ORDER
New Delhi , the 12th September 1975
G.S.R. 492 (E ) /Ess . Com/Sugarcane . In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955 ) , the Central Government hereby makes the following Order further to amend the Sugarcane ( Control ) Order , 1966 , namely:-
1. (1 ) This Order may be called the Sugarcane ( Control) Amendment Order , 1975 .
(2) It shall come into force at once .
2. In the Sugarcane ( Control ) Order , 1966 ,-
(i ) to sub- clause (7) of clause 5A , the following proviso shall be added , namely:-
"Provided that the additional price shall become payable to a sugarcane grower , even when he supplies less than 85 per cent of the sugarcane so agreed , if for the same supply 'he has not been subjected to any penalty by or under any Central or State Act or any rules or orders made thereunder for his failure to supply 85 per cent of sugarcane so agreed . " ;
(ii) in the Second Schedule ,
(a) for Explanations 2 and 3 , the following explanations shall be substituted , namely:-
"2. 'R' is the amount in rupees of sugar produced during the sugar year ex- cluding the excise duty paid or payable to the factory by the purchaser.

3. 'L' is the value in rupees of sugar produced during the sugar year, as cal- culated on the basis of the unit cost per quintal ex - factory, exclusive of excise duty , determined with reference to the minimum sugarcane price fixed under clause 3 , the final working results of the year and the Cost Schedule and return recommended by the Tariff Commission from time to time . "
(b) for Explanation 7 , the following explanation shall be substituted , namely:-
"7. The amount ' R' referred to in Explanation 2 shall be computed as under , namely:-
(i) the actual amount realised during the sugar year ; and
(ii ) the estimated value of the unsold stocks of sugar held at the end of 30th September , calculated in regard to free sugar stocks at the average rate of sales name during the fortnight 16th to 30th September and in regard to levy sugar stocks at the notified levy prices as on the 30th September .' .

सा० फा० मि० 492 ( प्र) प्रा० ति०/ ईल. केन्द्रीय सरकार , आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , ईख (नियंत्रण) आदेश , 1966 में और संशोधन करने के लिए निम्नलिखित आदेश करती है , अर्थातः
1. ( i ) इस आदेश का नाम ईख ( नियंत्रण ) संशोधन आदेश , 1975 है ।
( 2 ) यह तुरन्त प्रवत्त होगा ।
2. ईख ( नियंत्रण ) आदेश , 1966 में ,
( i ) खण्ड 5 क के उपखण्ड ( 7 ) में निम्नलिखित परन्तुक जोड़ा जाएगा , अर्थातः--
" परन्तु ईख उत्पादक को तब भी, जब वह इस प्रकार करार पाई गई ईख के 85 प्रतिशत से कम प्रदाय करता है, अतिरिक्त कीमत संदेय हो जाएगी , यदि उसी, प्रदाय के लिए उस पर , इस प्रकार करार पाई गई ईख के 85 प्रतिशत का प्रदाय न करने के कारण किसी केन्द्रीय या राज्य अधिनियम का तदधीन बनाए गए किन्हीं नियमों या आदेशों के द्वारा या अधीन कोई शास्ति नहीं लगाई गई है " ;
( ii) द्वितीय अनुसूची में ,
( क) स्पस्टीकरण 2 और 3 के स्थान पर निम्नलिखित स्पष्टीकरण रखे जाएंगे , अर्थातः--
" 2 ' आर ' चोनी वर्ष के दौरान उत्पादित चीनी की रुपयों में ऐसी रकम है जिसमें से विक्रेता द्वारा कारखाने की संदत्त या संवेय उत्पाद शुल्क श्रपजित कर दिया गया है ।

3. ' एल' चीनी वर्ष के दौरान उत्पादित चीनी का कारखानों द्वारा पर यूनिट लागत प्रति क्विंटल के आधार पर यथा संगणित रुपयों में ऐसा मूल्य , जिसमें से कि खण्ड 3 के अधीन नियत न्यूनतम ईख कीमत के प्रतिनिर्देश से अवधारित उत्पाद शुल्क अपर्जित कर दिया गया है , वर्ष के अन्तिम कार्यकरण परिनाम और टेरिफ आयोग द्वारा समय समय पर सिफारिश की गई लागत अनुसूची और विवरणी हैं । " ;
( ख ) स्पष्टीकरण 7 के स्थान पर , निम्नलिखित स्पष्टीकरण रखा जाएगा , अर्थातः--
" 7 स्पष्टीकरण 2 में निर्दिष्ट ' आर ' रकम की संगणना निम्नलिखित रुप में की जाएगी, अर्थात--
( i) चीनी वर्ष के दौरान वसूल की गई वास्तविक रकम,; प्रौर
( ii) 30 सितम्बर , के अंत में वारित , न बेचे गए चीनी के स्टाकों का प्राक्कलित मूल्य जो 16 से 30 सितम्बर , तक के पखवाड़े के दौरान किए गए विक्रयों की ौसन दर पर मुक्त चीनी स्टाकों के बारे में तथा 30 सितम्बर , को विद्यमान , अधिसूचित लेबी कीमतों पर लेबी चीनी स्टाकों के बारे में संगणित किया गया है । "
