senior Select List officer appointed to a non-cadre post in respect of which a certificate is given there should be one junior Select List Officer whose name appears in the same part of the Select List officiating in a senior post under rule 9 of the Indian Forest Service ( Cadre ) Rules , 1966" .
(b) At the end of clause (c) of the proviso, in sub-rule (4) of rule 4, the following shall be added , namely:
"Or, where their names appear in different parts of the Select List for a Joint Cadre, in the order of their dates of birth" .

सां० फा० ति ० 161 (प्र) -प्रखिल भारतीय सेवा अधिनियम , 1951 ( 1951 का 61) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार, सम्बद्ध राज्यों की सरकारों से परामर्श करने के पश्चात्, श्रखिल भारतीय सेवा ( संयुक्त काडर) नियम, 1972 में और आगे संशोधन करने के लिये निम्नलिखित नियम बनाती है, अर्थात्:--
( 1) इन नियमों का नाम अखिल भारतीय सेवा ( संयुक्त काडर ) संशोधन नियम , 1975 1.
(2) ये नियम राजपत्र में प्रकाशन व राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।।
2' ( 1 ) अखिल भारतीय सेवा ( संयुक्त काडर) नियम, 1972 में,--
(i) नियम 6 के उपनियम ( 2 ) के बाद निम्नलिखित नियम जोड़े जायेंगे , अर्थात्ः-
" (3) इन नियमों की अनुसूची 3 में दशितनियम, भारतीय वन सेवा के ऐसे संयुक्त काडर की बाबत जिसके संबंध में भारतीय वन सेवा ( भर्ती ) नियम, 1966 के नियम 8 उप नियम ( 3 ) के अधीन करार हुआ है , संघटक राज्यों में से किसी राज्य की राज्य वन सेवा के सदस्यों की प्रोन्नति द्वारा भरी जाने वाली रिक्तियों को उस संघटक राज्य के कार्यकलापों के सम्बन्ध में सेवा करने वाले अधिकारियों के प्रयोजन के लिये , उसमें उपदशित रीति में संशोधित किए जायेंगे ।" ;
( ii) अनुसूची II और उसके नीचे की प्रविष्टियों के पश्चात, निम्नलिखित अनुसूची को अन्तःस्थापित किया जाएगा, अर्थात

1. भारतीय वन सेवा ( काडर ) नियम, 1966
नियम 11 के पश्चात , निम्नलिखित नियम अन्तःस्थापित करें, अर्थात्
" 11 (क) किसी संयुक्त काडर को गठित करने वाले राज्यों के कार्यकलाप सम्बश्व में सेवा करने वाले उस सवा के सबस्यों की बाबत कतिपय शक्तिः THE GAZETTE OF INDIA EXTRAORDINARY

प्रयोग करने के लिये प्राधिकार संघटक राज्यों में से किसी राज्य के कार्य- कलापों के संबंध में सेवा करने वाले उस सेवा करने वाले उस सेवा के सदस्यों से सम्बन्धित नियम 9 के अधीन राज्य सरकार की शक्तियां , उस राज्य की सरकार द्वारा प्रयोग की जाएंगी । "
2. भारतीय वन सेवा ( प्रोन्नति द्वारा नियुक्ति ) विनियम, 1966
(क) विनियम 5 के उपविनियम ( 2 ) के पश्चात् निम्नलिखित उनधिनियम अन्तः- स्थापित करें, अर्थात :-
" 2 (क ) उपविनियम ( 1) और ( 2 ) में किसी बात के होते हुए, भी, उपविनियम (1 ) में निर्दिष्ट सूची प्रत्येक राज्य वन सेवा की बाबत अलग- अलग तैयार की जाएगी । उस सूचो के ऐसे प्रत्येक भाग में सम्मिलित राज्य वन सेवा के सदस्योंकी संख्या, उस सूची के तैयार किए जाने की तारीख से प्रारम्भ होने वाले बारह मास की अवधि के दौरान, भर्ती नियमों के नियम 9 के अधीन उनके लिए उपलभ्य पदों में प्रत्याशित अधिष्ठायी रिक्तियों की संख्या के दुगुने या सम्बद्ध संघटक राज्य की सरकार के अधीन भारतीय वन सेवा ( काडर सदस्य संख्या का नियतन ) विनियम, 1966 की अनूसूची में के काडर ( जिसे इसमें इसके पश्चात काडर अनुसूची कहा गया है ) की मद 1 के सामने दशित ज्येष्ठ पदों के और उस राज्य के सामने काल्पनिक रूप से अंकित काडर अनुसूची की मद 2 के सामने दर्शित ज्येष्ठ पदों के दस प्रतिशत, इनमें से जो भी अधिक हो , से अधिक नहीं होगी ।
स्पष्धीकरण. काडर अनुसूची की मद 1 के सामने दर्शित संघटक राज्यों में से प्रत्येक राज्य की सरकार के अधीन पदों की संख्या के अनुपात में विभाजित , संयुक्त काडर कीकाडर अनुप्ची की मद 2 के सामने दर्शित ज्येष्ठ पदों की संख्या इस उप- विनियम के प्रयोजन के लिए संघटक राज्यों में से प्रत्येक राज्य के सामने काल्पनिक रूप से अंकित की जाएगी । رو
(ख) विनियम 8 में , अन्त में निम्नलिखित स्पष्टीकरण जोड़ दिया जाएगा, अर्थात्
स्पष्टीकरण-जहां संयुक्त काडर की दशा में कोई चयन सूची विनियम 5 के उपविनियम ( 2क) के अधीन तैयार की गई हो, वहां राज्य वन सेवा के किसी ऐसे सदस्य की नियुक्तिजिसका नाम चयन सूची में हो, उस राज्य वन सेवा का जिसका वह सदस्य है, नियंत्रण करने वासे संघटक राज्य की सरकार के अधीन के किसी पद पर ही की जाएगी और ऐपी नियुक्ति करते समय , संवटक राज्य उस क्रम का अनु- सरण करेगा जिसमें कि ऐसे नाम चयन सूची के उस भाग में दिए हुए हैं:
परन्तु जहां प्रशासनिक अत्यावश्कताएं एसी अपेक्षा करें , वहां राज्य वन सेवा का कोई ऐसा सदस्य जो चयन सूची के उस भाग में के क्रम में उससे ठीक नीचे नहीं है, काडर नियमों के नियम 9 के उपबन्त्रों के अश्वीन रहते हुए , किसी काडर पद पर उस दशा में नियुक्त किया जा सकेगा, जिसमें राज्य सरकार का यह समाधान हो जाए कि:
(i) रिक्ति का तीन मास से अधिक बने रहना सम्भाव्य नहीं है;
(ii) रिक्ति को भरने के लिये कोई उपयुक्त काडर अधिकारी उपलब्ध नहीं है ।

(ग) विनियम 9 के उपविनियम ( 1 ) के पश्चात् , निम्नलिखित परन्तुक जोड़ दिया जाएगा, अर्थात: -
" परन्तु राज्य वन सेवा के सदस्यों की नियुक्ति भर्ती नियमों के नियम 8 के उपनियम ( 3 ) के अधीन हुए करार के अनुसार उस क्रम में की जाएगी जिसमें कि राज्य वन सेवा के सदस्यों के नाम तत्समय प्रवृत्त चयन सूची के सुसंगत भाग में दिए हुए हों । "
30. भारतेय वन सेवा ( ज्येष्ठता विनियमन ) नियम, 1968
( क) नियम 3 के उपनियम ( 2 ) के खण्ड ( ग) में , परन्तुक के सष्टीकरण 4 के अन्त में, निम्नलिखित परन्तुक जोड़ दिया जाएगा, अर्थात्:--
"परन्तु यह और भी कि प्रमाणपत्र संघटक राज्य की सरकार द्वारा दिया जाएगा और ऐसे अधिकारियों की संख्या जिनकी बाबत प्रमाण पत्र दिया गया है, भारतीय वन सेवा ( प्रोन्नति द्वारा नियुक्ति ) विनियम , 1966 के विनियम -5 के उपविनियम ( 2 क ) के अधीन चयन सूची के सुसंगत भाग की अधिक अनुज्ञेय सदस्य- संख्या के आधे से अधिक नहीं होगी और किसी काडर से बाहर के पद पर नियुक्त किए गए प्रत्येक ऐले अपेष्ट चयन सूची अधिकारी के लिए , जिसकी बाबत प्रमाण पत्र दिया गया है , भारतीय वन सेवा ( काडर ) नियम, 1966 के नियम 9 के अधीन किसो ज्येष्ठ पद पर स्थानापन्न रुप में कार्य करने वाला एक ऐसा कनिष्ठ चयन सूवी अधिकारी होना चाहिए जिसका नाम चयन सूची के उसी भाग में दिया हुआ ह।। "
(ख) नियम 4 के उपनियम ( 4 ) में परन्तुक के खण्ड ( ग ) के अन्त में निम्नलिखित जोड़ दिया जाएगा , अर्थात्:-
"या, जहां उनके नाम किसी संयुक्त काडर के लिये चयन सूची के विभिन्न भागों में दिए हुए हों, वहां ज्येष्ठता उनकी जन्म की तारीख के क्रम में होगी । "
