GSR . 448 ( E ) . In exercise of the powers conferred by sub - sections (2) and (3 ) of section 33 of the Indian Ports Act , 1908 ( 15 of 1908 ) , the Central Government hereby makes the follow- ing amendments in Part II of the First Schedule to the said Act , with effect from the expiration of sixty days from the date of publication of this order in the Official Gazette, namely :-
(a) Under the heading " Eastern Group " , after the existing entries relating to the District of Tinnevelly , the following entries shall be inserted , namely :-

सा० का ० ति० 448 ( अ) केन्द्रीय सरकार भारतीय पत्तन अधिनियम , 1908 ( 1908 का 15 ) की धारा 33 की उपधारा ( 2 ) और ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त अधिनियम की प्रथम अनुसूची के भाग 2 में , राजपत्र में इस आदेश के प्रकाशन की तारीख से साठ दिन की समाप्ति से, निम्नलिखित संशोधन करती है, अर्थातः-
( क ) ' पूर्वी समूह " शीर्षक के अधीन तिनावली जिले से संबधित विद्यमान प्रविष्टियों के पश्चात् निम्नलिखित प्रविष्टियां अन्तः स्थापित की जाएंगी , अर्थात-

(क) नव तूती कोरिन पत्तन पर आने वाले , जल डमरुमध्म उपनिवेशों या श्रीलंका के साथ व्यवसाय- रत विदेशी पोत या स्टीमर की दशा में अधिक से अधिक एक रुपया पचास पैसे प्रति टन ।

पत्तन में प्रत्येक बार प्रवेश पर शुल्क देय है ।
( ख) नय तूतीकोरिन पत्तन पर आने वाले किसी अन्य विदेशी पोत या स्टीमर की दशा में, अधिक से अधिक एक रुपया पचास पैसे प्रति टन ।

( ग ) नव तूतीकोरिन पत्तन पर आने वाले तटवर्ती पोत या स्टीमर की दशा में अधिक से अधिक एक रुपया पचास पैसे प्रति टन ।
शुल्क 30 दिन में एक बार देय है ।
( घ) नव तूतोकोरिन पत्तन पर आने वाले तटवर्ती स्टीमर की दशा में , अधिक से अधिक एक रुपया 50 पैसे प्रति टन ।
शुल्क साठ दिन में एक बार देय है " ।
( ङ) कर्णनावों ( टग ) लांचों , निरीक्षण- लांचों श्रादि की दशा में , जिन्हें ऊपर सम्मिलित नहीं किया गया है, अधिक से अधिक एक रुपया पचास पैसे प्रति टन ।
(ख ) स्पष्टीकरण में
(ख) " प्रथम अनुसूचो के भाग 2 के स्पष्ट करण " शीर्षक के अन्तर्गत , स्पष्ट करण 1 में , खण्ड ( खख ) में , " मद्रास " शब्द के पश्चात् " नब तूतीकोरिन " शब्द अन्तःस्थापित किए जाएंगे ।

G.S.R. 449 (E) . In exercise of the powers conferred by Sub - section ( 1 ) of Section 33 of the Indian Port Acts , 1908 ( 15 of 1908 ) , the Central Government hereby directs that with effect from the day following the expiration of 60 days from the date of publication of this order in the Official Gazette , port dues shall be levied , on vessels entering the Port of New Tuticorin and described in the first column of the Schedule below , at the rates specified in the second column thereof and at the times fixed in the third column of the said Schedule .

The due is payable once in sixty days, provided that the payment of the due once made shall be valid only for three entries into the port ( including the entry on which the payment was made) during the said period of sixty days .
Exceptions:-
(a) Vessel entering the Port of New Tuticorin in ballast and not carrying passengers shall be charged with the port dues at three- fourth of the port dues .
(b) Vessels entering the Port of New Tuticorin but not discharging or taking in any cargo or passenger (for purpose of repair ) shall be charged with half of the port dues .

सा० का ० ति ० 449 ( श्र ) . केन्द्रीय सरकार , भारतीय पत्तन अधिनियम, 1908 ( 1908 का 15 ) की धारा 33 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निवेश देती है कि इस आदेश के राजपत्त्र में प्रकाशन की तारीख से साठ दिन की समाप्ति के ठीक अगले दिन से नव तूतीकोरिन पत्तन में प्रविष्ट होने वाले तथा इससे उप।बद्ध अनुसूची के स्तम्भ ( 1 ) में वर्णित जलयानों पर, उसके स्तम्भ ( 2 ) में विनिर्दिष्ट दरों पर तथा उक्त अनुसूची के स्तम्भ 3 में नियत समयों पर , पत्तन शुल्क उद्गृहीत होगा , अर्थात्:--

पत्तन पर शुल्क का संदाय करने पर पोत से साठ दिन तक पुनः शुल्क नहीं लिया जाएगा ।
शुल्क साठ दिन में एक बार देय है परन्तु शुल्क का एक बार किया गया संदाय साठ दिन की उक्त अवधि के दौरान, पत्तन में केवल तीन बार प्रवेश के लिये ( जिसमें वह प्रवेश भी सम्मिलित है , जिस पर संदाय किया गया था ) विधि मान्य है ।
अपवाव
( क) नव तूतीकोरिन पत्तन पर बेलास्ट सहित प्रवेश करने वाला और यात्री न ले जाने वाले जलयान पर उस दर के जो उस पर अन्यथा प्रभार्य होती , तीन चौथाई पत्तन शुल्क से प्रभारित किया जाएगा, और
( ख ) जब कोई जलयान नव तूतीकोरिन पत्तन में ( सिर्फ मरम्मत के लिए ) प्रवेश करता है , किन्तु वहां न कोई स्थोरा या यात्री उतारता या लादता है तो उस पर शुल्क का आधा प्रभार्य होगा ।

In exercise of the powers conferred by sub - sections ( 2) and ( 3 ) of section 33 of the Indian Ports Act , 1908 ( 15 of 1908 ) , the Central Government hereby makes the following amendments in Part II of the First Schedule to the said Act , with effect from the expiration of sixty days from the date of publication of this Order in the Official Gazette , namely :
(a) under the heading " Western Group" , after the existing entries relating to the District of South Canara , the following entries shall be inserted, namely :-

सा ० का ० मि० 450 ( प्र) -केन्द्रीय सरकार भारतीय पत्तन अधिनियम , 1908 ( 1908 का 15 ) की धारा 33 की उपधारा ( 2 ) और ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त अधिनियम की प्रथम अनुसूची के भाग 2 में , राजपत्न में इस आदेश के प्रकाशन की तारीख से साठ दिन की समाप्ति से निम्नलिखित संशोधन करती है , अर्थात्ः-

(ख ) स्पष्टीकरण में
( ख) "प्रथम अनुसूची के भाग 2 के स्वष्टीकरण " शीर्षक के अ तर्गत , स्पष्टीकरण 1 में , खंड ( ख ) में, " विशाखापत्तनम " शब्द के पश्चात्, " नव मंगलौर " शब्द अतःस्थापित किए जाएंगे ।
