NOTIFICATIONS
New Delhi , the 31st May 1975
S.O. 239 ( E ) . In exercise of the powers conferred by clause ( a) of sub - section ( 3 ) of Section 17 of the Employees ' Provident Funds and Family Pension Fund Act , 1952 (19 of 1952 ) , and in continuation of the notification of the Government of India in the Ministry of Labour No. S.O. 190( E) , dated the 29th April , 1975 , the Central Government hereby directs that every employer in relation to an establishment exempted under clause ( a) or clause ( b ) of sub - section ( 1 ) of Section 17 of the said Act or in relation to an employce or a class of employces exempted under paragraph 27 , or as the case may be , paragraph 27A of the Employees' Provident Fund Scheme , 1952, shall transfer the monthly provident fund contributions within fifteen days of the close of the month to the Board of Trustecs , duly constituted in respect of that establishment , and that the said Board of Trustees shall invest every month , within a period of two weeks from the date of receipt of the said amounts from the employer , the provident fund accumulations , that is to say , the contributions , interest and sundry receipts as reduced by any obligatory outgoings , in accordance with the following pattern , namely:--
45 per cent ( i) Central Government securities .
25 per cent ( ii ) State Government securities and State or Central Government guaranteed securities .
30 per cent (iii ) Post Office Time Deposits and Small Savings .
The above pattern will be in force for the period from 1st June , 1975 to 30th June, 1975.

2. All rc - investment of provident fund accumulations ( whether invested in securities created and issued by the Central Government or in savings certificates issued by the Central Government or in securities created and issued by a State Government ) shall also be made according to the pattern mentioned in paragraph 1 above .
3. The Board of Trustees shall formulate proper procedure for prompt investment or reinvestment of accumulations in accordance with the aforesaid directions and shall have it approved by the Regional Provident Fund Commissioner concerned .

का० ग्रा ० 239 ( प) करंचारी भविष्य निधि और कटुम्ब पेंशन निधि अधिनियम , 1952 (1952 का 19) की धारा 17 की उपधारा ( 3 ) के खंड ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये और भारत सरकार के श्रम मंत्रालय की अधिसूचना सं ० का ० ग्रा ० 190 श्र, दिनांक 29 अप्रैल,1975 के क्रम में, केन्द्रीय सरकार एतद्वारा निदेश देती है कि उक्त अधिनियम की धारा 17 की उपधारा ( 1 ) के खंड ( क ) या ( ख ) के अधीन छट प्राप्त स्थापन से संद्ध या कर्मचारी भविष्य निधि स्कीम , 1952 के पैरा 27 या, यथास्थिति, पैरा 27-क के अधीन छूट प्राप्त किसी कर्मचारी या कर्मचारियों के वर्ग से संद्ध प्रत्येक नियोजक भविष्य निधि के मासिक श्रभिदाय उम स्थापन की बाबत सम्यक रूप से गठित न्यामी बोर्ड को मामाम्त के पन्द्रह दिन के भीतर अम्तरित कर देगा और उक्त न्यासी बोड भविष्य निधि संचयनों को , अर्थात् अभिदायों, ब्याज और विविध प्राप्तियों को बाध्यकर निर्गमों को कम करके, निम्नलिखित नमूने के अन्मार हर मास , नियोजक से उक्त रकमों की प्राप्ती की तारीख से दो सप्ताह की अवधि के भीतर विनिहित करेगा , श्रर्थात्ः-
( 1) केन्द्रीय सरकार प्रतिभूतियों में
45%
( 2) राज्य सरकार प्रतिभतियों में और राज्य सरकारों या केन्द्रीय सरकार द्वारा गारण्टीकृत प्रतिभूतियों में
25%
( 3) डाकत्ररों में प्रावधिक जनाम्रों और लग बवतों में
30%
उनक्ति नमूना प्रथम जून , 1975 से 20 जन , 1975 तक की अवधि के लिए प्रवृत्त रहेगा ।
2. भविष्य निधि सचयनों के सभी पुत्रिनित्रात ( चाहे केन्द्रीय सरकार द्वारा सृष्ट और जारी को गई प्रतिभूतियों में विनिहित किये जायें या केन्द्रीय सरकार द्वारा जारी किये गये बचत प्रमाण-पत्रों में या किसी राज्य सरकार द्वारा सुष्ट और जारी की गई प्रतिभूतियों में) भी आर पैरा -1 में उपणित नमूने के अनुसार किये जायेंगे ।
3. न्यासी बोर्ड संचयनों 'के पूर्वोक्त निदेशों के अनुसार तत्काल विनिधान या पुरविनिधान लिए उचिन प्रक्रिया बनायेंगा और उसे संबंधित प्रादेशिक भविष्य निधि आयुक्त से अनुमोदित करायेंगा

कॉ० ग्रा० 240 ( प्र ), कर्मचारी भविष्य निधि स्कीम पैरा 52 के उप-पैरा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये और भारत सरकार के श्रम मंत्रालय की अधिसूचना सं० का ० आ० 191 ( श्र) , दिनांक 29 अप्रैल , 1975 के क्रम में केन्द्रीय सरकार एतद्वारा निदेश देती है कि भविष्य निधि अभिदायों के संचयनों, ब्याज और अन्य प्राप्तियों, को बाध्यकर निर्गमों को कम करके, निम्न- लिखित नमूने के अनुसार विनिहित किया जायगा, अर्थात्ः--
45% ( 1 ) केन्द्रीय सरकार प्रतिभूतियों में
25% ( 2 ) राज्य सरकार प्रतिभतियों में और राज्य या केन्द्रीय सरकार द्वारा गारण्टीकृत प्रतिभूतियों में ,
30 % ( 3 ) डाकघरों में आषधिक जमाओं और लघु बचतों में
उपर्युक्त नमूना प्रथम जून , 1975 से 30 जून 1975 तक की अवधि के लिये प्रवृत्त रहेंगा ।
2. भविष्य निधि संचयनों के सभी पुर्नावनिधान ( चाहे केन्द्रीय सरकार द्वारा सुष्ट और जारी की गई प्रतिभूतियों में विनिहित किये जायें या केन्द्रीय सरकार द्वारा जारी किये गये बचत प्रमाण पत्त्रों में या किती राज्य सरकार द्वारा सृष्ट और जारी की गई प्रतिभूतियों में ) भी ऊपर पैरा -1 में उपणित नमूने के अनुसार किये आयेंगे ।
