NOTIFICATION
New Delhi, the 23rd September 1975
G.S.K. 500 (E ) . In exercise of the powers conferred by section 87 of the Punjab Re- organisation Act , 1966 ( 31 of 1966) , the Central Government hereby extends to the Union territory of Chandigarh , the Haryana Relief of Agricultural Indebtedness Act , 1975 (Haryana Act No. 22 of 1975 ) as in force in the State of Haryana at the date of this notification , subject to the following modifications , namely :
Modifications
1. In section 1 ,-
(a) in sub - section (2 ) , for the words " State of Haryana " , the words " Union terri- tory of Chandigarh " shall be substituted;
(b) after sub- section (2 ) , the following sub- section shall be inserted , namely :-
"(3) It shall come into force on such date as the Administrator may, by noti- fication in the Chandigarh Gazette , appoint . " .
2. In section 2, clause (a) shall be relettered as clause (aa) thereof , and before the clause as so relettered the following clause shall be inserted , namely:-
"( a) "Administrator " means the Administrator of the Union territory of Chandi- garh appointed by the President under article 239 of the Constitution; " .

3. In section 3 , for the words " may , by notification by the State Government , be the extended from time to time for a period not exceeding two yearsears in the aggregate " , words " may be extended , from time to time for a period not exceeding two yearyears in the aggregate by the Administrator , by notification in the Chandigarh Gazette , " shall be substituted .
ANNEXURE
The Haryana Relief of Agricultural Indebtedness Act, 1975 ( Haryana Act 22 of 1975 ) as extended to the Union Territory of Chandigarh
An Act to provide relief from indebtedness to landless labourers , rural artisans , mar- ginal farmers and small farmers .
Be it enacted by the Legislature of the State of Haryana in the Twenty - sixth Year of the Republic of India as follows :-
1. Short title and extent . ( 1 ) This Act may be called the Haryana Relief of Agricultural Indebtedness Act, 1975 .
(2) It extends to the whole of the Union territory of Chandigarh .
(3) It shall come into force on such date as the Administrator may, by notification in the Chandigarh Gazette , appoint .
2. Definitions .--- In this Act , unless the context otherwise requires,
( a) " Administrator " means the Administrator of the Union territory of Chandigarh appointed by the President under article 239 of the Constitution;
(aa) "bank" means a banking company as defined in section 5 of the Banking Regulation , Act , 1949 ( Central Act 10 of 1949 ) , and includes the State Bank of India constituted under the State Bank of India Act , 1955 ( Parliament Act 23 of 1955), a subsidiary bank as defined in the State Bank of India (Subsidiary Banks) Act , 1959 ( Parliament Act 38 of 1959 ) , a corresponding new bank as defined in the Banking Companies (Acquisition and Transfer of Undertakings ) Act , 1970 (Parliament Act 5 of 1970 ) , and the Agricultural Refinance Corporation constituted under the Agricultural Refinance Cor- poration Act , 1963 ( Parliament Act 10 of 1963 ) ;
(b) " civil court " includes-
(i) any court exercising jurisdiction under the Provincial Insolvency Act , 1920 (Central Act 5 of 1920) ;
(ii ) a Panchayat established under the Punjab Gram Panchayat Act , 1952 ( Pun- jab Act 4 of 1953 ) , while exercising functions of a civil court ;
(iii ) a court exercising powers under the Provincial Small Cause Courts Act, 1887 (Central Act 9 of 1887) ;
(c) " co - operative society " means .. a society registered or deemed to be registered under the Punjab Co-operative Societies Act , 1961 ( Punjab Act 25 of 1961 ) ;
(d) " debt " includes all liabilities owing to a creditor in cash or kind , secured or unsecured , payable under a decrce or order of a civil court or otherwise and subsisting on the date of commencement of this Act whether due or not due but it does not include-
(i ) a debt due to the Central Government , any state Government , a local autho rity , a co - operative society or a bank;
(ii ) a debt due to any Government company within the meaning of the Companies Act , 1956 ( Parliament Act 1 of 1956) ;
(iii) a debt due to the Life Insurance Corporation of India established under the Life Insurance Corporation Act , 1956 (Parliament Act 3 of 1956) , or other corporations established under any law for the time being in force;
(iv) any rent due in respect of any property let out to a debtor ;
(v) any liability arising out of breach of trust of any tortious liability ;

(vi) any liability in respect of wages or remuneration due as salary or otherwise for services rendered ;
(vii) any liability in respect of maintenance whether under a decree of civil court or otherwise;
(viii) any debt which represents the price of any goods or property purchased by a debtor;
(ix) any advance of money given to the debtor by a person as the price of goods or property to be sold later on ;
(x) any sum recoverable as arrears of land revenue ;
(e) " debtor " means a Jandless labourer , a marginal farmer , a small farmer or a rural artisan , who owes a debt ;
(f) "landless labourer " means a person who does not own any agricultural land and whose principal means of livelihood is manual labour on agricultural land;
(g) " marginal farmer " means a person who owns agricultural land not exceeding one hectare and whose principal means of livelihood is income from agricultural land or by manual labour on agricultural land or from production or repair or traditional tools , implements and other articles or things used for agricul- ture or purposes ancillary thereto or by practising craft by his own labour or by the labour of the members of his family in a rural area ;
(n) "rural artisan " means a person who does not own any agricultural land and whose principal means of livelihood is production or repair of traditional tools , implements and other articles or things used for agriculture or purposes ancillary thereto and also a person who normally earns his livelihood by practising a craft either by his own labour or by the labour of the members of his family in a rural area :
or ( i ) " small farmer " means a person who owns agricultural land exceeding one hectare but not exceeding two hectares and whose principal means of livelihood is income from agricultural land or by manual labour on agricultural land from production or repair of traditional tools , implements and other articles or things used for agriculture or purposes ancillary thereto or by practising craft by his own labour or by the labour of the members of his family in a rural area .
3. Moratorlum of certain debts . Notwithstanding anything contained in any enactment for the time being in force or in any contract or other instruments having the force of law and save as otherwise provided in this Act every debt advanced before the commencement of this Act to a debtor shall stand suspended for a period of one year from the date of the commencement of this Act which period may be extended , from time to time , for a period not exceeding two years in the aggregate , by the Administrator , by notification in the Chandigarh Gazette , and-
(i ) any proceeding pending in any civil court for the recovery thereof shall stand postponed till the expiry of the aforesaid period ,
( ii ) no civil court having jurisdiction shall entertain any suit or proceeding for the recovery of the debt suspended during the aforesaid period.

को हरियाणा राज्य में यथा प्रवृत्त , हरियाणा कृषि ऋणिता राहत अधिनियम , 1975 ( 1975 का हरियाणा अधिनियम सं ० ) को, निम्नलिखित उपान्तरणों के अधीन रहते हुए , चण्डीगढ़ संघ राज्यक्षेत्तत्र को विस्तारित करती है , अर्थात्: --
उपान्तरण
1. धारा 1 में, -
(
क) उपधारा ( 2 ) में, " हरियाणा राज्य " शब्दों के स्थान पर , " चण्डीगढ संघ राज्य- क्षेत्र " शब्द रखे जाएंगे ;
( ख) उपधारा ( 2 ) के पश्चात्, निम्नलिखित उपधारा अन्तः स्थापित की जाएगी, अर्थात्:--
" ( 3 ) यह उस तारीख को प्रवृत्त होगा , जो प्रशासक , चण्डीगढ़ राजपत्र में अधि- सुचना द्वारा नियत करे । "
2. धारा 2 में , खण्ड ( क ) को उसके खण्ड ( कक ) के रूप में पुर्नाक्षरित किया जाएगा और इस प्रकार पुर्नाक्षरित खण्ड के पूर्व निम्नलिखित खण्ड अन्तःस्थापित किया जाएगा, अर्थात्ः--
( क ) "प्रशासक " से संविधान के अनुच्छेद 239 के अधीन राष्ट्रपति द्वारा नियुवत खण्डी- गढ़ संघ राज्यक्षेत्र का प्रशासक अभिप्रेत है ;
3. धारा 3 में , "कुल मिलाकर दो वर्ष से अनधिक की अवधि के लिए, राज्य सरकार द्वारा, अधिसूचना द्वारा समय समय पर बढ़ाई जा सकेगी " शब्दों के स्थान पर "कुल मिलाकर दो वर्ष से अनधिक की अवधि के लिए प्रशासक द्वारा , चण्डीगढ़ राजयत्न में अधिसूचना द्वारा समय -समय पर बढ़ाई जा सकेगी" शब्द रखे जाएंगे ।
चण्डीगढ़ संघ राज्य क्षेत्र को यथा विस्तारित हरियाना कृषि ऋणिता राहत प्रधिनियम , 1975 ( 1975 का हरियाना अधिनियम 22 )
भूमिहीन श्रमिकों , ग्राम्य कारीगरों , सीमांत कृषकों और छोटे कृषकों को ऋणिता से राहत देने के लिए अधिनियम ।
भारतीय गणराज्य के छब्बीसवें वर्ष में हरियाणा राज्य विधान-मंडल द्वारा निम्नलिखित रूप में अधिनियमित हो :-
1. संक्षिप्त नाम और विस्तार ( 1 ) इस अधिनियम का नाम हरियाणा कृषि ऋणिता राहत श्रधिनियम , 1975 है ।
( 2 ) यह सम्पूर्ण चण्डीगढ़ संघ राज्यक्षेत्र पर विस्तारित है ।
( 3 ) यह ऐसी तारीख को प्रवृत्त होगा जिसे प्रशासक , चण्डीगढ़ राजपत्तत्र में , श्रधिसूचना द्वारा नियत करे ।

2. परिभाषाएं. इस अधिनियम में, जब तक संदर्भ से अन्यथा अपेक्षित न हो
(क) "प्रशासक" से संविधान के अनुच्छेद 239 के अधीन राष्ट्रपति द्वारा नियुक्त चण्डी- गढ़ संघ राज्यक्षेत्र का प्रशासक अभिप्रेत है ;
(कफ) "बैंक" से बैंककारी विनियम अधिनियम , 1949 ( 1949 का केन्द्रीय अधिनियम 10 ) की धारा 5 में यथा परिभाषित बैंककारी कम्पनी अभिप्रेत है , और इसमें भारतीय स्टेट बैंक अधिनियम , 1955 ( 1955 का संसद् अधिनियम 23 ) के अधीन गठित भारतीय स्टेट बैंक, भारतीय स्टेट बैंक ( समनुषंगी बैंक ) अधिनियम 1959 ( 1959 का संसद अधिनियम 38 ) में यथा परिभाषित समनुषंगी बैंक , बैंककारी कम्पनी ( उपक्रमों का अर्जन और अन्तरण ) अधिनियम , 1970 ( 1970 का संसद अधिनियम 5 ) में यथा परिभाषित तत्समान नया बैंक और कृषिक पुर्नावत निगम अधिनियम, 1963 ( 1963 का संसद अधिनियम 10 ) के अधीन गठित कृषिक पुषित निगम सम्मिलित हैं ;
(ख ) " सिथिल न्यायालय" में--
( i ) प्रान्तीय दिवाला अधिनियम , 1920 ( 1920 का केन्द्रीय अधिनियम 5 ) के अधीन अधिकारिता का प्रयोग करने वाला कोई न्यायालय :
( ii ) पंजाब ग्राम पंचायत अधिनियम , 1952 ( 1953 का पंजाब अधिनियम 4 ) के अधीन स्थापित पंचायत , जब वह सिविल न्यायालय के कृत्यों का प्रयोग कर रही हो ;
( iii) प्रान्तीय लघुवाद न्यायालय अधिनियम, 1887 ( 1887 का केन्द्रीय अधि- नियम 9 ) के अधीन शक्तियों का प्रयोग करने वाला न्यायालय , सम्मिलित हैं ;
( ग ) "सहकारी सोसाइटी " से पंजाब सहकारी सोसाइटी अधिनियम , 1961 ( 1961 का पंजाब अधिनियम 25) के अधीन रजिस्ट्रीकृत या रजिस्ट्रीकृत समझी गई सोसाइटी अभिप्रेत है ;
( घ) "ऋण" में सिविल न्यायालय की डिक्री या आदेश के अधीन या अन्यथा देय और इस अधिनियम के प्रारम्भ की तारीख को अस्तित्वयुक्त, लेनदार को, नकद या वस्तु के रूप में , प्रतिभूत या अप्रतिभूत , देय सभी दायित्व , चाहे शोध्य हों या शोध्य न हों, सम्मिलित हैं , किन्तु इसमें निम्नलिखित सम्मिलित नहीं है-
( i) केन्द्रीय सरकार , किसी राज्य सरकार , स्थानीय प्राधिकारी, सहकारी समिति या किसी बैंक को शोध्य ऋण ;
( ii ) कम्पनी अधिनियम , 1956 ( 1956 का संसद अधिनियम 1 ) के अर्थ के अर्न्तगत किसी सरकारी कम्पनी को शोध्य ऋण ;
( iii ) जीवन बीमा निगम अधिनियम , 1956 ( 1956 का संसद अधिनियम 3 ) के अधीन स्थापित भारतीय जीवन बीमा निगम की या तत्समय प्रवृत्त किसी विधि के अधीन स्थापित अन्य निगमों को शोध्य ऋण ;

( iv ) ऋणी को किराए पर दी गई किसी सम्पत्ति की बाबत शोध्य कोई किराया ;
(V) किसी अपकृत्य- दायित्व के न्यास - भंग से उद्भूत होने वाला कोई दायित्व ;
(vi ) की गई सेवाओं के लिए वेतन के रुप में या अन्यथा , शोध्य मजदूरियों या पारि- श्रमिक की बाबत कोई दायित्व ;
( vii ) भरणपोषण की बावत कोई दायित्व , चाहे वह सिविल न्यायालय की डिक्री के अधीन या अन्यथा हो ;
(viii ) कोई ऐसा ऋण, जो किसी ऋणी द्वारा क्रया किए गए किसी माल या संपत्ति की कीमत व्यपदिष्ट करता हो ;
(ix) तत्पश्चात् विक्रीत किए जाने के लिए माल या संपत्ति की कीमत के रुप में किसी व्यक्तिद्वारा ऋणी को दिया गया कोई अग्रिम धन ;
(x) भूमि राजस्व के बकाया के रूप में वसूल करने योग्य कोई रकम ;
(ङ) "ऋणी" से ऐसा भूमिहीन श्रमिक, सीमांत कृषक, छोटा कृषक या ग्राम्य कारीगर अभिप्रेत है , जिसने ऋण चुकाना है ;
( च) " भूमिहीन श्रमिक" से ऐसा व्यक्ति श्रभिप्रेत है जिसकी अपनी कोई कृषि -भूमि नहीं है और जिसकी जीविका का मुख्य साधन कृषि -भूमि पर शारीरिक श्रम है ;
( छ) ' सीमांत कृषक" से ऐसा व्यक्ति श्रभिप्रेत है , जिसके पास अपनी एक हेक्टयर से अनधिक कृषि भूमि है और जिसकी जीविका का मुख्य साधन , कृषि - भूमि से या कृषि भूमि पर शारीरिक श्रम द्वारा या कृषि या उसके अनुषंगी प्रयोजनों के लिए प्रयुक्त होने वाले परम्परागत औजारों , उपकरणों और अन्य वस्तुओं या चीजों के उत्पादन या मरम्मत से या किसी ग्राम्य क्षेत्र में अपने श्रम द्वारा या श्रपने कुटुम्ब के सदस्यों के श्रम द्वारा शिल्प-कर्म द्वारा श्राय , है ;
(ज ) ' ग्राम्य कारीगर " से ऐसा व्यक्ति अभिप्रेत है , जिसके पास अपनी कोई कृषि- भूमि नहीं है और जिसकी जोविका का मुख्य साधन कृषि या उसके अनुषंगी प्रयोजनों के लिए प्रयुक्त होने वाले परम्परागत औजारों , उपकरणों और अन्य वस्तुओं या चीजों का उत्पादन या मरम्मत करना है और ऐसा व्यक्ति भी श्रभिप्रेत है जो सामान्यतः या तो अपने श्रम द्वारा या अपने कुटुम्ब के सदस्यों के श्रम द्वारा किसी ग्राम्य क्षेत्र में शिल्प- कर्म द्वारा अपनी जीविका उपार्जित करता है ;
(झ) " छोटे कृषक" से ऐसा व्यक्ति श्रभिप्रेत है , जिसके पास अपनी एक हैक्टेयर से अधिक किन्तु दो हेक्टेयर से अनधिक कृषि भूमि है और जिसकी जीविका का मुख्य साधन , कृषि- भूमि से या कृषि - भूमि पर शारीरिक श्रम द्वारा या कृषि या उसके अनुषंगी प्रयोजनों के लिए प्रयुक्त होने वाले परम्परागत औजारों, उपकरणों और अन्य वस्तुओं या चीजों के उत्पादन या मरम्मत से या किसी ग्राम्य क्षेत्र में अपने श्रम द्वारा या अपने कुटुम्ब के सदस्यों के श्रम द्वारा शिल्प - कर्म द्वारा नाय , है ।

3. कतिपय ऋणों का ऋण स्थगन तत्समय प्रवृत्त किसी अधिनियमिति में या किसी संविदा या विधि का बल रखने वाले अन्य लिखतों में अन्र्तावष्ट किसी बात के होते हुए भी और इस अधिनियम में अन्यथा उपबन्धित के सिवाय , किसी ऋणी को इस अधिनियम के प्रारम्भ के पूर्व दिया गया प्रत्येक ऋण , इस अधिनियम के प्रारम्भ की तारीख से एक वर्ष की अवधि के लिए , जो प्रशासक द्वारा चण्डीगढ़ राजपत्र में अधिसूचना द्वारा समय - समय पर , कुल मिलाकर दो वर्ष से अनधिक के लिए बढ़ाई जा सकेगी, निलंबित रहेगा , भौर--
( i ) उसकी वसूली के लिए किसी सिविल न्यायालय में लंबित कोई कार्यवाही पूर्वोक्त अवधि की समाप्ति तक मुल्तवी रहेगी ;
( ii) पूर्वोक्त अवधि के दौरान अधिकारिता प्राप्त कोई सिविल न्यायालय निलंबित ऋण की वसूली के लिए कोई वाद या कार्यवाही प्रहण नहीं करेगा ।
