SUBJECT . Supplementary licences to actual users borne on the books of the DGTD- submission of applications for grant of import licences for the licensing period April , 1975-March , 1976 .
No. 59 - ITC ( PN ) / 75 .--Attention is invited to para 21 of Section 1 of the ITC Policy , Red Book ( Vol . I ) for the period April 1975 -March 1976 , in terms of which applications for grant of supplementary licences from scheduled industries borne on the books of the DGTD and engaged in 'Select ' industries are to be sub- mitted in the appropriate form and mannetr prescribed in the ITC Hand Book of Rules and Procedure , 1975-76 through the DGTD .
2. In order to simplify the procedure for submission of applications in terms of the Import Policy for the licensing period April 1975 March 1976, it has been decided that actual users borne on the books of the DGTD and engaged in ' Select ' industries specified in Appendix I of the Red Book ( Vol. I) for the period 1975-76 , should submit applications for grant of licences for import of raw materials and components under the supplementary licensing scheme in the form 'C'- II as given in the Annexure of this Public Notice ,
3. As required in para 4 of the Ministry of Commerce , Public Notice No. 41- ITC ( PN ) / 75 , dated 5th June , 1975, the applications for supplementary licences should be accompanied with a copy of the application submitted for grant of automatic licence .

4. The last date for receipt of applications for supplementary licences will be the 31st October , 1975 as provided in para 22 of Section I to the Import Trade Control Policy ned book ( Vol. 1 ) for the period April , 1975-March , 1976 .

NOTE-Production programme should be spelt out item - wise giving quantity and value against each item ( A detailed justification of the production programme envisaged to be given alongwith full particulars of orders in hand and separate data for orders under negotiation ) .
23. Full details of the enclosures attached with the application (every copy of the document should be marked as a true copy and signed beneath by the applicant ) .

NOTE
1. Applicants are advised to read the licensing instruction for the current Deriod carefully before filling up the application form for import licence.
2. The information required against the various items , in the form should be given legibly and completed in all details to avoid correspondence and delay in the disposal of applications . The licensing authorities have discretion to reject an application if the application is not complete in all respects .
3. Documentary evidence if asked for should be sent alongwith the appli- cation.
4. Any special reasons in support of the application may , if necessary be explained in a covering letter attached to the application .
5. Application should be signed by the Proprietor , Partner or Managing Director of the firm or by any person duly authorised to sign legal declaration on behalf of the firm . The position held by the persons signing the application should be clearly stated .
6. An applicant supplying incorrect Information may be liable to have his licence cancelled and in addition may be debarred from the grant of any import licence in future .
7. Seven coples of lists of raw materials and components may be sent as enclosures ( In respect of Engineering Industries where lists of raw materials included in Automatic licence is intended to be substituted hy a revised list seven copies of revised list alongwith full justi- fication may be furnished ) .
8 A copy of the application on form C - 1 submitted directly to CCI & E for grant of AUTOMATIC LICENCE together with the enclosures including Chartered Accountant's certificate should be sent as enclosures .

महानिदेशालय तकनीकी विकास की पुस्तकों मे आए हुए और " बुनिन्दा ," उद्योगों में लगे हुए अनुसूचित उद्योगों से सम्पूरक लाइसेंसो की मंजूरी के लिए प्राप्त आवेदनपत्र आयात व्यापार नियन्त्रण नियम तथा क्रियाविधि पुस्तक 1975-76 में निर्धारित उपयुक्त प्रपत्न मे और निर्धारित तरीके से महानिदेशालय तकनीकी विकास के माध्यम से प्रस्तुत किए जाने हैं ।
2. अप्रैल , 1975-- मार्च 1976 लाइसेंस अवधि के लिए श्रायात नीति के अनुमार आवेदन - पत्नों को प्रस्तुत करने की क्रियाविधि को सरल बनाने के लिए यह निश्चय किया गया है कि महानिवेशालय तकनीकी विकास की पुस्तकों में आए हुए और 1975-76 अवधि की रेड बुक्र ( वा ० 1 ) के परिशिष्ट -1 में विशिष्टिकृत "चुनिन्दा " उद्योगों में लगे हुए वास्तविक उपयोक्ताओं को सम्पूरक लाइसेंस योजना के अधीन कच्चे माल और संघटकों के आयात के लिए लाइसेंसों की मंजूरी के लिए आवेदन-पत्त्र इस सार्वजनिक सूचना के अनुबन्ध में दिए गए प्रपत्त ' ती'- II मे प्रस्तुत करने चाहिए ।
3. जैसा कि वाणिज्य मंत्रालय की सार्वजनिक सूचना सं ० 41 -साई ० टी० सी० (पी० एन ० ) / 75 दिनांक 5-6-1975 के पैरा 4 में अपेक्षित है , सम्पूरक लाइसेंसों के लिए आवेदन- पत्न , स्वतः लाइसेंस की मंजूरी के लिए प्रस्तुत किए गए आवेदन -पत्न की एक प्रति के साथ साथ गाना चाहिए ।
4. सम्पूरक लाइसेंसों के लिए श्राबेदन-पत्नों की प्राप्त की अन्तिम तारीख 31 अक्टूबर 1975 होगी जैसा कि अप्रैल 1975 --मार्च 1976 अवधि की श्रायात व्यापार निमन्त्रण नीति रेड- बुक ( वा ० 1 ) के खंड 1 के पैरा 22 में दिया गया है ।

( यह आवेदन -पत्त्र मुख्य नियंत्रक , आयात- निर्यात को महानिदेशालय तकनीकी विकास के माध्यम से प्रस्तुत किया जाना चाहिए । तीन प्रतियां प्रस्तुत करनी चाहिएं जिन में से एक प्रति महा- निदेशारणय तकनीकी विकास द्वारा रख ली जाएगी , एक प्रति श्रार्थिक सलाहकार, उद्योग तथा नागरिक संभरण संत्रालय को महानिदेशालय तकनीकी विकास द्वारा भेजी जाएगी और तीसरी प्रति मुख्य नियंत्रक , आयात- निर्यात को भेजी जाएगी ) ।

14. आयात किए जाने वाले कच्चे माल केके व्यौरे ( नीचे के सरणी प्रपत्त्र में प्रस्तुत किए जाने हैं ) :--
(i ) क्रम संख्या
( ii ) कच्चे माल का पूरा विवरण देना चाहिए
( iii ) श्रायात व्यापार नियंत्रण संख्या और भाग
( iv ) माना ( भार सं ० , अन्य उपयक्त लेखा इकाई )
(v ) मूल्य ( लागत -बीमा-भाड़ा)
( vi) आयात भावेदनपत्त्र क, तिथि को आवेदक के पास उसके निजी गोदाम में , उत्पादन ऋण लेखे के अधीन बैंक में पड़ा हुआ या किसी अन्य स्थान पर आयातित कच्चे माल का स्टाक ( माता और लागत-बीमा-भाड़ा मूल्य )
( vii ) आयात भावेदन -पत्न की तिथि को हस्तगत लाइसेन्सों के प्रति प्रायातित कच्चे माल की प्रत्याशित श्रामद (मात्रा और लागत -बीमा - भाड़ा मूल्य ) ( हस्तगत लाइसेन्सो के प्रति जो माल यात्ना मार्ग मे हो या जिसके लिए आदेश दे दिया गया हो या आवेश दिए जाने हों उसकी प्राप्ति सूचना में शामिल होनी चाहिए)
( viii ) प्रभ्युक्तियां
जारी किए गए आयात लाइसेन्सों/ रिहाई आदेशों का कुल लागत- बीमा -भाड़ा मूल्य और पिछले तीन वर्षों के दौरान आयात किए गए माल का लागत-बीमा - भाड़ा मूल्य । क्या निर्यात करने वाला एकक वित्तीय वर्ष 1974-75 या पंचांग वर्ष 1974 के दौरान अपने उत्पादन का 20 प्रतिशत या इससे अधिक निर्यातकर्ता एकक है । यदि हां, तो निर्यात निष्पादन को स्वीकार करने वाले मुख्य नियन्त्रक, आयात- निर्यात के पत्र की संख्या और दिनांक निर्दिष्ट कीजिये ।
17. क्या प्राधिकार - पत्त्र मांगा गया है ? यदि हां, तो उस फर्म का नाम जिसके पक्ष में यह मांगा गया है ।
18. उस सीमा- शुल्क कार्यालय का नाम जिसमें , यवि श्रयात लाइसेन्स मंजूर किया गया , तो वह पंजीकृत किया जाएगा ।
19. प्रत्येक अन्तिम उत्पाद के लिए उत्पादन क्षमता ।
20. गत तीन वित्तीय वर्षों में प्रत्येक उत्पाद के लिए मात्रा के अनुसार वास्तविक उत्पादन एवं उसका बहें मूल्य ।
हिप्पणी. यदि किसी अवधि के लिए उत्पाद बन्द पड़ा था तो उस अवधि का समय और कारणो का संकेत करें ।

21. उस संस्थान के मामले में जो आयातित कच्चे माल का उपयोग कर रहा है तो उपर्युक्त ( 20 ) के सामने प्रर्दाशश यदि कोई वास्तविक उत्पाद है और जो महानिदेशक तकनीकी विकास से भिन्न स्रोतों से प्राप्त कच्चा माल विदेशी मुद्रा विनिमय सहायता के माध्यम से उपलब्ध किया है उसका संकेत करें ।
22. वर्तमान एवं अगले वर्षों के लिए प्रत्येक उत्पाद के लिए अलग से उत्पाद कार्यक्रम ।
टिप्पणः- उत्पादन कार्यक्रम प्रत्येक मद के सामने मात्रा और मूल्य को देते हुए मदवार दर्शाया जाना चाहिए ( विचाराधीन उत्पादन कार्यक्रम का विस्तृत औचित्य जो हस्तगत आदेशों के पूरे व्यौरे के साथ दिया जाना है और सौदे के अधीन आदेशों के लिए अलग अलग तिथि)
23 . आवेदन - पत्न के साथ संलग्न पत्त्रों के पूरे ब्यौरे ( दस्तावेज की प्रत्येक प्रति सही प्रतिलिपि के रूप में चिह्नित होनी चाहिए और नीचे आवेदक द्वारा हस्ताक्षरित होनी चाहिए ।
24. महानिदेशक तकनीकी विकास में प्रयोजक महानिदेश का नाम
( 1 ) मैं/ इम एतद्वारा घोषणा करते हैं कि इस आवेदनपत्तन के अन्तर्गत माल के लिए पूरक लाइसेन्स के लिए कोई आवेदनपत्त्र नहीं भेजा है ।
( 2 ) मैं/ हम एतद्वारा घोषणा करते हैं कि आयात के लिए उस माल के लिए जिसके लिए आवेदन पत्र भजा गया है वह उन नई वस्तुओं के विनिर्माण में उपयोग के लिए नई है जिनके लिए उद्योग ( विकास एवं विनियम ) अधिनियम , 1951 के अधीन लाइसेंस नहीं प्राप्त किया गया है ।
( 3 ) मैं, हम इसके द्वारा घोषणा करते हैं कि यदि लाइसेन्स स्वीकृत किया जाता है तो हमारे कारखाने में उस माल का कच्चे माल अथवा उपषंगी के रूप में केवल उपभोग के लिए किया आएगा और उसका कोई भी भाग किसी अन्य पार्टी को बेचा नहीं जाए । या उसके द्वारा उपयोग करने के लिए स्वीकृति नहीं दी जाएगी ।
( 4) मै हम इसके द्वारा घोषणा करते हैं कि मेरी/ हमारी जहां तक जानकारो और विश्वास है उपर्युक्त विवरण सत्य और सही है । मुझे/ हमें पूरी तरह पता है कि मुझे, हमें उपर्युक्त विवरण के आधार पर जारो किए गए लाइसेन्स को यदि यह पता चल जाता है कि उपर्युक्त विवरण या तथ्य गलत या झूट है सरकार द्वारा मामले की परिस्थितियो को ध्यान में रखते हुए कोई भी अन्य कार्रवाई करने के अलावा रद्द किया जा सकता है ।

2 प्रपत्त्र में विभिन्न मदों के सामने आवश्यक जानकारी साफ और पूर्ण व्यौरों के साथ भेजी जानी चाहिए ताकि पत्त्राचार कम करना पड़े और आवेदन पत्नों के निपटान में विलम्ब न हो सके । लाइसेंस प्राधिकारी को यह विशेष अधिकार है कि यदि आवेदन पत्र सभी प्रकार से पूर्ण नही है तो उसे रद्द कर सकता है ।
3. पूछने पर दस्तावेजी साध्य आवेदन पत्र के साथ भेजे जाने चाहिए ।
4. आवेदन पत्र के समर्थन में कोई विशेष कारण यदि वह आवश्यक हो, तो उसे आवेदन पत्र के लिए संलग्न आवेदम पत्न में बताया जाना चाहिए ।
5 . आवेदन पत्र फर्म के स्वामी , भागोदार या प्रबन्ध निदेशक द्वारा था कर्म की ओर से कानूनी घोषणा पर हस्ताक्षर करने के लिए विधिवत् प्राधिकृत किसी भी व्यक्ति के द्वारा हस्ताक्षरित होना चाहिए ।
6. गलत जानकारी देने वाले' आवेदक के लाइसेंस को रद्द करने के अलावा उन भविष्य में किसी भी आयात लाइसेंस को प्रदान करने से वंचित कर दिया जाएगा ।
7. कच्चे माल और संघटकों की सूची की सात प्रतियां अनुलग्नक के रूप में भेजी जाएं ( अभियांत्रिक उद्योगों के मामले में जहां कच्चा माल आटोमेटिक लाइसेंस में शामिल होता है उसे एकपरि- शोधित सूची द्वारा प्रतिस्थापित किया जाना है और उस परिशोधित सूची की सात प्रतियां भेजी जाए )
8. सनदी लेखा पाल के प्रमाण -पत्र सहित अनुलग्नक के साथ आटोमेटिक लाइसेंस के लिए मुख्य नियंत्रक श्रायात निर्यात को सी -1 प्रपत्न में सीधे भेजे गए आवेदन पत्र की एक प्रति अनु- लग्नक के रूप में भेजी जानी चाहिए ।
