SUBJECT-- Import of Fruits , dried , salted or preserved all sorts , NOS excluding Dates [ S. No.No. 21 ( a) ( ii ) / IV ] , ( il )( il ) Dates [ S. No. 21 ( b ) /IV ] , ( lit ) Medicinal Herbs ( Crude Drugs ) ( S. No. 87-109 / IV ) , ( iv ) Asafoetida [ S. No. 31 ( b ) / V ] and other Miscellaneous items from IRAN during November , 1975-October , 1976 .
No. 122 - ITC ( PN)/ 75 . It has been decided to grant licences for import of various commodities from Iran during November , 1975-October , 1976 , to the Established Im- porters , having past imports within the prescribed basic years , as shown against each item in Annexure I to this Public Notice . The licensing policy for each item has been indicated in Col. 6 of the aforesaid Annexure .
2. The Established Importers , eligible in terms of the current policy , may submit their applications to the respective licensing authority viz . Jt . Chief Controller of Imports & Exports , Bombay or Jt . Chief Controller of Imports & Exports ( Central Licensing Area) ,

New Delhi on or before the 26th December , 1975 in the usual form and manner . No past import documents are required to be produced , provided such documents were submitted to the licensing authorny concerncu in the past and were accepted by them for issue of licences for import of commoanties from Iran indicated in Anneхше 1. They should , however , quote details of licences obtained in the preceding two periods . Where , however , the Established importers are appiying for the first time , they are required to produce unimpeachable documents relating to past imports from Iran in respect of the items as in Annexure 1 for any one year within the prescribed basic years .
3. It has also been decided that the importers , who are eligible in terms of Annexure II to this Public Nouce will also be granted licences for import of Dry Fruits only from Iran on equal value basis of Rs . 8,500/- cach . They may submit their applications for import of Dry Fruits only from Iran for November , 1975-October , 1976 licensing period to the St. Chief Controller of Imports & Exports ( Central Licensing Area) , New Dethi on or before the 26th December , 1975 in the usual form and manner , complete in all respects .
4. The minimum value of licences for dry fruits will be Rs . 8,500/- . The minimum value of licences for Dates , Asafoetida and Gums & Resins licensable on quota percen- tage basis , will be Rs . 1000/ - for the year . It is , however , clarified that in the case of transfer /division of quota by Established Importers relating to above cases , the succeeding parties will be enutled to get licences in proportion to their share in approved quota of the original firm as provided in Para 45 (2) of the 1.T.C. Hand Book of Kwies and Procedure , 1975-76 . Where the licences are issued on equal value basis in terms of this Public Notice , the entitlement of each party is to be divided propor- tionately among the split up concerns of the parent firm , in case of transfer /division of quota rights .
5. It may be noted that no double benefit will be given in respect of Dry Fruits , which is permitted for import both under Annexure 1 and Annexure II . The applicants for dry fruns should submit only one application either in terms of Annexure I or in terms of Annexure II, and they should clearly mention in their application that they have applied in one capacity only and not under both.
6. Established Importers , holding quota certificates for Crude Drugs on General Currency Area , which includes Iran, who are desirous of claiming licences under this policy have to have past imports of Crude Drugs from Iran in a different basic year than the one for which they hold quota certificates on General Currency Area. Evidence to this effect should be produced to the licensing authority , so that no double benefit accrues in respect of the same past imports .
7. Licensing will be done within the monetary limit fixed for each item . All incom- plete applications are liable to be rejected .
8. Import licences granted in eligible cases will be valid for import from Iran either by sailing vessels or land route . In the case of Dry Fruits , import will be allowed by steamships upto the full face value of the licences and such imports will be on c.i.f. basis . In the case of Dates import may be effected by land route , sailing vessels or steamship of either country whichever is available earliest if the licenses so desire at any time during the validity period of the licences .
9. Import licences issued in pursuance of this Public Notice will be valid upto 31st December, 1976 and will not be extended .
10. The provisions of Paragraph 119 and 120 of Section I of the Import Trade Con- trol Policy Book (Vol . I) for the period April , 1975-March , 1976, relating to minimum and maximum value of licences will not apply to the licences issued in terms of this Public Notice .
11. Attention of importers of asafoetida is invited to the Prevention of Food Adul- teration Rules and in their own interest, they are advised to ensure that asafoetida imported from Iran conforms to the specifications prescribed under the aforesaid rules. In order to ensure that the asafoetida imported by the importers conforms to the pres- cribed standard , Port Health Organisations will test each consignment of asafoetida. Port Health Organisations after testing cach consignment will seal the asafoetida (Hing ) bags under their own seal . These bags may not be further subjected to testing by State/ Local bodies so long as their seals are intact and there is no evidence that the bags have been tampered with unless there are some special reasons for the same.

विषय. नवम्बर , 1975 से अक्तूबर, 1976 के दोरान फलों , मेवे , नमकीन अथवा हर प्रकार के परिरक्षित खजूरों को छोड़कर अन्यथा जो उल्लिखित नहीं है [क्रम सं ० 21 ( ए ) ( 2 ) / 4] , ( 2 ) खजूर , क्रम सं ० 21 (बी) / 4, ( 3 ) औषधीय बूटियां ( अपरिष्कृत श्रौषधियां) क्रम सं ० 87-109/ 4 ] , ( 4) हींग ( क्रम सं ० 31 (वी ) / 5 तथा अन्य विविध मदों का ईरान से आयात ।
संख्या 122 - आई ० टी ० सी० ( पी० एम० ) /75.-प्रस्तुत सार्वजनिक सूचना के अनुबन्ध -1 के लिए दिखाई गई मदों में से हर एक अलग मद के लिए नवम्बर , 1975 से अक्तूबर , 1976 की अवधि के लिए संस्थापित श्रायातकों को, जिन्होंने विहित आधार भूत वर्ष में आयात किया था , ईरान से विभिन्न पदाथौ के आयात के लिए लाइसेंस देने का निश्चय किया है । हर एक भद के लिए लाइसेंस देने की नीति णित अनुबन्ध के कालम -6 में बताई गई है ।
2. वर्तमान आयात नीति के अन्तर्गत पान्न संस्थापित आयातकों को चाहिए कि वे अपना आवे- दन पत्र संबंधित लाइसेंस जारी करने वाले प्राधिकारी अर्थात् संयुक्त मुख्य नियंत्रक , श्रायात -निर्यात, बम्बई या संयुक्त मुख्य नियंत्रक ( केन्द्रीय लाइसेंस क्षेत्र ) , नई दिल्ली को विहित प्रपत्त में श्रीर विधिरूप से 26 दिसम्बर , 1975 तक अथवा उससे पहले भेज दें । पिछले किए गए आयात से सम्बद्ध दस्तावेजों कोप्रस्तुत करने की आवश्यकता नहीं है बशर्ते कि उन दस्तावेजों को सम्बद्ध लाइसेंस प्राधिकारी को ईरान THE GAZETTE OF INDIA EXTRAORDINARY

से पदार्थों के आयात लाइसेंसों के लिए , जिन पदार्थों का उल्लेख अनुबन्ध -1 में किया गया है , पहले भेजा गया था और वे मन्जूर कर लिए गए थे । परन्तु , उनके लिए यह आवश्यक होगा कि उन्होंने पूर्व दो अवधियों में जो लाइसेंस लिए थे , उनका ब्यौरा दें, परन्तु जहा संस्थापित श्रायातक पहली बार पत्र भेज रहे हैं, उन्हें चाहिए कि विहित आधार पर भूत वर्ष में से किसी भी एक वर्ष में ईरान से आयात की गई मदों का , जिनका ब्यौरा अनुबन्ध -1 में दिया गया है , उससे संबंधित संशयातीत दस्तावेजों को प्रस्तुत करें ।
3. यह भी निश्चय किया गया है कि ऐसे आयातक , जो प्रस्तुत सार्वजनिक सचना के अनुबन्ध-2 के अन्तर्गत योग्य हैं , उन्हें केवल ईरान से प्रत्येक 8,500 रुपये के समान मूल्य के आधार पर सूखे फलों के श्रायात के लिए लाइसेंस भी दिए जाएगे । उन्हें चहिए कि वे नवम्बर , 1975 से अक्तूबर , 1976 की लाइसेंस अवधि के लिए ईरान से केवल सूखे फलों के आयात के लिए आवेदन -पत्तों को हर प्रकार से पूरा करके विहित प्रपत्र में और विधि रूप से सयुक्त मुख्य नियंत्रक, आयात-निर्यात ( केन्द्रीय लाइसेंस क्षेत्र ) , नई दिल्ली को 26 दिसम्बर , 1975 तक अथवा उससे पहले भेज दें ।
4. सुखे फलों के लिए लाइसेंसों का न्यूनतम मूल्य 8,500 रुपये होगा । खजूर , हींग और गोंद तथा रेजिन्स जो कोटा प्रतिशतता के आधार पर लाइसेंस के योग्य है , उनके लिए वर्ष के लिए लाइसेंस का न्यूनतम मूल्य 1000 रुपये होगा । लेकिन, इस बात का स्पष्टीकरण किया जाता है कि उपर्युक्त मामलों से संबंधित स्थापित श्रायातकों द्वारा कोटा के स्थानान्तरण/विभाजन की स्थिति में आयात व्यापार नियंत्रण नियम और कार्यविधि , हैंडबुक 1975-76 की कंडिका 45 ( 2 ) में दी गई व्यवस्थाओं के अनुसार अनुवर्ती पार्टियां मूल फर्म के स्वी कृत कोटे में से अपने हिस्से के अनुपात में लाइसेंस प्राप्त करने के अधिकारी होंगी । प्रस्तुत सार्वजनिक सूचना के अनुसार जहां समान मूल्य के आधार पर लाइसेंस दिए जाते हैं, कोटा अधिकारों के स्थानान्तरण/ विभाजन होने की स्थिति में मूल फर्म से संबंधित बिपाटी के भीतर हर एक पार्टी के हक का श्रनुपातिक रूप से आवंटन किया जाता है ।
5. यह ध्यान रहे कि सूखे फल जो अनुबन्ध-1 तथा 2 दोनों के अन्तर्गत आयात के लिए अनु- शप्त है, इनके सम्बन्ध में दोनों प्रकार के लाभ नहीं दिए जाएंगे । सूखे फलों के श्रायात करने वाले आवेदकों को चाहिए कि वे या तो अनुबन्ध -1 की शर्तों के अनुसार अथवा अनुबन्ध-2 की शर्तों के अनुसार केवल एक ही आवेदन पत्न भेजें और उन्हें चाहिए कि वे अपने आवेदन पल्लों में स्पष्ट रूप से लिख दकि उन्होंने केवल एक के लिए आवेदन पत्न भेजा है न कि दोनों के लिए ।
6. सामान्य मुद्रा क्षेत्र , जिसमें ईरान सम्मिलित है, से अपरिष्कृत भेषजों के लिए कोटाधारी संस्थापित मायातक जो इस नीति के अन्तर्गत लाइसेंस प्राप्त करने के इच्छुक हैं, उनके लिए यह अनिवार्य है कि जिस वर्ष के लिए उनके पास सामान्य मुद्रा क्षेत्र के लिए कोटा प्रमाण-पत्र है , उससे भिन्न किसी एक मूल वर्ष में , भूतकाल में उन्होंने ईरान से अपरिष्कृत भेषजों का आयात किया हो । इस सम्बन्ध में , लाइसेंस प्राधिकारी को साक्ष्य प्रस्तुत करना चाहिए जिससे कि भूतकाल में किए गए एक ही प्रकार के मायातों के लिए दो तरफा लाभ उपार्जित न किया जाए ।
7. हर एक मद की निश्चित मौद्रिक सीमा के भीतर ही लाइसेंस दिया जाएगा । सभी अधूरे आवेदन-पत्रों को अस्वीकृत कर दिया जाएगा ।
8. वैध मामलों में दिए जाने वाले आयात लाइसेंसों का ईरान से नौप्रस्थान पोतों अथवा मार्गों से भायात के लिए वैध माना जाएगा । सूखे फलों के मामले मे , लाइसेंसों के पूरे अंकित मूल्य तक पोतनाब द्वारा आयात करने की इजाजत होगी और ऐसे आयातों का आधार लागत -त्रीमा - भाड़ा होगा ।

यदि लाइसेंसों की वैधता अवधि के समय लाइसेंसधारी किसी समय ऐसा चाहे तो खजूरों के मामले में आयात स्थल मार्ग , नावपोतों या किसी भी देश के पोतों- जो भी पहले उपलब्ध हो उसी के द्वारा किया जा सकता है ।
9. प्रस्तुत सार्वजनिक सूचना के विषय में जारी किए गए लाइसेंस 31 दिसम्बर , 1976 तक वैध होंगे तथा भविष्य में उनकी अवधि नही बढ़ाई जाएगी ।
10. अप्रैल , 75-मार्च , 76 अवधि के लिए आयात व्यापार नियंत्रण नीति पुस्तक (बा ० 1 ) के खंड 1 की कंडिका 119 और 120 में दी गई व्यवस्थाएं जो लाइसेंसों के न्यूनतम तथा अधिक- तम मूल्य से संबंधित है , इस सार्वजनिक सूचना के अनुसार जारी किए गए लाइसेंसों के लिए लागू नहीं होगी ।
11. हींग के आयातकों का ध्यान खाय मिलावट निरोधक नियमों की ओर दिलाया जाता है और उनके निजी हित के लिए उन्हें यह सुनिश्चित करने की सलाह दी जाती है कि ईरान से आयात किया हींग पूर्वोक्त नियमों के अन्तर्गत निर्धारित विशिष्टिकरणों के अनुसार हो । यह सुनिश्चित करने के लिए कि आयातकों द्वारा आयात किया गया हींग निर्धारित मानक के अनुरूप है , पत्तन पर स्वास्थ्य संगठन हींग के प्रत्येक परेषित माल का परीक्षण करेगा । प्रत्येक बार प्रेषित माल का परीक्षण करने के बाद पत्तन स्वास्थ्य संगठन अपनी निजी सील के अन्तर्गत हींग के थैलों को सीलबंध करेगा । इन थैलों को राज्य/ स्थानीय निकायों द्वारा श्रागे तब तक परीक्षण करने की आवश्यकता नहीं है जब तक उनकी सील सम्पूर्ण है और जब तक विशेष कारणों से यह साध्य नहीं मिलता है कि उन में सम्मिश्रण किया गया है ।

( 1) उन संस्थापित आया- तकों को जिन्होने अफगा- निस्तान से ताजे फलो का आयात पाच वर्षों के दौरान अपने खाते पर किया था जिसका अन्त 30-6-57 को हुआ ।

( 2) उन संस्थापित आया- तकों को जिन्होंने ताजे फलों का आयात 1951- 52 से लेकर 1970-71 तक की अवधि के दौरान किसी सामान्य क्षेत्र मे आने वाले देशों में अफगानिस्तान को छोड़ कर किन्तु पाकि- स्तान शामिल है , अपने बाते से किया हो ।
( 3 ) उन संस्थापित आया- नकों को जिनका ताजे फलों का आयात 1945- 46 से 1950-51 की अवधि के दौरान किसी सामान्य क्षेत्र से आने वाले देशों में अफगानिस्तान को छोड कर , जिनमें पाकि स्तान शामिल है , अपने खाते से किया हो, बशर्ते कि 1960-64 के दौरान पाकिस्तान से किए जाने वाले तदर्थ ताजे फलों के आयात लाइसेसों को लाइ- मेंस प्राधिकारी ने मंजूर कर लिया था ।
( 4) उन संस्थापित आया- तकों का जिनका सूखे फलों का आयात 1951-52 से लेकर 1970-71 की अवधि के दौरान उनके खाते में हो ।

समितियों को निम्नलिखित प्रस्तुत करने पर: --
(क) सम्बद्ध सहकारी समि- तियों के पंजीयक से इस संबंध मे एक प्रमाण पत्र कि सहकारी ममितियां अभी भी विद्यमान हैं ।
(ख) संलग्न प्रपत्र में एक शपथ-पत्र , देखें , अनुबन्ध-3
(ग) सनदी लेखापाल से इस संबंध में एक प्रमाण- पत्ता कि विलीय वर्ष 1967-
6,1969-69, 1969 70,1970-71 एवं 1971- 72के दौरान समिति का ताजे फलों का व्यवसाय 15,000 रुपये ( परब्रह हजार रुपये ) से कम नहीं था ।
यदि उपर्युक्त उप-कंडिका (ग) में यथा संदर्भित एक प्रमाण पत्र भत में प्रस्तुत कर दिया गया था और यह ईरान में सुखे फलों के आयात के लिए लाइसेंम जारी करने के लिए लाइ- मॅस प्राधिकारी द्वारा स्वीकार कर लिया गया था तो उसे पुनः प्रस्तुत करने की मावश्यकता नहीं है । केवल पूर्व के आवेदन पत्र जिसके साथ इस प्रकार का प्रमाण पत्र भेजा गया था, उसका संकेत कर देना चाहिए ।

शपथ - पत्र का प्रारूप
(सहकारी समिति का नाम ) के सचिव/ अध्यक्ष श्री . जिनका निवास स्थान . पत्त । सुपुत्त्र. है का शपथ-
मैं मैं उपर्युक्त नामक अभिसाक्षी एतद्वारा निष्ठापूर्वक शपथ लेता हूं और घोषणा करता हूं कि (सहकारी समिति का नाम ) की ओर मे इस शपथ पत्न की पुष्टि करने के लिए विधिवत् प्राधिकृत हूं और यह घोषणा करता हूं--
(1) कि.
( सहकारी समिति का नाम और पता ) ताजे फलों का व्याणर करती रही है और अब भी कर रही है ।
( 2) कि यदि उपर्युक्त पैरा ( 1 ) में उल्लिखित घोषणा गलत या झूठी पाई जाती है तो इस घोषणा के भ्राधार पर पूर्वोक्त सहकारी समिति को प्रदान किया गया कोई भी लाइसेंस सरकार द्वारा आरोपित किसी भी खंड या यथा संशोधित आयात और निर्यात (नियंत्रण) अधिनियम और श्रायात ( नियंत्रण ) आदेश , 1955 के अधीन की जाने. वाली किसी अन्य कार्रवाई को ध्यान में रखे बिना रद्द कर दिया जाएगा ।
