WEALTH - TAX
New Delhi , the 31st March 1976
S.O. 267 ( E ) . In exercise of the powers conferred by section 46 of the Wealth- tax Act, 1957 ( 27 of 1957 ) , the Central Board of Direct Taxes hereby makes the following rules further to amend the Wealth - tax Rules , 1957 , namely:-
1. (1 ) These rules may be called the Wealth - tax ( Second Amendment ) Rules , 1976.
( 2) They shall come into force on the 1st day of April , 1976
2. In the Wealth - tax Rules , 1957 ( hereinafter referred to as the principal rules ) , after Chapter V , the following Chapter shall be inserted , namely :-
" CHAPTER VA
SETTLEMENT OF CASES
22A . Form of application for settlement of case ( 1 ) An application for settle- ment of a case under sub - section ( 1 ) of section 22C shall be made in quintuplicate in Form DA ,
(2) The form of application referred to in sub - rule ( 1 ) and the form of verl . fication appended thereto shall be signed by the person specified in section 15A .

(3 ) Every application in connection with the settlement of a case shall be accompanied by a fee of five hundred rupees .
22B . Fee for furnishing copy of report . ( 1 ) The following scale of fees shall be levied by the Settlement Commission for furnishing under section 22G a copy of any report or part of any report made by any Wealth - tax authority to the Settlement Commission ;-
For the first two hundred words or less
80 paise
For every additional hundred words or fraction thereof
40 paise .
(2) The fee referred to in sub - rule ( 1 ) shall be recovered in advance in cash ." .
3. In the principal rules , -
(a) in Form F,
(i) in item 6 , after the figures and brackets " 18 ( 1 ) " , the figures , letter and brackets "/ 18 ( 1 ) " shall be inserted;
(ii ) in item 7 , after the figures and brackets " 18 ( 3 ) " , the figures , letter and brackets " / 18A ( 1 ) " shall be inserted ;
(iii ) in item 8 , after the figures " 18 " , the figures , letter and brackets "/ 18A ( 1 ) / 23 " shall be inserted;
(b ) after Form D, the following Form shall be inserted , namely :-

NOTES :-
1. The application for settlement must be in quintuplicate ,
2. The application for settlement must be accompanied by a fee of five hundred rupees . The fee should be credited in the Treasury or a branch of the State Bank of India or a branch of the Reserve Bank of India and the triplicate challan sent to the Settlement Commission with the application for settlement , The Settle- ment Commission will not accept cheques, drafts , hundies or other negotiable instruments .
3. * The number and year of application will be filled in in the office of the Settlement Commission .
+4 . If the space provided is found insufficient , separate enclosures may be used for the purpose .
5. The application for settlement of a case shall not be allowed to be with- drawn by the applicant . " .

नई दिल्ली, 31 मार्च , 1976
का० श्रा० 267 ( प्र ) . केन्द्रीय प्रत्यक्ष कर बोर्ड, धन-कर श्रधिनियम, 1957 ( 1957 को 27 ) की धारा 16 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , धन - कर नियम, 1957 में और संशोधन करने के लिए निम्नलिखित नियम बनाता है, अर्थात्: -
1. ( 1 ) इन नियमों का नाम धन-कर ( द्वितीय संशोधन) नियम, 1976 है ।
(2) ये एक अप्रैल, 1976 को प्रवृत्त होंगे ।
2. धन कर नियम, 1957 ( जिन्हे इसमें इसके पश्चात् मूल नियम कहा गया है ) में, अध्याय V के पश्चात्, निम्नलिखित अध्याय जोड़ा जाएगा, अर्थात्: --
"अध्याय क
मामलों का समझौता
22क. मामले के समझौते के लिए आवेदन का प्ररूप. ( 1 ) धारा 22 क की उपधारा ( 1 ) के अधीन मामले के समझौते के लिए आवेदन प्ररूप घरु में पाच प्रतियों में किया जाएगा ;
( 2 ) उपनियम ( 1 ) में निर्दिष्ट आवेदन के , प्ररूप और उससे संलग्न सत्यापन के प्ररूप पर उस व्यक्ति द्वारा हस्ताक्षर किए जाएंगे जो धारा 15 क में विनिर्दिष्ट है ।
होगी । (3 ) किसी मामले के समझौते के सम्बन्ध में प्रत्येक आवेदन के साथ पांच सौ रुपये फीस
22 ख . रिपोर्ट की प्रति बने के लिए फीस ( 1 ) किसी धन कर प्राधिकारी द्वारा समझौता आयोग को दी गई किसी रिपोर्ट या किसी रिपोर्ट के भाग की धारा 22 छ के अधीन प्रतिलिपि देने के लिए समझौता आयोग द्वारा निम्नलिखित फीसमान अधिरोपित किया जाएगा :---
80 पैसे प्रथम दो मौ या उससे कम शब्दों के लिए

( 2 ) उपनियम ( 1 ) में निर्दिष्ट फीस नकद रूप में अग्रिम वसूल की जाएगी । " 3. मूल नियमों में.-
(क) प्ररूप व में,
( i) मद 6 में , " 18 ( 1) " श्रहों श्रोर कोष्ठकों के पश्चात्, " / 18 ( 1) " अंक , अक्षर और कोष्ठरु जोडे जाएंगे ;
( i ) मद 7 में , " 18 ( 3 ) " अंतो और कोष्ठक्रों के पश्चात्, " / 18 क ( 3 ) " अंक, अक्षर और कोष्ठक जोडे जाएंगे ;
( iii ) मद 8 में , " 18 " अंकों के पश्चात्, "/ 18 क ( 1 ) / 23 " अंक , अक्षर और कोष्ठक जोड़े जाएंगे ;
( ख ) प्ररूप घ के पश्चात् निम्नलिखित प्ररूप जोडा जाएगा , अर्थात :-

6. धन-कर प्राधिकारी जिसके समक्ष कार्यवाही/ कार्यवाहियां लम्बित है / हैं ।
7. यदि आवेदन , अपील अधिकरण के समय लम्बित किसी अपील का प्रत्याह्ररण करने के पश्चात् किया गया है तो वह तारीख जिसको अपील का प्रत्याहरण अनुज्ञात करने बाले अधिकरण का आदेश आवेदक को संसूचित किया गया था ।

* 3. मावेदैन की संख्या और वर्ष समझौता भ्रायोग के कार्यालय में भरे जाएंगे ।
+-4. यदि दिया गया स्थान अपर्याप्त पाया जाए तो इस प्रयोजन के लिए पृथक संलग्नकों का प्रयोग किया जा सकता है ।
5. किसी मामले के समझौते के लिए आवेदन का श्रावेदन द्वारा वापस लिया जाना अनुशात नहीं किया जाएगा । "
