NOTIFICATION
New Delhi , the 30th December , 1975
G.S.R. 597 ( E ) .- In exercise of the powers conferred by sub - section ( 1 ) of section 13 of the Central Sales Tax Act , 1956 ( 74 of 1956 ) the Central Govern . ment hereby makes the following rules further to amend the Central Sales Tax (Registration and Turnover ) Rules , 1957 , namely : -
1. ( 1 ) These rules may be called the Central Sales Tax ( Registration and Turnover) Amendment Rules , 1975 .
( 2 ) They shall come into force at once .
2. In the Central Sales Tax ( Registration and Turnover ) Rules , 1957 ( here- inafter referred to as the said rules ) , in rule 12 ,-
(i ) in sub - rule ( 1 ) -
(a) in the first proviso , for the word and figures " December , 1975 " the word and figures " December , 1976 " shall be substituted ;
(b) after the second proviso , the following proviso shall be inserted , namely: -
"Provided also that where , in the case of any transaction of sale , the delivery of goods is spread over to different financial years it shall be necessary to furnish a separate declaration or certi- flcate in respect of goods so delivered in each financial year . " ;

( ii ) in sub - rule ( 2 ) -
(a) after the words " indemnity bond" ,bond" , where they first occur , the words and letter " in Form G " , shall be inserted ;
(b) the following proviso shall be inserted at the end , namely : - "Provided that where more than one form of declaration is lost , the purchasing dealer or the selling dealer , as the case maymay be , may furnish one such indemnity bond to cover all the forms of declarations so lost . " ;
(iii) in sub - rule ( 5) in the third proviso , for the word and figures 'Decem- ber, 1975" , the word and figures "December , 1976 " shall be substituted .
3. In Form E - I appended to the said rules , in each of the portion relating to the " Original " , " Duplicate " and " Counterfoil " , the following shall be inserted at the end , namely: -
"Explanation . In this form, item D ( iii ) shall not be applicable in cases covered by the second proviso to sub - section ( 2 ) of section 6. "
4. In Form E- II appended to the said rules , the Explanation at the end in each of the portion relating to the " Original " , " Duplicate " and " Counterfoil" shall be renumbered as Explanation ( 1 ) and after Explanation ( 1 ) as so renumbered , the following Explanation shall be inserted , namely : -
"Explanation ( 2) . In this form , item D ( ill ) shall not be applicable in cases covered by the second proviso to sub - section ( 2 ) of section 6. "
5. After Form F. appended to the said rules , the following form shall be inser- ted , namely : -
"The Central Sales - tax ( Registration and Turnover ) Rules , 1957 .

WHEREAS sub - Rule ( 2 ) of Rule 12 of the Central Sales - tax ( Registration and Turnover ) Rules , 1957 requires that in the event a blank or a duly completed form of declaration is lost while it is in the custody of the purchasing dealer or in transit to the selling dealer , the purchasing dealer and as the case may be also a selling dealer each to furnish an indemnity bond to , in the case of purchas- ing dealer, the notified authority from whom the said form was obtained and in the case of a selling dealer , the notified authority of his State .

NOW the condition of the above written bond or obligation is such that the Obligor shall in the event of a loss suffered by the Government ( in respect of which the decision of the Government or the authority appointed for the purpose shall be final and binding on the Obligor ) as a result of the misuse of the Form , pay to the Government on demand and without demur the said sum of Rs .. स१० कॉ० नि ० 597 ( अ ) केन्द्रीय सरकार , केन्द्रीय विक्रय कर अधिनियम , 1956 की धारा 13 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय विक्रय कर ( रजिस्ट्रीकरण और श्रावर्त ) नियम 1957 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात :--
1. ( 1 ) इन नियमों का नाम केन्द्रीय विक्रय कर ( रजिस्ट्रीकरण और श्रार्वत ) संशोधन नियम 1975 है ।
( 2 ) ये तुरन्त प्रवृत्त होंगे ।
2 . केन्द्रीय विक्रय कर ( रजिस्ट्रीकरण और श्रावर्त ) नियम 1957 में ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) , नियम 12 में, -
( i) उपनियम ( 1 ) में,-
(क ) प्रथम परन्तुक में " दिसम्बर 1975 " शब्द और अंकों के स्थान पर "दिसम्बर 1976 " शब्द और अंक रखे जाऐंगे;.
(ख ) द्वितीय परन्तुक के पश्चात निम्नलिखित परन्तुक जोड़ा जाएगा :-- "परन्तु यह और कि जहां , किसी विक्रय के संव्यवहार की दशा में , माल का परिदान विभिन्न वित्तीय वषों में किया जाना हो तो , प्रत्येक वित्तीय वर्ष में इस प्रकार परिदत्त माल की बाबत एक प्रथक घोषणा या प्रमाणपत्र प्रस्तुत करना आवश्यक होगा । " ;
( ii) उप नियम ( 2 ) में,
( क ) " क्षतिपूर्ति बन्धपत्त्र " शब्दों के ठीक पहले, जहां वे पहली बार आए हैं, " प्ररूप छ में" शब्द और अक्षर जोड़े जाऐंगे ;
( ख ) अन्त में निम्नलिखित परन्तुक जोड़ा जाएगा , अर्थात
परन्तु जहां घोषणा के प्ररुपों में से एक से अधिक खो जाए तो, यथास्थिति , क्रेता व्यौहारी या विक्रेता व्यौहारी इस प्रकार खोए हुए सभी घोषणा के प्ररूपों की बाबत एक ही ऐसा क्षतिपूर्ति बन्धपत्र प्रस्तुत कर सकता है । " :
( iii) उपनियम ( 5 ) में , तृतीय परन्तुक में " दिसम्बर , 1975 " शब्द और अंकों के स्थान पर " दिसम्बर , 1976 " शब्द और अंक रखे जाऐंगे ।
3. उक्त नियमों से उपाबद्ध प्ररून ड ० 1 में, " मूल प्रति " " दूसरी प्रति" तथा " प्रति- पर्ण" से सम्बन्धित प्रत्येक भाग में अन्त में निम्नलिखित जोड़ा जाएगा , अर्थात्:--
" स्पष्टीकरण -- इस प्ररूप में , धारा 6 की उपधारा ( 2 ) के द्वितीय परन्तुक के अन्तर्गत सम्मिलित मामलों में मद घ ( ।।। ) लागू नहीं होगी । " ।

4. उक्त नियमो से उपाबद्ध प्ररूप ड ० 2 में, "मूल प्रति " , " दूसरी प्रति " और " प्रति- पर्ण" से सम्बन्धित भाग में से प्रत्येक में अन्त मे दिया गया स्पष्टीकरण , स्पष्टीकरण ( 1 ) के रूप में पुनःसंख्याकित किया जाएगा और इस प्रकार पुनः संख्याकित स्पष्टीकरण ( 1 ) के पश्चात्निम्नलिखित स्पष्टीकरण जोड़ा जाएगा , अर्थात :--
"स्पष्टीकरण ( 2 ) - इस प्ररूप में , धारा 6 की उपधारा ( 2 ) के द्वितीय परन्तुक के अन्तर्गत सम्मिलित मामलों में मद घ ( ।।। ) लागू नहीं होगी । " ।
5. उक्त नियमों से उपाबद्ध प्ररूप च के पश्चात निम्नलिखित प्ररूप जोड़ा जाएगा, अर्थात् :-
" केन्द्रीय विक्रय कर ( रजिस्ट्रीकरण और श्रावर्त ) नियम , 1957
प्ररूप च क्षतिपूर्ति बन्धपत्र का प्ररूप [नियम 12 ( 2 ) और 12 ( 9 ) देखिए ]
इस विलेख से सब लोगों को ज्ञात हो कि मैं राज्य में, तारीख -जो कि केन्द्रीय विक्रय कर 1956 के अधीन , --रजिस्ट्रीकरण संख्या- -सुपुत्र के अन्तर्गत रजिस्ट्रीकृत व्यौहारी हूं । हम मैसर्स - भारतीय विधि के अन्तर्गत एक रजिस्ट्रीकृत फ़र्मी / कम्पनी हैं और हमारा रजिस्ट्रीकृत कार्यालय-- --स्थान पर है तथा हम केन्द्रीय विक्रय कर अधिनियम, 1956 के अधीन राज्य में , रजिस्ट्री- करण सं ० -तारीख- -के अन्तर्गत रजिस्ट्रीकृत ब्यौहारी हैं ( जिसे इसमें इसके पश्चात् बाध्यताकारी कहा गया है) भारत के राष्ट्रपति/ के राज्यपाल ( जिसे इसमें इसके पश्चात् 'सरकार ' कहा गया है ) -रुपए ( रुपए ) की राशि का सरकार द्वारा मांग के प्रति

किए जाने पर बिना किसी आपत्ति के सरकार को संदाय करने के लिए वचनबद्ध और दृढतापूर्वक आबद्ध हूं / हैं , जिस संदाय के पूर्णतः और सही रूप में किए जाने के लिए मैं स्वयं को, अपने वारिसों, निष्पादकों , प्रशासकों , विधिक अभिकर्ताओं और समनुदेशतियो को आबद्ध करता हूं । हम स्वयं को और अपने उत्तराधिकारियों तथा समनुदेशतियों को तथा उन सब व्यक्तियों को जिनका तत्समय हमारी श्रातिस्यों तथा कारोबार पर नियंत्रण हो, आबद्ध करते हैं ।
श्राज-- --एक हजार नो सोत्रर्ष के माम के दिन हस्ताक्षरित है ।
यतः केन्द्रीय विक्रय कर ( रजिस्ट्रीकरण और आवर्त ) नियम , 1957 के नियम 12 के उपनियम ( 2 ) में यह अपेक्षा की गई है कि यदि कोई रिक् यत्र सम्यक रूप से भरे गए घोषणा पत्न का प्ररूप खो जाता है , चाहे खोने की यह घटना तब हुई हो जब ऐसा प्ररूप क्रेता व्योहारी की अभिरक्षा में हो य। तब जब विक्रेत। व्यौहारी को उसका अभिवहन हो रहा हो तो, यथास्थिति, क्रेता व्यौहारी तथा विक्रेता व्यौहारों भो क्रतशः उस अधिसूचित प्राधिकारी को जिससे उक्त प्ररूप प्राप्त किया गया था, तथा उस राज्य के श्रधिसूचित प्राधिकारी को , भेजेगा ।

और यतः बाध्यताकार। ऐसा केन। व्योह रो * / विक्रेत। व्य.हार है ।
और यतः बाध्यताकारी ने प्ररूगी/ प्ररू ची/ प्रहर ० 1 प्ररूप ७० 27 में प्रमाण- है और जो कि रिक्त था । सम्यक् हा से भरा गया था (प्राधिकारी का नाम और पदाभिधान) द्वारा जारी प.न , जिसकी संख्या और जो किया गया था और भेजा गया था। उसके द्वारा--- उसे प्राप्त हुश्रा था * तथा ( विक्रेता व्यौहारी ) -(क्रेना व्यौहारो का नाम ) को से -(क्रेता व्यौहारी के राज्य के अधिसूचित प्राधिकारी ) को भेजा गया था ( जिसे इनमें इसके पश्चात "प्रा " कहा गया है ) एवं नीचे णिन माल को बाबत था ।

अब आर लिखित बन्धयत्न या बाध्यता की शर्त यह है कि प्ररूप के दुरूपयोग के परिणामस्वरून सरकार द्वारा उठाई गई किसी हानि की दशा में ( जिसके सम्बन्ध में सरकार का या इस प्रयोजन के लिए नियुक्त किए गए प्राधिकारी का विनिश्चय अन्तिम तथा बाध्यता- कारी पर आबद्धकर होगा) बाध्यताकारी सरकार को मांग किए जाने पर बिना किसी आपत्ति के उक्त-- -- रुपए ( रुपए की रकम का (शब्दों में )
संदाय करेगा तथा अन्य रूप से सरकार की क्षतिपूर्ति करेगा और उसे उस प्ररूप के दुरुपयोग के परिणामस्वरून उपगत सभी दायित्वों के लिए और उनके सम्बन्ध में क्षतिपूर्ति करेगा और सरकार को कोई हानि न होने देगा तथा ऐसा करने पर ऊपर लिखित बन्धपत्र या बाध्यता शून्य हो जाएगी किन्तु अन्त्रथा वह पूर्णनः प्रवत्त प्रभावी और सामर्थ्यपूर्ण रहेगी । बाध्यता- कारी उक्त रकम के संदाय के लिए अनुसूची में विनिर्दिष्ट सम्पत्तियों को समुचित बन्धक पत्र द्वास/ वाभिव पत्त्र द्वारा बन्धक रखने / भारित करते के लिए भचनबद्ध है ।

तथा यह विलेज इस बात के भी साध्यस्वरूर है कि इसके अन्तर्गत बाध्यताकारी का दायित्व सरकार के प्रबिरत रहने के कारण या किसी कार्य या चूक के कारण या सरकार द्वारा सवय विइ जाने या अनुप्रास के कारण कम या समाप्त नहीं हो जाएगा ।
सरकार इस विलेख पर प्रभार्थ स्टाम्प शुल्क , यदि कोई हो, वहन करना स्वीकार करती है ।
