New Delhi , the 26th September 1975
S.O. 538 ( E ) . The following Order made by the President is published for general information:
ORDER
Whereas my predecessor - in - office had on 28th March , 1974 , made an Order , suspending for a period of six months the operation of certain provisions of the Government of Union Territories Act , 1963 (20 of 1963 ) , ( hereinafter referred to as " the Act " ) in relation to the Union territory of Pondicherry , and making certain incidental and consequential provisions which appeared to him to be necessary and expedient for administering the Union territory of Pondicherry in accordance with the provisions of article 239 of the Constitution during the aforesaid period:
And whereas I had on 26th September . 1974 and 7th March , 1975 , made further Orders continuing the suspension of operation of the provisions of the Act , suspended under the aforesaid Order , for a further period of six months on each occasion from the date or which the first mentioned Order would otherwise have expired ;
And whereas I have received a report from the Administrator of the Union territory of Pondicherry and , after considering the report and other information received by me , I am satisfied that the situation in the Union territory continues to be such that the administra- tion of that territory cannot be carried on in accordance with the provisions of the Act and

that for the proper administration of the Union territory it is necessary that the operation of the provisions of the Act suspended by my predecessor - in- office under the first mentioned Order should continue to remain suspended , and the incidental and consequential provisions made therein should continue to operate , beyond the period of one year and six months ;
Now, therefore, in exercise of the powers conferred by section 51 of the Act and all other powers enabling me in that behalf , I. Fakhruddin Ali Ahmed, President of India, høreby direct ,-
(a) that the operation of the provisions of the Act , suspended by virtue of clause (a) of the first mentioned Order , shall continue to remain suspended , and the incidental and consequential provisions made by virtue of clause (b) of the aforesaid Order shall continue to be operative , for a further period of six months with effect from the 28th September , 1975 ; and
(b) that for the words " one year and six months " occurring in clause (a) of the first mentioned Order , as subsequently amended , the words " two years " shall be substituted .

राष्ट्रपति द्वारा किया गया निम्नलिखित श्रादेश सर्वसाधारण कॉ० प्रा ० 538 ( श्र ) को जानकारी के लिए प्रकाशित किया जाता है :-
प्रावश
मेरे पद में पूर्वर्वात ने 28 मार्च , 1974 को एक आदेश किया था जिसमें पाण्डोचेरी संघ राज्यक्षेत्र के संबंध में संघ राज्यक्षेत्र शासन अधिनियम, 1963 ( 1963 का 20 ) (जिसे इसमें इसकै पश्चात् " अधिनियम" कहा गया है ) के कतिपय उपबंधों का प्रवर्तन, छह मास की अवधि के लिए निलंबित कर दिया गया था और जिसमें पूर्वोक्त अवधि के दौरान, संविधान के अनुच्छेद 239 के उपबंधों के अनुसरण में पाण्डीचेरी संघ राज्यक्षेत्र के प्रशासन के लिए ऐसे कतिपयन आनुषंगिक और पारिणामिक उनबंध बनाए गए थे , जो उन्हें आवश्यक और समीचीन प्रतीत हुए ;
और मैंने 26 सितम्बर , 1974 और 7 मार्च , 1975 को, उस तारीख से जिसको प्रथम वर्णित आदेश अन्यथा समाप्त हो गया होता, प्रत्येक अवसर पर छह मास की और अवधि के लिए पूर्वोक्त आदेश के अधीन निलंबित , अधिनियम के उपबन्धों के प्रवर्तन का निलंबन जारी रखने के लिए और आदेश किए थे ;
और मुझे पाण्डीचेरी संघ राज्यक्षेत्र के प्रशासक से एक रिपोर्ट प्राप्त हुई है और मुझे प्राप्त रिपोर्ट तथा अन्य जानकारी पर विचार करने के पश्चात् मेरा यह सपाधान हो गया है कि संघ राज्यक्षेत्र में ऐसी स्थिति जारी है कि उस राज्यक्षेत्र का प्रशासन अधिनियम के उपबन्धों के अनुसार नहीं चलाया THE GAZETTE OF INDIA EXTRAORDINARY

जा सकता और यह कि संघ राज्यक्षेत्र के उचित प्रशासन के लिए , यह आवश्यक है कि प्रथम वणित आदेश के अधीन मेरे पद में पूर्ववर्ती द्वारा निलंबित अधिनियम के उपबंधों का प्रवर्तन निलंबित ही बना रहना चाहिए और उसमें बनाए गए भानुषंगिक भौर पारिणाभिक उपबंध डेढ़ वर्ष की अवधि के परे प्रतित रहने चाहिए ।
अतः , अब , मैं, फखरुद्दीन अली अहमद, भारत का राष्ट्रपति , अधिनियम की धारा 51 द्वारा प्रदत्त शक्तियों और उस निमित्त मुझे समर्थ बनाने वाली सभी अन्य शक्तियों का प्रयोग करते हुए , निदेश देता हूं : --
( क ) कि अधिनियम के उपबंधों का प्रवर्तन , जिसे प्रथम वर्णित श्रादेश के खण्ड ( क ) के आधार पर निलंबित किया गया था, निलंबित ही रहेगा और पूर्वोक्त श्रादेश की मद ( ख ) के आधार पर बनाए गए आनुषंगिक और पारिणामिक उपबंध 28 सितम्बर , 1975 से छह मास की और श्रवधि के लिए प्रतित रहेंगे ; और
(ख ) यह कि यथा तत्पश्चात् संशोधित प्रथम वणित आदेश के खण्ड (ख ) में आए हुए " डेढ़ वर्ष " शब्दों के स्थान पर " दो वर्ष " शब्द रखे जाएंगे ।
