ORDER
New Delhi , the 2nd August 1976
S.O. 520 (E ) . In exercise of the powers conferred by sub - rule ( 2) of rule 114 of the Defence and Internal Security of India Rules , 1971 , the Central Govern- ment hereby makes the following Order further to amend the Packaged Com- modities ( Regulation ) Order , 1975 , namely:-
1. ( 1 ) This Order may he called the Packaged Commodities Amendment Order , 1976 . (Regulation)
(2) It shall come into force after a period of one month from the date of its publication in the Official Gazette
2. In the Packaged Commodities ( Regulation ) Order , 1975,-
( i) in paragraph 2 ,-
(a) in clause (e ) , the words " to any person other than a dealer " shall be added at the end:
(b) in clause ( h ) , for the words , " or dissimilar " , the brackets and words " (whether in quantity or size ) " , shall be substituted;

(c) in clause (1 ) , for the words " whether of identical quantity or not " the words " of identical quantity " shall be substituted;
(d) in clause ( m ) , for the words " so that the quantity of the product" , the words "so that the product or the quantity of the product" shall be substituted ;
(e) in items ( i ) of clause ( n ) after the words " ex - factory price" the words " inclusive of commission payable to wholesalers and retailers and of other charges , including advertising , delivery , packing , forwarding and the like ; and " shall be inserted;
( ii ) in sub -paragraph ( 1 ) of paragraph 3 ,-
(a) in clause ( iii ) , for the word " pre - packed : " , the words " manufac- tured or pre - packed : " shall be substituted;
(b) in the first proviso to clause ( fil ) , for the word "pre- packed" , the words "manufactured or pre - packed " shall be substituted;
(c) in the first proviso to clause ( iii ) , for item ( b ) , the following shall be substituted , namely : -
" (b ) any package containing bread and any uncanned package of vegetables , fruits , ice - cream , butter , cheese , fish meat ог the like;"
(d) in the proviso to clause ( iv) , for item ( a) the following shall be substituted , namely : -
" (a) any uncanned package of vegetables , fruits , ice- cream , butter , cheese , fish , meat or the like ;" ;
( e) after sub - paragraph ( 3 ) , the following shall be inserted , namely : -
" ( 3A ) It shall be the duty of the manufacturer , or , where the manu- facturer is not the packer , of the packer , to ensure that the provisions of sub - paragraph ( 3 ) are complied with by the wholesaler. " ;
( f ) in the proviso to sub - paragraph ( 7 ) of paragraph 3 , after the word "weight " , the words " or measure " shall be added ;
(iii) in sub - paragraph ( 2 ) of paragraph 5 , the following shall be added at the end, namely : " and also a list indicating the rates at which local taxes ( including Central Sales Tax, if not included in the price indicated on the package ) are lcviable on the commodities contained in packages sold by him . " ;
( iv) in paragraph 7,-
(a) in sub - paragraph ( 3 ) , after the words " the total quantity contained in the multi - piece package " , the words , " the month and the year in which the commodity was manufactured or pre - packed , name and address of the manufacturer , or where the manufac- turer is not the packer , of the packer" shall be inserted ;
(b) for sub -paragraph ( 4 ) , the following shall be substituted , namely : -
" (4) Where the dimensions and weight , or combination thereof, of a commodity has or have a relationship to the price of that com- modity , the declaration of quantity on the package containing such commodity shall also include a declaration as to such dimensions , weight or combination , " ;
(v) in paragraph 8 ,-
( a) in sub - paragraph ( 1 ) , for the figures and words " 20 samples at random from each batch of packages " , the words " samples at random from each batch of packages in accordance with the provisions of the Third Schedule. " shall be substituted ;
(b) in sub - paragraph ( 5) in clause (b ) for the words " the error " , the words " the error in deficiency " shall be substituted ;

(vl ) ( a) in paragraph 11 , after clause ( b ) , the following explanation shal be inserted , namely :-
"Explanation .--In clauses ( a) and ( b ) of this paragraph , the expression " industry " does not include any workshop , service station or any other place where servicing or repairing of any motor vehicle within the meaning of the Motor Vehicles Act , 1939 , is under- taken. "
(b) in clause ( f ) , for the words " the commodity " , the words 'the commo- dity , if sold by weight or measure , " shall be substituted ;
(vii ) after the second Schedule , the following shall be inserted , namely :-

MANNER OF SELECTION OF SAMPLES OF PACKAGES
1. Where , for the determination of the net quantity of any commodity contained in a package , it is necessary to open the package , taken by way of sample , and it is not possible to refill such package , such sample shall be selected al random having regard to the total number of packages in the batch . In such a case, the number of packages to be selected as samples shall be the number specified in column ( 2 ) of Table I, corresponding to the entry in column ( 1 ) of that Table .

2. Where , for the determination of the net quantity of any commodity con- tained in a package , it is not necessary to open the package , taken by way of sample , or where it is necessary to open only one or two packages , taken by way of samples for the purpose of determining the tare , such sample shall be selected at random having regard to the total number of packages in the batch . In such a case , the number of packages to be selected as samples shall be the number specified in column ( 2 ) of the Table II , corresponding to the entry in column ( 1 ) of that Table .

sample shall be selected at random , from every batch of packages and shall be расkеd out from the top , bottom , centre , right , left , front ; rear ; etc. of the stocks so that the samples may adequately represent the packages in the batch.
4. Where , for the determination of the net quantity of any commodity con- tained in a package , it is necessary to take samples from the place where the package is being filled such sample shall be selected from among the packages which have already been filled , or in the alternative , the requisite number of empty containers may be taken over and each of them shall be adequately marked for proper identification and the tare of each container shall be accu- rately noted and thereafter the marked out containers shall be introduced at random in the packing process so that , after the packages are filled it may be possible to determine whether the packages do contain the net quantity of the commodity as declared on the container .

आदेश
नई दिल्ली, 2 अगस्त , 1976
का० पा ० 520 (प) .- केन्द्रीय सरकार, भारत रक्षा और श्रान्तरिक सुरक्षा नियम , 1971 के नियम 114 के उपनियम ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , पॅकेज में रखी गई वस्तु (विनियमन ) आदेश, 1975 में और संशोधन करने के लिए निम्नलिखित आदेश देती है, अर्थात्ः - 1. ( 1 ) इस आदेश का नाम पैकेज में रखी गई वस्तु ( विनियमन ) संशोधन श्रादेश, 1976 है ।
( 2 ) यह राजपत्त्र मे प्रकाशन की तारीख से एक मास की अवधि के पश्चात् प्रवृत्त होगा ।
2. पकेज में रखी गई वस्तु ( विनियमन ) आदेश , 1975 में,-
( i ) परा 2 में, --
(क) खण्ड (ङ) में, अन्त में " जबकि ऐसे विनिर्माता द्वारा वस्तु का वितरण किया जाता है" शब्दों के स्थान पर " जबकि ऐसे विनिर्माता द्वारा व्यवहारी से भिन्न किसी व्यक्ति को वस्तु का वितरण किया जाता है " शब्द रखे जाएंगे ;
( ख ) खण्ड ( ज ) में, " या असमान " शब्दों केके स्थान पर " ( चाहे मात्रा में या श्राकार में) , " कोष्ठक , शब्द और कामा रखे जाएंगे ;
(ग ) खण्ड ( ठ ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा , अर्थात्ः--
(ठ ) "बहु - खण्डीय पैकेज " से ऐसा पैकेज अभिप्रेत है , जिसमें एक ही वस्तु के, अभिन्न मात्रा मे , दो या अधिक नृथक पैकेज बन्द किए गए या लेबल किए गए खण्ड हैं, जो पृथक् खण्डो मे या सम्पूर्ण पैकाज के रूप में फुटकर बिक्री के लिए श्राशयित हों;
(ध) खण्ड ( ड ) में , " जिससे उसमें रखे गए उत्पाद की मात्रा " शब्दो के स्थान पर "जिससे उसमें रखे गए उत्पाद या उत्पाद की मात्रा " शब्द रखे जाएंगे , भारत का असाधारण राजपत्र

(ङ ) खण्ड ( क ) की मद ( i ) में, " कारखाना बाह्य मूल्य " शब्दों के पश्चात् " जिसमें थोक विक्रेताओं और फुटकर- विक्रेताओं को संदेय कमीशन और अन्य प्रभार, जिसमें विज्ञापन , परिदान , पंक करना , परेषण और समरूप बातें आती हैं , सम्मिलित हैं ; और " शब्दों को अन्तःस्थापित किया जाएगा;
( ii ) पैरा 3 के उपपरा ( 1 ) में,--
(क) खण्ड ( iii ) में, " जिसमें वस्तु" शब्दों के पश्चात् " विनिर्मित या " शब्द अन्तःस्थापित किए जाएंगे;
(ख) खंड ( iii ) के प्रथम परन्तुक मे, " जिसमें वस्तु" शब्दों के पश्चात् " विनिर्मित या " शब्द अन्तःस्थापित किए जाएंगे ;
( ग ) खंड ( iii ) के प्रथम परन्तुक में , मद ( ख ) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्ः-
( ख ) ऐसे पैकेज, जिनमें ब्रेड है और सब्जियों, फलों, आईसक्रीम , मक्खन , पनीर, मछली , मांस या समरूप वस्तुओं के ऐसे पैकेज, जो डिब्बाबन्द नहीं हैं, पर किसी घोषणा की थाथ- श्यकता नही होगी;
( घ ) खण्ड( iv ) के परन्तुक मे , मद ( क ) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्ः--
( क ) सब्जियों , फलो , आईसक्रीम , मक्खन , पनीर, मछली , मांस या समरूप वस्तुओं के एसे पैकेजों पर , जो डिब्बाबन्द नहीं है , मूल्य सम्बन्धी घोषणा करने की अपेक्षा नही होगी;
( ङ) उपपैरा ( 3 ) के पश्चात् निम्नलिखित अन्तःस्थापित किया जाएगा , अर्थात्ः-
" ( 3 क ) विनिर्माता का , या जहां विनिर्माता पंकर नहीं है वहां पैकर का , यह कर्तव्य होगा कि वह यह सुनिश्चित करे कि थोक विक्रेता द्वारा उपपैरा ( 3 ) के उपबन्धों का अनुपालन किया गया है । "
( च ) पैरा 3 के उपपैरा ( 7 ) के परन्तुक में , " भार " शब्द के पश्चात् " या माप " शब्द जोड़े जाएंगे;
( iii) पैरा 5 के उपपैरा ( 2 ) में , अन्त में , " फुटकर विक्रय कीमत " शब्दों के पश्चात् " और साथ ही ऐसे दरें दर्शाते हुए , जिन पर उसके द्वारा बेचे गए पैकेजों में रखी वस्तुओं पर स्थानीय कर ( जिसमें कन्द्रीय विक्रय कर भी , यदि उसे पंकज पर उपदर्शित कीमत मे न जोड़ा गया हो तो , सम्मिलित है ) उद्ग्रहणीय हैं , एक सूची " शब्द अन्तःस्थापित किए जाएंगे ।
(iv) पैरा 7 मे,-
(क) उपपरा ( 3 ) में, " बहु -खण्डीय पैकेज मे रखी गई कुल मात्ना " शब्दों के पश्चात् " वह मास और वर्ष , जिसमें वस्तु " विनिर्मित या पहले से ही पंक की गई थी, विनिर्माता का, या जहां विनिर्माता पंकर नहीं है , वहां पैकर का , नाम और पता " शब्द भन्तःस्थापित किए जाऐंगे ;
(ब ) उप-परा ( 4) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्ः--
" ( 4) जहां वस्तु की लम्बाई, घौड़ाई और तोल या उन के समुच्यय का उस वस्तु के मूल्य से सम्बन्ध हो वहां उस पंकज के ऊपर , जिस में वह वस्तु रखी है , अंकित मात्रा की THE GAZETTE OF INDIA EXTRAORDINARY PART II-SEC. 3 (11) 1624
घोषणा में ऐसी लम्बाई - चौडाई, तौल या समुच्यय सम्बन्धी घोषणा भो सम्मिलित होगी" ;
(v) पैरा 8 में, -
( क) उप-पैरा ( 1 ) मे अक और गब्द "पैकेजों के प्रत्येक बँच से यादृच्छिक रूप से 20 नमूने, " के स्थान पर शब्द " तृतीय अनुसूची के उपबन्धों के अनुसार पैकेजों के प्रत्येक बैच से यत्त्र- तत्त्र से नमूने " रखे जाएंगे ;
( ख) उप-पैरा ( 5 ) के खंड (ख ) में, " त्रुटि " शब्द के स्थान पर " ऊनता में वृटि" शब्द रखे जाएंगें ।
( क) पैरा 11 मे खट ( ख ) के पश्चात् निम्नलिखित स्पष्टीकरण अन्तःस्थापित (vi)
किया जाएगा, अर्थात --
"
स्पष्टीकरण. इस पैरा के खण्ड ( क) और ( ख) मे " उद्योग " शब्द के अन्तर्गत कोई कर्मशाला , सर्विस स्टेशन या ऐसा अन्य स्थान नही है जहा मोटर यान अधिनियम, 1939 के अर्थ के अन्तर्गत आने वाले किसी मोटर यान की सर्विस या मरम्मत की जाती हो " ।
(ख) खण्ड (च ) में " वस्तु" शब्द के स्थान पर " वस्तु , यदि वह तोल कर या माप से बेचो जाए तो, " शब्द रखे जाएगे ,
(vii) द्वितीय अनुसूची के पश्चात् निम्नलिखित अन्त स्थापित किया जाएगा, अर्थात्ः--

पैकेजों के नमूने चुनने की रीति--
1. जहा किसी पैकेज में रखी हुई वस्तु की शुद्ध मावा अवधारित करने के लिए , नमूने के नोर पर लिए गए पैकेज को खोलना आवश्यक हो आर ऐसे पैकज को फिर से भर देना सम्भव न हो यहा उस बैच के पैकेजों की कुल सख्या को ध्यान में रखते हुए यत्त्र- तत्व से ऐसा नमूना चुना जाना चाहिए । ऐसे मामले में नमूनों के तौर पर चुने जाने वाले पैकेजों कीसच्या सारणी-1 के स्तम्भ ( 2 ) में विनिर्दिष्ट सख्या होगी जाउससारणी के स्तम्भ ( 1 ) की प्रविष्टि की तत्स्थानो होगी ।

2. जहां किसी पैकेज में रखी हुई वस्तु की शुद्र मात्रा अवधारित करने के निए नमूने के तौर पर लिए गए पैकेज को खोलना अ वश्यक न हो या जहां पैकेज का वजन श्रवधारित करने के प्रयोजनार्थ नमून के तौर पर लिए गए एक या दो पैकेजों को खोलना आवश्यक हो , वहां बैच के पैवेजों की कुल संख्या को ध्यान में रखते हुए यत्र - तत्न से ऐसे नमूने चने जाएंगे । ऐसे मामले में नमूनों के तौर पर चुने जाने व से
की संख्या सारणी 2 के स्तम्भ ( 2 ) में विनिदिष्ट संख्या होगी जो उस सारणी के स्तम्भ ( 1 ) की प्रविष्टि की तत्स्थानी होगी ।

जहां किसी पैकेज में रखी हुई किसी वस्तु की शुद्ध मात्रा अवधारित करने के लिए विनिर्माता या पैकरद्वारा भाण्डागार , गोदाम या किसी अन्य स्थान में रखे गए पैकेजों वेः नमूने लेना श्रावश्यक हो वहां पैकेजों मेंः प्रत्येक बैच्च में से यत्र- तत्र से नमूने चुने जाएंगे और नमूने स्ट क के ऊपर से , सबसे न'चे से , बीच में से, बाएं से , बाएं से , पीछे आदि से इस प्रकार निकाले जाएंगे ताकि वे उस बैच के पैकेजों का पर्याप्तरून से निरुपण कर सकें ।
4. जहां किसी पैकेज मं रखी हुई किली वस्तु की शुद्ध मात्रा अवधारित करने के लिए उस स्थान से, जहा पैकेज भरा जा रहा हो , नमूने लेना श्र वश्य क हो, वहां ऐसे नमूने उन पैकेजों में से लिए ज एंगे जो भरे जा चुके हों या, विकल्प्तः , अपेक्षित संख्या मे रिक्त आधान ले लिए जाएंगे और उनमें से प्रत्येक को समुचित पहचान के लिए पर्याप्तरूप से चिन्हित कर दिया जाएगा तथा प्रत्येक आधान का वजन ठीक -ठीक नोट कर लिया जाएगा और तत्पश्चात्चिन्हि अधनों को पंवेज करने की प्रक्रिया में यत्त्र- तत्त्र रख दिया जाएगा ताकि पैकेजों को भर दिए जाने के पश्चात् यह अवधारण करना सम्भव हो सके कि आधान पर घोषित की गई वस्तुकी शुद्ध मात्रा वस्तुतः पैकेज के भीतर है या नहीं ।
