G.S.R. 287 (E ) . In exercise of the powers conferred by section 10A of the Former Secre- tary of State Service Officers ( Conditions of Service) Act , 1972 (hereinafter referred to as the said Act) , the Central Government , being satisfied that the conditions regarding tetirement benefits applicable to an I.C.S. member of the Indian Administrative Service. who retired or retires from service on or after 1st January , 1973 , have become less favour- able than those applicable to or in relation to the other officers of the Indian Adminis- trative Service , hereby orders that every such I.C.S. member may , as respects annuity. death - cum - retirement gratuity benefits , family pension benefits and any other retirement benefits , exercise an option in writing onoption in writing on or before the 31st December , 1975 , to be governed, with effect from the 1st January , 1973 ,1973 by the same rules and regulations as are applicable to the other members of the Indian Administrative Service , and upon the exercise of the option , every such I.C.S. member shall as respects annuity and other benefits aforesaid be governed as from the said date by the same rules and regulations as are applicable to the other members of the Indian Administrative Service:
Provided that every person who exercises the option as aforesaid shall not be entitled to the credit of any amount to the provident fund account as is referred to in clause (d ) of section 7 of the said Act and where any such amount has already been credited to the provident fund of such member , the provisions of this Order shall apply to him only if such amount is refunded to the Government:
Provided further that the Central Government may , if satisfied that any person had casonable cause for not exercising the option within the period aforesaid , permit him te exercise the option , the expiry of the period notwithstanding .

सा०का० नि० 287 ( अ ) -भूतपूर्व सेक्रेट्री आफ स्टेट सेवा अधिकारी ( सेवा की शर्तें) अधिनियम , 1972 ( इपके बाद उक्न अधिनियम के रूप में निर्दिष्ट ) के सुण्ड 10 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार , इस श्राप्त से संतुष्ट होकर कि भारतीय प्रशासन सेवा के एक ऐसे आई ० सी० एस ० सदस्य के लिए जो 1 जनवरी , 1973 को अथवा इसके बाद सेवानिवृत्त हो गया हो अथवा सेवानिवृत्त होता हो, लागू सेवा निवृत्ति लाभो संबंधी पार्टी, भारतीय प्रशासन सेवा के अन्य सदस्यों पर अथवा उन के बारे में लागू शर्तों की श्रषेक्षा कम अनुक्ल रह गई हैं , यह आदेश देती है कि आई ० सी० एम ० का ऐसा प्रत्येक सदस्य ओ वार्षिकी राशि, मूत्यु -तथा-सेवा निवृसि उपदान, पारिवारिक पेंशन लाभ तथा किसी अन्य सेवा निवृत्ति लाभ के लिए , उन्हीं नियमों तथा विनियमों द्वारा, जो भारतीय प्रशासन सेवा के अन्य सदस्यों पर लागू हैं , 1-1-1973 से शासित होने के लिए 31 दिसम्बर , 1975 को अथवा इससे पहले लिखित रूप में विकल्प देता है और विकरूप देने के बाद आई ० मी० एस ० का ऐसा प्रत्येक सदस्य ओ वार्षिकी राशि और अन्य उपरोक्त लाभ प्राप्त करता है , उक्त तारीख से उम्हीं नियमों तथा विनियमों द्वारा शासित होगा जो भारतीय सेवा के अन्य सदस्यों परलागू है:
परन्तु यह कि प्रत्येक व्यक्ति जो उपरोक्त विकल्प का प्रयोग करता है अपने भविष्य निधि ग्वाते में जमा उस राशि का हकदार नहीं होगा जिसका उल्लेख उक्त नियम की धारा 7 के खंड ( घ ) में किया गया है और जहां ऐसी राशि ऐसे सदस्य की भविष्य निधि में पहले ही जमा की जा चुकी है तो इस ग्रावेश के उपबन्ध उस पर केवल तभी लागू होंगे जबकि एसी राशि सरकार को वापिस लौटा दी जाए:
परन्तु यह भी कि यदि केन्द्रीय सरकार, इस बात से संतुष्ट हो जाए कि उपरोक्त अवधि के भीतर किसी व्यक्ति द्वारा विकल्प प्रयोग न किए जाने का वाजिब कारण है तो इस अवधि की समाप्ति के बाव- जूद भी उसे विकल्प प्रयोग करने की अनुमति दे सकती है ।

G.S.R. 288 ( E) . In exercise of the powers conferred by section 10A of the Former Secretary of State Service Officers (Conditions of Service ) Act , 1972 , the Central Govern- ment , being satisfied that the conditions regarding benefits by way of compensation for the increase in cost of living or otherwise applicable to former Secretary of State Service Officers havebecome less favourable than those applicable to or in relation to any cor- responding class on category of other officers of the Indian Administrative Service or the Indian Police Service or any comparable service , hereby directs that every former Secretary of State Service Officer who has retired from service or who may retire here- after . and who receives his pension in India , be granted such ad hoc relief or graded relief or both as would be admissible to him if he is a member of the Indian Administrative Service or the Indian Police Service or , as the case may be , other comparable service , not being a former Secretary of State Service Officer .
2. This Order shall be deemed to have come into force on 1st January , 1973 .

सा० फा० नि० 288 ( अ ) भूतपूर्व सेक्रेट्री आफ स्टेट सेवा प्रधिकारी ( सेवा की शर्तें) अधिनियिम , 1972 के खण्ड 10 क द्वारा प्रदत्त शक्तियो का प्रयोग करत हुए , केन्द्रीय सरकार , इस बात से संतुष्ट होकर कि भूतपूर्व सेक्रेट्री आफ स्टेट सेवा अधिकारियो को रहन मन्हन के वर्ष में वद्धि की प्रतिपूति द्वारा अथवा अन्यथा दिए जाने वाले लाभों के संबंध में गत भारतीय प्रणामन सेवा भथवा भारतीय पलिम सेवा अथवा किसी भी तुलनीय सेवा के अन्य अधिकारियों की तदनुरूपी श्रेणी अथवा वर्ग पर ग्रथवा ननके सम्वन्ध में लागू गौ की अपेक्षा कम अनुकूल हो गई है , यह निदेश देती है कि भूतपूर्व मेक्रेट्री आफ स्टेट मेवा के पत्येक अधिकारी को जो सेवा से निवृत्त हो चुका हो अथवा जो इसके बाद निवृत्त हो, और जो अपनी पेंशन भारत में प्राप्त करना हो, ऐसी नदर्थ गहायता अथवा बर्गीकृत महायता अथवा दोनों ही, प्रदान की जाएं जो उसे, यदि वह भूपपर्व मेक्रेट्री आफ स्टेट सेवा अधिकारी न होकर भारतीय पशासन सेवा या भारतीय पुलिम मेवा अथवा अन्य तलनीय मेवा, जैसी भी स्थिति हो , का सदस्य होना, दी जाली ।
2. यह आदेश एक जनवरी, 1973 का लागू हुआ समझा जाएगा ।
