ORDER
New Delhi , the 26th May 1975
S.O. 231 (E ) . Whereas the industrial undertaking known as M/ s . Britannia Engincering Company , Calcutta ( Titagarh Unit) in the State of West Bengal is engaged in the Scheduled Industries , namely , Railway Rolling Stock and Tea Machinery ;
And whereas the Company owning the said industrial undertaking , namely , the Britannia Engineering Company Limited is being wound up by the Calcutta High Court ;
And whereas the Central Government is of the opinion that it is necessary in the interests of the general public , and in particular , in the interests of production , supply and distribution of articles relatable to the concerned scheduled industries , to investigate into the possibility of re - starting the said industrial undertaking ;
And whereas on an application made by the Central Government under section 15A of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) , to the Calcutta High Court praying for permission to make an investigation into such possibility , the Calcutta High Court has granted the permission;
Now, therefore, in excercise of the powers conferred by section 15A of the Industries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government hereby appoints, for the purpose of making an investigation into the possibility of re - starting the aforesaid Industrial undertaking , a body of persons consisting of:-

( i ) Shri C. R. Guba Majumdar , Secretary to the Governmentof West Bengal , Closed & Sick Industries Department , Calcutta .

2. The above body shall submit its report within a period of 21 days from the date of publication of this order in the Official Gazette.

नई दिल्ली, 26 मई , 1975
का० प्रा० 231 ( अ) -यतः पश्चिमी बंगाल राज्य में मैसर्स ब्रिटेनिया इंजीनियरिंग कम्पनी, कलकत्ता (टीटागढ़ यूनिट ) के नाम से ज्ञात औद्योगिक उपक्रम अनुसूचित उद्योग अर्थात् रेलवे रोलिंग स्टाक और चाय मशीन में लगा है ,
और यतः उक्त औद्योगिक उपक्रम , अर्थात् ब्रिटेनिया इंजीनिरिंग कम्पनी लिमिटेड का स्वामित्व रखने वाली कम्पनी का कलकत्ता उच्च न्यायलय द्वारा परिसमापन किया जा रहा है ;
और यतः केन्द्रीय सरकार की राय है कि लोक हित में, विशेषकर संबद्ध अनुसूचित उद्योगों से संबंधित वस्तुम्रों के उत्पादन पूति और वितरण के हितों में उक्त औद्योगिक उपक्रम के पुनः श्रारम्भ करने की संभावना की जांच करने की आवश्यकता है ;
और यतः केन्द्रीय सरकार द्वारा उद्योग ( विकास और विनियमन ) अधिनियम 1951 (1951 का 65 ) की धारा 15 क के अधीन कलकत्ता उच्च न्यायलय को , ऐसी संभावना की जांच करने की अनुज्ञा के लिये प्रार्थना करते हुये , आवेदन किये जाने पर , कलकत्ता उच्च न्यायलय ने अनुज्ञा दे दी है ;
अतः अब उद्योग ( विकास और विनियमन) अधिनियम 1951 ( 1951 का 65) की धारा 15 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये केन्द्रीय सरकार पूर्वोक्त औद्योगिक उपक्रम के पुनः आरम्भ करने की संभावना की जांच करने के प्रयोनार्थ एक निकाय नियुक्त करती है जिसमें निम्नलिखित व्यक्ति होगे ।
प्रध्यक्ष
( i) श्री सी० श्रार ० मजूमदार, सचिव, पश्चिमी बंगाल सरकार , बन्द और रुग्ण उद्योग विभाग, कलकत्ता ।
रुवस्थ
(i ) श्री आर० जे ० सानी , प्रबंध निदेशक , जेसोप्स एण्ड कम्पनी लिमिटेड , कलकत्ता ।
