ORDER
New Delhi , the 28th May , 1975
S.O. 232 ( E ) .- Whereas by the Order of the Government of India in the late Ministry of Industrial Development and Internal Trade ( Department of Industrial Development) , S.O. dated the 6th March , 1971 , the mathe management of the industrial undertaking known as Messrs . Braithwaite and CompanyCompany ( India ) Limited , Calcutta ( hereinafter in this Order referred to as the said industrial undertaking ) has been taken over under section 18A of the Industries ( Develop- ment and Regulation) Act , 1951 ( 65 of 1951 ) , for a period of five years commencing from the 6th day of March , 1971 ;
And whereas by the Order of the Government of India in the late Ministry of Industrial Development No. S.O. 381 ( E ) , dated the 29th May , 1972 ( hereinafter referred to as the said Order ) , read with the Orders of the Government of India in the late Ministry of HeavyHeavy Industry No. S.O. 296 ( E ) , datedS.O. 296 ( E ) , dated 28th May , 1973 and No. S.O. 327 ( E ) , dated the 28th May , 1974, the Central Government , in exercise of the powers conferred by clause ( b ) of sub - section ( 1 ) , read with sub- section (2 ) , of section 18FB of the said Act declared that a operation of all contracts , assur- ances of property , agreements , settlements , awards , standing orders or other instruments in force to which the said industrial undertaking was a party or which may be applicable to it immediately before the 6th day of March , 1971 , shall remain suspended up to the 28th of May , 1975 ;

And whereas the Central Government is satisfied that it is necessary so to do in the interests of the general public with a view to preventing fall in the volume of production in a scheduled industry , namely , railway rolling stock;
Now, therefore , in exercise of the powerspow conferredrred by clause (b ) of sub - section (1) of section 18FB of the Industries (Development and Regulation ) Act , 1951 (65 of 19517 ) , the Central Government hereby declares that the operation of all contracts , assurances of property , agreements , settlements , awards , standing orders or other instruments in force to which the said industrial undertaking was a party , or which may be applicable to it immediately before the 6th day of March , 1971 , shall remain suspended for the period commencing on and from the 29th of May, 1975 , and ending with the 5th of March, 1976 , and that all or any of the rights privileges , obligations and liabilitiesliabilities accruing or arising thereunder before the sald date shall remain remain suspended for the said period.

का० आ० 232 ( श्र ) .यतः भारत सरकार के भूतपूर्व औद्योगिक विकास और आन्तरिक व्यापार मंत्रालय (श्रौद्योगिक विकास विभाग ) के श्रादेश सं ० का० आ ० 1027, तारीख 6 मार्च, 1971 द्वारा मेसर्स ब्रेथवेट एण्ड कम्पनी ( इण्डिया ) लिमिटेड , कलकत्ता के नाम से ज्ञात औद्योगिक उपक्रम ( जिसे इस श्रादेश में इसके पश्चात् उक्त श्रौद्योगिक उपक्रम कहा गया है ) का प्रबन्धतंत्र , उद्योग (विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18क के अधीन 6 मार्च , 1971 से प्रारम्भ होने वाली पांच वर्ष की अवधि के लिए ग्रहण कर लिया गया है ;
और यतः केन्द्रीय सरकार ने भारत सरकार के भूतपूर्व भारी उद्योग मंत्रालय के आदेश सं ० का० था० 296 ( ई) , तारीख 28 मई, 1973 और सं ० का ० श्र ० 327 ( ई) , तारीख 28 मई, 1974 के साथ पठित भारत सरकार के भूतपूर्व औद्योगिक विकास मंत्रालय के आदेश सं ० का० आ० 381 ( ई ) , तारीख 29 मई, 1972 ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है) द्वारा उक्त अधिनियम की धारा 18च ख की उपधारा ( 2 ) के साथ पठित उपधारा ( 1 ) के खण्ड (ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , घोषित किया था कि प्रवृत्त ऐसी सभी संविदाओं, सम्पत्ति के हस्तान्तरणपत्नों, करारों , समझौतों, पंचाटों, स्थायी आदेशों या अन्य लिखतों का प्रघर्तन , जिनका उक्त श्रौद्योगिक उपक्रम एक पक्षकार था या जो 6 मार्च, 1971 से ठीक पूर्व उसे लागू थी, 28 मई, 1975 तक निलम्बित रहेगा ;
और यतः केन्द्रीय सरकार का समाधान हो गया है कि अनुसूचित उद्योग , अर्थात्, रेलवे रोलिंग स्टाक में उत्पादन के परिमाण में कमी को रोकने की दृष्टि से जनसाधारण के हितों में ऐसा करना आवश्यक है :

अतः , अब , केन्द्रीय सरकार, उद्योग ( विकाप्त और त्रिनियमन) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18च ख की उपधारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , घोषणा करती है कि प्रवृत्त ऐसी सभी संविदाओं, सम्पत्ति के हस्तान्तरणपत्त्रों, करारों, समझौतों, पंचाटों, स्थायी आदेशों या अन्य लिखतों का प्रवर्तन , जिनका उक्त औद्योगिक उपक्रम एक पक्षकार था या जो 6 मार्च , 1971 से ठीक पूर्व उसे लागू थी, 29 मई , 1975 से प्रारम्भ होने वाली और 5 मार्च , 1976 को समान्त होने वाली सन्धि तक के लिए निलम्बित रहेगा और यह कि उक्त तारीख के पूर्व उसके अधीन प्रोभूत या उत्पन्न होने वाले सभी या उन में से कोई अधिकार , विशेषाधिकार , बाध्यताएं और दायित्व उक्त अवधि के लिए निलम्बित रहेंगे ।
