S.O. 665 (E ) /18E/IDRA/75.-Whereas the Central Government has , by its notified order in Ministry of Industry and Civil Supplies , No. S.O. 508 ( E) , dated 12th September , 1975 , issued under the clause ( a) of sub - section ( 1 ) of section 18AA of the Industries (Development and Regulation) Act , 1951 ( 65 of 1951 ) authorised Shri M. K. Modwel to take over the management of the Industrial Undertaking known as M/s . Sen Raleigh Industries Limited, Calcutta (hereinafter in this order referred to as the industrial undertaking ) , for the periods specified therein;
Now , therefore , in exercise of the powers conferred by sub - section ( 2) of section 18 (E) of the said Act , the Central Government hereby specifies in the schedule annexed hereto the exceptions , restrictions and limitations subject to which the Companies Act , 1956 (1 of 1956 ) shall continue to apply , to the industrial undertaking in the same manner as it applied thereto before the issue of the said notified order under section 18AA .

फो० प्रा० 665 ( प्र) / 18 उ ०/ ३० वि० वि ० प्र०/ 75 .--केन्द्रीय सरकार ने , उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 फक की उपधारा ( 1 ) के खण्ड ( क ) के अधीन जारी किए गए उद्योग और नागरिक पूति मंत्रालय के अधिसूचित आदेश सं ० का ० ग्रा ० 508 ( अ) , तारीख 12 सितम्बर, 1975 द्वारा श्रो एभ ० के ० माडोल को मैसर्स सन रेलेद्द इण्डस्ट्रीज लिमिटेड, कलकता ( जिसे इस आदेश में इसके पश्चात् औद्योगिक उत्क्रम कहा गया है ) के नाम से ज्ञात ओद्योगिक उपक्रम का प्रवन्ध उसनें विनिर्दिष्ट अवधियों के लिए ग्रहण करने के लिए प्राधिकृत किया है ;
अतः, अज, फेन्द्रोन सरकार, उक्त अधिभिधन की धारा 18 ( ङ) की उपधारा ( 2 ) द्वारा प्रदत शक्तियां का प्रयोग करते हुए इससे उनबद्ध अनुसूची में उन छूटों, निर्वन्धनों और सीमाओं को विनिर्दिष्ट करतो है जिनंत अवान रहते हुए कम्पनी अधिनियम , 1956 ( 1956 का 1 ) औद्योगिक उपक्रम को उस रीति से लागू होता रहेगा जैसे बद्धारा 18 कक के श्रवीन उक्त अधिसूचित श्रादेश के जारी करने से पूर्व लागू होता था ।

वे छूटे, निर्वन्धन और सीमाएं जिनके अधीन रहते हुए स्तम्भ ( 1 ) में वर्णित उपबन्ध उपक्रम को लागू होंगे

Ancillary Indus- tries (Lugs) Private Limited , Calcutta ( hereinafter in this order referred to as the industrial undertaking ) , for the periods specified therein;

अतः , अब , केन्द्रीय सरकार, उक्त अधिनियम की धारा 18 (ङ ) की उपधारा ( 2 ) द्वारा प्रदत्त शक्ति रों का प्रयोग करते हुए इससे उपाबद्ध अनुसूची में उन छूटों, निर्बन्धनों और सीमाओं को विनिर्दिष्ट करनी है जिनके अधीन रहते हुए कम्पनी अधिनियम, 1956 ( 1956 का 1 ) प्रौद्योगिक उपक्रम को उस रीति से लागू होता रहेगा जैसे वह धारा 18 कक के अधीन उक्त अधिसूचित श्रादेश के जारी करने से पूर्व लागू होता था ।

अतः , अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 18 ( ङ ) की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए इससे उपावद्ध अनुसूची में उन छूटों, निर्बन्धनों और सीमाओं को विनिर्दिष्ट करती है जिनके अधीन रहते हुए कम्पनी अधिनियम , 1956 ( 1956 का 1 ) औद्योगिक उपक्रम को उस रीति से लागू होता रहेगा जैमे वह धारा 18 कफ के अधीन उक्त अधिसूचित आदेश के जारी करने से पूर्व लागू होता था ।
