NOTIFICATION
New Delhi , the 15th January 1976
The following notification made by the President on the 15th January, 1976 is published for general information:-
S.O. 42 (E ) -ln exercise of the powers conferred by clause (n) of article 371F of the Constitution, the President hereby extends to the State of Sikkim the enactments specified in the Schedule annexed hereto subject to the modifications , if any , specified in that Schedule and the following further modifications , namely: -
(1 ) Any reference in the said enactments to a law not in force , or to a functionary not in existence, in the State of Sikkim shall be construed as a reference to the correspond- ing law in force , or to the corresponding functionary in existence , in that State:
Provided that if any question arises as to who such corresponding functionary is or if there is no such corresponding functionary , the Central Government shall decide as to who such functionary will be and the decision of the Central Government shall be final .
(2) Notwithstanding anything contained in the relevant provision , if any , of each such enactment for the commencement thereof , the provisions of each such enactment shall come into force in the State of Sikkim on such date as the Central Government may , by notification in the Official Gazette , appoint :
Provided that different dates may be appointed for different provisions of any enact- ment and for different areas in the State of Sikkim and any reference in any such pro- vision to the commencement of the Act shallbe construed as a reference to the coming into force of that provision in the area where it has been brought into force.

नई दिल्ली, 15 जनवरी , 1976
राष्ट्रपति द्वारा 15 जनवरी , 1976 को की गई निम्नलिखित अधिसूचना सर्वसाधारण का जानकारी के लिए प्रकाशित की जाती है:--
का ० प्रा० 42 ( प्र ) . राष्ट्रपति , संविधान के अनुच्छेद 371च के खण्ड ( क) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , इनसे उपाबद्ध अनुसूची में विनिर्दिष्ट अधिनियमितियों का विस्तार उस अनुसूची में विनिर्दिष्ट उपान्तरणों, यदि कोई हों, तथा निम्नलिखित और उपान्तरणों के अधीन सिक्किम राज्य पर करते हैं , अर्थात्:--
( 1 ) उक्त अधिनियमितियों में , सिक्किम राज्य में ऐसी विधि, जो प्रवृत्त नही है या ऐसे कृत्यकारी जो विद्यमान नहीं है , के प्रति निर्देश का अर्थान्वयन उस राज्य की तत्समान प्रवृत्त या तत्समान विद्यमान कृत्यकारी के प्रति निदेश के रूप में किया जाएगा ;
परन्तु यदि ऐसा प्रश्न उत्सन्न होता है कि ऐसा तत्समान कृत्यकारी कौन है या यदि ऐसा तत्समान कृत्यकारी नहीं है , तो केन्द्रीय सरकार यह विनिश्चित करेगी कि ऐसा कत्यकारी कौन होगा और केन्द्रीय सरकार का विनिश्चिय अन्तिम होगा ।
( 2) प्रत्येक ऐसी अधिनियमित के सुसगत उपबन्ध में, यदि कोई हो , उसके प्रारम्भ की भाबत अन्र्ताषष्ट किसी बात के होते हुए भी, ऐसी प्रत्येक अधिनियमिति के उपबन्ध सिक्किम राज्य में उस तारीख को प्रवृत्त होंगे जिसे केन्द्रीय सरकार राजपत्त्र में अधिसूचना द्वारा नियत करे :
परन्तु किसी अधिनियमिति के विभिन्न उपबन्धों और सिक्किम राज्य के विभिन्न क्षेत्रों के लिए विभिन्न तारीखें नियत की जा सकेंगी तथा ऐसे उपबन्ध में, अधिनियम के प्रारम्भ के प्रति किसी निर्देश का अर्थान्वयन, उस क्षेत्र में, जहां वह प्रवृत्त किया गया है उस उपबन्ध के प्रवत्त होने के प्रति निर्देश के रूप में किया जाएगा ।
