का ० नि ० आ ० 188.-- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए और रक्षा मंत्रालय , राष्ट्र कोर महानिदेश लय ( वर्ग 1 श्रलिपिकवर्गीय ) भर्ती नियम , 1960 को और रक्षा मन्त्रालय, राष्ट्रीय कैडेट कोर महानिदेशालय ( वर्ग 1 राजपत्नित ) मि चारिषुम्द अधिकारी ( श्रेणी 1) भर्ती नियम, 1998 को अधिक्रान्त करते हुए रक्षा मंत्रालय , राष्ट्रीय कैडेट कोर महानिदेशालय में महिला कर्मचारिवृन्द अधिकारी समूह 'क' के पदों पर भर्ती की पद्धति को विनियमित करने वाले निम्नलिखित नियम बनाने हैं, अर्थात्: --
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय कैडेट कोर ( महिला कर्मत्रारिवृन्द अधिकारी ) भर्ती नियम, 1976 है ।
( 2) ये राजपक्ष में प्रकाशन की तारीख को प्रवृत्त होगे ।
2. लागू होना:-ये नियम इससे उपाबद्ध अनुसूची के स्तम्भ 1 में विनिर्दिष्ट पदो को लागू होगे ।
3. पद संख्या, वर्गीकरण और वेतनमान उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे जो उक्त अनुसूची के स्तम्भ 2 से 4 तक में विनिविष्ट हैं ।
4. भर्ती की पद्धति, थायु-सीमा और अहंताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, श्रहंताएं और उनसे संबंधित भन्य बातें वे होंगी जो उक्त प्रमुसूची के स्तम्भ 5 से 13 तक में विनिविष्ट हैं ।
5 निरर्हताएं:-वह व्यक्ति--
( क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या
(छ) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है ;
उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगाः
परन्तु यदि केन्द्रीय सरकार का समाधान हो जाए कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है भौर ऐसा करने के लिए अन्य भाधार मौजूद हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
6. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, उसके लिए जो कारण हैं उन्हें लेखयद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमो के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों या पदो की बाबत , आदेश द्वारा , शिथिल कर सकेंगी ।
7. व्यावृत्ति: इन नियमों की कोई भी बात ऐसे क्षारक्षणों और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए भादेशों के भनुसार भनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष प्रवर्गों के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(अर्हताएं , अन्यथा मुहित श्रभ्य- थियों की दशा में , संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ; विशेषतया, अनुभव सम्बन्धी अर्हता , अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यर्थियों की वशा में शिथिल की जा सकती है ) बांछनीय:

In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Ministry of Defence , Directorate General National Cadet Corps ( Class 1 Non-ministerial ) Recruitment Rules , 1960 and the Ministry of Defence , Directorate General Cadet Corps (Class I Gazetted) Lady Staff Officer ( Grade I) Recruitment Rules , 1968 , the President hereby makes the following rules regulating the method of recruitment to the Group A posts of the Lady Staff Officer in the Directorate General of National Cadet Corps , Ministry of Defence , namely :-
1. Short title and commencement . ( 1 ) These rules may be called the Ministry of Defence , Directorate General of National Cadet Corps ( Lady Staff Officer) Recruitment Rules , 1976 .
(2) They shall come into force on the date of their pub- lication in the Official Gazette .
2. Application. These rules shall apply to the posts spe- cified in column 1 of the Schedule annexed hereto:

4. Method of recruitment , age limit and qualifications.- The method of recruitment to the said posts , age limit , qualifications and other matters connected therewith shall be as specified in columns 5 to 13 of the Schedule afore- said:
5. Disqualifications . No person,-
(a) who has entered into or contracted , a marriage with a person having a spouse living or
(b) who having a spouse living , has entered into or contracted a marriage with any person,
shall be eligible for appointment to any of the said posts : Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
6. Power to relax. Where the Central Government is of opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recoded in writing, and in con- 298

S.R.O. 189.-In exercise of the powers conferred by sec- tion 184 of the Navy Act , 1957 (62 of 1957) , the Central Government hereby makes the following regulations further to amend the Navy (Pension) Regulations , 1964 .
का० मि० भा ० 189.- केन्द्रीय सरफार , नौसेना अधिनियम , 1957 (1957 का 62 ) की धारा 184 द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए, नौसेना (पेंशन ) विनियम, 1964 में और संशोधन करने के लिए निम्नलिखित विनियम बनाती है ।
1. (1) These Regulations may be called the Navy (Pension) Seventh Amendment Regulations , 1976 .
1. ( 1 ) इन विनियमों का नाम नौसेना ( पेंशन ) सातौँ संशोधन विनियम, 1976 है ।
(2) They shall come into force on the date of their pub- lication in the official Gazette.
( 2 ) ये राजपत्ता में प्रकाशन की तारीख को प्रवृत होंगे ।
2. In the Navy (Penston ) Regulations , 1964, for clause (iv) of sub- regulation (2) of regulation 187 , the following shall be substituted , namely :
2. नौसेना (पेंशन) विनियम , 1984 में विनियम, 187 को उप- विनियम ( 2 ) के खण्ड ( iv ) के स्थान पर निम्नलिखित रखा आएगा, अर्थात्:-
"( iv) Pensioners drawing their pensions from Treasuries, Post Offices and Pension Paymasters shall be allowed to draw their pensions on the last working day of the month , except in the month of March , if the first two days of the succeeding month are public holidays."
"( iv) खजानों, डाकघरों या पेंशन वेतन मास्टरों से अपनी पेंशन लेने वाले पेंशनरों को, मार्च मास के सिवाय भास के अंतिम कार्यकारी विन को, यदि पश्चात्वर्ती मास के प्रथम यो दिन सार्वजनिक छुट्टियां हैं पेंशन लेने की अनुज्ञा दी जाएगी । "

का० ति० आ० 190. केन्द्रीय सरकार, नौसेना श्रधिनियम, 1957 (1957 का 62 ) की धारा 134 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , नौसेना (पेंशन ) विनियम, 1964 में और संशोधन करने के लिए निम्नलिखित विनियम बनाती है, अर्थात्: --
(c) after sub - regulation ( 2) , the following Note shall be inserted, namely :-
1. ( 1 ) इन विनियमों का नाम नौसेना ( पेंशन) आठवाँ संशोधन विनि- यम, 1976 है ।
( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. नौसेना ( पेंशन ) विनियम, 1964 में , विनियन 69 में,--
"Note -Those discharged from service due to mis- conduct, corruption , lack of integrity or moral turpitude are not normally eligible for gratuity, but they may be sanctioned gratuity in excep- tional cases at the discretion of the President at a rate not exceeding that for which they are normally qualified ."
(क) उपांत शीर्षक में , "पदच्युत " शब्द के पश्चात् "हटाए गए " शब्द अन्तः स्थापित किए जाएंगे :

नई दिल्ली, 20 जुलाई , 1976 " ( 1 क ) ऐसे किसी व्यक्ति पर, जिसे अधिनियम की धारा 15 के अधीन सेवा से हटाया गया है, पेंशन या उपदान या दोमों का अनुदाम उस दर से करने के लिए विचार किया जा सकेगा जो दर उस दर से अधिक नहीं है, जिसके लिए वह, यदि उसे उसी तारीख को पदच्युत किया गया होता, तो श्रम्यथा अहित होता:
का० कि ० आ०191.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रक्षा अनुसंधान और विकास संगठन रक्षा मंज्ञालय, वर्ग 3 और वर्ग 4 ( अग्नि सेवा) पद भर्ती नियम, 1974 में और संशोधन करने के लिए निम्नलिखित नियम बनाते है, अर्थात्:-
परन्तु विनियम 5 के श्रधीन सक्षम प्राधिकारी , यदि श्रावश्यक समझा जाए, प्रत्येक मामले के गुणावगुणों पर, पेंशन या उपदान या दोनों की रकम में कोई कटौती कर सकता है । "
1. ( 1) इम नियमों का नाम रक्षा अनुसंधान और विकास संगठन रक्षा मंत्रालय, वर्ग 3 और वर्ग 4 ( अग्नि सेवा) पद भर्ती ( द्वितीय संशोधन) नियम, 1976 है ।
(ग) उपविनियम ( 2 ) के पश्चात् निम्नलिखित टिप्पण अन्तः-
स्थापित किया जाएगा , अर्थात्:-

S.R.O. 191. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President here- by makes the following rules further to amend the Defence Research and Development Organisation , Ministry of Defence Class III and Class IV (Fire Service) posts , Recruitment Kules, 1974 , namely :-
S.R.O. 190.-in excrcise of the powers conferred by sec- tion 184 of the Navy Act , 1957 ( 62 of 1957 ) , the Central Government hereby makes the following regulations Central to amend the Navy (Pension) Regulations , 1964 , namely :
1. ( 1 ) These regulations may be called the Navy ( Pension) Eight Amendment Regulations , 1976 .
1. (1) These rules may be called the Defence Research and Development Organisation , Ministry of Defence Class III and Class IV ( Fire Service) posts , Recruitment ( Second Amendment) Rules , 1976:
(2) They shall - come into force on the date of their pub- lication in the Official Gazette .

69, 2. In the Navy (Pension ) Regulations , 1964, in regulation
(a) in the marginal heading , after the word "dismissed" , the word "removed" shall be inserted;
(b) alter sub- regulation (1 ) , the following sub -regulation shall be inserted , namely :-
2. In the Schedule to the Defence Research and Develop- ment Organisation, Ministry of Defence Class III and Class IV (Fire Service) posts, Recruitment Rules , 1974 against Sl . No. 1 relating to the post of Junior Instructor , under column 7 , for the existing entry , the following entry shall be substituted, namely :--
"Not exceeding 40 years" .
"( IA) A person who is removed from service under section 15 of the Act, may be considered for the grant of pension or gratuity or both at the rate not exceeding that for which he would have other- wise qualified had he been discharged on the same date :
