G.S.R. 546 ( E ) . In exercise of the powers conferred by sub - section ( 1 ) of sec- tion 35 of the Indian Ports Act , 1908 ( 15 of 1908 ) , the Central Government hereby directs that , with immediate effect , the fees as specified below shall be levied for Berth Hire services rendered to the vessels at the Major Port of New Tuticorin .

BERTH HIRE FEES

(1) Foreign going vessels shall be charged berth hire fees at 20 paise per Net Registered Ton , subject to a minimum of Rs . 500/ - ( Rupees five hundred ) per day or part thereof .

(2) Coasting vessels shall be charged berth hire fees at three / fourths of the rate applicable to foreign going vessels but subject to a minimum of Rs . 350/ - per day or part thereof .

सा०का० नि० 546 ( प्र) -केन्द्रीय सरकार , भारतीय पत्तन अधिनियम , 1908 ( 1908 का 15 ) ) की धारा 35 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निदेश देती है कि नव तूतीकोरिन महापत्तन पर जलयानों में की गई बर्थ भाड़ा सेवाओं के लिए नीचे विनिर्दिष्ट फीस तुरन्त उद्‌गृहीत की जाएगी ।

नर्थ भाड़ फीस

( 1) विदेशगामी जलयानों से प्रति दिन या उसके भाग के लिए 500-00 रु ० ( पांच सौ रुपए) की न्यूनतम फ़ीस के अधीन रहते हुए , 20 पैसे प्रति शुद्ध रजिस्ट्रीकृत टन की दर से बर्थ भाड़ा फीस प्रभारित की जाएगी ।

( 2 ) तटवर्ती जलयानों से प्रति दिन या उसके भाग के लिए 350 रु ० की न्यूनतम फीए के अधीन रहते हुए , विदेशगामी जलयानों को लाग दर का तीन चौथाई भाग बर्थ भाड़ा 'फीस के रूप में प्रभारित किया जाएगा ।

In exercise of the powers conferred by sub - section ( 1 ) of Section 35 of the Indian Ports Act , 1908 ( 15 of 1908 ) , the Central Government hereby makes the following order regulating the levy of fees for Pilotage and other services in the Major Port of New Tuticorin , namely:-

ORDER

1. Short title and commencement .- ( 1 ) This order may be called the Major Port of New Tuticorin Pilotage and other services ( Fees ) Order , 1975 .

(2) It shall come into force at once .

2. Definitions . In this order ,-

( i ) ' daylight hours ' means the hours from 06.00 to 18.00 hours .

( li ) ' Port' means the Major Port of New Tuticorin ,

(111 ) ' Schedule ' means the schedule to this order .

3. Fees for pilotage during daylight hours . The fees for pilotage in the Port during daylight hours shall be as specified in the Schedule below:

NOTE . ( 1 ) The fees levied under this scale shall include the services of the Pilots and the services of launches with the crew , and exclude the services of the Tugs engaged in the Mooring or Unmooring operation of the vessel .

(2) " Registered Ton" referred to under columns ( 3 ) and ( 4 ) relating to "Charges payable " in the schedule above is the Net Registered nnage on which all vessels are charged "Pilotage fees - Mooring or Unmooring Charges " .

( 3 ) The charges for services of the Tugs incurred shall be levied separately .

4. Night Pilotage Fees. For navigation of vessels between 18.00 hours and 06.00 hours , charges at the following rates shall be levied .

Foreign Vessel

15 Paise per Net Registered Ton of the Vessel .

Cuating Vessel .

9 Paise per Net Registered Ton of the Vessel.

NOTE. ( 1 ) The above charges shall be levied for services during the above specified hours for mooring / unmooring of vessel and also for shifting of vessels from one berth to another or in the same berth .

(2 ) The above charges are in addition to the charges leviable for ' Pilotage' , ' shifting charges' , ' mooring or unmooring charges' .

( 3 ) The charges shall be levied in cases of navigation commenced during the hours of darkness ( that is to say, betweenbetween 18.00 hours and 06.00 hours ) . For this purpose , the time of boarding the vessel by the Pilot shall be deemed as the commencement of navigation .

5. Detention fee . A fee of Rs . 300 /in respect of Coasting vessel and Rs . 450/ - in respect of Foreign Vessel shall be levied for first hour or part of an hour that a pilot is kept waiting on board any vessel at the Port of New Tuticorin beyond 30 minutes after boarding such vessel . Detention fee for every subsequent hour or part thereof shall be levied at the rate of Rs . 100/ - in respect of coasting vessel and Rs . 150 / - in respect of Foreign vessel .

6. Cancellation fee. A fee of Rs . 450 / in respect of Foreign vessel and Rs . 300/- in respect of Coasting vessel shall be levied when the services of pilots are re- quisitioned for pilotage but not utilised after the pilot boarding a vessel ,

NOTE. ( 1 ) The above charges are not leviable in cases of ( a) Cancellations received sufficiently in time before the Pilots boarding the vessels , and ( b ) cancellations caused under exceptional circumstances for reasons that could not be attributed to the vessels ' fault .

(2) The charges as above shall be levied not only in cases of cancellations of requisitions for outward pilotage of vessels but also for the can- cellations of requisitions for shifting of berths of vessels and re- mooring or for turning a vessel around in her berth or for remooring a vessel in the same berth due to position of heavy lifts .

7. Fees for on carrlage of pilot. If an outward bound vessel carries away a Pilot outside the port limits due to bad weather, compensation at the rate of Rs . 50.00 per hour shall be payable by the Master of the vessel till the pilot reports back for duty at the Port . In addition , thethe boarding and loading expenses of the Pilot on board the ships and the cost of sending him back to the Port shall also be payable by the Master of the vessel .

8. Fees for Shifting and Mooring or remooring of vessels . Fees at the following rates shall be levied :-

सा० का० ति ० 547 ( प्र ) केन्द्रीय सरकार, भारतीय पत्तन अधिनियम , 1908 ( 1908 का 15 ) की धारा 35 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए नब तूतीकीरिन महापत्तन में मार्गदर्शन तथा अन्य सेवाओं के लिए फीस के उदग्रहण को विनियमित करते हुए निम्नलिखित आदेश करती है , अर्थात्:--

( 1 ) इस आदेश का नाम नब तूतीकोरिन महापत्तन 1. संक्षिप्त नाम और प्रारम्भ मार्गदर्शन और अन्य सेवायें ( फीस ) आदेश , 1975 हृ ।

( 2 ) यह तुरंत प्रवृत्त होगा ।

2. परिभाषाएं इस आवेश में:--

( i ) 'दिन का समय ' से 06.00 बजे से 18.00 बजे तक का समय अभिप्रेत है ।

( ii ) 'पसन' से नव तूतीकोरिन महापत्तन अभिप्रेत है ।

( iii ) 'अनुसूची' से इस आदेश की अनुसुची अभिप्रेत है ।

3. विन के समय मार्गदर्शन फीस पत्तन में दिन के समय की मार्गदर्शन फीस ऐसी ोगी जैसी नीचे दी गई अनुसूची में विनिर्दिष्ट की गई है: --

टिप्पण. ( 1 ) इस मान पर उद्‌गृहीत फीस के अन्तर्गत पाइलाटों की सेवायें और लांचों तथा उनके कर्मीदल की सेवायें होंगी और यान का लंगर डालने या लंगर खोलने की संक्रिया में लगी हुई कर्षणनावों की सेवाएं इसमें सम्मिलित नहीं होगी ।

( 2 ) ऊपर अनुसूची में "संदेय प्रभार " से सम्बद्ध स्तंभ ( 3 ) श्रौर ( 4 ) के नीचे निर्दिष्ट "रजिस्ट्रीकृत टन " ऐसा शुद्ध रजिस्ट्रीकृत टन भार है , जिस पर जलयानों से "मार्ग- दर्शन फीस , लंगर डालने या लंगर खोलने के प्रभार " प्रभारित किए जाते हैं ।

( 3 ) कर्षणनावों की सेवाओं से उपगत प्रभार पृथकतः उद्‌गृहीत किए जायेंगे ।

4. रात्रि के समय मार्गवर्शम फीस जलयानों के 18.00 बजे से नौवहन के लिए निम्नलिखित दरों पर प्रभार उद्‌गुहीत किए जायेंगे :- 06.00 बजे के बीच

विदेशी' जलयान

जलयान के प्रति शुद्ध रजिस्ट्रीकृत टन पर 15 पैसा

तटवर्तीय जलयान

जलयान के प्रति शुद्ध रजिस्ट्रीकृत टन पर 9 पैसा

टिप्पण --( 1 ) उक्त प्रभार ऊपर विनिर्दिष्ट घंटों के दौरान जलयानों के लंगर डालने/ लंगर खोलने और यानों को एक बर्थ से दूसरे में या उसी बर्थ में स्थानान्तरण के लिए की गई सेवाओं के लिए उद्गृहीत किया जाएगा ।

( 2 ) उक्त प्रभार 'मार्गदर्शन ', ' स्थानान्तरण प्रभार ' , 'लंगर डालने या लंगर खोलने के प्रभार' के अतिरिक्त है ।

( 3) अंधकार के समय ( अर्थात् 18.00 बजे और 06.00 बजे के बीच ) प्रारम्भ किए गए नौवहन के मामलों में प्रभार उद्‌गृहीत किए जायगे । इस प्रयोजन के लिए पाईलाट के जल यान पर चढ़ने का समय नौवहन के प्रारम्भ का समय माना जाएगा ।

5. मिरोष फीस.-न्व तूलीकोरिन महापत्तन में किसी जलयान पर किसी पाइलाट को जलयान पर चढ़ने के पश्चात् 30 मिनट से अधिक समय तक प्रतीक्षा रत रखा जाता है तो प्रथम घंटे के लिए या घंटे के किसी भाग के लिए तटवर्ती जलयान की दशा में 300 रु ० और विदेशी जलयान की दशा में 450 रु ० की फीस उद्‌गृहीत की जाएगी । प्रत्येक पश्चात्वर्ती घंटे या उसके मार्ग के लिए तटवर्ती जलयान की दशा में 100 रु ० और विदेशी जलयान की दशा में 150 रु ० की फीस उद्‌गृहीत की जाएगी ।

6. रहकरण फीस मार्गदर्शन के लिए पाइलाटों की सेवाओं की अध्यापेक्षा किए जाने पर किन्तु पाइलाट के जलयान पर चढ़ने के पश्चात् उसकी सेवाओं का उपयोग न करने पर विदेशी जलयानों पर 450 रु ० और तटवर्ती जलयानों की बाबत 300 रु ० की फीस उद्गृहीत की जाएगी ।

टिप्पण ( 1 ) उक्त प्रभार

( क ) पाइलट के जलयान पर चढ़ने से पूर्व पर्याप्त समय के भीतर प्राप्त रद्दकरण ,

( ख ) असाधारण परिस्थितियों द्वारा होने वारेः रद्दकरण जो जलयान के दोष के कारण नहीं ,

के मामले में उद्‌ग्रहणीय न होंगे ।

( 2 ) उपरोक्त प्रभार , जलयानों के बर्हिगमन मार्गदर्शन के लिए अध्यपेक्षाओं के रहकरण की बाबत ही नहीं उद्गृहीत किए जायेंगे अपितु जलयानों के बों के स्थानान्तण या पुनः लंगर डालने या अपने ही बर्थ में किसी जलयान को घुमाने या अधिक भार के कारण किसी जल यान को उसी बर्थ में पुनः लंगर डालने की अध्यपेक्षाओं के लिए भी उद्‌गृहीत किए जायेंगे ।

7. पाइलाट को साथ ले जाने के लिए फीस-यदि मौसम की खराबी के कारण कोई बहिर्गामी जलयान किसी पाइलाट को पत्तन की सीमाओं से बाहर ले जाता है तो जलयान का मास्टर 50 रु ० प्रति घंटा की दर पर तब तक प्रतिकर संदप्त करेगा , जब तक पाइलाट पत्तन पर वापस आकर ड्यूटी के लिए रिपोर्ट नहीं करता । इसके साथ ही पोत पर पाइलाट के आवास और आहार का खर्च और उसे पत्तन तक वापस भेजने का खर्च भी जलयान के मास्टर द्वारा संदेय होगा ।

8. जलयानों के स्थानान्तरण और लंगर डालने या पुनः लंगर डालने के लिए फी:-- फीस निम्नलिखित दरों पर उद्यणीय होगी-

टिप्पण. फीस के अन्तर्गत , पाइलाटों की सेवायें कर्मीदल सहित लांचों की सेवाएं आती है भौर स्थानान्तरित करने या पुनः लंगर डालने की संक्रिया में या दोना म लगी कर्ण नावों की सेवाएं नहीं श्रांती ।

In exercise of the powers conferred by sub - section ( 1 ) of section 35 of the Indian Ports Act , 1908 ( 15 of 1908 ) , the Central Government hereby directs that , with immediate effect , the fees as specified in the schedule annexed hereto shall be levied for services rendered to vessels at the Major Port of New Tuticorin.

SCHEDULE

Charges for night and holiday work

1. Applications for work during the second and third shift and on Sundays and Port's holidays should reach the Traffic Manager in writing not later than 12.00 Noon on week days and 11.00 A.M. on Saturdays .

2. The application should give in detail the name of the vessel , the period , nature of cargo and the nature of work and the berth where the work is to be done . Applications received after the periods specified shall not ordinarily be considered .

The applications should be in the prescribed form ,

3. The minimum period for which night and holiday work shall be applied for and charges levied shall be half of a shirt ,

4. The fees detailed in the Table below shall be leviable for landing , ship- ment or both or any other handling of cargo , done by a vessel at all berths or moorings or points , whether with Port's or outside labour .

5. Night work in respect of a ship shall commence from the second shift . that is to say 02.00 p.m. and for delivery of cargo and for entry of exports from 06.00 p.m.

6. Permission for holiday work on Port's holidays shall be restricted to any vessel which the Traffic Manager consider " emergent" .

7. Night and holiday work as per the Table below shall be charged for admittance of cargoes for shipment to a vessel that has not applied for work and for work not connected with any vessel after 06.00 p.m. and for delivery of cargo landed from a vessel that has not applied for work after 6.00 p.m.

8. If steamer Agent works for import or export cargo of a vessel and if a shipper or consignee also work for the same vessel, no charge shall be made against the shipper or consignee if the Steamer Agents have applied for night and holiday work for shipment or landing .

9. No landing and shipment work shall be permitted during recess hours . However , this shall not apply to tankers discharging bulk oil to in- stallations and shipment of bulk oil from installations to vessels , vessels bunkering fuel oil or to vessels discharging or loading liquid cargo by pumping in bulk .

10. No reduction in the night and holiday charges laid down in the Table shall be allowed due to any recess period that the Port may fix from time to time .

11. Two hours' clear notice in writing shall be given of cancellation of night and holiday work . If cancelling orders are not received in writing for each application , night and holiday charges for the full period applied for shall be charged as per Table given below: -

NOTE . Delivery of import cargo and admission of cargo for shipment will be allowed on all working days from 10.00 a.m. to 06.00 p.m. without levy of night and holiday charges , For delivery of cargo and admission of cargo for shipment, the periods 06.00 a.m. to 10.00 a.m. and from 6.00 n.m. to 10.00 p : m: on all week days for levy of night and holiday charges will be reckoned as half a shift .

सा०का ० नि० 548 ( प्र) - केन्द्रीय सरकार , भारतीय पत्तन अधिनियम , 1908 ( 1908 का 15 ) की धारा 35 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निदेश देती है कि इससे उपाबद्ध अनुसूची में नव तूतिकोरिन महापत्तन में जलयानों पर की गई सेवाओं के लिए यथा- विनिर्दिष्ट फीसें तुरन्त उद्‌गृहीत होंगी ।

अनुसूची

रात्रि तथा अवकाश कार्य के लिए प्रभार :

1. द्वितीय और तृतीय पारी के दौरान तथा रविवारों और पत्तन अवकाश दिनों पर कार्य के लिए आवेदन यातायात प्रबन्धक को लिखित रूप में सप्ताह दिवसों के मध्याह्न 12 बजे तथा रविवारों को पूर्वाह्न 11-00 बजे तक पहुंचने चाहिए ।

2. आवेदन में जलयान का नाम , अवधि व्यौरा की प्रकृति और कार्य का स्वरूप तथा वह बर्थ जहां कार्य किया जाना है , विस्तृत रूप में दिया जाना चाहिए । विनिश्चित अवधि के पश्चात्प्राप्त श्रवदनों पर सामान्यतः विचार नहीं किया जाएगा ।

आवेदन विह्नित प्ररूप में होने चाहिएं ।

3. वह न्यूनतम अवधि , जिसके लिए रात्रि और अवकाश दिवस कार्य के लिए आवेदन किया जाएगा और प्रभार उद्घहीत किए जाएंगे आधी पारी की होगी ।

4. नीचे की सारणी में विस्तृत रूप में दी गई फीसें, सभी बयों नवबंधों या बिन्दुओं पर चाहे पत्तन के या बाहरी श्रमिकों द्वारा किसी जलयान से किए गए अवतरण , नवप्रेषण या दोनों या स्थोरा के कोई अन्य कार्य के लिए उग्रणीय होंगी ।

5. किसी पोत की बाबत रात्रि का कार्यद्विर्ती पारी से प्रारम्भ होगा , अर्थात् 02.00 अपराहन से तथा स्थोरा के परिदान और आयात के प्रवेश के लिए 06.00 से प्रारम्भ होगा ।

6. पलन के अवकाश दिनों पर अवकाश दिवस कार्य के लिए अनज्ञा किसी ऐसे जलयान तक निबन्धित होगी जिसे यातायात प्रबन्धक ' "आपातिक" समझें ।

7. 06.00 बजे अपराहन के पश्चात् नीचे की सारणी के अनुसार रात्रि और अवकाश दिवस कार्य पर किसी ऐसे जलयान पर नवप्रेषण के लिए स्थोरा के प्रवेश के लिए प्रभार्य होगा जिसको कार्य के लिए आवेदन नहीं किया और जो कार्य किसी जलयान के सम्बन्ध में नहीं हैं , 06.00 बजे अपराहन के पश्चातऔर किसी ऐसे जलयान से श्रवरित स्थोरा फे परिदान के लिए जिसके कार्य के लिए आवेदन नहीं किया गया है, प्रभार्य होगा ।

8. यदि स्टीमर अभिकर्ता किसी जलयान के श्रायात या निर्यात स्थोरा के लिए कार्य करता है, और यदि कोई नौप्रेषक यापरेषिती उसी जनयान के लिए कार्य करें, तो नौप्रेषक या परेषिती के विरुद्ध कोई प्रभार नहीं लगाया जाएगा, यदि स्टीमर अभिकर्ताओं ने नौप्रेषण या अवतरण के लिए रात्रि और अवकाश दिवसकार्य के लिए आवेदन किए हैं ।

9. विरामकाल के दौरान अवतरण और नौप्रेषण कार्य की अनुज्ञा नहीं दी जायेगी । फिर भी संस्थापनों का प्रमुंज तेल विसर्जित करनेवाले टैंकरों तथा संस्थापनों से जलयानों या ईअन तेल बंकर करने वाले जलयानों को या प्रपुंज में पम्प करने के द्वारा स्थोरा तरल विजित करने वाले या लदान करने वाले जलयानों को लागू नहीं होगा

10. किसी विरामकाल की अवधि के कारण जो पत्तन समय -समय पर नियत करे, सारणी में अधिकथित रात्रि और अवकाश दिवस प्रभारों में से कटौती मंजूर नहीं की जाएगी ।

11. रात्रि और अवकाश दिवस कार्य के रद्दकरण की दो घंटे की लिखित रूप में स्पष्ट सूचना दी जाएगी । यदि प्रत्येक आवेदन के लिए लिखित रद्द करना आदेश प्राप्त नहीं होते हैं तो आवेदन की गई पूरी अवधि के लिए रात्रि तथा अवकाण दिवस प्रभार नीचे वी गई सारणी के अनुसार प्रभारित की जाएगी:-

एक पारी के आधे या उसके भाग के लिए न्यूनतम 93.75 रु ० की सीमा में रहते हुए प्रति पारी 187.50 रु ०

(ख ) किसी तटवर्ती जलयान और विदेशी पोत द्वारा

श्राधी पारी या उसके किसी भाग के लिए 125 ६० की न्यूनतम की सीमा में रहते हुए 250 रु ० प्रति पारी

श्राधी पारी या उसके किसी भाग के लिए 125 रु ० कीन्यूनतम की सीमा में रहते हुए 125 रु ० प्रति पारी ।

2. रविवार के दिन तथा अवकाश के दिन प्रथम पारी/ द्वितीय पारी/ तृतीय पारी के दौरान किए गए कार्य के लिए ।

(क) विदेशी यान द्वारा

श्राधी पारी या उसके किसी भाग के लिए 187.50 रु ० की न्यूनतम की सीभा मं रहते हुए 375 रु ० प्रतिपारी

आधी पारी या उसके किसी भाग के लिए 95.75 रु० की न्यूनतम की सीमा में रहते हुए 187.50 रु० प्रति पारी ।

विदेशी पाल पोत द्वारा । (ख ) किसी तटवर्ती जलयान और श्राधी पारी या उसके किसी भाग के लिए 125 रु ० कीन्यूनतम की सीमा में रहते हुए 250 रु ० प्रति पारी

3. आयात स्योरा के परिधान या नौत्रेषण के लिए स्योरा का प्रवेश होने देने के लिए ग्रहण करना जब तक यान काम नहीं कर रहा है ।

आधी पारी या उसके किसी भाग के लिए 37.50 रु० की न्नयूतम की सीमा में रहते हुए प्रत्येक आत्रेदक से प्रतिपाते 75 रु ० ।

( क) कार्य दिन 06.00 बजे अपराह्न से 10.00 बजे श्रपराल तक ।

( i) 10.00 बजे अपराह्न से 06.00 बजे पूर्वाह्न तक ।

( ii ) 06.00 बजे पूर्वाह्न से 10.00 बजे पूर्वाल तक ।

(ख ) रविवार के दिन और अवकाण दिनों पर प्रथम द्वितीय और तृतीय पारी के दौरान ।

टिप्पणः-आयात स्थोरा का परिक्षान और नौप्रेषण के लिए स्थोरा का ग्रहण सभी कार्य दिनों में 10.00 बजे पूर्वाह्न से 06.00 बजे अपराह्न तक रात्रि और अवकाश दिन के प्रभारों के बिना अनुज्ञात किया जाएगा । स्योरा के परिदान और नौप्रेषणहेतु स्थोरा के ग्रहण के लिए सप्ताह के सभी दिनों को , रात्रि और अवकाश दिन प्रभार के लिए 06.00 पूर्वाल्ल से 10.00 बजे पूर्वाहन तक और 06.00 बजे अपर। ल से 10.00 बजे अपराह्न तक का समय श्राधी पारी गिना जाएगा ।

G.S.R. 549 ( E ) . In exercise of the powers conferred by sub - section ( 1 ) of section 35 of the Indian Ports Act , 1908 ( 15 of 1908 ) , the Central Government hereby makes the following Order , namely : -

1. Short title and commencement.- ( 1 ) This Order may be called the New Mangalore Port Pilotage and other Attendant Services ( Fees ) Order , 1975 . ( 2) It shall come into force atonce .

2. Fees for Pilotage and other Attendant Services .- Fees for pilotage and other attendant services in the Port of New Mangalore shall be as specified in the Schedule appended to this order .

NOTES : I . In the above entries , ' ship ' means a vessel propelled solely by wind power and ' steamer' means any vessel other than a ship .

2. In respect of sailing vessels fitted with auxilliary engines entering the Port of New Mangalore , pilotage fees shall be charged at the rate applicable to ships .

3. The vessel for whose convenience adjacent berth or berths is or are kept vacant due to the nature of cargo to be handled at that particular berth or for any other reason shall be charged additional pilotage fees for each of the berth so kept vacant at the rate applicable to the particular vessel .

II . DETENTION CHARGES OF STEAMERS

(i) For cancellation of a requisition for the services of a Pilot with less than two hours notice to the Deputy Conservator

( ii ) For detention of a pilot by a steamer for more than thirty minutes beyond the time for which the requisition was made

NOTES. 1. In cases where a pilot boards a steamer but has to return on being informed that his services are not required " cancellation charges specifled in sub - item ( i ) above shall be levied .

2. If a pilot is made to wait for more than 30 minutes after boarding the steamer and is being informed that his services are not required 'detention charges ' specified in sub - item ( ii ) above shall be levied in addition to cancellation . Charges of tugs , if any , specified for the hire of Port's tugs .

Provided that the Deputy Conservator may at his discretion , waive the whols or part of the detention or cancellation charges or tug hire so incur- red, if the detention or cancellation was due to circumstances beyond the control of the Master of the steamer and if the Pilot certifies to that effect in writing .

III . SURCHARGE

A surcharge of 57.5 per cent on the rates specified above shall be payable in addition by vessels , not being home trade vessels , employed in trading between any Port or place in India and any other Port or place outside India or between Ports or places outside India .

सा ० ११० नि ० 594 ( श्र) . भारतीय पत्तन अधिनियम , 1908 ( 1908 का 15 ) की धारा 35 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार निम्नलिखित आदेश करती है, अर्थात् : --

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इस आदेश का संक्षिप्त नाम नव मंगलौर पत्तन मार्गदर्शन और अन्य श्रनुषगिक सेवाए (फ़ीस ) आदेश , 1975 हैं ।

( 2 ) यह तुरन्त प्रवृत्त होगा ।

2. मार्गदर्शन और अन्य श्रानुषंगिक सेवाश्रों के लिए फीस-नव मंगलौर पत्तन में मर्ग- दर्शन और अन्य आनुषंगिक सेवाओं के लिए फीस वह होगी जो इस आदेश से उपाबद्ध अनुसूची में विनिर्दिष्ट है ।

विध्पण.-

1. उपर्युक्त प्रविष्टियों में ' पोत' से पूर्णतया वायु शक्ति से नोदित जलयान अभिप्रेत है और 'स्टीमर' से पोत से भिन्न कोई जलयान अभिप्रेत है ।

2. नव मंगलौर पत्तन में प्रवेश करने वाले , अतिरिक्त इजनों से युक्त पाल-जलयानों की बाबत, मार्गदर्शन फ़ीस पोतों को लागू दर पर प्रभारित की जाएगी ।

3. ऐसे जलयान से , जिसकी सुविधा के लिए निकटवर्ती बर्थ या बर्थों, बर्थ विशेष पर सम्भाले जाने वाले स्थोरा की प्रकृति के कारण रिक्त रखी आए या रखी जाएं , जलयान विशेष को लागू दर पर , इस प्रकार रिक्त रखी गई प्रत्येक बर्थ के लिए , अतिरिक्त मार्गदर्शन फ़ीस प्रभारित की जाएगी ।

( II ) स्टोमरो को रोव मे के प्रभार

( i)

प्रति जलयान 500 रु ०

उप संरक्षक को दो घण्टे से कम समय की सूचना देकर पायलट की सेवाओं की मांग के रद्दकरण के लिए

( ii ) उस समय के पश्चात्, जिसके लिए मांग की गई थी, तीस मिनट से अधिक समय के लिए किसी स्टीमर द्वारा पायलट को रोकने के लिए

प्रति जलयान 300 रु ०

प्रथम षण्टे या उसके भाग के लिए

प्रति जलयान 100 रु ०

प्रत्येक पश्चात्वर्ती घण्टे या उसके भाग के लिए

हिव्पण.-1. ऐसे मामलों में, जहां पायलट स्टीमर पर चढ़ता है , किन्तु उसे यह सूचित किए जाने पर वापस जाना पड़ता है कि उसकी सेवाएं अपेक्षित नहीं हैं , ऊपर उपमद ( 1 ) में विनिर्दिष्ट " रकरण प्रभार " उद्‌गृहीत किए जाएंगे ।

2. यदि पायलट को स्टीमर पर चढ़ने के पश्चात् 30 मिनट से अधिक समय के लिए प्रतीक्षा करनी पड़ती है और उसे यह सूचित किया जाता है कि उसकी सेवाएं प्रपेक्षित नहीं हैं, तो ऊपर उपमद ( ii ) में विनिर्दिष्ट " रोकने के प्रभार " , पत्तन की कर्ण नावों के भाड़े पर लिए जाने के लिए विनिर्दिष्ट, रद्दकरण प्रभार , कर्णनाव-प्रभारों , र्याद कोई हों, के अतिरिक्त उद्गृहीत किए जाएंगे THE GAZETTE OF INDIA EXTRAORDINARY

परन्तु उपसंरक्षक, स्वविवेकानुसार , इस प्रकार उपगत , रोकने या रद्दकरण प्रभारों या कर्णनाव के भाड़े को पूर्णतः या भागतः अधित्यजित कर सकेगा जब कि रोका जाना या रद्दकरण स्टीर के मास्टर के नियंत्रण के बाहर की परिस्थितियों के कारण था, और पायलट लिखित रूप में उस प्राशय का प्रमाणपत्र दे देता है ।

III अधिभार

भारत में किसी पत्तन या स्थान और भारत के बाहर किसी अन्य पत्तन या स्थान के बीच अथवा भारत के बाहर पत्तनों या स्थानों के बीच व्यापाररत जलयानों द्वारा , जो स्वदेशी व्यवसाय जलयान नहीं है , ऊपर विनिदिष्ट दरों पर 57.5 प्रतिशत का प्रधिभार अतिरिक्त रूप से संदेय होगा ।
