NOTIFICATION
New Delhi , the 5th February 1976
G.S.R. 63 (E).-Whereas certain draft rules further to amend Prevention of Food Adulteration Rules , 1955 , were published , as required by Sub- section (1 ) of section 23 of the Prevention of Food Adulteration Act , 1954 (37 of 1954 ), at pages 2702-2704 of the Gazette of India , Part II , Section 3 , Sub -section ( i ) , under the notification of the Govern- ment of India in the Ministry of Health and Family Planning ( Department of Health ) No. G.S.R. 1145 , dated the 26th October , 1974 , inviting objections/ suggestions from the persons likely to be affected thereby till the 26th November , 1974 ;
And whereas the said Gazette was made available to the public on 26th October , 1974 ;
And whereas objections and suggestions received from the public on the said draft notification 'have been considered by the Central Government ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 23 of the said Act, the Central Government , after consultation with the Central Committee for Food Standards , hereby makes the following rules further to amend the Prevention of Food Adulteration Rules , 1955 , namely : --
RULES
1. (1 ) These rules may be called the Prevention of Food Adulteration ( Amendment ) Rules , 1975 .
(2) They shallhall come into force on the date of their publication in the Official Gazette except rules 3 , 4 , 5 , 6 and clause (vii) of rule 10 which shall come into force after a period of six months from the date of such publication .

2. In the Prevention of Food Adulteration Rules , 1955 , ( hereinafter referred to as the said rules ) , in rule 29 , after item ( n) , the following item shall be inserted , namely:-- " (o) Sweetened ice , thread candies and similar products " .
3. In rule 32 of the said rules , in the first proviso , the words " including the statement under any clause " , the words , brackets and letters " under clause ( d) and ( e) " , shall be substituted .
4. After rule 22 of the said rules , the following rule , shall be inserted , namely:-
"32-A . Nutritional Food. The food claimed to be enriched with nutrients such as minerals , proteins or vitamins shall give the quantities of such added nutri- ents on the label . '
5. In rule 42 of the said rules , after sub - rule ( K) , the following sub - rules , shall be inserted, namely:-
" (L ) Masala.-Every package of mixed masalas shall bear a label specifying the ingredients of the products in descending order by weight .
(M) Compounded Asafoetida . Every container of Compounded Asafoetida shall indicate the percentage of flour of the kind used in the compound on the label ." .
6. In rule 50 of the said rules , in sub - rule ( 1 ) , after item (s) , the following items , shall be inserted, namely:-
"(t) Sweetened ice , thread candies and similar products ;
(u) Sugar cane juice , fresh fruit juice and sharbats ( not covered under the Fruit Products Order , 1955) . " .
7. In rule 55 of the said rules , in the table , after item 30 , the following item shall be inserted , namely:-

" 31. Dry mixis of Ras-Gollas .
8. After rule 59 of the said rules , the following provison shall be inserted , namely:-
Provided that dry mixes of Ras-Gollas 'and Vadas may contain butylatedhydroxy- anisole ( BHA) not exceeding 0.02 per cent calculated on the basis of fat content:
Provided further that antioxidants permitted in rule 59 may be used in permitted flavouring agents in consentration not exceeding 0.01 per cent . " .
9. After rule 64 in Part XIII of the said rules , the following rule shall be inserted , namely:-
" 64 - A Foodgrade solvents . Isoprovl alcohol- Food grade may be used as solvant in food industry ." .
10. In the appendix ' B ' to the said rules :-
(i ) in item A.01.01 , in the proviso , for the words , " sucrose " , the words "total sugars expressed as sucrose " shall be substituted;
(ii ) after item A.05.17.02 , the following item shall be inserted , namely :-
"A.05.17.03 Pinheads. Pinheads shall be wholly derived from the spikes of piper nigrum . They shall be reasonably dry and free from insects ' . The colour shall be from dark - brown to black . The extraneous matter shall not exceed 6 per cent . " ;
(iii ) item A.11.14 , shall be renumbered as A.11.02.21 ;
( iv) in item A.14, after the word " species " , the following shall be inserted , namely:- "and includes (i ) leaf , ( ii ) broken , ( iii ) fanning and ( iv) dust " ;
(v) in item A.17.02 , against the entry (a ) , for the figures and words "57.9 to 60.2" , the figures and words " 55.6 to 60.2 " shall be substituted;
(vi ) in item A.17.05 , for the words and brackets "Mustard oil (Saroon Ka Tel ) " ? the words and brackets " Rapeseed Oil (Tora oil ) " ? or " mustard oil (Saroon Ka- Tel) " shall be substituted;

(vii ) in item A.18.02 , against the entry ( e ) , for the figures "0-18 " , the figures " 0-12 " shall be substituted ;
(viii ) in item A.18.09 , against the entry "Moisture " , for the figures " 5.0 " , the figures "7.5" shall be substituted;
(ix) in item A.18.14, after the words " edible groundnut flour , " , the words "edible soya flour , " shall be inserted .

सा० का० मि ० 63 ( प्र ) -खाद्य श्रमिश्रण निवारण , नियम , 1955 में और संशोधन करने के लिए कतिपय नियमों का प्रारुप , खाद्य श्रपमिश्रण निवारण , अधिनियम, 1954 ( 1954 का 37 ) की धारा 23 की उपधारा ( 1 ) द्वारा यथा अपेक्षित , भारत सरकार के स्वास्थ्य और परिवार नियोजन मंत्रालय (स्वास्थ विभाग ) की अधिसूचना संख्या सा ० का ० नि ० 1145 , तारीख 25 अक्टूबर , 1974 के अधीन भारत के राजपत्त्र , भाग 2 , खण्ड 3, उपखण्ड ( 1 ) के पृष्ठ 2699-2702 पर प्रकाशित किया गया था , जिसमें 26 नवम्बर , 1974 तक उन सभी व्यक्तियों से अ.क्षेप और सुझाव मांगे गए थे , जिनके उससे प्रभावित होने की संभावना थी;
और उक्त राजपत्न 26 अक्टूबर , 1974 को जनता को उपलब्ध करा दिया गया था ;
और केन्द्रीय सरकार ने उक्त अधिसूचना के प्रारूप की बाबत जनता से प्राप्त प्राक्षेपों प्रौर सुझावों पर विचार कर लिया है ;
अतः , अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 23 की उपधारा ( 1 ) द्वारा प्रदत्त शाक्तियों का प्रयोग करते हुए , केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात्, खाद्य अपमि- श्रण निवारण नियम , 1955 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्ः-
नियम
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का नाम खाद्य श्रपमिश्रण निवारण (संशोधन) नियम, 1976 है ।
( 2 ) ये, नियम 3 , 4 , 5, 6 तथा नियम 10 के खण्ड ( vii ) के सिवाय, जो ऐसे प्रकाशन की तारीख से छह मास की अवधि के पश्चात् प्रवृत्त होंगे , राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।
2. खाद्य अमिश्रण निवारण नियम , 1955 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) में , नियम 29 में, मद ( ४ ) के पश्चात् निम्नलिखित मद अन्तःस्थापित की जाएगी , अर्थात्:--
" ( ण ) मीठी की गई बर्फ , यूड कैण्डियां और इसी प्रकार के उत्पाद । " [PART THE GAZETTE OF INDIA EXTRAORDINARY

3. उक्त नियमों के नियम 32 में, प्रथम परन्तुक में, -
"किसी खण्ड के अधीन विवरण सहित विशिष्टियां विनिर्दिष्ट करना श्रावश्यक नहीं है " शब्दों के स्थान पर " खण्ड ( घ ) और ( ड़ ) के अधीन विशिष्टियां विनिर्दिष्ट करना आवश्यक नहीं होगा " शब्द, कोष्ठक और अक्षर रखे जाएंगे ।
अर्थात्ः--
4. उक्त नियमों के नियम 32 के पश्चात् निम्नलिखित नियम अन्त. स्थापित किया जाएगा, " 32 क पोषणज खाद्यय ऐसे खाद्य के , जिसके बारे में यह दावा किया गया है कि वह खनिजों प्रोटीनों या विटामिनों जैसे पोषकों से भरपूर है , लेबिल पर ऐसे अतिरिक्त पोषकों की मात्राएं दी जाएंगी । " ।
5. उक्त नियमों के नियम 42 में, उपनियम ( ट ) के पश्चात्, निम्नलिखित उपनियम अन्तस्थापित किए जाएंगे , अर्थात्ः--
(ठ ) मसाला -मिश्रित मसालों के प्रत्येक पैकेज पर एक लेबिल होगा , जिसमें वजन के अवरोही क्रम में उत्पादों के संघटकों को विनिर्दिष्ट किया जाएगा ।
(ड) मिश्रित हींग. मिश्रित हींग के प्रत्येक श्रधान के लेबिल पर मिश्रण में प्रयुक्त श्राटे के प्रकार की प्रतिशतता उपदर्शित की जाएगी । " ।
6. उक्त नियमों के नियम 50 में , उपनियम ( 1 ) में , मद ( घ ) के पण्चात् निम्नलिखित मदें अन्तः स्थापित की जाएंगी, अर्थात्ः-
" ( न) मीठी की गई बर्फ , थूड कैण्डियां और उसी प्रकार के उत्पाद;
( प) गन्ने का रस , ताजा फलों का रस और शरबत ( जो फलउत्पाद आदेश , 1955 के भन्तर्गत नहीं माते हों ) । " ।
7. उक्त नियमों के नियम 55 में, सारणी में , मद 30 के पश्चात् निलिखित मद अन्तः- स्थापित की जाएगी , अर्थात् -

8. उक्त नियमों के नियम 59 के पश्चात्, निम्नलिखित परन्तुक अन्त स्थापित किए जाएंगे , अर्थात्ः--
"परन्तु रसगुल्ला और बड़ा के शुष्क मिश्रों में बसा अंश के आधार पर संगणित , 0.02 से अधिक व्यूटीटिड -हाईड्राक्सी -एनीसोल (BHA ) हो सकेगा :
परन्तु यह और कि नियम 59 में अनुज्ञात प्रति आक्सी कारकों का सान्द्रता में 0.01 प्रतिशत से अनधिक, अनुज्ञात सुर्शच कर्मों में उपयोग किया जा सकेगा । " ।

9. उक्त नियमों के भाग 13 में नियम 64 के पश्चात, निलिखित नियम अन्तःस्थापित किया जाएगा, अर्थात्ः--
" 64-क खाद्य श्रेणी विलायकः खाद्य उद्योग में बिलायक के रुप में आईसोश्रोपिल एल्कोहल--खाद्य श्रेणी का उपयोग किया जा सकेगा । "
10. उक्त नियमों के परिशिष्ट 'ख ' में, ---
(i) मद ए.01.01 में , परन्तुक में, "स्यूक्रोज " शब्द के स्थान पर "स्यूक्रोज के रूप में श्रभिव्यक्त कुल शर्करा " शब्द रखे जाएंगे ;
( ii) मद ए.05.17.02 के पश्चात्, निम्नलिखित मद अन्तःस्थापित की जाएगी, अर्थात्ः-
"ए ०05.17.03 दिनहेडः पूर्णतः पाद्दार नःइयम की स्पाइकों से लिए जाएंगे । ये पर्याप्त शुष्क और कीटहित होंगे । रंग गहरा भूरा से काला होगा । बाह्य पदार्थ 6 प्रतिशत से अधिक नहीं होगा । " ;
( iii) मद ए . 11.14 को मद ए . 11.02.21 के रूप में पुनःसंख्यांकित किया जाएगा । ;
( iv) मद ए . 14 में "स्पीशीज " के पश्चात् निम्नलिखित अन्त स्थापित किया जाएगा,
अर्थात्ः-
"भौर उसमें ( i ) पत्ती, ( ii ) टूटन, ( iii ) फटकन ( iv ) बुकनो सम्मिलित है " ;
(v) मद ए . 17.02 में, प्रविष्टि ( क ) के समने , " 57.9 से 60.2 तक" अंकों और शब्दों के स्थान पर , " 55. 6 से 60. 2 तक " अंक और शब्द रखे जाएंगे ;
(vi) मद ए . 17.05 में , " सरसों का तेल " शब्दों के स्थान पर ' तोरिया तेल या सरसों का तेल' शब्द रखे जाएंगे ;
(vii) मव ए. 18.02 में, प्रविष्टि ( ङ) ' के सामने , " 0.18" अंकों के स्थान पर " 0.12" अंक रखे जाएंगे ;
(viii) मद ए . 18.09 में, प्रविष्टि " आहेत। " के सामने, ' 5.0 अंकों' के स्थान पर, ' 7.5'अंक रखे जाएंगे ;
(ix) मद ए . 18.14 में , 'खाद्य भूगफली भाटा ' शब्दों के पश्चात् 'बाज सोया आटा' शब्द अन्त. स्थापित किए जाएंगे ।
