NOTIFICATION
New Delhi , the 22nd August 1975
S.O. 442 (E ) . In pursuance of clause 4 of the Colliery Control Order , 1945 , as continued in force by section 16 of the Essential Commodities Act , 1955 ( 10 of 1955 ) , the Central Government hereby makes the following amendments in the notification of the Government of India in the Ministry of Energy (Department of Coal ) No. S.O. 408 (E) dated the 1st August , 1975 , namely:-
In the said notification , in the notes occurring after Table IV-
(a) for paragraph 1 the following paragraph shallbe substituted , namely :-
"The Useful Heat Value shall be calculated as follows:-
Firstly, the gross calorific value is determined in accordance with the undermen- tioned formulae , namely :-
(i) in the case of Low Moisture coals
1.8Q 165 F136 (V- 0.1A) -108M ; and
(ii) in the case of High Moisture coals 1.8Q 154 [ 100-( 1.1A + M ) ] -108 M

A Ash percentage
M Moisture percentage
F, V, A, and M above shall be determined in accordance with the relevant clauses of Indian Standards Specification No. I-S : 1350-1959 and be calculated after equilibrating at 60 % relativeive humidity and 40 ° C temperature vide clause 11.3 of the same Indian Standards Specification .
The gross calorific value determined in terms of ( i) or ( ii) above shall then be reduced as indicated in the Table below for different percentages of ash , to arrive at the Useful Heat Value .

(b) in paragraph 2 , -
(i) for the expression "F.O.R. prices " the expression "F.O.R. Colliery Siding
prices" shall be substituted;
( ii) for the word "exist " , the words " exist or are entered into " shall be substituted;
(c) in paragraph 3 for the words " exciso duty " , the words "duties of excise" shall bo
substituted;
(d) in paragraph 4 ,-
(i) for the words " excise duty " , in both the places where they occur, the words
"duties of excise " shall be substituted;
( li) for the words and figures " after the first August , 1975 " the words and figures
"on or from the first August , 1975 " shallbe substituted;
(e) after paragraph 4 the following paragraphs shall be inserted , namely:
"5. For the removal of doubts it is hereby declared that for the purpose of the
fixation of prices of various grades of coal referred to in this notification ,
the grades into which the coals are categorised in this notification alone
shall be taken into account .

6. The prices as notified by ťnis notification shall not apply to coal and coke sold for export .
7. The prices of coal as notified by this notification shall be applicable to bitumi- nous coals and sub - bituminous coals as defined in Indian Standards Specifi- cation No. IS : 770-1964 , but not to anthracitic and lignitic coals .
8. For undertaking special sizing or beneficiation of coal , additional charges as may be negotiated between the purchaser and the producer may be realised over and above the notified prices .
9. "High Moisture Coals " are coals whose moisture content determined under Clause 6.7 of Indian Standards Specification No. IS : 1350-1959 , exceeds, 2 per cent . All other coals are " Low Moisture Coals " .
10. The prices notified in Table III for Hard Coke shall not apply to small sized coke or coke brecze below 12 millimetre size" .

का० आ० 442 ( प्र) -श्रावश्यक वस्तु अधिनियम , 1955 ( 1955 का 10 ) की धारा 16 द्वारा प्रचलन में आए कोयला खान नियंत्रण आदेश , 1945 की धारा 4 के अनुसरण में , केन्द्रीय सरकार द्वारा भारत सरकार , ऊर्जा मंत्रालय ( कोयला विभाग ) की 1 अगस्त, 1975 की अधिसूचना संख्या का ० आ ० 408 (श्र ) में एतद्वारा निम्नलिखित संशोधन किया जाता है, अर्थातः--
उक्त अधिसूचना में सारणी -4 के बाद की टिप्पणियों में--
(क ) पैरे 1 के लिए निम्नलिखित परा रखा जायगा, अर्थात् :--
"उपयोगी ऊष्मामान का इस प्रकार आकलन किया जाएगा :-
प्रथम, निम्नलिखित सूत्र के अनुसार सकल कैलोरीमान निश्चित किया जाप्ता है, अर्थात्:-
( i ) कम गोले कोयले के मामले में
1.8 क्यू-165 एफ +136 ( बी-- 0.1 ए ) -108 एम तथा
( ii ) अधिक गोले कोयले के मामले में 1.8 क्यू-154 ( 100- ( 1.1 एएम ) ) -108 एम
जहां क्यू-सकल ऊष्मामान किलोकैलोरीज में प्रति किलोग्राम
एफ-नियत कार्बन प्रतिशतता
बी-वाष्पशील तत्वों की प्रशिशतता
ए-राख प्रतिशतता

उपर्युक्त एफ , वी, ए तथा एम का निर्धारण भारतीय मानक विशिष्टि संख्या भा ० या ० 1350-1959 की सम्बन्धित धाराओं के अनुसार किया जाएगा तथा इसे ० 60 % सम्बन्धित आर्द्रता पर और भारतीय मानक की उसी विशिष्ट की धारा 11.3 के द्वारा 40° सेन्टीग्रेड तापमान पर सन्तुलित कर के निकाला जाएगा ।
इसके बाद , उपर्युक्त ( i) या ( ii) के अनुसार निर्धारित सकल कैलोरी मान को निम्नलिखित सारणी में दशित राख के विभिन्न प्रतिशत के लिए कम कर दिया जाएगा ताकि उपयोगी ऊष्मा मान ज्ञात किया जा सके ।

( i ) शब्द "रेल पर्यन्त निशुल्क मूल्यों " के स्थान पर " रेल पर्यन्त निशुल्क खान मुहाना साइडिंग मूल्य" शब्द रखे जायेंगे ।
( ii) शब्द " किए गए हैं " के स्थान पर " किए गए हैं अथवा किए जाते हैं" शब्द रखे जायेंगे ।

(ग) पैरा 3 में शब्द " उत्पादन शुल्क" के स्थान पर " उत्पादन सम्बन्धी शुल्क" शब्द रखे जायेंगे ;
( घ) पैग 4 में --
(:) शब्द " उत्पादन शुल्क" के बदले , दोनों ही स्थानों में जहां ने आते हैं, " उत्पादन सम्बन्धी शल्क" शब्द ग्खे जायेंगे ।
( ii) " पहली अगस्त, 1975 के बाद " शब्द और अकों के स्थान पर " पहली अगस्त , 1975 को या से" शब्द और अंक रखे जायेंगे
( ङ ) पैरा 4 के बाद निम्नलिखित पैरा जोड़े जायेंगे , अर्थात्: ---
" 5. सन्देहों को दूर करने के लिए एतद्वारा यह घोषित किया जाता है कि इस अधिसूचना में उल्लिखित विभिन्न कोयला ग्रेडों के मूल्य निर्धारण हेतु केवल उन्हीं ग्रेडों का शामिल किया जाएगा जिनका इस अधिसूचना में वर्गीकरण किया गया है ।
6. इस अधिसूचना में प्रकाशित कोयला मूल्य निर्यात के लिए बेचे गए कोयले और कोक पर लागू नहीं होंगे ।
7. इस अधिसूचना में प्रकाशित कोयला मूल्य भारतीय मानक विशिष्टि संख्या भा ० मा ० 770-1964 में निर्दिष्ट बिटूमनी कोयला तथा उप - बिटूमनी कोयला पर लागू होगा किन्तु ऐंध्र साइटिक और लिगना- इटिक कोयले पर लागू नहीं होगा ।
8. विशिष्ट श्राकार वाले या परिष्कृत कोयले पर, अधिसूवित मूल्य के अलावा, यह प्रभार भी लिया जाएगा जो खरीदार और उत्पादक के बीच तय हो ।
9. " अधिक गीला कोयला " वह कोयला है जिनमें भारत य मानक विशिष्टि संख्या भा ० मा ० 1350-1959 की धारा 6.7 के अनुसार नियत नमा तत्व 2 प्रतिशत से अधिक होता है । अन्य सभी प्रकार का कोथला कम " गःला कोयला " होता है ।
10 . सारणी 3 में हार्ड कोक के लिए अधिसूचित मूल्य छोटे आकार के कोक या 12 मिली मीटर से कम आकार के कोक- चूरे पर लागू नहीं होंगे ।
