New Delhi, the 18th October 1975
G.S.R. 530 (E ) . In exercise of the powers conferred by Section 13 of the Equal Remu- neration Ordinance , 1975 ( 12 of 1975 ) , the Central Government hereby makes the follow- ing rules , namely:-
CHAPTER I
Preliminary
1. Short title and commencement .-( 1 ) These rules may be called the Equal Remunera- tion Rules , 1975 .
(2) They shall come into force on the date of their publication in the Official Gazette
2. Definitions . In these rules , unless the context othewise requires : -
(a) " Ordinance " means the Equal Remuneration Ordinance , 1975 .
(b) "Authority " means the authority appointed by the appropriate Government under sub- section ( 1 ) of Section 7.
(c) " Form" means a form appended to these rules .
(d) " Section" means a section of the Ordinance .
( e) "registered trade union" means a trade union registered under the Trade Unions Act, 1926 ( 16 of 1926 ) .

CHAPTER 11
Complaints and claims under the Ordinance
3. Complaints regarding contravention of the Ordinance .- ( 1 ) Every complaint under clause ( a) of sub - secuon (1 ) of section saali be made in tripncate , im Form 'A ' to the Authority appomted for the purpose .
(2) A single complaint may be made by or on behalf of , or in respect of , a group of workers , if they are employed in the same establishment and the complaint relates to the same contravention .
(3 ) A complaint may be made by the worker himself or herself orby any legal praс- titioner , or by any official of a registered trade union , authorised in writing to act on nis or her behalf or by any Inspector appointed under Section 9 or by any other person acting with the permission of the Aulnority.
4. Claim regarding non -payment of wages etc .-( 1 ) Every claim under clause ( b) of sub - section ( 1 ) of section 7 shall be made in triplicate , in Form 'B ' to the Authority appointed for the purpose .
(2) A single application may be made by or on behalf of, or in respect of, a group of workers , if they are employed in the same establishment and their claims are the same .
(3 ) A claim may be made by the worker 'himself or herself or by any legal practi- tioner or by any official of a registered trade union , authorised in writing to act on his or her behaif or by any Inspector appointed under Section 9 or by any other person acting with the permission of the Authority .
5. Authorisation . The authorisation under sub - rule ( 3 ) of rule 3 or sub - rule ( 3 ) of rule 4 shall be in Form 'C' which shall be presented to the Authority to whom the com- plaint or the claim , as the case may be , is made and shall form part of the record .

सा० का० ति० 530 ( प्र ) - केन्द्रीय सरकार, समान पारिथमिक अध्यादेश , 1975 ( 1975 का 12 ) की धारा 13 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाती है, अर्थात्
अध्याय 1
श्रारम्भिक
1. संक्षिन्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम रामान पारिश्रमिकः नियम, 1975 है ।
( 2 ) ये राजनत्र में प्रकाशन का ताराख को प्रवृत्त होंगे ।
2. परिभाषाएं-इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो:-- (क) " श्रध्यादेश " से ममान पारिश्रमिक अध्यादेश, 1975 अभिप्रेन है ।
(ख ) "प्राधिकारी " से धारा 7 की उपधारा ( 1 ) के अधीन समुचित सरकार द्वारा नियुक्त प्राधिकारो अभिप्रेत है ।
( ग) "प्ररूप" से इन नियमों से संलग्न प्ररूप अभिप्रेत है ।
( घ) " धारा" में अध्यादेश की धारा अभिप्रेत है ।
( छ) " रजिस्ट्रोकून व्यवसाय संघ" से व्यवसाय संघ अधिनियम, 1926 ( 1926 का 16 ) के अधोन रजिस्ट्रोकृन व्यवसाय संत्र अभिप्रेत है ।
अध्याय 2
अध्यादेश के अधोन परिवाद और दावे
3. अध्यादेश के उल्लंघन को बाबत परिवार ( 1 ) धारा 7 की उपधारा ( 1 ) के खण्ड ( क ) के अधीन प्रत्येक परिवाद इस प्रयोजन के लिए नियुक्त प्राधिकारी के समक्ष प्ररून " क" में तीन प्रतियों में किया जाएगा ।
( 2 ) यदि कर्मकारों का समुह एक ही स्थापन में नियोजित हो और परिवाद उसी उल्लंघन के सम्बन्ध में हो, तो उनके द्वारा या उनकी ओर से या उनकी बाबत एक ही परिवाद किया जा सकेगा ।
( 3 ) परिवाद , स्वयं कर्मकार द्वारा या किसी विधि व्यवसायी द्वारा या उसकी ओर से कार्य करने के लिए लिखित रूप में प्राधिकृत रजिस्ट्रीकृत व्यवसाय संघ के किसी पदाधिकारी द्वारा या धारा 9 के अधीन नियुक्त किसी निरीक्षक द्वारा या प्राधिकारी की अनुज्ञा से कार्य करने वाले किसो अन्य व्यक्ति द्वारा किया जा सकेगा ।
4. मजदूरो श्रादि का संदाय न किये जाने की बाबत दावा के खण्ड ( घ ) के अधीन प्रत्येक दावा इम प्रयोजन के लिए नियुक्त में तोत प्रतियों में किया जाएगा । ( 1 ) धारा 7 को उपधारा ( 1 ) प्राधिकारी के समक्ष प्ररूप 'ख' SEC. 3 ( 1 ) ]

( 2) यदि कर्मकारों का समूह एक हो स्थापना में नियोजित हो और उनके दावे एक से हों, तो उनके द्वारा था उनकी ओर से या उसको बाबत एक हो आवेदन किया जा सकेगा ।
(3) परिसाद , स्वयं कर्मकार द्वारा या किसी विधि व्यवसायी द्वारा या उसकी ओर से कार्य करने के लिए लिखित रूप में प्राधिकृत रजिस्ट्रीकत व्यवसाय संघ के किसी पदधारी द्वारा या धारा 9 के अधोत नियुक्त किसी निरीक्षक द्वारा या प्राधिकारी की अनुज्ञा से कार्य करने वाले किसी अन्य व्यक्ति द्वारा किया जा सकेगा ।
5. प्राधिकरण. नियम 3 के उपनियम ( 3 ) के अधीन या नियम 4 के उपनियम ( 3 ) के अधोत प्राधिकरण प्रश्न " ग " में होगा और उसे उस प्राधि हारी को प्रस्तुत किया जाएगा जिसके समक्ष , ययास्थिति, परिवाद या दावा किया गया है और यह अभिलेख का भाग हो जाएगा ।
प्रध्याय 3
रजिस्टरों का रखा जाना
6. नियोजक द्वारा रजिस्टरों का रखा जाना. प्रत्येक नियोजक प्ररूप 'घ ' में कर्मकारों का एक रजिस्टर रखेगा ।

ऊपर दिए गए तदनुसार परिवादी प्रार्थना करता है कि प्राधिकारी .. परिवाद का विनिश्चय करें और उसमें ऐसा आदेश या ऐसे आदेश पारित करें जो वह ठीक और उचित समझें ।

( 3) अर्जीदार / अर्जीदारों को .. तक की अवधि के लिए वैसे ही काम या उसी प्रकृति के काम के लिए उन दरों के बराबर मजदूरी नहीं दी गई है / थी जिन दरों पर भिन्न लिंग के कर्मकारों को दिया जाता है ।
( 4) अर्जीदार / श्रर्जीदारों को मजदूरी की दर पर संदत्त की गई थी / है जब कि वैसे ही काम या वैसे ही प्रकृति के काम के लिए भिन्न लिंग के कर्मकारों को की दर पर मजदूरी का संदाय किया गया था या किया गया है ।
( 5) अर्जीदार अपने द्वारा चाहे गए अनुतोष का मूल्य .. रुपए ) प्राक्कलित करता है / करते हैं । रु ० ( शब्दों में ....
( 6 ) अतः अर्जीदार प्रार्थना करता है / करते हैं कि प्राधिकारी ऊपर दिए गए दावे का विनि श्चय करें और उस पर ऐसा भादेश पारित करें या करें जो वह ठीया श्रीर उचित समझें ।
