New Delhi , the 1st March 1976
G.S.R. 104 ( E ) . In exercise of the powers conferred by sub - rule ( 1 ) ofrule 8 of the Central Excise Rules , 1944 , and in supersession of the Notification of the Government of India in the Ministry of Finance (Department of Revenue and Insurance ) No. 88 / 72 - Central Excises , dated the 17th March , 1972 , the Central Government hereby exempts vacuum and gas - filled bulbs , falling under sub - item ( 1 ) of Item No. 32 of the First Schedule to the Central Excises and Salt Act , 1944 ( I of 1944 ) and of the description specified in column ( 2 ) of the Table hereto annexed , from so much of the duty of excise leviable thereon asisin excess of the duty specified in the corresponding entry in column ( 3 ) thereof :-

3. Miniature Bulbs

Nil 4. Bulbs not exceeding 60 watts of the type known as Tungsten Filament Incandescent Lamps for general lighting purposes with rated voltage of IHOV and above , when produced by an industrial unit where the capital invested on the plant and machinery installed in such unit does not , in the opinion of an officer not below the rank of an Assistant Collector of Central Excise , exceed three lakhs of rupees .
5. All other vacuum and gas filled bulbs not exceeding 60 watts .

Explanation 1. For the purpose of this notification , ' Miniature Bulbs' shall mean only such bulbs or lamps ( excluding Krypton or Argon gas filled Bulbs ( Lamps ) for Miner's Cap Lamps ) which have the following wattage and dimensions , namely: ---
( i ) wattage not exceeding 6 watts ;
( ii) length less than 30 mm ( nominal ) ; and
( iii) diameter less than 18 mm ( nominal ) .
Explanation 2. For the purpose of determining under this notification the classifica- tion and nomenclature of bulbs or lamps or , as the case may be , the wattage , length or diameter of bulbs or lamps , the definition as well as the prosedure for testing , including allowances for tolerances , as prescribed in the Indian Standard Specifications shall be adopted .

सा० का ० ति ० 104 ( घ) केन्द्रीय सरकार, केन्द्रीय उत्पाद शुल्क नियम , 1944 के नियम 8 के उपनियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के वित मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना सं ० 88/72 केन्द्रीय उत्पाद शुल्क तारीख 17 मार्च , 1972 को अधिक्रांत करते हुए , केन्द्रीय उत्पाद शुल्क और समक अधिनियम, 1944 ( 1944 का 1) की प्रथम अनुसूची की मद सं ० 32 की उपमद ( 1 ) के अन्तर्गत आने वाले और इससे उपाबद्ध सारणी के स्तंभ ( 2 ) में विनिर्दिष्ट वर्णन के निर्वात तथा गैस -पूरित बल्बों को उन पर उग्रहणीय उतने उत्पाद- शुल्क से छूट देती है जितना उसथेः स्तंभ ( 3 ) में तत्सम्बन्धी प्रविष्टि में विनिर्दिष्ट उत्पाद शुल्क से अधिक है,

11 प्रतिशत मूल्यानुसार 2 टेलीफोन और टेलीग्राम स्त्रिच बोर्डों मे और सहबद्ध प्रयोजनों के लिए उपयोग में लाए जाने वाले दृश्य सूचक लैम्प ।

शून्य 4 साधारण प्रकाश के प्रयोजनार्थ टंग्सदन फ्लिामेन्ट इनकैन्डीमेन्ट लैम्पो केके रूप में आंत प्रकार के 60 वाद में अनधिक के बल्ब जिनकी अनुमत बोल्टत्ता 110 बोल्ट और उसमे अधिक है , जब वे ऐसे औद्योगिक यूनिट द्वारा उत्पादित हों , जहां यूनिट में प्रतिष्ठापित संयंत्र और मशीनरी पर विनिहित पूजी ऐसे अधिकारी की राय में जो केन्द्रीय उत्पाद शुक्क के सहायक कलक्टर से निम्न पंबित का अधिकारी नही है , तीन लाख रुपए से अधिक नहीं है ।
15 प्रतिशत मूल्यानुसार 5 60 वाट से अनधिक के सभी अन्य निर्वाचित और गैस पूरित बल्ग ।
स्पष्टीकरणः- ( 1. ) इस अधिसूचना के प्रयोजनार्थ भिनिएचर बल्बों से , माइनर्स कैप लैम्पों के लिए , क्रिपटन या आर्गन गैस -पूरित बल्बों ( लैम्पों ) को अपवर्जित करके, केवल ऐसे बल्ब या लैम्प अभिप्रेत है जिनकी वाटता और लम्बाई चौड़ाई निम्नलिखित है, अर्थातः
(i) 6 बाट से भनधिक वाटता ;
( ii ) 30 एम एम ( अभिहित ) से अनधिक लम्बाई ;
( iii) 18 एम एम ( श्रभिहित ) से श्रमधिक व्यास ।
स्पष्टीकरण--( 2. ) इस अधिमूवना के अधीन बल्दों या सैम्पों का वर्गीकरण और नाम या यथास्थिति बल्यो या लैम्पों की घाटता सम्बाई या व्यास अवधारित करने के प्रयोजन के लिए, जो भारतीय मानक विनिर्देशों में विहिन परिभाषा तथा परीक्षण के लिए प्रक्रिया, जिसमें सह्यता के लिए छूट भी सम्मिलित है, अपनाई जाएगी ।
