MEMORANDUM REGARDING DELEGATED LEGISLATION

Section 8 of the Act entitles a Member of Parliament to receive such medical facilities for himself and for members of his family and to such housing, telephone and postal facilities as may be provided in the rules made under section 9. Clause 2 of the Bill seeks to amend section 8 with a view to entitling a Member of Parliament also to receive such water, electricity, constituency and secretarial facilities or such amount in cash in lieu of all or any of such facilities as may be provided by rules made under section 9.

Clause 3 of the Bill seeks to substitute clause (f) of sub-section (3) of section 9 with a view to providing that rules may also be made with regard to the matters mentioned in section 8 as proposed to be amended by clause 2 of the Bill.

The matters with regard to which rules may be made are matters of detail which can hardly be provided for in the Bill itself. The delegation of legislative power is, therefore, of a normal character.

Secretary-General.
