New Delhi , the 23rd January 1976
G. S. R. 38 ( E) .- In exercise of the powers conferred by sub - section ( 1 ) of section 37 of the Apprentices Act , 1961 (52 of 1961 ) , and after consulting the Central Apprenticeship Council , the Central Government hereby makes the following ules further to amend the Apprenticeship Rules , 1962 , namely : I. ( 1 ) These rules may be called the Apprenticeship ( Second Amendment) Rules , 1976.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In rule 7 of the Apprenticeship Rules , 1962 , for sub - rules ( 1 ) and ( IA) , the following sub - rules shall be substituted namely:-
" ( 1 ) The minimum rates of Stipend payable to trade apprentices shall be ав follows:-
During the first year of training
Rs . 130/ - per month .
During the second year of training
Rs . 140/ - per month .
During the third year of training
Rs . 150/- per month .
Rs . 200/- per month .
During the fourth year of training

provided that in the case of trade apprentices referred to in clause ( a) of section 6 of the Act , the period of training already undergone by them in a school or other institution recognised by the National Council , shall be taken into account for the purpose of determining the rate of stipend payable .
( IA) The minimum rates of Stipend payable to graduate shall be as follows :- or technician ' apprenticen
( 1) Engineering Graduates
Rs . 280/ - per month ( for post Institutional Training) .
(ii) Sandwich course student from Degree Institutions Rs . 180/ - per month .
(ill) Diploma Holders
Rs . 180/ - per month ( for post Institutional Training) .
( iv) Sandwich course student from Diploma Institutions Rs . 150/- per month . "

सा० का० नि० 38 (प्र ) -शिक्षु श्रधिनियम, 1961 ( 1961 का 52 ) की धारा 37 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय शिक्षुता परिषद् से परामर्श करने के पश्चात् केन्द्रीय सरकार , शिक्षुता नियम , 1962 में और संशोधन करने के लिए , निम्नलिखित नियम बनाती है, अर्थात्ः--
1. ( 1 ) इन नियमों का नाम शिक्षुता (द्वितीय संशोधन) नियम, 1976 है ।
( 2 ) ये राजपत्त्र में प्रकासन की तारीख को प्रवृत्त होंगे ।
2. शिक्षुता नियम ,1962 के नियम 7 में, उप- नियम ( 1 ) और ( 1ए ) के स्थान पर निम्न- लिखित उप- नियम रखे जाएंगे , अर्थात्ः-
" ( 1 ) व्यवसाय शिक्षु को दी जाने वालो वृत्तिका की न्यूनतम दरें नीचे लिखे अनुसार होंगीः-
130 रु ० प्रति मास प्रशिक्षण के पहले वर्ष के दौरान
140 रु ० प्रति भास प्रशिक्षण के दूसरे वर्ष के दौरान
150 रु ० प्रति मास प्रशिक्षण के तीसरे वर्ष के दौरान
200 रुपये प्रति मास प्रशिक्षण के चौथे वर्ष के दौरान
परन्तु अधिनियम की धारा 6 के खंड ( क ) में निर्दिष्ट व्यवसाय शिक्षुओं की दशा में , देय वृत्तिका की दर के अवधारण के प्रयोजनार्थ , उन शिक्षुओं द्वारा राष्ट्रीय परिषद् से मान्यता प्राप्त विद्यालय था अन्य संस्था में पहले ही प्राप्त प्रशिक्षण की अवधि को गणना में लिया जाएगा ।

( 1 ए ) स्नातक या तकनीशियन शिक्षुओं को देय वृत्तिका की न्यूनतम दरें नीचे लिखे अनुसार होंगीः-
(i) इंजीनियरी स्नातक
( ii ) डिग्री संस्थानों का सैंडविच पाठ्यक्रम का छात्र
(iii) डिप्लोमाधारी
280 रु० प्रति मास ( उत्तरवर्ती संस्थागत प्रशिक्षण के लिए )
180 रु ० प्रति भास
180 रु ० प्रति मास ( उत्तरवर्ती संस्थागत प्रशिक्षण के लिए)
(( iv) डिप्लोमा संस्थाओं का सैंडविच पाठ्यक्रम का छात्र 150 रु ० प्रति मास"
