ORDER
New Delhi , the 9th January 1976
S.O. 30(E) . In exercise of the powers conferred by section 5 of the Essential Commo- dities Act, 1955 ( 10 of 1955) , the Central Government hereby directs that the powers conferred on it by sub - section ( 1 ) of section 3 of the said Act to make orders to provide for the matters specified in clauses (c ) , ( d) , (e) , (f) , (g ) , (a) , ( i) , ( ii ) and (j ) of sub- section (2) thereof shall , in relation to all commodities other than foodstuffs and fertilisers ( whether inorganic , organic or mixed) . be exercisable also by the State Government of Sikkim subject to the following conditions , namely: --
1. in regard to the making of Order under the said clause (c) :-
(1) where the price at which any essential commodity may be bought or sold is controlled by or under any other law for the time being in force , no order shall be made in pursuance of the powers hereby delegated;
(ii ) where the price is not so controlled, no order shall be made in pursuance of the powers hereby delegated in respect of any essential commodity,-
(a) if the wholesale prices or retail prices , or both, of such commodity have been fixed by the manufacturers or producers thereof with the approval of the Central Government , except on the basis of such prices;
(b) in any other case , except with the prior concurrence of the Central Gov- ernment;

2. in regard to the making of orders under the said clause (d), the delegation of powers under the said clause shall not extend to inter - state transport or distribution and the powers under that clause shall not be exercised so as to prejudicially affect such transport or distribution in pursuance of any Order issued by the Central Government; 3. in regard to the making of orders under the said clause ( f) , prior concurrence of the Central Government shall be obtained;
4. in regard to the making of an order relating to any of the matters specified in the said clause (j ) , the Government of Sikkim shall authorise only an officer of that Govern- ment;
5. no order shall be issued in pursuance of the powers hereby delegated if it is in- consistent with any Order made by the Central Government under the said Act .

आदेश
नई दिल्ली, 9 जनवरी, 1976
का ० प्रा ० 30 (प्र) . केन्द्रीय सरकार , आवश्यक वस्तु अधिनियम , 1955 ( 1955 का 10 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निदेश करती है कि उसकी उपधारा ( 2 ) के खण्ड (ग ) , ( घ ) , ( ङ ) , ( च) , ( छ) , ( ज ) , ( स) और (का) में विनिर्दिष्ट मामलों का उपबंध करने के लिए आदेश करने के लिए उक्त अधिनियम की धारा ( 3 ) को उपधारा ( 1 ) द्वारा उसको प्रदत्त शक्तियों का प्रयोग , खाद्य संदायों और उर्वरकों ( अकार्बनिक , कार्बनिक या मिश्रित ) से भिन्न सभी वस्तुओं के सम्बन्ध में, निम्नलिखित शर्तों के अधीन रहते हुए , सिक्किम राज्य सरकार द्वारा भी किया जा सकेगा, अर्थात: --
1. उक्त खण्ड ( ग ) के अधीन श्रादेश करने के सम्बन्ध में : --
( i ) जहां वह कीमत, जिस पर कोई आवश्यक वस्तु खरीदी या बेची जाए , तत्समय प्रवृत्त किसी अन्य विधि द्वारा या उसके अधीन नियंत्रित की जाए , यहां इसके द्वारा प्रत्यायोजित शक्तियों के अनुसरण में कोई आदेश नहीं किया जाएगा ;
( ii ) जहां कीमत इस प्रकार नियंत्रित नहीं की जाए , वहां किसी श्रावश्यक वस्तु की बाबत इसके द्वारा प्रत्यायोजित शक्तियों के अनुसरण में
( क ) कोई आदेश उस दशा में ऐसी कीमतों के आधार पर के सिवाय नहीं किया जाएगा जबकि ऐसी वस्तु की थोक कीमतें या फुटकर कीमतें, या दोनों, केन्द्रीय सरकार के अनुमोदन से, उसके विनिर्माताओं या निर्माताओं द्वारा नियत की गई हैं ;
(ख) किसी अन्य मामले में , केन्द्रीय सरकार की पूर्व सहमति के सिवाय, कोई आदेश नहींकिया जाएगा ,
2. उक्त खण्ड ( ध ) के अधीन आदेश करने के संबंध में , उक्त खण्ड के अधीन शक्तियों का प्रत्यायोजन अन्तर्राज्यीय परिवहन या वितरण को लागू नहीं होगा और उस खण्ड के अधीन शक्तियों का प्रयोग इस प्रकार नहीं किया जाएगा जिससे केन्द्रीय सरकार द्वारा जारी किए गए किसी आदेश के अनुचरण में ऐमे परिवहन या वितरण पर प्रतिकूल प्रभाव पड़े ।

3. उक्त खण्ड ( च ) के अधीन आदेश करने के सम्बन्ध में, केन्द्रीय सरकार की पूर्व सहमति ली जाएगी;
4. उक्त खण्ड ( ङ ) में विनिर्दिष्ट किसी मामले से सम्बन्धित आदेश करने के सम्बन्ध में , सिक्किम सरकार उस सरकार के किसी अधिकारी को ही प्राधिकृत करेगी ;
5. इसके द्वारा प्रत्यायोजित शक्तियों के अनुसरण में उस स्थिति में कोई आदेश जारी नहीं किया जाएगा , जबकि वह उक्त अधिनियम के अधीन केन्द्रीय सरकार द्वारा किए गए किसी श्रादेश से असंगत हो ।
