G.S.R. 57 (E) ---In pursuance of rule 92B of the Central Excise Rules , 1944 and sub- section ( 3 ) of section 3 of the Additional Duties of Excise (Goods of Special Importance ) Act, 1957 ( 58 of 1957 ) , and in supersession of the notification of the Government of India in the Ministry of Finance (Department of Revenue and Insurance ) No. 96 / 75 - Cen- tral Excises , dated the 30th April , 1975 , the Central Government hereby fixes , for the different sizes of centrifugals installed for the manufacture of Khandsari Sugar in the units working with or without the aid of sulphitation plant , as the case may be and specified in column ( 1 ) of the Table below , the rates of additional excise duty calculated, from the date on which the unit commences manufacturing operations during a season

to the date the unit closes down at the end of the season , per week as specified in the corresponding entries in column ( 2) or column ( 3 ) thereof , as the case may be :

Provided that:-
(i ) the week for the purposes of this notification shall be reckoned as from 1st to 7th , 8th to 14th , 15th to 21st and 22nd to 28th day of a calendar month except the month of February in a leap year , and the week in the month of February in a leap year shall be reckoned as from 1st to 7th, 8th to 14th , 15th to 21st and 22nd to 29th ;
(ii ) the duty for the remaining 2 or 3 days of the calendar month , except the month of February , as the case may be , shall be calculated at the rate of one - third of the weekly rates of duty specified in column ( 2) or (3 ) of the Table , as the case may be , and shall be payable by the manufacturer alongwith the duty payable by him for the fourth week , namely , from 22nd to 28th of that calendar month;
( iii) for the period beginning on the 1st day of July and ending with the 31st day of October , tac rate of duty applicable to any type of centrifugal shall be two- thirds of the rate fixed for that typc .
1st Explanation. For the purpose of this notification " day " means a period of twenty four hours beginning at 9.00 A.M. This notification shall come into force from February , 1976 .

3 की उपधारा ( 3 ) के अनुसरण में और भारत सरकार के वित्त मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना सं ० 96 / 75 -केन्द्रीय उलाद-शुल्क , तारीख 30 अप्रैल , 1975 को अधिक्रान्त करते हुए केन्द्रीय सरकार यथास्थिति, सल्फाइटेशन संयत्त्र की सहायता से या उसके बिना काम करने वाली यूनिटों में खांडखारी चीनी के विनिर्माण के लिए स्थापित विभिन्न आकारों के उपकेन्ट्री ( सेन्ट्रीफ्यूगल ) के लिए जो नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट हैं , अतिरिक्त उत्पादन शुल्क की वे दरें नियत करती है , जो उस तारीख से लेकर जब यूनिट किसी मौसम में विनिर्माण संक्रियाएं श्रारम्भ करती है उस तारीख तक जब वह यूनिट मौसम के अंत में बन्द हो जाती है , प्रति सप्ताह संगणित की जाएंगी जैसा कि उस सारणी के यथास्थिति स्तम्भ ( 2 ) या स्तम्भ ( 3 ) की तत्स्थानी प्रविष्टियों मेंविनिर्दिष्ट हैं ।

से 14वें दिन तक , 15वें से 21 वें दिन तक और 22 वें से 28 वें दिन तक की जाएगी, और
अधिवर्ष में फरवरी मास में सप्ताह की गणना पहले 7वें दिन तक , 8वे से 14वें दिन तक , 15 वे से 21 वें दिन तक और 22 वें से 29 वें दिन तक की जाएगी ।
( ii ) कलेण्डर मास के, फरवरी मास के सिवाय , यथास्थिति , शेष 2 या 3 दिन के लिए, शुल्क की गणना सारणी के , यथास्थिति, स्तम्भ ( 2 ) या ( 3 ) में विनिर्दिष्ट साप्ताहिक शुल्क दरो की एक - तिहाई दर से की जाएगी और शुल्क विनिर्माता द्वारा चौथे सप्ताह के लिए अर्थात उस कलेण्डर मास के 22 वें दिन से 28 वें दिन तक के लिए संदेय शुल्क के साथ -साथ उसके द्वारा सदेय होगा ।
( iii ) जुलाई के पहले दिन को आरम्भ होकर अक्तूबर के 31 वें दिन को समाप्त होने वाली अवधि के लिए किसी भी प्रकार के अपकेन्द्रियो को लागू शुल्क की दर उस प्रकार के अपकेन्द्रीयों के लिए नियत दर की दो - तिहाई होगी ।
स्पष्टोक रण.--इस अधिसूचना के प्रयोजनों के लिए ' दिन' से चौबीस घण्टों की वह अवधि अभिप्रेत है जो प्रातः 9 बजे श्रारम्भ होता है । यह अधिसूचना 1 फरवरी , 1976 से प्रवृत होगी ।

Provided that:-

सा० का० नि ० 58 ( श्र) केन्द्रीय उत्पाद शुल्क नियम , 1944 के नियम 92 ख के अनुभरण में केन्द्रीय सरकार यथास्थिति , सल्फाइटेशन संयंत्र की सहायता से या उसके बिना काम करने वाली यूनिटों में खांडसारी चीनी के विनिर्माण के लिए स्थापित विभिन्न आकारों के उपकेन्द्रों ( सेन्ट्रोफियूगल ) के लिए , जो नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट है , शुल्क की दरें नियत करती है , जो उप तारीख से लेकर जब यूनिट किसी मौसम में विनिर्माण क्रियाएं आरम्भ करती है उस तारीख तक जब वह यूनिट मौसम के अन्त में बन्द हो जाती है , प्रति सप्ताह संगणित की जाएंगी जैमा कि उप सारणी के यथास्थिति स्तम्भ ( 2 ) या स्तम्भ ( 3 ) की तत्स्थनी प्रविष्टियों में विनिदिष्ट है

परन्तु,--

( ii) कलेण्डर मास के , फरवरी भास के सिवाय , यथास्थिति , शेष 2 या 3 दिन के लिए शुल्क की गणना सारणी के, यथास्थिति, स्तम्भ ( 2 ) या ( 3 ) में विनिर्दिष्ट साप्ताहिक शुल्क दरों की एकतिहाई दर से की जाएगी और शुल्क विनिर्माता द्वारा चौथे सप्ताह के लिए अर्थात् उस कलण्डर मास के 22वें दिन से 28वें दिन तक के लिए संदेय शुल्क के साथ -साथ उसके द्वारा संदेय होगा ।
( iii ) जुलाई के पहले दिन को आरम्भ होकर अक्टूबर के 31 वें दिन को समाप्त हं वाली अवधि के लिए किसी भी प्रकार के अवकेन्द्रियों को लागू शुल्क की उस प्रकार के अवकेन्द्रियों के लिए नियत दर की दो - तिहाई होगी ।
स्पष्टीकरण.-- इस अधिसूचना के प्रयोजनों के लिए 'दिन ' से चौबीस घण्टों की वह अवधि अभिप्रेत है जो प्रातः 9 बजे आरम्भ होती है ।
यह अधिसूचना 1 फरवरी , 1976 से प्रवृत्त होगी ।

G.B.R. 59 ( E ) . In exercise of the powers conferred by sub - section ( 2 ) of Section 3 of the Central Excises and Salt Act , 1944 ( 1 of 1944 ) and in supersession of the notification of the Government of India in the Ministry of Finance ( Depart- ment of Revenue and Insurance ) No. 232 / 75 - Central Excises , dated the 1st December , 1975, the Central Government hereby fixes a tarifftariff value of Two Hundred and Ninetyfive rupees per quintal for sugar falling under sub - item (1 ) of Item No. 1 of the First Schedule to the said Act and chargeable with duty ad valorem .
Provided that nothing contained in this notification shall apply to sugat required by the Central Government to be sold under clause ( f ) sub - section ( 2 ) of Section 3 of the Essential Commodities Act , 1955 ( 10 of 1955 ) .
This notification shall come into force from 1st Februrary , 1976 ,

सा० हा ० नि० 59 ( श्र) -केन्द्रीय उत्पाद शुल्क और नमक अधिनियम , 1944 ( 1944 का 1 ) की धारा 3 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के ( राजस्व और बीमा विभाग ) की तारीख 1 दिसम्बर , 1975 की अधिसूचना सं ० 232/75 के ० ज ० शु ० को अतिष्ठित करते हुए केन्द्रीय सरकार उक्त अधिनियम की प्रथम अनुसूची की मद सं ० 1 की उपमद स ( 1 ) के अन्तर्गत आने वाली और मूल्यानुसार शुल्क से प्रभार्य चीनी के लिए दो सो पंचानवे रुपये प्रति क्विंटल मूल्य एतद्वारा नियत करती है ।
परन्तु इस अधिसूचना में अन्तविष्ट कोई भी बात केन्द्रीय सरकार द्वारा श्रावश्यक वस्तु अधिनियम , 1955 ( 1955 का 1 ) की धारा 3 की उपधारा ( 2 ) के खण्ड (छ) के अधीन की जाने के लिए अपेक्षित चीनी पर लागू नही होगी ।
यह अधिसूचना 1 फरवरी , 1976 से प्रवृत्त होगी ।
