New Delhi , the 17th December 1975
G.S.R. 586(E ) .- Whereas the draft of the Motor Vehicles ( National Permits ) Rules , 1975 , was published as required by sub - section ( 1 ) of section 133 of the Motor Vehicles Act, 1939 (4 of 1939 ) at pages 2111 to 2116 of the Gazette of India , Extraordinary Part II , Section 3 , sub - section ( i ) , dated the 15th October , 1975 , under the notification of the Government of India in the Ministry of Shipping and Transport (Transport Wing ) No. GSR . 521 (E) dated the 15th October , 1975 , inviting objections and suggestions from all persons likely to be affected thereby upto a period of 45 days from the date of publication of the said notification in the Official Gazette ;
And whereas the said Gazette was made available to the public on the 18th October , 1975;
And whereas the objections and suggestions received on the said draft rules have been considered by the Central Government ;
Now, therefore , in exercise of the powers conferred by sub- section ( 15 ) of section 63 of the said Act , the Central Government hereby makes the following rules , namely:-
1 Short title , extent and commencement.-( 1 ) These rules may be called the Motor Vehicles ( National Permits ) Rules , 1975 .
(2) They shall extend to the whole of India .
(3 ) They shall come into force on the date of their publication in the Official Gazette .

2. Definitions . In these rules , unless the context otherwise requires ,
(a) " Act " means the Motor Vehicles Act, 1939 (4 of 1939 ) ;
(b) "authorisation " means a document issued by an appropriate authority to a public carrier throughout the territory carrier authorising him to operate as a public carrier of India or in such contiguous States as are specified in the national permit granted to him;
(c) " Schedule " means a Schedule appended to these rules ;
(d) " section" means a section of the Act ,
3. Forın, contents and duration etc. of the authorisation . ( 1 ) An application for the grant of an authorisation shall be made in the form set forth in the Fust Schedule .
(2) Every authorisation shall be made in the form set forth in the Second Schedule .
(3) The period of validity of an authorisation shall not exceed one year at a time .
4. Authorisation fee . ( 1) The fee for the grant of an authorisation shall be Rs . 500/- per annum and every application for the grant of the same shall be accompanied by a bank draft for the said amount in favour of the appropriate authority .
(2) The fee paid under sub - rule ( 1 ) shall be returned in full to an applicant who is not granted a national permit .
5. Maximum laden weight of a motor vehicle for the grant of a national permit.-No public carrier shall be granted a national pernit in respect of a motor vehicle which has a registered laden weight of more than 16,000 kgs . in the case of a rigid chassis vehicle or 20,000 kgs . in the case of an articulated vehicle or a tractor-trailer combination .
6. Age of the motor vehicle for the purposes of a national permit .-( 1 ) A national permit shall not be granted in respect of a motor vehicle which is more than four years old on the date of initial grant of the permit or is more than nine years old at any other point of time .
(2) When a vehicle covered by a national permit is proposed to be replaced by another vehicle , the latter vehicle shall be not more than four years old on the date of such replacement .
7. Distinguishing particulars to be exhibited on the motor vehicle .( 1 ) A motor vehicle plying under a national permit shall be painted in brown colour with 30 cms , broad white borders and the letters "NATIONAL PERMIT " shall be inscribed on two sides of the vehicle in bold letters within a circle of 60 cms . diameter .
(2) A board with the following inscriptions and with blue letters on white background shall be carried in the motor vehicle , such board being clearly visible above the " Public Carrier" board , namely:-

8. Bill of Lading to be carried by the motor vehicle . ( 1 ) A motor vehicle plying under a national permit shall at all times carry a Bill of Lading in the form set forth in the Third Schedule .
(2) Carriage of goods not in conformity with the declaration in the Bill of Lading shall be construed as an infringement of the conditions of the national permit , rendering the national permit holder liable for action under section 60 .
9. Quarterly Return to be filed by a national permit holder .--A national permit holder shall file a quarterly return , in respect of the motor vehicle covered by these rules in the form set forth in the Fourth Schedule to the appropriate authority of the State in which the national permit is issued and the said authority , in turn , shall forward copies thereof to the appropriate authorities of the other States concerned .
10. Matters to be borne in mind by the appropriate authority while granting a national permit . In addition to the matters specified in section 55 and section 63 , the appropriate authority shall , in granting a national permit , bear in mind the following matters , namely:--
(a) the contribution of the applicants to movement of goods between the States in the interest of the public;
(b) the experience of the applicants in the movement of goods on the basis of Regional , State and inter -State region permits;
(c) in the case of granting national permits to those holding inter- State permits , whether they have surrendered the required number of the latter permits so as to fall within the limits laid down in sub- section ( 13 ) of section 63 .

सा० का ० ति ० 586 ( भ) .--यतः मोटर गाड़ी ( राष्ट्रीय परमिट) नियम , 1975 का प्रारूप मोटर गाड़ी अधिनियम 1939 ( 1939 का 4) की धारा 133 की उपधारा ( 1 ) द्वारा यथा अपेक्षित भारत सरकार के नौवहन और परिवहन मंत्रालय ( परिवहन पक्ष) की अधिसूचना सं ० सा ० का ० नि० 521 ( ई ) दिनांक 15 अक्तूबर , 1975 के अधीन भारत के दिनांक 15-10-75 के राजपत्न , भ्रसाधारण भाग 2 खंड 3 , उपखंड ( 1 ) के पृष्ठ संख्या 2116 से 2122 पर प्रकाशित किया गया जिसमें उक्स अधिसूचना के राजपत्र में प्रकाशन की तारीख से 45 दिनों की अवधि तक उन सभी व्यक्तियों से भ्राक्षेप तथा सुझाव मांगे गये थे जिनके उससे प्रभावित होने की संभावना थी ।
और यत: उक्त राजपत्र जनता का 18 अक्तूबर, 1975 को उपलब्ध कर दिया गया ।
किया है । और यत : केन्द्रीय सरकार ने उक्त प्रारूप नियमों पर प्राप्त आक्षेपों और सुझावों पर विश्वार
अत : अब केन्द्रीय सरकार , उक्त अधिनियम की धारा 63 की उपधारा ( 15) द्वारा प्रदत्त शक्तियों को प्रयोग करते हुए एतद्वारा निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त नाम, विस्तार और प्रारम्भ ( 1) इन नियमों का नाम मोटर गाड़ी ( राष्ट्रीय परमिट) नियम 1975 है ।
(2 ) इसका विस्तार सम्पूर्ण भारत पर है ।
( 3) ये नियम राजपत्त्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं. इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -
(क) ' अधिनियम' से मोटर गाड़ी अधिनियम, 1939 ( 1939 का 4) अभिप्रेत है ।
(ख ) अनुज्ञप्ति से वे कागज अभिप्रेत हैं जिन्हें समुचित प्राधिकरण द्वारा सार्वजनिक वाहन के लिए जारी किया गया है । जिसमें उसे अधिकार दिया गया है कि भारत के सम्पूर्ण क्षेत्र में या ऐसे संलग्न राज्यों में जो राष्ट्रीय परमिट उन्हें दिये गये हैं, में निविष्ट किये गये हैं सार्वजनिक वाहनों के रूप में परिचालन कर सकते हैं ।
(ग ) अनुसूची से इन नियमों से उपाबद्ध अनुसूची अभिप्रेत है ।
( घ ) धारा से अधिनियम की धारा अभिप्रेत है ।

3. अनुज्ञप्ति का स्वरूप , विषय वस्तु और अवधि इत्यादि ( 1 ) अनुज्ञप्ति देने के लिए आवेदन पत्त प्रथम अनुसूची में बताये गये प्रपत्त्र में किया जाएगा ।
(2 ) प्रत्येक अनुज्ञप्ति द्वितीय अनुसूची में बताये गये प्रपत्त्र में होगी ।
( 3 ) अनुज्ञप्ति की वैधता की अवधि एक समय में एक साल से अधिक नहीं होगी ।
4. अनुज्ञप्ति शुल्क (1) अनुज्ञप्ति देने का शुल्क पांच सौ रुपये प्रतिवर्ष होगा और उसके लिए आवेदन पत्त्र उक्त राशि के बैंक ड्राफ्ट के साथ प्राधिकरण के नाम पर दिया जाएगा ।
( 2 ) उप नियम ( 1 ) के अधीन दिया गया शुल्क उस आवेदन कर्ता को पूरा लौटाया जायेगा, जिसे राष्ट्रीय परमिट नहीं दिया गया हो ।
5. राष्ट्रीय परमिट देने के लिए मोटर गाड़ी का अधिकतम लवाम-भार.--मोटर गाड़ी के लिए किसी भी सार्वजनिक वाहन को राष्ट्रीय परमिट नहीं दिया जाएगा यदि रिजिड चसिस गाड़ी की हालत में 16000 कि ० ग्रा ० अथवा जुड़वां गाड़ी अथवा ट्रैक्टर ट्रेलर कम्बीनेशन की हालत में 20 हजार कि ० ग्रा ० से अधिक पंजीकृत लदान भार है ।
6. राष्ट्रीय परमिट के प्रयोजन के लिए मोटर गाड़ी की प्रायु -( 1 ) उस मोटर गाड़ी के लिए राष्ट्रीय परमिट नहीं दिया जाएगा जो राष्ट्रीय परमिट देने को प्रारंभिक तारीख को 4 वर्ष से अधिक पुरानी हो अथवा किसी भी समय में 9 वर्ष से अधिक पुरानी हो ।
( 2) जब राष्ट्रीय परमिट की गाड़ी को किसी अन्य गाड़ी द्वारा बदलने का प्रस्ताव हो तो पश्चायुक्त गाड़ी बदलने के समय 4 वर्ष से अधिक पुरानी न हो ।
7. मोटर गाड़ो पर प्रशित किया जाने वाला विशेष ब्योरा ( 1) राष्ट्रीय परमिट के अन्तर्गत चलने वाली मोटर गाड़ी का रंग भूरा होगा जिसमें ( 30 से ० मी० ) चौड़ी सफेद , पट्टी होगी और उस पर गाड़ी के दोनों ओर बड़े अक्षरों में 60 से ० मी ० के ब्यास के वृत्त के अन्तर्गत " राष्ट्रीय परमिट " लिखा होगा ।
( 2) मोटर गाड़ी पर एक पटल होगा जिसमें सफेद पृष्ठ भूमि में नीले अक्षरों से निम्न- लिखित लिखा होगा ऐसा बोर्ड सार्वजनिक वाहनों के पटल के ऊपर साफ दिखायी देगा, अर्थात्: -
" राष्ट्रीय परमिट राज्य/ राज्यों में वैध"
8. मोटर गाड़ी द्वारा ले जाया जाने वाला लवान पत्र ( 1 ) राष्ट्रीय परमिट के अंदर चलने वाली मोटर गाड़ी हर समय तीसरी अनुसूची में बताये गये प्रपत्र में लदान पत्न रखेगा ।
(2) माल की ढुलाई लदान पत्त्र में जो घोषणा के अनुरूप न हो, उसे राष्ट्रीय परमिट की शर्तों का उल्लंघन समझा जाएगा और धारा 60 के अन्तर्गत राष्ट्रीय परमिट धारी पर कार्यवाही की जा सकती है ।

9. राष्ट्रीय परमिट बारी द्वारा फाइल की आने वाली तिमाही विवरणी.-- राष्ट्रीय परमिय्धारी इन नियमों के अन्तर्गत आने वाली मोटरगाड़ियों की बाबत उस राज्य जिसमें राष्ट्रीय परमिट जारी किया गया है , के समुचित प्राधिकरण को चोथी अनुसूची में बताये गये प्रपत्र में तिमाही विवरणी देगा और उक्त प्राधिकारण उसकी प्रतियां अन्य संबंधित राज्यों के समुचित प्राधिकरणों को अपनी ओर से भेजेगा ।
10. राष्ट्रीय परमिट बेते समय समुचित प्राधिकरण द्वारा वे मामले जिन्हें उन्हें ध्यान में रखना है.--धारा 55 और धारा 63 में निर्दिष्ट मामलों के अलावा समुचित प्राधिकरण राष्ट्रीय परमिट देते समय निम्नलिखित मामलों को ध्यान में रखेगा, अर्थात्:--
(क) जनता के हित में राज्यों के बीच माल को लाने ले जाने की ओर आवेदक का योगदान ।
(ख) क्षेत्रीय , राज्य और अन्तर्राज्यीय क्षेत्र परमिट के अधार पर माल के लाने ले जाने में आवेदक का अनुभव ।
( ग) उनको जिनके पास अन्तर्राज्यीय के परमिट हैं , की राष्ट्रीय परमिट देने के मामले में क्या उन्होंने पश्चादुक्त परमिटों को अपेक्षित संख्या में अभ्यर्पित कर दिया है ताकि वे धारा 63 की उपधारा 13 में निर्धारित सीमा के अन्तर्गत आ सकें ।
