ORDER
New Delhi , the 23rd January 1976
S.O. 55 ( E ) /18AA/IDRA/75.-Whereas in exercise of the powers conferred by sub - section ( 1 ) of section 18AA of the Industries (Development and Regu- lation) Act, 1951 ( 65 of 1951 ) , the Central Government , in the late Ministry of Industrial Development by its Order No. S.O. 695 ( E ) / 18AA/ IDRA / 72 , dated the 3rd November , 1972 , authorised the Industrial Reconstruction Corporation of India Limited , Calcutta ( hereinafter referred to as the said Corporation ) to take over the management of Ganesh Flour Mills Company Limited , Delhi (hereinafter referred to as the said undertaking ) :
And whereas the said Corporation took over the management , for a period of five years , of the said undertaking on the 4th November , 1972 and have been holding office as such subject to the right of the Central Government to ter- minate the same earlier ;
And whereas the Central Government considers it necessary to terminate the appointment of the said Corporation as authorised person and to authorise instead the body of persons referred to in paragraph 2 of this Order as the Board of Management ;
Now , therefore , in exercise of the powerswers conferred by sub - section ( 1 )(1) of section 18AA of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951) and all other powers enablingit in this behalf, the Central Government hereby terminates the appointment of the said Corporation as authorised person and authorises instead the body of persons referred to in paragraph 2 of this Order

as the Board of Management of the said undertaking subject to the following terms and conditions , namely :-
( i ) The Board shall comply with all directions issued from time to time by the Central Government ,
( ii ) The Board shall hold office upto and inclusive of the 2nd November , 1977,
( iii ) The Central Government may terminate the appointment of the Board or of any of the persons comprising the Board earlier , if it considers necesary to do so .

का. श्र . 55 ( श्र ) / 18 फक/ आई डी श्रार ए/ 75.--उद्योग ( विकास और विनियमन ) अधिनियम,1951 ( 1951 का 65) की धारा 18 कक की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार ने अपने आदेश सं ० का ० श्रा ० (9,5 ( 5) / 18 षक/ आईडी आर ए / 72 तारीख 3 नवम्बर, 1972 द्वारा भारतीय औद्योगिकः पुनर्गठन निगम लिमिटेड , कलकत्ता (जिसे इसमें इसके पश्चात्, उक्त निगम कहा गया है ) को, मेसर्स गनेश फ्लोर मिल्स कम्पनी लिमिटेड ( जिसे इसमें इसके पश्चात् उक्त उपक्रम कहा गया है ) , का प्रबन्ध लेने के लिए प्राधिकृत किया था:
तथा उक्त निगम ने उक्त उपक्रम का प्रबन्ध 4 नवम्बर , 1972 को ले लिया था ;
तथा उक्त उपक्रम के प्रबन्ध को , उक्त निगम से , इस श्रादेश के पैरा 2 में प्रबन्ध बोर्ड के रूप में निर्दिष्ट घ्यक्तियों के निकाय को स्थानान्तरित करने की प्रस्थापना की गई है ;

अतः अब उद्योग ( विकास और विनियमन) अधिनियम, 1951 (1951 का 65) की धारा 18 कक की उपधारा ( 1 ) द्वारा प्रदस शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार उक्त प्रबन्ध बोर्ड को उक्त उपक्रम का प्रबन्ध ले लेने के लिए निम्नलिखित शर्तों और निबन्धनों के अधीन प्राधिष्कृत करती है, अर्थात : -
( i ) बोर्ड , केन्द्रीय सरकार द्वारा समय समय पर जारी किए गए सभी निदेशों का अनुपालन करेगा ;
( ii) बोर्ड, केन्द्रीय सरकार द्वारा उक्त उपक्रम का प्रबन्ध ग्रहण करने की तारीख से आरम्भ होने वाले 5 वर्ष की अवधि के लिए अर्थात 2 नवम्बर , 1972 तक पद धारण करेगा ;
( iii) यदि केन्द्रीय सरकार ऐसा करना आवश्यक समझे तो वह बोर्ड या बोर्ड में सम्मिलित व्यक्तियों में से किसी की नियुक्ति पहिले समाप्त कर सकेगी ;
