SUBJECT. Export against Commodity Credit of Rs . 100 Million ( 1974 ) extended by the Government of India to the Government of Bangladesh .
No. 28 - ETO ( PN ) /75 -Attention is invited to Public Notice No. 46 - ETC ( PN ) / 74 dated the 26th December , 1974 and Public Notice No. 7 - ETC ( PN ) / 75 dated 7th March , 1975 issued by the Ministry of Commerce on the above subject .
2. The matter has been further reviewed and it has been decided that the export under the above mentioned Commodity Credit will be allowed from India to Bangladesh in respect of the commodities indicated below within the financial ceilings mentioned against each of them: -

3. Export of cotton yarn and any other textile items under the aforesaid Com- modity Credit will be allowed only through the Cotton Textile Export Promotion Council , who will be the eligible exporter for the items .
4. The contracts to be financed under this Commodity Credit should be signed and the irrevocable Letters of Credit established on or before the 31st December , 1975. The Letter of Credit will cover 90 per cent of C & F value of the goods upto Indo - Bangladesh Border when transported to Bangladesh by rail or upto the port of disembarkation when transported by sea in vessels of Indian flag. If the goods are transported in non - Indian owned vessels , the letter of Credit will cover 90 per cent of the F.O.B. value of such goods . The Letters of Credit should specify that the first 10 per cent would be met by remittances from Bangladesh in free convertible currency as down payment while the balance 90 per cent would be financed from this Commodity Credit of Rs . 100 million . Reimburse- ment of 90 per cent of the C &F value of the goods upto the Indo - Bangladesh border when tratosported to Bangladesh by rail , or upto the port of disembarkation in Bangladesh when transported by sea in vessels of Indian flag or 90 per cent of the F.O.B. value of the goods if transported in non - Indian owned vessels , shall be provided by the State Bank of India , Chowringhee Branch Calcutta from the Rupecs One hundred million credit ( 1974 ) extended by the Government of India to the Government of People's Republic of Bangladesh , provided that no reimburse ment shall be made after 30-6-1976 . The Letter of Credit will be made opега- tive by the State Bank of India after verifying the ceiling to the extent of 90 per cent of the C &F or the F.O.B. value ( as the case may be ) only and it will be the responsibility of the negotiating bank to ensure that the remain- ing 10 per cent of the amount of the credit has been received ta free foreign exchange. All claims to the State Bank of India for payment of 90 per cent of C & F / F.O.B . valuevalue willwill need to be supported by a certificatecertifica of the negotiating bank that the 10 per cent directly payable has been received .
5. Paragraphs 1 & 4 of Public Notice No 46 - ETC ( PN ) / 74 dated 26-12-74 and paragraphs 2 and 4 of Public Notice No. 7 - ETC ( PN ) / 75 dated 7th March , 1975 may be deemed to have been amended accordingly .

विषय.--बंगला देश सरकार के लिए भारत सरकार द्वारा बढ़ाए गये 10 करोड़ रुपये ( 1974) के पण्यवस्तु क्रेडिट के मद्दे निर्यात ।

जारी की गई सार्वजनिक सूचना संख्या 46- ई० टी ०सी ० (पी ० एन ० ) / 74 दिनांक 26 दिसम्बर ,
1974 और सार्वजनिक सूचना संख्या -7 ई ० टी० सी० (पी ० एन) / 75 दिनांक 7 मार्च ,
1975 की ओर ध्यान आकृष्ट किया जाता है ।
2. मामले की आगे और पुनरीक्षा की गई है और यह निर्णय किया गया है कि उपर्युक्त
पण्यवस्तु क्रेडिट के अन्तगत नीचे उल्लिखित पण्यवस्तुओं के सम्बन्ध में भारत से बंगला देश को
निर्यात करने की अनुमति प्रत्यक पण्यवस्तु के सामने उल्लिखित वित्तीय उच्चतम सीमा तक दी
जायेगीः-

3. उक्त पण्यवस्तु क्रेडिट के अन्तर्गत सूत एवं अन्य वस्त्र की मदों के निर्यात की अनुमति
केवल सूती वस्त्र निर्यात संवधन परिषद् के माध्यम से ही दी जाएगी जो कि इन मदों का पात्त्र निर्यातक
होगी ।
4. इस पण्यवस्तु क्रेडिट के अन्तर्गत श्रर्थयुक्त की जाने वाली संविदाएं हस्ताक्षरित की जानी चाहिएं
और 31 दिसम्बर , 1975 को या इससे पूर्व अपरिवर्तनीय साखान की स्थापना हो जानी चाहिए ।
जब माल रेल द्वारा बांगला देश को भेजा जाएगा तब भारत बांगला देश बोर्डर तक और जब माल
भारतीय ध्वज के पोतयान में समुद्र द्वारा भेजा जाएगा तो जहाज से माल उतरने के पत्तन तक माल के
लागत तथा भाड़ा मूल्य का 90 % साखपत्त्र में शामिल किया जाएगा । यदि माल भारत के अपने
पोतयान में नहीं भेजा जाता है तो साखपन्न में ऐसे माल के जहाज पर निःशुल्क मूल्य का 90 %
शामिल होगा । साखपत्र को यह विशिष्टकृत करना चाहिए कि प्रथम 10 % तत्क्षण भुगतान के रुप
में स्वतंत्र परिवर्तनीय मुद्रा मे बागला देश से परेषण के द्वारा पूरा किया जाएगा जबकि शेष 90 %
का वित्तदान इस दस करोड़ रुपये में पण्यवस्तु क्रेडिट से किया जाएगा । जब माल रेल द्वारा बांगला
देश को भेजा जाता है तब भारत बांगला देश बोर्डर तक या जब भारतीय ध्वज पोतदान में माल समुद्र
द्वारा भेजा जाता है तो बांगला देश में जहाज से माल उतरने के पत्तन तक माल के लागत एवं भाड़ा
के 90 % की प्रतिपूति या जब माल भारत के अपने पोतयान में नहीं भेजा जाता है तो भाल के जहाज
१ र निःशुल्क मूल्य के 90 % की व्यवस्था बांगला देश जनतंत्र गणराज्य सरकार को भारत सरकार द्वारा

बढ़ाए गए 10 करोड़ रुपये ( 1974 ) में से भारत के स्टेट बैंक , चौरंगी शाखा , कलकत्ता द्वारा की जाएगी बशर्ते कि 30-6-76 के बाद कोई परेषण नहीं किया जाएगा । साखपक्ष को भारत के स्टेट बैंक द्वारा केवल तभी प्रभावी किया जाएगा जब लागत एवं भाड़ा के 90 % की उच्चतम सीमा का या जहाज पर निःशुल्क मूल्य ( जैसा भी मामला हो ) का सत्यापन कर लिया जाता है और यह सौदा तय करने वाले बैंक की जिम्मेदारी होगी कि वह इस बात का सुनिश्चिय करे कि क्रेडिट की धनराशि का शेष 10 % स्वतंत्र विदेशी मुद्रा में प्राप्त कर लिया गया है । लागत एवं भाड़ा/ जहाज पर निःशुल्क मूल्य के 90 % के भुगतान का भारत के स्टेट बैंक से दावा करने के लिए सौदा करने वाले बैंक का इस बात का समर्थन करने के लिए एक प्रमाण पत्र की जरुरत होगी कि 10 % सीधे ही किए आने योग्य भुगतान प्राप्त कर लिया गया है ।
5. सार्वजनिक सूचना संख्या 46 ई टी सी ( पी एन ) / 74 दिनांक 26-12-74 के पैरा । भौर 4 को तथा सार्वजनिक सूचना संख्या 7 - ई टी सी ( पी एन ) / 75 दिनांक 7 मार्च , 1975 के पैरा 2 और 4 को तवनुसार संशोधित किया गया समझा जाए ।
