ORDER
New Delhi , the 6th June 1975
G.S.R. 324 ( E) . In exercise of the powers conferred by article 263 of the Constitution , the President hereby makes the following further modifications in the Order of the Government of India in the Ministry of Finance ( Department of Revenue and Insurance ) , No. G.SR. 238 , dated the 1st February , 1968 , namely :-
1. In paragraph 1 of the said Order ,-
( i ) in sub - paragraph ( 1 ) , in clause ( d ) , for the words " Kerala , Madras and Mysore " , the words " Karnataka , Kerala and Tamil Nadu " shall be substituted;
(ii ) in sub - paragraph (2 ) , in clause ( a) , for item ( iii ) , the following items shall be substituted, namely :-
"( iii ) a Member of the Central Board of Excise and Customs and ex officio Additional Secretary to the Government of India in the Ministry of Finance, who is for the time being in charge of the subjects of sales - tax and Medicinal and Toilet Preparations ( Excise Duties ) Act , 1955 ;
(iv ) the Joint Secretary ( Plan Finance ) in the Ministry of Finance , Department of Expenditure :
Provided that the Joint Secretary ( Plan Finance) may , when he considers it necessary so to do , authorise the Director (Plan Finance ) in the Ministry of Finance , Department of Expenditure , to act on his behalf as member ;
(v) the Adviser ( Financial Resources ) in the Planning Commission or his representative ." ;

( iii ) sub - paragraph ( 3 ) shall be lettered as clause ( a) of that sub - paragraph and in clause ( a) as so lettered , for the words " The Under Secretary " , the words "The Director or , as the case may be , the Deputy Secretary " shall be substituted;
(iv) after clause ( a) as so lettered , the following clause shall be inserted , namely :-
"(b) The Director or the Deputy Secretary aforesaid shall be assisted by the Under Secretary (Sales - tax) in the Ministry of Finance in respect of work relating to sales - tax , and by the Under Secretary ( Medicinal and Toilet Preparations) in the said Ministry in respect of work relating to State Excise Duties and such other items of work referred to in sub - paragraph ( 2 ) of paragraph 2 which are taken up for discussion by the Council by common consent." ;
(v) in sub -paragraph ( 11 ) , for the words " officer or , as the case may be , the senior most officer of the Ministry of Finance who is for the time being a member of the Regional Councils " , the words " senior most officer of the Ministry of Finance" shall be substituted.
2. Paragraph 2 of the said Order shall be renumbered as sub - paragraph ( 1 ) of that paragraph and after sub- paragraph ( 1 ) as so renumbered , the following sub - paragraph shall be inserted , namely :-
"(2 ) Every Regional Council may also discuss any other financial or taxation matter ( other than sales - tax and State Excise Duties ) by common consent . " .
3. In paragraph 4 of the said Order , the words " the officer , or as the case may be , " wherever they occur , shall be omitted .

नई दियो , 6 जून, 1975
सा० का ० नि ० 324 ( श्र) राष्ट्रति, संविधान के अनुच्छेद 263 द्वारा प्रदत्त शक्तियोंका प्रयोग करते हुए , भारत सरकार के वित्त मन्त्रालय ( राजस्व और बीमा विभाग ) के आदेश सं ० मा ० का ० नि ० 236 , तारीख 1 फरवरी , 1968 में निम्नलिखित और उपान्तरण करते , हैं अर्थात्.--
1. उक्त आदेश के पैग 1 मे, --
( i ) उर-पैरा ( 1 ) में, खण्ड ( घ ) में , " केरल , मद्राम और मैसूर " शब्दों के स्थान पर " कर्नाटक , केरल और तमिलनाडु " शब्द रखे जाएंगे ;
( ii ) उप-नैश ( 2 ) में, बण्ड (क ) में मद ( iii ) के स्थान प . निम्नलिखित मदे रखी जाएंगी अर्थात्: --
" ( iii ) केन्द्रीय उत्साद-शुन्क और सामा- गुल्क बोर्ड का सदस्य और पदेन अपर सचिव , भारत सरकार वित्त मन्त्रालय , जोकि तत्समय विश्रा कर तथा औषधिय और प्रसाधन निभितियां ( उत्पादन शुल्क ) अधिनियम , 1955 के विषयों का भारसाधक है ;
( iv ) मंयुक्त सचिव ( योजना वित्त ) , वित मन्त्रालय , व्यय विभागः परन्तु संयुक्न मचिव ( योजना वित्त ) , जच वह ऐना करना प्रावश्यक समझे , निदेशक (योज ।। वित ) , विन मन्त्रालय व्यय विभाग को अपनी ओर से सदस्य के रूप में कार्य करने के लिए प्राधिकृत कर सकेगा;

(V) सलाहकार ( वित्तीय सोत ) , योजना आयोग या उसका प्रतिनिधि । "
(iii ) उप-पैरा ( 3 ) को उम पैरा के खण्ड (क ) के रूप में लिखा जाएगा और इस प्रकार लिखे गए खण्ड ( क ) में " अवर सचिव " शब्दों के स्थान पर " यथा- स्थिति, निदेशक या उप सचित्र " शब्द रखे जाएंगे ;
(iv ) इस प्रकार लिने गए खण्ड ( क ) के पश्वात् निम्ननिवित खण्ड अन्त.थापित किया जाएगा अर्थात्ः--
" (ख ) उपर्युक्त निदेशक या उन सचिव की सहायता विक्रय कर से संबंधित काय की बाबत अवर सचिव ( त्रिका-कर ) , वित मन्त्रालय द्वारा तथा राज्य उलादन शुल्कों और पैरा 2 के उ -पैरा ( 2 ) मे निर्दिष्ट काम की अन्य ऐसी मत्रों, जिन्हें सामान्य सम्मति द्वारा परिषद् द्वारा विचार - विमर्श के लिए लिया गया है, से संबंधित काम की बाबत अवर सचिव ( औषत्रीय और प्रसाधन निमितियां ) , उक्त मन्त्रालय द्वारा की जाएगी" ;
( v) उा - वैरा ( i ) में " वित्त मन्त्रालय के , यथास्थिति, अधिकारी या ज्येष्ठतम अविकारी जो तत्ममय क्षेत्रोय ररिषदों का ज्येष्ठतम सदस्य है " शब्दों के स्थान पर " विन मन्त्राचन के ज्येनस अधिकारी " शब्द रखे जाएंगे ।
2. उक्त प्रादेश के पैरा 2 को उप पैरा के अ-पैरा ( 1 ) के हा में पुनः संख्यांकित किया जाएगा और इस प्रकार पुनः मंख्यांकित उप-पैरा ( 1 ) के पश्चात् निम्नलिखित उप-पैरा अन्तःस्थापित किया जाएगा , अर्थात्ः-
" ( 2 ) प्रत्येक क्षेत्रीय परिषद् सामान्य सहमति से किसी अन्य वित्तीय या कराधान विजय ( जो त्रिरुप- कर और राज्य उत्पाद शुल्को मे भित्र है) पर भी विवार-विमर्श कर सकेगा " ।
3. उक्त आदेश के गैंग 4 में " यथास्थिति , अधिकारी या " शब्दो का जहां कही भी वे आए हों, लोग किया जाएगा ।
