NOTIFICATION
New Delhi , the 25th March 1976
S.O. 229 ( E ) . In exercise of the powers conferred by the proviso to article 309 and clause ( 5 ) of article 148 of the Constitution read with rule 45 of the Funda- mental Rules , the President , after consultation with the Comptroller and Auditor General in relation to persons serving in the Indian Audit and Accounts Depart- ment , hereby makes the following rules further to amend the Allotment of Gov- ernment Residences ( General Pool in Delhi ) Rules , 1963 , namely :-
1. These rules may be called the Allotment of Government Residences ( Gene- ral Pool in Delhi ) Second Amendment Rules , 1976 .
2 In the Allotment of Government Residences ( General Pool in Delhi ) Rules , 1963, in Supplementary Rule 317 -B -3-
(1 ) for the second proviso to sub - rule ( 5 ) , the following proviso shall be substituted , and shall be deemed to have been substituted with effect from the 1st day of January , 1976 , namely :-
"Provided further that-
( a) where the officer concerned has made any such offer before the 1st January , 1976 in pursuance of any instructions issued by that Government on or after the 9th September , 1975 and such offer is refused ( whether before or after the 1st January , 1976 ) , he shall be liable to pay damages as provided in sub - rule (4) with effect from the 1st January , 1976 ; and

(b) where the officer concerned has made the offer aforesaid on or as after the 1st January , 1976 and has been paying damages provided in sub - rule ( 4 ) as from that date, he shall continue to pay such damages until his offer is accepted or , if his offer is refused, so long as he occupies the Government residence ." ;
(2) in sub - rule ( 7 ) , the following shall be inserted at the end , namely:-
"subject to the modification that the references in sub - rule ( 5 ) to the 1st January , 1976 , shall be construed as references to the date of expiry of the period of six weeks specifled in clause ( b ) of sub - rule ( 6) ." .
Explanatory Memorandum
The amendment to the second proviso to sub - rule ( 5 ) of new S.R. 317 - B - 3 , is of a clarifying nature and seeks to make the proviso conform to the orders issued earlier with effect from 1st January , 1976 , by the Central Government in O.M. No. 12031 ( 1 ) /74-Pol.II , dated the 9th September , 1975 , read with Office Memo- randum of even number dated the 15th November , 1975 and the 9th December , 1975, in regard to allotment of Government residences to its employees owning residential accommodation at their places of posting . Retrospective effect to the amendment as from 1st January , 1976 , when S.R. 317 - B - 3 , aforesaid came into force , has , therefore , become necessary to make the rule consistent with the earlier orders .

का ० प्रा०229 ( प्र ) .-- राष्ट्रपति, मूल नियमों के नियम 45 के साथ पठित संविधान के अनुच्छेद 309 केके परन्तुक तथा अनुच्छेद 148 के खण्ड ( 5 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारतीय लेखा परीक्षा और लेखा विभाग में सेवारत व्यक्तियों के सम्बन्ध मे नियंत्रक महालेखा परीक्षक से परामर्श करने के पश्चात् सरकारी निवास -स्थान आबंटन ( दिल्ली में साधारण पूल ) नियम , 1963 में और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्
1. इन नियमों का संक्षिप्त नाम सरकारी निवास-स्थान आबंटन (दिल्ली में साधारण पूल ) द्वितीय संशोधन नियम , 1976 है ।
2. सरकारी निवास-स्थान श्राबंटन ( दिल्ली में साधारण पुल ) नियम , 1963 में , श्रनुपूरक नियम 317-ख-3 में,-
( 1 ) उपनियम ( 5 ) के द्वितीय परन्तुक के स्थान पर निम्नलिखित परन्तुक रखा जाएगा , और 1 जनवरी , 1976 से प्रतिस्थापित समझा जाएगा , श्रथात्:- "परन्तु यह और कि
(क ) जहां सम्बधित अधिकारी ने सरकार द्वारा 9 सितम्बर, 1975 को या उसके पश्चात् जारी किए गए किन्ही अनुदेशों के अनुसरण में कोई एसी प्रस्थापना की है और ऐसी प्रस्थापना को ( 1 जनवरी , 1976 से पूर्व या उसके पश्चात्) अस्वीकार कर दिया जाता है तो सम्बन्धित अधिकारी 1 जनवरी , 1976 से उप- नियम ( 4 ) में यथा उपबन्धित नुकसानी देने का दायी होगा ; और THE GAZETTE OF INDIA EXTRAORDINARY

( ख ) जहां सम्बन्धित अधिकारी के उपरोक्त प्रस्थापना 1 जनवरी , 1976 को या उसके पश्चात् की है और वह उपनियम ( 4 ) में यथा उपबन्धित नुकसानी उस तारीख से दे रहा है , वह ऐसी नुकसानी तब तक देता रहेगा जब तक कि उसकी प्रस्थापना स्वीकार नही कर ली जाती या , यदि उसकी प्रस्थापना अस्वीकार कर दी जाती है तो तब तक जब तक कि वह सरकारी निवास स्थान का अधिभोग करता है । " ;
( 2) उपनियम ( 7) मे , अन्त में निम्नलिखित जोडा जाएगा , अर्थात्:--
"किन्तु यह इस उपान्तरण के अधीन रहते हुए कि उपनियम ( 5 ) में 1 जनवरी , 1976 के प्रति निर्देशों का यह अर्थ लगाया जाएगा कि वे उपनियम ( 6) के खण्ड (ख) मे विनिर्दिष्ट छह सप्ताह की अवधि के पर्यवसान की तारीख के प्रति निर्देश हैं । "
स्पष्टीकरण ज्ञापन
अनुपूरक नियम 317 -ख-3 के उपनियम ( 5 ) के द्वितीय परन्तुक का संशोधन स्पष्टीकरण के रूप में है और उसका आशय परन्तुक को केन्द्रीय सरकार द्वारा कार्यालय ज्ञापन सं ० 12031 ( 1 ) / 74- पालिसी II, तारीख 15 नवम्बर, 1975 और तारीख 9 दिसम्बर, 1975 के साथ पठित उसी संख्या के कार्यालय ज्ञापन , तारीख , 9 सितम्बर 1975 द्वारा अपने उन कर्मचारियो को सरकारी निवास स्थान के आबंटन की बाबत जिनके उन स्थानों पर , जहां ये पदस्थ हैं , अपने निवास स्थान हों , आबंटन की बाबत जारी किए आदेशो के अनुकूल बनाने और उन्हे 1 जनवरी 1976 से प्रभावी करने का है । अतः संशोधन को 1 जनवरी , 1976 से , जब अनुपूरक नियम 317 -ख -3 प्रवृत्त हुआ , भूतलधी प्रभाष से लागू करना पूर्वतर आदेशों के साथ नियमों की संगति की दृष्टि से आवश्यक हो गया है । ,
