G.S.R. 453 (E) .-In exercise of the powers conferred by sub- section (2) of section 79 of the Customs Act , 1962 ( 52 of 1962 ) and in supersession of the Baggage ( Conditions of Exemption ) Rules , 1963 [ Notification of the Government of India , in the Ministry of Finance (Department of Revenue and Insurance ) , No. 19 , dated the 23rd January , 1963 ] , the Central Government hereby makes the following rules , namely :---
1. These rules may be called the Baggage ( Conditions of Exemption) Rules , 1975 .
2. Where any goods in the baggage of a passenger or a member of the crew are exempted under section 79 of the Customs Act , 1962 ( 52 of 1962) from payment of import duty leviable thereon , the exemption shall be subject to the condition that such goods shall not be sold , displayed , advertised or offered for sale or displayed in a shop-
(a) and, in the case of fire - arm also that such firc - arm shall not be gifted , or given to a retainer or otherwise parted with , until such fire - arm has been used for a period not less than ten years from the date of clearance by such person or passenger or member of the crew , or
(b) and, in the case of a T. V, set , also that such a T. V. sct shall not be gifted or otherwise parted with , until such T. V. set has been used for a poriod not less than five years from the date of clearance by such person or passenger or member of the crew , or

(c) and, in the case of any other goods , until the market price of such goods has depreciated to less than fifty per cent of their market price when now .

सा ० फा ० ति० 453 ( अ) . केन्द्रीय सरकार , सीमा - शुल्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 79 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सामान (छूट की शर्तें ) नियम , 1963 [ भारत सरकार के वित्त मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना सं ० 19 , तारीख 23 जनवरी , 1963 ] को अधिक्रान्त करते हुए , निम्नलिखित नियम बनाती है , भर्थात:--
1. इन नियमों का नाम सामान ( छूट की शर्तें) नियम 1975 है ।
2. जहां किसी यात्री या कर्मी- दल के किसी सदस्य के सामान में का कोई माल, उस पर उपग्रहणीय आयात शुल्क के संदाय से, सीमा - शुष्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 79 के अधीन छूट-प्राप्त है, वहां छूट इस शर्त पर होगी कि ऐसे माल को विक्रय नहीं किया जाएगा या विक्रय के लिए प्रदर्शित . विज्ञापित , या प्रस्तुत नहीं किया जाएगा या किसी दुकान में प्रदर्शित नहीं किया जाएगा :--
( क) और, अग्न्यायुद्ध की दशा में यह शर्त भी कि ऐसा अग्न्यायुद्ध तब तक दाम नहीं किया जाएगा या किसी प्रतिघातक को नहीं दिया जाएगा या अन्यथा उसे अपने से अलग नहीं किया जाएगा जब तक कि ऐसा अग्न्यायुद्ध ऐसे व्यक्ति या यात्री कर्मीदल के सदस्य द्वारा उसकी निकासी की तारीख से कम से कम दस वर्ष तक उपयोग में न लाया जा चुका हो, या
(ख) और , दूरदर्शन सेट की दशा में , यह शर्त भी कि ऐसा दूरदर्शन सेट तथ तक दान नहीं किया जाएगा या प्रन्यथा उसे अपने से अलग नहीं किया जाएगा , जब तक ऐसा दूरदर्शन सेट ऐसे व्यक्ति या यात्त्री या कर्मीदल के सदस्य द्वारा निकासी की तारीख से कम से कम पांच वर्ष तक उपयोग में न लाया जा चुका हो, या
( ग ) और , किसी अन्य माल की दशा में , यह शर्त भी कि अब तक ऐसे माल की बाजार- क. मत में उसकी उस बाजार कीमत के , जब वह माल नया था , पचास प्रतिशत से कम गिरःवट न श्रा गई हो ।

G.S.R. 454 (E ) . In exercise of the powers conferred by sub- section (2) of Section 79 of the Customs Act , 1962 (52 of 1962) the Central Government hereby makes the following rules further to amend the Transfer of Residence Rules , 1969 , namely:-
1. (1) These rules may be called the Transfer of Residence (Amendment) Rules , 1975 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Transfer of Residence Rules , 1969 in rule (2 ) , for the words , brackets and figures "Baggage (Conditions of Exemption ) Rules 1963 " the words , brackets and figures "Baggage (Conditions of Exemption ) Rules , 1975" shall be substituted.

सा ० का० ति० 454 ( प्र) केन्द्र. य सरकार , सीमा- शुल्क अधिनियम, 1962 (1962 का 52 ) की धारा 79 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए . निवास-स्थानान्तरण नियम , 1969 में और सशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात :-
1. ( 1 ) इन नियमों का नाम निवास -स्थानान्तरण ( संशोधन ) नियम, 1975 है ।
( 2) ये राजपत्र में प्रकाशन का तारीख से प्रवृत्त होंगे ।
2. निवास -स्थानान्तरण नियम , 1969 में, नियम ( 2) में, " सामान (छूट की शर्तें) नियम , 1963 " शब्दों , कोष्ठकों और अंकों के स्थान पर " सामान (छूट की शर्तें) नियम , 1975" शब्द, कोष्ठक और अंक रखे जायेंगे ।
