NOTIFICATION

CENTRAL EXCISES

New Delhi, the 26th August 1976

G.S.R. 767(E).—In exercise of the powers conferred by sub-rule (i) of rule 8 of the Central Excise Rules, 1944, the Central Government hereby makes the following further amendments to the notification of the Government of India in the Department of Revenue and Banking No 198/76-Central Excises, dated the 16th June, 1976 namely:—

in the said notification, after paragraph 3, the following paragraph shall be inserted- namely:—

"3A Where a manufacturer—

(i) docs not clear the whole or any part of any excisable goods specified against serial No, 26 of the Table hereto annexed but manufactures, from the said excisable goods not so cleared, any article; or

'ii) manufactures, from molten metal obtained in the processing of alumina or bauxite or both, articlein either case falling within any of the sub-items [not being sub-item (a)(i)] of Item No. 11 of the First Schedule to the Central Excises and Salt Act. 1944 (I of 1944) and clears such, article from the factory, then for the purposes of (his notification, such manufacturer shall be deemed to have cleared the excisable goods specified against the said serial No. 26."
