SUBJECT.- Import Policy for registered exporters for the licensing period April, 1975- March, 1976 .
No. 81 - ITC ( PN) /75.-Attention is invited to annexures VII , VIIA, IX and XV of the mport Trade Control Policy (for registered exporters ) (Vol . II) for the licensing period April , 1975- March , 1976 , prescribing import application forms to be submitted by registered exporters , merchant exporters , manufacturers exporters , export houses and for rant of advance licence for fulfilling specific export orders by registered exporters .
2. In order to simplify the procedure for submission of applications in terms of the import policy as contained in Import Trade Control Policy Red Book (Vol . II ) for the verlod April , 1975-March , 1976, it has been decided that applications for grant of advance licences against specific export orders by registered exporters shouldbe submitted to the licensing authorities concerned in the revised form given in annexure I of this public notice . Similarly , in the case of import of goods against exports made by registered exporters representing merchant /manufacturer exporters as well as eligible export houses , applications for grant of licences for import of goods under the import olicy as contained in Volume II of the Red Book for the period 1975-76, should be submitted to the licensing authorities concerned in the form given in annexure II of this ublic notice .

3. It is clarified that the applications for grant of advance licences as well as fo unport of goods against exports made by registerea exporters representing merchants manufacturer exporters as well as eligible export houses , alrcady submitted in the existin forms referred to in para 1 above will be considered by the licensing authorities . It not necessary for such applicants to submit fresh applications in the revised forms given in annexures I and Il of this public notice . Further , in order to make use of th existing forms in stock , there is no objection to the applications being made in existin forms upto the 31st December , 1975 .

Technical Development (in the case of firms borne on the list of DGTD ) /State Directorate of Indus- tries (in the case of SSI Units ) or any other authority competent to register a unit as a manufacturer . UNDERTAKINGS / DECLARATION
I/We hereby solemnly undertake/declare :
(i) that no other application for import licence has been made or will be made in future against exports covered by this application except advance licence (s ) mentioned against Col. 13 ( a) ;
( ii) the consignment (s ) / parcel (s ) have not been returned . If at any time , the exported goods are returned by the consignee or if the sale proceeds in respect of the goods in question or are not realised through an authorised channel within six months from the date of export or such extended period as the Reserve Bank of India may permit , necessary intimation shall be sent to the licensing authority , within one month , thereof , and the value of import licences issued against this application shall be liable to be set off against future import licences due to me / us or to my / our nominees , without prejudice to any other action that may be taken in this behalf . If any amount is paid to the foreign buyer at any time on account of any penalty or damage pertaining to the exports covered by this application , the intimation thereof shall be sent to the licensing authority within one month thereof;
(iii) if as a result of a scrutiny by the licensing authority any excess licensing is found to have been done to me/ us or to my/ our nominees against this applica.ion , the same shall be liable for being adjusted against future licences due to me or to my /our nominees under any category without prejudice to any other action that may be taken in this behalf;
(iv) I /We hereby declare that the particulars and statements made in this application a tue to the best of my / our knowledge and nothing has been concealed or held the "om;
(v) I/We hereby undertake that any licence granted on the basis of this application shall be liable to cancellation or being made ineffective without prejudice to any other action that may be taken in this behalf, if any information furnished in this application is found to be wrong or incorrect or misleading:
(vi) I /We hereby declare that the prices charged for books / journals / periodicals exported were not less than the listed foreign prices minus a discount of not more than 40 per cent . In cases no foreign price was listed . the books /journals / periodicals were exported at a price not less than the listed Indian prices converted into foreign currency at the official exchange rate , minus the usual trade discount not exceeding 40 per cent ;
(vii) I /We declare that the figures on the basis of which this application for replenishment licence is made do not include exports of books / journals / periodicals intended for internal use only and prohibited from being exported ; 1.

2. लाइसेन्स अवधि अप्रैल , 1975--मार्च, 1976 के लिए आयात व्याश्रार नियंत्रण नीति रेड बुक ( वा० 2 ) में निहित आयात नीति की शर्तों के अनुसार आवेदन पत्र प्रस्तुत करने की प्रसौ अनुसार आवेदन-पत्र प्रस्तुत करने की क्रियाविधि को सरल बनाने के लिए यह निश्चय किया गया है ि विशिष्ट निर्यात आदेशों के प्रति अग्रिम लाइसेन्सों का मंजूरी के लिए पंजीकृत निर्यातकों को अप आवेषन-पत्त्र इस सार्वजनिक सूचना के अनुबंध -1 में दिए गए परिशोधित प्रप्त में सम्बद्ध लाइसेन् प्राधिकारी को प्रस्तुत करने चाहिएं । इसी प्रकार से व्यापारी/ विनिर्माणकर्ता निर्यातकों और साथ . पात्न निर्यात सदनों का प्रतिनिधित्व करने वाले पंजीकृत निर्यातकों द्वारा किए गए निर्यातों के प्रा भाल के आयात के मामले में 1975-76 अवधि की रेडबुक वा०-2 में निहित आयात नीति के अधी माल के आयात के लिए लाइसेन्स की मंजूरी के लिए आवेषन- पत्त्र इस सार्वजनिक सूचना के अनुबंध- में दिए गए प्रपत्न में सम्बद्ध लाइसेन्स प्राधिकारी को प्रस्तुत करने चाहिएं ।
3. यह स्पष्ट किया जाता है कि अग्रिम लाइसेन्सों को मंजूरी के लिए और व्यापारी/ विनिर्माण कर्ता निर्यातकों और पात्न निर्यात सदनों का प्रतिनिधित्व करने वाले जिन पंजीकृप्त निर्यातकों ने अप द्वारा किए गए निर्यातों के प्रति माल के आयात के लिए अपने आवेदन-पत्र उपर्युक्त पैरा 1 में संदर्भि विद्यमान प्रपत्नों में पहले ही प्रस्तुत कर दिए हैं, उन पर भी लाइसेन्स प्राधिकारियों द्वारा विच किया जाएगा । ऐसे आवेदकों के लिए इस सार्वजनिक सूचना के अनुबंध -1 और 2 में दिए गए र्पा शोधित प्रपत्रों में नए आवेदन-पत्र प्रस्तुत करना श्रावश्यक नहीं होगा । आगे , स्टाक में विद्यमान प्रप. को उपयोग करने के विचार से यदि 31-12-1975 तक उन्हीं प्रपत्तों में आवेदन-पत्त्र दिए जाए तो कोई मापत्ति नहीं होगी ।

9. सम्बद्ध निर्यात संवर्धन परिषद्/ पणब. र्ड द्वारा जारी किए गए पंजीकरण प्रमाण पत्र की संख्या और तिथि ( पंजीकरण प्रमाण पत्र की फोटोस्टेट प्रति भेजनी है ) । पात्न निर्यात सदन के मामले में भी पात्रता प्रमाण पत्र की संख्या और तिथि उद्धृत कीजिये और उसकी एक फोटोस्टेट प्रति संलग्न कीजिये ।
10. क्या महानिदेशालय तकनीकी विकास एकक है या लघु पैमाना उद्योग एकक/ पात्न निर्यात मदन के मामले में उन समर्थक विनिर्मातओं ( ओं ) के नाम दीजिये जिनको निर्यात आदेश पालन के लिए तैयार माल के विनिर्माण के लिए आयातित सामग्री दी जाएगी और वह निर्दिष्ट कीजिये कि क्या वे महानिदेशालय तकनीकी विकास एकक हैं या लघु पैमाना उद्योग एकक ।
11. महानिदेशालय तकनीकी विकास ( महानिदेशालय तकनीकी विकास की सूची में सम्मिलित फर्म के मामले में ) । राज्य उद्योग निदेशालय [ लघु पैमाना उद्योग एककों के मामले में या विनिर्माणकर्ता के रूप में एकक को पजीकृत करने के लिए समर्थ किसी श्रन्य प्राधिकारी द्वारा आवेदक को आवंटित पंजीकरण संख्या/पात्र निर्यात सदन के मामाले में समर्थन करने वाले विनिर्माण कर्ता ( श्रों ) की पंजीकरण संख्या दीजिए ] ।

( 5) क्मा विपयाधीन निर्यात आदेश के प्रति पहले ही कोई निर्यात किया गया है , यदि हां तो उसका जहाज पर निशुल्क मूल्य निर्दिष्ट कीजिये ।
( २) ( क) या िित आदेश गरिवर्तनीग साख पत्त्र द्वारा समर्पित है या किसी अग्रिम भुगतान द्वारा ( कृपया गाख पत्र को एक फोटोस्टेट प्रति भेजिये )
या
(ख ) क्या निर्यात आदेश साइट ड्राफ्ट ( दर्शनी हुन्डी ) , डी ० ए ० जैसे भुगतान के विभिन्न तरीकों के आधार पर है
था
( ग) क्या आवेदक ऐसी व्यवस्था में प्रविष्ट हुआ है जिसके द्वारा यह निर्यात किए जाने वाले उत्पाद की निर्यात आय में से आयातित माल का भुगतान करेगा
था
( घ) क्या विदेशी क्रेता आयातित माल इस शर्त पर संभरित करने के लिए सहमत हो गए हैं कि वह संसाधित करने और परिष्कृत करने के बाद निर्यात किया जाएगा ।
( 7 ) आवेदन पत्त्र में सम्मिलित निर्यातों पर विदेशी एजेन्ट को चुकाये गये या चुकाये जाने वाले ( निर्यातक द्वारा बाद की तिथि पर ) कमीशन या बट्टे की धनराशि ।
2. ( 1 ) क्या निर्यात किए जाने वाले उत्पाद पंजीकृत निर्यातकों के लिए श्रायात नीति में सम्मिलित है । ( कृपया रेडबुक में यथा निर्दिष्ट निर्यात उत्पाद की संदर्भ संख्या दीजिए ) ।
( 2 ) निर्यात आदेश के आधार पर पंजीकृत निर्यात नीति के अन्तर्गत अनुमेय आयात प्रति- पूति प्रतिशता ।
3. आवेदित लाइसेस और पिछले अग्रिम लाइसेंसों के मूल्य के सम्बन्ध में ब्यौरे

( 5 ) यदि हां , तो क्या इन लाइसेसों के प्रति निर्यात दायित्त्र अब भी बाकी है ।
( 6) यदि निर्यात दायित्व आणिक रूप में था पूर्णरुपेण पूरा करना बाकी है तो उसके ब्यौरे निम्नलिखित अनुसार, दीजिए :-
(क ) लाइसेंस की संख्या और दिनांक ।
ख) लाइसेंस जारी करने वाले प्राधिकारी का नाम ।

( घ ) निर्यात दायित्व को पूर्ण करने के लिए अनुमित समय सीमा ।
( ड ) प्रत्येक लाइसेस के प्रति पहले ही पूर्ण कर दिए गए निर्यात दायित्व का मूल्य ।
( च ) निर्यात दायित्व को पूर्ण न करने के कारण ।

1. मै, हम एतद् द्वारा घोषणा करता हू / करते है कि यदि यह लाइसेस मजूर किया गया तो माल केवल कच्च। सामग्री / संघटको या उपसाधको के रूप मे हमारे कारखाने में उपभोग के लिए प्रयोग किया जाएगा और उसका कोई भ भाग किसः भो अन्य पक्ष को न तो बेचा जाएगा और न किसी भी अन्य पक्ष को उपयोग करने की यनुमति दी जाएगी ।
2 न / हम एतद्वारा घावगाकरताह करते है कि उपयुक्त कथन मेरे / हमारे ज्ञान और विश्वास के अनुसार सत्य और सही है । मुझे / हमे पूर्ण रुपेण ज्ञात है कि यदि यह पाया गया कि कोई भी कथन या कथन का कोई भी तथ्य गलत या झूठा है तो कोई भी जुर्माना जो मरकार थोप सकती है या कोई भी कार्रवाई जो मामले की परिस्थिति को ध्यान में रखते हुए कर सकती है उसके अतिरिक्त प्रस्तुत विए गए कथन के श्राधा 7 पर मुझे / हम प्रदान किया गया कोई भी लाइसेस रद्द किया जा सकता है या अप्रभावी किया जा सकता है ।

9. आयकर सत्यापन प्रमाण-पत्र के लिए निर्धारित पंजीकरण संख्या या उससे छूट की संख्या । श्रायकर सत्यापन पंजीकरण छूट संख्या की प्रमाणित या फोटोस्टेट प्रति भी संलग्न कीजिए (यदि वर्तमान श्रय -कर सत्यापन प्रमाण-पत्र संख्या नहीं है तो पिछली आय -कर सत्यापन प्रमष्ण-पत्र संख्या दी जा सकती है ) ।

11. (क ) निर्यातित उत्पाद और वे उत्लाद-वर्ग जिससे ये संबंधित है के ब्यौरे ।
( ख ) इस आवेदन पत्त्र के अन्तर्गत आने वाले उत्पाद अनुसार निर्यात का जहाज पर निः- शुल्क मूल्य, रुपये ।
( ग) उस अवधि का विशेष रूप से उल्लेख करें जिसके दौरान निर्यात किए गए थे और क्या आवेदन-पत्र तिमाही आधार पर या छमाही आधार पर किया गया है या और किसी आधार पर जो विशेष रूप से सरकार द्वारा तय किया गया है ।
(घ ) इस आवेदन पत्त्र के अन्तर्गत आने वाले निर्यातों पर विदेशी सभरक को अदा की मई या की जाने वाले ( निर्यातक द्वारा बाद की तारीख को ) कमीशन या छूट की धनराशि ।
12. क्या उसी उलाद वर्ग और निर्यात की उसी ग्रत्रप्ति के अन्तर्गत आने वाले निर्यातों के मद्दे किसी किस्म का आवेदन- पत्त्र किया गया है ।
13. ( क ) क्या उन निर्यातों का ( संलग्न निर्यात विवरण के अनुसार ) दावा कर लिया गया है जिन के मद्दे आवेदन किया गया है या सौदे के माध्यम से किसी आयात लाइसेस के लिए या पूजीगत माल के मद्दे प्रेषण के लिए या किसी भी श्रेणी के यन्तर्गत ग्रायास लाइसेंस प्राप्त करने के लिए दावा किया जाना है ।
(४) अग्रिम लाइसेस के प्यारे र्याद कोई इस आवेदन पत्र के अन्तर्गत निर्यातों के मद्दे प्राप्त किया गया है ।
14. क्या निर्यात प्रत्यक्ष बिक्री के श्राधार, परेषण/ अनुमोदन के आधार मुक्त बघलाई के ग्राधार पर किया गया है ?

15. क्या संलग्न विवरण में उल्लिखित सभी निर्यातों उसमें से किसी भी निर्यात के १ मद्दे नकद सहायता प्रदान करने के लिए कोई , आवेदन पत्र दिया गया है ? यदि हां तो उस आवेदन पत्र की संदर्भ संख्या एवं तारीख का संकेत करें ।
16. आवेदक को महानिदेशक तकनीकी विकास/ गज्य उद्योग निदेशक/ किसी भी अय प्रायोजक प्राधिकारी द्वारा निर्धारित की गई पंजी रण संख्या :

17. उस उत्पाद वर्ग के नाम जिसके लिए पात्रता प्रमाण पत्र जारी किया गया है ।

20. आवेदित मदों की सूची ( सूची की पांच प्रतियां भजी जानी है ) ( 1 ) रुपया भुगतान क्षेत्र से आयात की जाने वाली मदों , ( 2 ) प्रज.र तथा जिग्स एवं उपकरणों की मदों, तथा ( 3 ) अन्य मदो की सूची के सैट अलग से भेजे जाने हैं ।

आयात का देश 21. वह आधा बताएं जिस पर आयात की मदों का दावा किया गया है अर्थात् ( क ) वास्तविक उपयोक्तालाइसेंस (वास्तविक उपयोक्ता लाइसेस की मूल अथवा उसको फोटोस्टेट प्रतियों का संलग्न करते हुए उसकी संख्या तथा दिनांक का उल्लेख करें ) , ( ख ) निर्धारित प्रपत्त पर प्रायोजक प्राधिकारी की सिफारिश ( उसी को संलग्न करें ) ( 2 ) रेड बुक ५१० 2 के खंड -2 के कालम 4 के आधार पर ।
22. यदि आवेदन किया गया है तो सरणीबद्ध मदों का लागत-बीमा- भाड़ा मूल्य ।
23. अन्य मदों का लागत बीमा भाड़ा मूल्य यदि उनकी मांग राज्य व्यापार निगम/ खनिज तथा धातु व्यापार निगम सैल अम्तरर्राष्ट्रिीय लि० के भंडार से की गई है ।
24. क्या प्राधिकरण की मांग की गई हैं ? यदि की गई है तो ब्यौरों सहित उस फर्म का नाम जिसके नाम में इसकी मांग की गई है अर्थात् उनके प्रबंधकों, भागीदारों स्वामियों श्राद के नाम ।
25. उस सीमा शुल्क कार्यालय का नाम जहां पर आयात लाइसेंस को यदि प्रदान किया जाएगा तो पंजीकृत कराया जाएगा ।
26. आवेदन पत्र में संलग्न अनुलग्नक के पूरे ब्यौरे ।
वचन- पत्र/ घोषणा-पत्र
मैं हम इसके द्वारा सत्यनिष्ठा से वचन देता हूं / देते है/ घोषणा करता हूं / करते हैं: ( 1 ) कि उपर्युक्त कालम 13 ( क ) में उल्लिखित अग्रिम लाइसेस ( सों ) को छोडकर इस आवेदनपत्त्र के अन्तर्गत आने वाले निर्यातों के मद्दे आयात लाइसेंस के लिए और कोई अन्य आवेदन पत्न नहीं दिया गया है अथवा भविष्य में नही दिया जाएगा ;
( 2 ) प्रेषण ( णों) / पार्सल ( लों) को नहीं लौटाया गया है । र्याद किसी समय प्रेषिती द्वारा निर्यातित माल नहीं लौटाए जाते हैं या विषयाधीन विक्रय लब्धि निर्यात करने की तारीख से छः मास के भीतर या रिजर्व बैंक आफ इंडिया द्वारा यथा स्वीकृत अवधि के भीतर प्राधिकृत माध्यम के THE GAZETTE OF INDIA EXTRAORDINARY [ PART I- SEC . 1 1024
द्वारा बभूल नही की जाती है तो इसके एक माम के भीतर ही आवश्यक सूचना लाइसेंस प्राधिकारी व भेजी जाएगी और इस आवेदन पत्र को दे जारी किए गए आयात लाइसेसों के मूल्य को इस संबंध किसी किस्म की जो कार्रवाई की जाएगी बिना किसी पूर्वाग्रह के मुझे हमे या मेरे / हमारे नामित देय आगामी आयात लाइसेसो के मूल्य में संजित कर लिया जाएगा । इस आवेदन प्ल के अन्तर्गत आने बाले निर्यात के सम्बन्ध में यदि विदेशी क्रेता को जुर्माने का नुकसान के आधार पर किसं किस्म की धनराशि का भुगतान किया जाता है तो इसकी सूचना एक मास के भीतर ही लाइसेंस प्राधिकारी को भेज दी जाएगी ।
( 3 ) लाइमेंम प्राधिकारी द्वारा निरीक्षण करने पर यदि यह पाया जाता है कि इस आवेदन पत् के मद्दे मुझे हमें या मेरे हमारे नामित को अधिक लाइसेस जारी कर दिए गए हैं तो उन्हे इस सम्बन्ध में जो कोई कार्रवाई की जाएगी , बिना किसी पूर्वाग्रह के किसी भी श्रेणी के अन्तर्गत मुझे या मेरे हमार नामित को देय आगामी लाइसेंसों में संमजित कर लिया जाएगा ।
(4) मैं, हम इसके द्वारा घोषणा करता हूं/ करते हैं कि इस आवेदन पत्र में दिए गये व्यौरे और ब्यान मेरी/ हमारी जानकारी में सत्य है और इसमें किसी चीज को छुपाकर अथवा दबा रखा नहीं गया है ।
( 5) मैं हम इसके द्वारा वचन देता हूं, देते हैं कि इस आवेदन पत्र के आधार पर स्वीकृत किए गए लाइसेंसों को यदि यह पाया जाता है कि इस आवेदन पत्त्र में दी गई जानकारी गलत अथवा सही नहीं पथन। अमजनक है तो इस सम्बन्ध में जो कोई कार्रवाही की जाएगी, बिना किसी पूर्वाग्रह के रद्द अथवा अप्रभावी कर दिया जाएगा ।
( 6) मैं/ हम इसके द्वारा घोषणा करता हूं, करते हैं कि निर्यातित पुस्तकों/ पत्रि- काओं/सावधिक पत्नों के लिए ली गई कीमतें 40 प्रतिशत तक कम करने पर भी सूचीबद्ध विदेशी कीमत से कम नहीं थी । ऐसे मामलों में जहा विदेशी कीमत सूचीबद्ध नही थी तो पुस्तकों/पत्ति- काओं सावधिक पत्नों का निर्यात 40 प्रतिशत तक सामान्य व्यापार बट्टे को घटाने पर भी सर- कारी मुद्रा विनिमय दर पर विदेशी मुद्रा में परिर्वाता सूचीबद्ध भारतीय की तों से कम पर नहीं था ।
( 7) मै' हम घोषणा करता हूं , करते हैं कि उन आंकड़ों में, जिनके प्राधार पर प्रतिपूर्ति लाइसेंस के लिए यह नादन पल्न दिया गया है केवल आन्तरिक उपयोग के लिए एवं निर्यात 'किए जाने के लिए प्रतिबन्धित पुस्तकों/ पत्रिकाओं/सावधिक पत्नों के निर्यात को शामिल नहीं किया जाएगा ।
( 8 ) मैं हम घोषणा करता हूं । करते हैं कि निर्यात पंजीकरण प्राधिकारी द्वारा नियत की गई निम्नतम सीमा कीमत से कम पर नहीं किया गया है ।
( 9 ) मेरा हमारा निर्यात बीजक से कम या बीजक से अधिक का नही है ।
