2. The dispute relates to 34 workmen who were alleged to be working as casual labourers in the Jambad colliery, which is now under the management of Coal Mines Autho- rity Limited. They stated thnt they were stopped from work with effect from 8-4-) 974 without any just or proper reason and that therefore they shall be reinstated.

3. The Coal Mines Authority Limited stated that the workmen nos. 9, 10, 13, 15, 17, 19, 20, 26, 32 and 33 never worked in the colliery and that they arc not entitled to any relief. With regard to the rest employers stated that they worked on certain days in a month, but they did not turn up for work afterwards.

4. When the reference came up for hearing today, the evidence of the Vice-President of the Union which spon- sored the case of the workmen, was recorded as the sole witness. He admits in his evidence that the workmen des- cribed in Ext. M-l list worked upto 8-4-74. With regard to 10 others he is not able to produce any documents. So we have to rely upon Ext. M-l list to show that the work- men contained in the list alone worked upto 8-4-74. They are workmen nos. 1 to 8, 12, 12,, 14, 16, 18, 21 to 25, 27 to 31 and 34. The employers did not adduce any counter evidence. It has therefore to be found that the workmen in Ext. M-l list above worked upto 8-4-74 and that they are entitled to come in as Casual labourers. Others, 10 in number, never worked as casual labourers before 8-4-74. The Union is also not able to produce any document or other evidence to prove that those 10 men worked as casual labourers at any time. In the absence of any evidence I find that workmen nos. 9, 10, 13, 15, 17, 19, 20, 26, 32 and 33 arc not entitled to any relief. The other workmen will be admitted as Casual workers to the colliery as and when work is available to casual labourer. But they would get preference over other casual workers who were appointed for work after 8-4-1974. The stopping of work in respect of 24 workmen referred to above is un- justified. No other relief is called for.

5. In the result, an award is passed in favour of the work- men nos. 1 to 8, 11, 12, 14, 16, 18, 21 to 25, 27 to 31 and 34 admitting them as Casual workers of the colliery and giving them work as and when such casual work is avail- able in preference to the casual workers recruited aftci 8-4-1974. And the claim of workmen nos. 9, 10, 13, 15, 17, 19, 20, 26, 32 and 33 is rejected.

AWARD

The Government of India, Ministry of Labour, by their Order No. L-19012/1/75-D. iTTB dated 14th July, 1975, referred an industrial dispute between the employers in rela- tion to the management of Jambad Colliery of the Coal Minei Authority Limited and their workmen, to this tribunal for ad- judication. The reference reads :

"Whether the action of the management ol Coal Mines Authority Limited in relation to Jambad Colliery, Post OHice Kajoragram, District Burdwan are jus- tified in stopping the employment of Sarva Shri Durja Dasa, Gantai Dasa, Ninga Nayaka, Govinda Dasa, Trinath Pradhana, Bancha Scnapa:i and Bauri Sahu, General Mazdoor/Wagon Loaders with effect from 16th September, 1974 ? If not, to what relief are the said workmen entitled 7"

2. Of the seven workmen mentioned in the Reference, Bauri Sahu (No. 7) had already been reinstated to the col- liery in question.

3. With regard to the rest, the Union Secretary ov.irained as a witness wants to have only No. 1 (Durja Dasa) and No. 5 (Trinath Pradhan) to be reinstated as casual workers. The management agrees to this demand. There was no case made out in favour of Nos. 2, 3 and 4 in the Refer- ence. They arc not therefore entitled to any relief.

4. In the result an award is passed in favour of work- men Nos. 1 and 5 (Durja Dasa and Trinath Pradhan) re- instating them as Casual labourers with immediate .ellect to Jambad Colliery subject lo the right of preference already given to the Casual labourers under an award dated 6-7-1976 in Reference No. 31 of 1975. The two workmen (Nos. I and 5) will get preference over all (he rest of the new casual employees who were recruited after 16-9-1974. Tlu.v are however not entitled to get any back wages. They .will be absorbed as and when casual vacancies arise in (he col- liery. The claim of the workmen nos. 2, 3 ;ind •! in Ihc Reference is rejected.
