SUBJECT. Import of Dates [ S. No. 21 ( b ) / IV ] from Oman ( Muscat ) during 1975-76 on annual basis .
No. 106 - ITC ( PN)/75.-It has been decided to grant licences for import of Dates from Oman (Muscat) , on annual basis , during 1975-76 licensing period on the following basis:--
Quota
Minimum value licence of Rs . 12,500/- each.
( i ) Established importers having past imports of Dates from Oman (Muscat) upto Rs . 12,500/ - .
50 % , subiect to Rs . 12,500/- . a minimum of (ii) Established importers having past imports of dates from Oman (Muscat) between Rs . 12,501/- and Rs . 15 lakhs .
45 % , subject to a minimum of Rs . 75,000 / -.
(iii) Established importers having past imports of dates from Oman (Muscat) between Rs . 1,50,001/- and Rs . 5 lakhs .
40 % , subject to a minimum of Rs . 2.25,000/ -
(iv) Established importers having past imports of dates from Oman (Muscat) over Rs . 5 lakhs .
2. The licences will be granted on the basis of past imports of dates from Oman (Muscat) in any one of the years of the prescribed basis period , namely 1956-57 to 1969-70 .

3. Established Importers , who had imported this item from the above country by Sailing vessels/Steamers may accordinglygly submit their applications to the Joint Chief Controller of Imports and Exports , Bombay , on or before the 31st October , 1975 in the usual form and manner , complete in all respects . Incomplete applications are liable to be rejected . No past import documents are required to be produced , provided such documents were submitted to the licensing authority concerned in the past and were accepted by them for issue of licences for import of Dates from Oman (Muscat) . They should, however , quote details of licences obtained in the preceding two periods . Where , however , the established importers are applying for the first time , they are required to produce unimpcachable documents relating to past imports of 'Dates' from Oman ( Muscat ) during any one year within the prescribed basic years .
4. All applicants should furnish along with their applications detailed information regarding the manner of import and disposal of dates imported against the licences obtained during the last three periods in the proforma as at Annexure I of this Public Notice.
5. Import licences granted to the eligible established importers will be valid upto the 31st July, 1976. No extension will be allowed under any circumstances . The importers are , however, free to utilise the full value of the licences any time within their validity period.
6. Licences issued in terms of above paragraphs will be valid for import upto 60 per cent by Sailing vessels and the balance by Steamers etc.
7. It may be noted that the minimum value of import licences for Dates from Oman (Muscat) during 1975-76 will be Rs . 12,500/- ( Rupees twelve thousand and five hundred only) subject to the provisions contained in para 45 ( 2) of I.T.C. Hand Book of Rules and Procedure, 1975-76 with regard to division of quotas .
8. The provisions of paragraph 119 and 120 of Section I of the Import Trade Control Policy Book (Vol . 1) for the period April , 1975- March , 1976 , relating to minimum and maximum value of licences will not apply to the licences issued in terms of this Public Notice. However the provisions of Paragraph 121 of section I of I.T.C. Policy Book (Vol . I) for the period April , 1975- March , 1976 will be applicable in the cases involving TQR/DQR .

विश्य.--वार्षिक आधार पर 1975-76 के दौरान श्रोमन ( मस्कत ) से खजूरों [क्रम संख्याः 21 ( बी ) / 4 ] का श्रायात ।
सं ० 106 -आई ० दो० सी० (पो ० एन ० )/ 75.--वार्षिक आधार पर लाइसेंस अवधि 1975-76 के दौरान निम्नलिखित आधार पर श्रीमन ( मस्कत ) से खजूरों का आयात करने के लिए लाइसेंस प्रदान करने का निश्चय किया गया है:--
कोटा
12,500 रुपये का न्यूनतम मूल्य लाइसेंस ।
( 1 ) वे सुस्थापित आयातक जिनका श्रीमन ( मस्कत ) से खजूरों का भूतकालीन श्रायात 12,500 रुपये तक है ।
50 प्रतिशत , यह न्यूनतम 12,500 रुपये के अधीन हैं ।
( 2) वे सुस्थापित आयातक जिनका श्रमन ( मस्कत ) से खजूरों का भूतकालीन आयात 12,501 रुपये और 1.5 लाख रुपये के बीच है ।
( 3 ) वे सुस्थापित श्रायातक जिनका श्रीमन ( मस्कत ) से खजूरों का भूतकालीन श्रायात, 1,50,001 रुपये और 5 लाख रुपये के बीच है ।
45 प्रतिशत , यह न्यूनतम 75,000 रुपये के अधीन है ।
( 4) वे सुस्थापित आयातक जिनका श्रीमन ( मस्कत ) से खजूरों का भूतकालीन आयात 5 लाख रुपये से अधिक का है ।
40 प्रतिशत, यह न्यूनतम 2,25,000 रुपये के अधीन है ।
2. लाइसेंस , निर्धारित मूल अवधि अर्थात् 1956-57 से 1969-70 तक के वर्षों में से किसी एक वर्ष में श्रोनन ( मस्कत ) से खजूरों के भूतकालीन श्रायातों के आधार पर स्वीकृत किए जाएंगे ।
3. वे सुस्थापित श्रायातक जिन्होंने इस मद का श्रायात उपर्युक्त देश से जलपोतों/ स्टीमर्स द्वारा किया था उन्हें चाहिए कि वे अपने आवेदनपत्न सामान्य प्रपत्त्र में एवं विधि से सभी प्रकार से पूर्ण करके 31 अक्तूबर , 1975 को या इससे पूर्व संयुक्त नियंत्रक, आयात मुख्य निर्यात , बम्बई को भेजें । अपूर्ण आवेदनपत्त्रों को अस्वीकार किया जा सकता है । किसी प्रकार के भूतकालीन आथातों से सम्बद्ध दस्तावेजों को भेजने की आवश्यकता नहीं है बशर्ते कि इस प्रकार के दस्तावेज श्रमिन ( मस्कत) से खजूरों के आयात के लिए लाइसेंस जारी करने के लिए उनके द्वारा सम्बद्ध लाइसेंस प्राधिकारी को पहले भेजें गए थे और उन्हें स्वीकार कर लिया गया था । लेकिन उन्हें चाहिए कि वे पूर्व दो अवधियों में प्राप्त किए गए लाइसेंसों के व्यौरों का संकेत करें । लेकिन , जिस मामले में सुस्थापित श्रायातक पहली बार आवेदन कर रहे हों उसमें उन्हें निर्धारित मूल वर्षों में से किसी एक वर्ष के दौरान श्रमन ( मस्कत ) से " खजूरों" के भूतकालीन आयातों से सम्बन्धित सही दस्तावेज प्रस्तुत करने आवश्यक हैं ।

4. सभी आवेदकों को चाहिए कि वे अपने आवेदनपत्रों के साथ प्रस्तुत सार्वजनिक सूचना के अनुबन्ध -1 में दिए गए प्रपत्न में गत तीन अवधियों के दौरान प्राप्त लाइसेंसों के मद्दे आयातित खजूरों के श्रायात की विधि एवं निपटान के बारे में विस्तृत सूचना भेजे ।
5. पात्न सुस्थापित आयातकों को प्रदान किए गए श्रयाप्त लाइसेस 31 जुलाई, 1976 तक वैध होंगे । किसी भी परिस्थिति में कोई सीमावृद्धि नहीं की जाएगी । लेकिन , श्रायातक लाइसेंसों की वैधता अवधि के भीतर किसी भी समय लाइसेंसों के पूर्ण मूल्य का उपयोग करने के लिए स्वतंत्र है ।
6. उपर्युक्त कंडिकाओं की शर्तों के अनुसार जारी किए गए लाइसेंस 60 प्रतिशत तक पाल पोतो द्वारा और शेष स्टीमरों आदि द्वारा आयात के लिए वैध होंगे ।
7. यह नोट कर लिया जाए कि आयात व्यापार नियंत्रण , नियम तथा क्रियाविधि हेड बुक, 1975-76 की कोटा विभाजन से सम्बन्धित कंडिका 45 ( 2 ) में निहित शर्तों के अधीन श्रओमन ( मस्कत ) से 1975-76 के दौरान खजूरों के श्रयाप्त के लिए आयात लाइसेंसों का न्यूनतम मूल्य 12,500 / - रुपये ( बारह हजार पांच सौ रुपये मात्र ) तक बढ़ा दिया गया है ।
8. अप्रैल , 75-मार्च , 76 अवधि की आयात व्यापार नियंत्रण नोति पुस्तक (वा० 1) के खंड -1 के लाइसेंसों के न्यूनतम और उच्चतम मूल्य से सम्बन्धित कंडिका 119 तथा 120 की शर्ते इस सार्वजनिक सूचना की शर्तों के अनुसार जारी किए गए लाइसेंसों के लिए लागू नहीं होंगी । लेकिन , अप्रैल, 1975-मार्च , 1976 अवधि के लिए अध्याप्त व्यापार नियंत्रण नीति पुस्तक ( वा० 1) के खंड -1 की कंडिका 121 की व्यवस्थाएं दी क्यू श्रार/ डी फ्यू आार के मामले में लागू होंगी ।

SUBJECT. Import of Dates [ S. No. 21 ( b ) / IV ] from Iraq during 1975-76 licensing period on annual basis .
No. 107 - ITC ( PN) / 75 . It has been decided to grant licences for import of Dates from Iraq to the Established Importers , having past import of Dates from that country by Sailing Vessels / Steamersetc. , within the prescribed basic years , on the following basis :-

100 % subject Rs. 15,000 /- . to a minimum of (i ) Established Importers having past imports of Dates from Iraq upto Rs . 1.5 lakhs .
95 % subject to Rs . 1.5 lakhs . a minimum of ( ii) Established Importers having past imports of Dates from Iraq bet- ween Rs . 1,50,001 / - and Rs. 5 lakhs .
60 % subject to a minimum of Rs , 4.75 Jakhs .
( iii ) Established Importers having past imports of Dates from Iraq bet- ween Rs . 5,00,001 / - and Rs . 15 lakhs .
50 % subject to a minimum of Rs . 9 lakhs .
( iv) Established Importers having past imports of Dates from Iraq of over Rs . 15 lakhs .
2. The basic period for all Established Importers of Dates from Iraq will be from 1956-57 to 1970-71 . For importers detailed in item ( 1 ) to ( iv) of the Annexure I to this Public Notice , the basic period will be as mentioned under each item .
3. The Established Importers should submit their applications to the Joint Chief Controller of Imports and Exports , C.G.O. Building , New Marine Lines , Churchgate , Bombay , Joint Chief Controller of Imports and Exports , 4 , Esplanade East , Calcutta , Joint Chief Controller of Imports and Exports , 1st Line Beach , Madras , Joint Chief Controller of Imports and Exports , Central Licensing Area , Indraprastha Bhawan , New Delhi , Deputy Chief Controller of Imports and Exports , T. D. Road , Ernakulam - 1 , (according to the jurisdiction under which they fall ) on or before the 31st October , 1975 . No past import documents are required to be produced , provided such documents were produced in the past and were accepted in the past by the licensing authority concerned for issue of licences for import of Dates from Iraq . However , the established impor- ters should quote the number and date of licences obtained by them in the preceding two periods . The established importers , applying for the first time for grant of licences for import of Dates from Iraq according to the current policy , should submit unimpeach- able documentary evidence of past import of Dates from Iraq within the prescribed basic years i.e. 1956-57 to 1970-71 .
4. Importers who are eligible in terms of Annexure I to this Public Notice will also be granted licences to the extent of Rs . 15,000/- each (Rupees fifteen thousand only ) for imports of Dates from Iraq irrespective of their past imports , subject to the provision contained in paragraph 45 (2 ) of the Import Trade Control Hand Book of Rules and Procedure , 1975-76 with regardto divisiondivision of quotas . They may submit theirheir applica- tions for import of Dates from Iraq for 1975-761975-76 period to Joint Chief Controller of Imports and Exports , Central Licensing Area , Indraprastha Bhawan , New Delhi , on or before the 31st October , 1975 , in the usual form and manner , complete in all respects .
5. In addition to the importers mentioned in Paragraphs 1 and 4 above , Cooperative Societies of pre- independence freedom fighters , which were registered prior to 31st March , 1973, will also be granted licences for import of Dates from Iraq, subject to the provi- sion contained in Paragraph 6 below . Presidents of such Societles will be required to produce an affidavit to the effect that all the members of the Society are bonafide free- dom fighters of pre - independence era . These societies should submit their applications to the Joint Chief Controller of Imports and Exports , Central Licensing Area , Indraprastha Bhawan , New Delhi , on or before 31st October , 1975 , in the usual form and manner; complete in all respects .
6. It may be noted that no double benefit will be given and the applicants should submit one application only either in terms of paragraph 1 to 3 or in terms of Paragraph 4 or Paragraph 5 and they should clearly mention in their applications that they have ap- plied in one capacity only and not under both. In the case of Cooperative Societies covered by paras 4 and 5 above , a certificate to the effect that no member of the society has applied for an import licence in his individual capacity or is the owners , proprietor , [ PART I- SEC . 11 THE GAZETTE OF INDIA EXTRAORDINARY

partner or share- holder in any body corporate , which has applied for an import licence under this Public Notice , should be produced .
7. All applicants should furnish alongwith their applications detailed information re- garding the manner of import and disposal of Dates imported against the licences obtained during the last three periods in the proforma as at Annexure III of this Public Notice .
8. Licences issued in terms of this Public Notice will be valid for imports of Dates from Iraq, subject to the condition that not less than 60 per cent of the face value of the licence shall have to be utilised for import of Dates from Iraq by Sailing Vessels only and the balance by Steamers , etc.
9. All incomplete applications are liable to be rejected .
10 , The licences issued in terms of this Public Notice will be valid upto the 31st July , 1976 , from the date of issue and no further extension in the validity period of the licences will be granted .
11. It may be noted that the minimum value of import licences for Dates from Iraq during 1974-75 will be Rs . 15,000 ( Rupees fifteen thousand only ) subject to the provisions contained in para 45 ( 2 ) of the I.T.C. Hand Book of Rules and Procedures , 1975-76 .
12. The provisions of paragraphs 119 and 120 of Section 1 of the Import Trade Control Policy Book ( Vol . 1 ) for the period April 1975-March 1976 , relating to minimum and maximum value of licences will not apply to the licences issued in terms of this Public Notice . However , the provisions of paragraph 121 of Section I of I.TC. Policy Book (Vol . 1 ) for the period April 1975-March 1976 willbe applicable in the cases involving TQR / DQR .

( iii) Established importers who have imports of fresh fruits to their credit from any of the countries in the 'General Area ' including Pekistan but excluding Afghanistan during the period from 1945-46 to 1950-51 provided these imports had been accepted by the licensing authority for grant of ad - hoc licences for im- port of fresh fruits from Pakistan during 1960 to 1964 .
( iv) Established Importers who have imports of dry fruits to their credit from Pakistanstan during the period 1951-52 to 1970-71 .

(v) Co - operative Societies dealing in fresh fruits , subject to the production of :-
(a) a certificate from the concerned Registrar of Co - operative So- cieties that the Co-operative Society is still in existence;
(b) an Affidavit in the proforma en- closed vide Annexure II ;
(c) a certificate from a Chartered Accountant to the effect that the Society had a turn - over of not less Rs . 15,000/ - (Rs . Fifteen thousand) during any one of the financial years 1968-69 , 1969-70 1970-71 and 1971-72 in fresh fruits.
If a certificate as referred to in sub -para (c) above had been produced in the past and it had been accepted by the licensing authority concerned for the issue of licences for import of Dates from Iraq, it need not be produced again . Only a reference to the carlier application with which such a certificate had been fur- nished should be made .

सं० 107 -प्राई ० टो ० सो ० ( पो० एन ० )/75.--इम बात का निश्चय किया मया है कि निर्धारित मून अवधि के दौरान निम्नलिखित आधार पर उन संस्थापित आयातकों को ईराक से खजूरों के आयात की स्त्रीकृति दी जाए जिन्होंने माल पोतों, स्ट्रीमरों द्वारा उस देश मे खजूरों का पहले आयात किया था

( 1 ) संस्थापित आयातक जिनका ईराक से खजूरों का पहले आयात 15 लाख रुपये तक का है ।

( 4 ) संस्थापित आयातक जिनका ईराक से खजूरों 50 प्रतिशत, कम से कम 9 लाख रुपये के अधीन ।
का पहले आयात 15 लाख रुपये से अधिक का है ।
2. ईराक से ' खजूरं । ' का आयात करने वाले सभी संस्थापित आयातकों के लिए मूल अवधि 1956-57 से 1970-71 तक होगी । इस सार्वजनिक सूचना के अनुबन्ध-1 की मद ( 1 ) से ( 4 ) -तक में आयातकों के लिए दिए गए विवरण के लिए मूल अवधि प्रत्येक मद के अन्तर्गत उल्लेख किए -गए के अनुसार होगी ।

3. संस्थापित श्रायातकों को चाहिए कि वे अपने श्रभावेदन पत्त्र संयुक्त मुख्य नियंत्रक, आयात -निर्यात, सी जी श्रो, न्यू बिल्डिंग , न्यू मेरिन लाइन्स , चर्चगेट , बम्बई/ संयुक्त मुख्य नियंत्रक , आयात-निर्यात , 4 , एस्पेलेनड ईस्ट, कलकत्ता/ संयुक्त मुख्त्र नियंत्रक , आयात -निर्यात , 1 , लाइन बीच मद्रास/ संयुक्त मुख्य नियंत्रक, आयात - निर्यात ( केन्द्रीय लाइसेस क्षेत्तत्र ) , इन्द्रप्रस्थ भवन , नई, दिल्ली, उप मुख्य नियंत्रक , श्रायात निर्यात , टी० डी० रोड , एर्नाकुलम -1 ( अधिकार क्षेत्र के अनुसार , जिसमें वे आते हैं ) 31 अक्तूबर 1975 को अथवा उससे पहले प्रस्तुत करै । पुराने आयात संबंधी दस्तावेज प्रस्तुत करने की कोई आवश्यकता नहीं है , बशर्ते कि ऐसे दस्तावेज भूतकाल में प्रस्तुत किए गए हों, और संबंधित लाइसेंस प्राधिकारी द्वारा ईराक से खजूरों के आयात के लए लाइसेंस जारी करने के लिए वे स्वीकार किए गए हों, लेकिन संस्थापित आयातकों को पूर्वागामी दो अवधियों में प्राप्त किए गए लाइसेंसों की संख्या तथा दिनांक का हवाला देना चाहिए । वर्तमान नीति के श्रनुसार, ईराक से खजूरों का श्रायात करने के लिए प्रथम बार लाइसेंस स्वीकृति के लिए आवेदन करने वाले संस्थापित आयातकों को ईराक के खजूरों के पूर्वगामी आयात का अधि- क्षेप्य दस्तावेजी साध्य निर्धारित मूल वर्षों अर्थात, 1956-57 से 1970-71 के भीतर प्रस्तुत करना चाहिए ।
4. उन प्रत्येक आयातको को भी जो प्रस्तुत सार्वजनिक सूचना के अनुबन्ध 1 के अनुसार उपयुक्त है, ईराक से खजूरों के उनके गत आयातों के ऊपर , ध्यान दिए बिना ही , कोटा के बटवारे के सम्बन्ध में, आयात व्यापार नियंत्रण नियम तथा कार्यविधि , हैंडबुक , 1975-76 की कंडिका 45 ( 2 ) में विहित व्यवस्थाओं के अधीन 15,000/- रुपये ( पन्द्रह हजार रुपये मात्र ) तक का आयत लाइसेंस दिया जाएगा । वे 1975-76 अवधि के लिए ईराक से खजूरों के श्रायात के लिए अपने आवेदन पत्र सामान्य प्रपत्र में और यथा रीति सब प्रकार से पूर्ण 31 अक्तूबर, 1975 को अथवा इससे पहले संयुक्त मुख्य नियंत्रक , भायात-निर्यात ( केन्द्रीय लाइसेंस क्षेत्र ) , नई दिल्ली को प्रस्तुत कर सकते हैं ।
5. इसके अतिरिक्त उपर्युक्त पारा 1 एवं 4 में उल्लिखित श्रायातक , स्वतंत्रता से पूर्व स्वतन्त्रता सेनानियों की सहकारी समितियां जो 31-3-1973 से पूर्व पंजीकृत की गई थीं , उन्हें भीं नीचे पारा 7 में निहित व्यवस्था के अधीन ईराक से खजूरों के आयात के लिए लाइसेंस स्वीकृत किए जाएंगे । इस प्रकार की समितियों के अध्यक्ष के लिए इस संबंध में एक शपथ पत्र देना आवश्यक होगा कि समिति के सभी सदस्य स्वतंतता से पूर्व के वास्तविक स्वतंत्रता सैनानी हैं । इन समितियों को चाहिए कि अपने आवेदन पत्र सामान्य प्रपत्र में और यथा रीति सब प्रकार से पूर्ण 31 अक्तूबर , 1975 को या इससे पूर्व संयुक्त मुख्य नियंत्रक , श्रायात - निर्यात केन्द्रीय लाइसेंस क्षेत्र , इन्द्रप्रस्थ भवन , नई दिल्ली , को प्रस्तुत करें ।
6. इसे ध्यान में रखा जाए कि दो तरफा लाभ नहीं दिया जाएगा और आवेदको कोया तो केवल उपर्युक्त कंडिका 1 से 3 अथवा कंडिका 4 , कंडिका 5 के अनुसार , एक आवेदनपत्त्र प्रस्तुत करना चाहिए तथा उन्हें अपने आवेदनपल्लों में स्पष्ट रुप से यह उल्लेख कर देना चाहिए कि उन्होंने केंदल एक ही की हैसियत के अन्तर्गत आवेदन किया है न कि नोदों की उपर्युक्त पारा 4 एवं 5 के अन्तर्गत आने वाली सहकारी समितियों के मामले में इस संबंध में एक प्रमाण पत्र दिया जाना चाहिए कि समिति के किसी भी सदस्य ने निजी रुप से आयात लाइसेंस के लिए आवेदन नहीं किया है या किसी भी उस बाडी कार्पोरेट का स्वामी, भागीदार अथवा हिस्सेदार नहीं है जिसने इस सार्वजनिक सूचना के अन्तर्गत आयात लाइसेंस के लिए आवेदन किया है ।
7. सभी आवेदकों को चाहिए कि वे अपने आवेदनपत्नों के साथ प्रस्तुत सार्वजनिक सूचना के अनुबन्ध-3 में दिए गए प्रपत्न में गत तीन अवधियों के दौरान प्राप्त लाइसेंसों के मद्दे आयतातित खजूरों के झायात की विधि एवं निपटान के बारे में विस्तृत सूचना भेजें ।

8. इस सार्वजनिक सूचना के अनुसार , जारी किए गए लाइसेंस ईराक से खजूरों के आयात के लिए इस शर्त के अधीन वैध ह। गे कि लाइसेंस के अंकित मूल्य के 60 प्रतिशत का उपयोग ईराक से " खजूरां " के आयात के लिए केवल माल पोतों द्वारा करना होगा और शेष स्टीमरों श्रादिद्वारा ।
9. सभी अधूरे आवेदन पत्न अस्वीकार कर दिए जाएंगे ।
10. इस सार्वजनकि सूचना के अधीन जारी किए गए लाइसेंस जारी होने की तिथि से 31 जुलाई, 1976 तक वैध होंगे तथा उनकी वैधता अवधि की और वृधि के लिए अनुमति नहीं दी गएंगी ।
11. इसे ध्यान में रखा जाए कि श्रायात व्यापार नियंत्रण नियम तथा कार्यविधि हैडबुक , 1975-76 की कंडिका 45 ( 2 ) मे निहित व्यवस्थात्रों के अधीन ईराक से खजूरों के श्रायात लाइसेंसों का न्यूनतम मूल्य 15,000 रुपये ( पन्द्रह हजार रुपये मात्र ) होगा ।
12. अप्रैल , 1975 -मार्च , 1976 अवधि की श्रायात व्यापार नियंत्रण नीति पुस्तक ( बा ० 1 ) के खंड 1 के पैरा 119 एवं 120 में निहित लाइसेंसों के न्यूनतम और अधिकतम मूल्य से संबंधित व्यवस्थाएं इस सार्वजिनक सूचना के अनुसार , जारी किए गए लाइसेंसों के लिए लागू नहीं होंगी । लेकिन , अप्रैल, 1975--मार्च, 1976 अवधि के लिए आयात व्यापार नियंत्रण नीति पुस्तक ( वा ० 1 ) के खंड -1 की कंडिका 121 की व्यवस्थाएं टी क्यू आर/ डी क्यू आर के मामले में लागू होंगी ।

ईराक से खजुरों के आयात के लिए तदर्थ लाइसेंस निम्नलिखित को जारी किए जायेंगे -
( 1 ) सस्थापित आयातक , जिन्होंने अपने खाते पर 30-6-57 को समाप्त होने वाले 5 वर्षों के दौरान अफगानिस्तान को ताजा फलों का आयात किया हो ।

के दौरान पाकिस्तान सहित सामान्य क्षेत्र के किसी भी देश से परन्तु अफगानिस्तान को छोड़कर , ताजा फलों का औयात किया हो ।
( 3 ) संस्थापित श्रायातक , जिन्होंने अपने खाते पर 1945-46 से 1950-51 तक की अवधि के दौरान पाकिस्तान सहित 'सामान्य क्षेत्रों , के किसी भी देश से परन्तु अफगानिस्तान को छोड़कर, ताजा फलों का आयात किया हो बशर्ते कि लाइसेंस प्राधिकारी द्वारा 1960 से 1964 के दौरान पाकिस्तान से ताजा फलों का आयात करने के लिए तदर्थ लाइसेंसों की मंजूरी देने के लिए ये भायात स्वीकृत कर लिये गये थे ।
( 4) संस्थापित आयातक, जिन्होंने अपने खाते पर 1951-52 से 1970-71 की अवधि के दौरान पाकिस्तान से सूखे फलों का श्रथात किया हो ।
( 5) ताजा फलों का व्यापार करने बल वाली सहकारी समितियों को निम्नलिखित प्रस्तुत करने पर
(क ) सम्बद्ध सहकारी समितियों के निबंधक से इस संबन्ध में एक प्रमाण पत्त्र कि सहकारी समितियां अभी भी विद्यमान है, [PART I- SEC . 11 THE GAZETTE OF INDIA EXTRAORDINARY

( ख ) सलग्न प्रपत्न में एक शपथ पत्र, देखें अनुबध-3
(ग) सनदी लेखापाल से इस सबंध में एक प्रमाण पत्न कि वित्तीय वर्ष 1968-69 , 1969- 70 , 1970-71 एवं 1971 72 के दौरान समिति का ताजे फलों का व्यवसाय 15000 रुपए ( पन्द्रह हजार रुपए) से कम नहीं था ।
यदि उपर्युक्त उप- कंडिका ( ग ) में यथा संदर्भित एक प्रमाण पत्न भूत में प्रस्तुत कर दिया गया था और यह ईराक से सूखे फलों के आयात के लिए लाइसेंस जारी करने के लिए लाइसेंस प्राधिकारी द्वारा स्वीकार कर लिया गया था तो उसे पुनः प्रस्तुत करने की आवश्य- कता नहीं है । केवल पूर्व के श्राबेदन पत्त्र जिसके साथ इस प्रकार का प्रमाण पत्र भेजा गया था उसका संकेत कर देना चाहिए ।

( 1) कि -( सहकारी समिति का नाम और पता) ताजे फलों का व्यापार करती रही है और अब भी कर रही है ।

( 2 ) कि यदि उपर्युक्त पैरा ( 1 ) मे उल्लिखित घोषणा गलत या झुठी पाई जाती है तो इस घोषणा के आधार पर पूर्वोक्त सहकारी समिति को प्रदान किया गया कोई भी लाइसेस सरकार द्वारा श्रारोपित किसी भी दंड या यथा संशोधित आयात और निर्यात (नियंत्रण ) अधिनियम और श्रायात ( नियंत्रण ) आदेश, 1955 के अधीन की जाने वाली किसी अन्य कार्रवाई को ध्यान में रखे बिना रद्द कर दिया जाएगा ।
