5.0, 627 (E) . In exercise of the powers conferred by clause ( g) of sub - section ( 1) of section 16 of the General Insurance Business (Nationalisation ) Act , 1972 ( 57 of 1972 ) , the Central Government hereby frames the following Scheme to regulate the termination . superannuation and retirement of Officers and Development Staff of the General Insurance Corporation and of its Companies , namely:-
1. Short title and commencement. ( 1 ) This Scheme may be called the General Insur- ance (Termination , Superannuation and Retirement of Officers and Development Staff) Scheme, 1976 .
(2) It shall come into force on the date of its publication in the Official Gazette .
2. Application. The provisions herein contained shall apply to all Officers and Deve- lopment Staff.

3. Definitions . In this Scheme, unless the context otherwise requires ,-
(a) "Act" means the General Insurance Business (Nationalisation) Act , 1972 (57 of 1972);
(b) "Board" means the Board of Directors of the Corporation or of the Company and includes , in relationto the exercise of powers of such Board , any com- mittee of the Board to which , or any officer of the Corporation or Company to whom, the Board has delegated any of its powers ;
( c) " Chairman" means ,-
(i) in relation to the Corporation , the Chairman;
(ii) in relation to the Company , the Chairman- cum -Managing Director ;
(d) " Company " means the National Insurance Company Limited , the New India Assurance Company Limited , the Oriental Fire and General Insurance Com- pany Limited , or the United India Fire and General Insurance Company Limited;
(e) " Corporation " means the General Insurance Corporation of India formed under section 9 of the Act ;
(f) "Devclopment Staff " means persons of the Development Staff as defined in clause (9 ) of paragraph 3 of the General Insurance ( Rationalisation of Pay Scales and Other Conditions of Service of Development Staff) Scheme , 1976;
( g ) " Officer " means an officer as defined in clause ( 1) of paragraph 3 of the General Insurance (Rationalisation of Pay Scales and Other Conditions of Service of Officers ) Scheme , 1975 and working in the Corporation or the Company;
(h) " Service" means the service under the Corporation or the Company , as the case may be;
(i) " transferred Development Staff" means persons in the servico of an Indian Insurance Company before the 1st day of January , 1973 and employed for the purpose of procuring general insurance business and categorised or designated as "Development Superintendent " or " Inspector Grade 1" or " Inspector Grade II " or as "Field Worker " under the General Insurance (Rationalisation of Pay Scales and Other Conditions of Service of Develop- ment Staff) Scheme , 1976;
( j ) " transferred Officer " means an officer who was deemed to have become an officer of the Corporation or of an Indian Insurance Company before the 1st day of January , 1973 , or any employee , as defined in paragraphs 3 ( C) of the General Insurance (Rationalisation and Revision of Pay Scales and other conditions of service of Supervisory , Clerical and Subordinate Staff) Scheme , 1974 who joined the service of the Corporation or of any Indian Insurance Company before the 1st day of January , 1973 and is promoted subsequently as an officer .
4. Superannuation and retirement ( 1 ) A transferred Officer or a person of the trans- ferred Development Staff shall retire on attaining the age of 60 years .
(2) An officer or a person of the Development Staff , appointed on or after the 1st day of January , 1973 , shall retire on attaining the age of 58 years .
Explanation . Where an officer or a person of the Development Staff has earned leave to his credit according to the rules framed by the Corporation or the Company , but not availed of as on the date of his retirement , and provided that he had applied for such leave sufficiently in advance before the date of his retirement and the leave was refused by the competent authority , he maybe permitted to avail of the leave on reaching the age of 60 years or 58 years , as the case may be , and in that case , the Officer or the person concerned will be deomed to retire from Service at the expiry of the leave so refused .
(3 ) Notwithstanding anything contained in sub - paragraph ( 1 ) or sub -paragraph ( 2 ) ,
(a) the Central Government , in respect of an Officer referred to in the First Sche dule appended to the General Insurance (Rationalisation of Pay Scales and Other Conditions of Service of Officers ) Scheme, 1975 ;

(b) the Board of the Corporation, in respect of the General Manager or Assistant General Manager referred to in the Second Schedule appended to the Scheme referred to in clause (a ) ;
(c) the Board of a company , in respect of an officer other than an officer referred to in clause ( a) or clause (b) , or in respect of a person of the Developinent Staff may , after giving the officer or person concerned three months' notice or salary in lieu thereof , determine the service of such officer or person-
(i) if he is a transferred officer or a person of the transferred Development Staff , after attaining the age of 55 years ; or
( ii) if he is appointed on or after the 1st day of January , 1973 , after attaining age of 50 years .
(4) Nothing contained in the foregoing sub- paragraphs shall affect the right of the appointing authority ,-
( a) to retire , remove or dismiss an officer or a person of the Development Staff in accordance with the provisions of the Conduct , Discipline and Appeal Rules framed by the Corporation or the Company , as the case maybe , in respect of its employces ;
(b) to terminate the Service of a person of the Development Staff in accordance with the provisions of sub - paragraph ( 3 ) of paragraph 5 or paragraph 11 of the General Insurance ( Rationalisation of Pay Scales and Other Condi- tions of Service of Development Staff ) Scheme , 1976;
(c) to retire an officer or a person of the Development Staff without notice or pay in lieu thereof on his being certified by a medical examiner , to be nominated for the purpose by the appointing authority , as being incapacitated for fur- ther continuous service either due to continued illness or accident :
Provided that if an officer or a person of the Development Staff has earned leave to us credit and be avails of such earned leave from the date such decision to retire him under this sub - paragraph is communicated to him , he will be permitted to avail of the full earned leave to his credit , in which event his retirement shall take effect from the date of expiry of such leave .
5. Determination of service . ( 1 ) An officer or a person of the Development Staff, other than one on probation , shall not leave or discontinue his Service without first giving notice in writing to the appointing authority of his intention to leave or discontinue the Service and the period of notice required to be given shall be three months :
Provided that such notice may be waived in part or in full by the appointing autho- rity at its discretion .
Explanation 1. In this Scheme , month shall be reckoned according to the English calendar and shall commence from the day following that on which the notice is received by the Corporation or the Company , as the case may be .
Explanation II .- A notice given by an officer or a person of the Development Staff under this paragraph shall be deemed to be proper only if he remains on duty during the period of notice and such officer or person shall not be entitled to set off any leave earned against the period of such notice.
(2) In case of breach by an officer or a person of the Development Staff of the provi- sions of sub - paragraph ( 1 ) , he shall be liable to pay to the Corporation or the Company concerned , as the case may be . as compensation sum coual to his salary for the period of notice required of him which sum may be deducted from any monies due to him .

का ० प्रा ० 627 ( प्र ) . साधारण वीमा कारबार ( राष्ट्रीयकरण ) अधिनियम , 1972 (1972 का 57) की धारा 16 की उपधारा ( 1 ) वेो खण्ड ( छ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार साधारण बीमा निगम और उसकी कम्पनियों के अधिकारियों और विकाप्त कर्मचारिवृन्द की सेवा की समाप्ति , श्रधिर्वाषता पर निवृत्ति तथा सेवा निवृत्ति के विनियमन के लिए निम्नलिखित स्कीम बनाती है, अर्थात्:--
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इस स्कीम का नाम साधारण बीमा ( अधिकारियों औरविकास कर्मचारिवृन्द की सेवा सभाप्ति , अधिवषिता पर निवृत्ति और सेवानिवृत्ति) स्कीम , 1976 है ।
( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. लागू होना.--इसमें सम्मिलित उपबन्ध सभी अधिकारियों और विकास कर्मचारिवृन्द कोलागू होंगे ।
3. परिभाषाएं. इस स्कीम में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो- (क ) " अधिनियम" से साधारण बीमा कारबार ( राष्ट्रीयकरण ) अधिनियम, 1972 (1972का 57) श्रभिप्रेत है ;
(ख) "बोर्ड" से निगम का या वाम्पनी का निदेशक बोर्डअभिप्रेत है और इसके प्रन्तर्गत, ऐसे बोर्ड की शक्तियों के प्रयोग के सम्बन्ध में, बोर्ड की कोई ऐसी समिति या निगम का कोई अधिकारी या ऐसी कम्पनी भी है , जिसे बोर्ड ने अपनी शक्तियों में से कोई प्रत्यायोजित की हों ;
(ग) "अध्यक्ष" से,-
( i) निगम के सम्बन्ध में, अध्यक्ष ; और
( ii ) कम्पनी के सम्बन्ध में, अध्यक्ष एवं प्रबन्ध निदेशक अभिप्रेत है ;
(घ) " कम्पनी" से नेशनल इंश्योरेंस दाम्पनी लिमिटेड, द न्यू इण्डिया एश्योरेंस कम्पनी लिमिटेड, द ओरियन्टल फायर एण्ड जनरल इंश्योरेंस कम्पनी लिमिटेड, या द युनाइटेड इण्डिया फायर एण्ड जनरल इंश्योरेंस कम्पनी लिमिटेड, अभिप्रेत है ;
(ङ) "निगम" से अधितियय को धारा 9 के अधोन बनाया गया भारतीय साधारण बीमा निगम अभिप्रेत है ; " भारत का असाधारण राजपचन

( च) " विकास कर्मचारिवृन्द " से साधारण बीमा ( विकास कर्मचारिवृन्द के वेतन मानों और सेवा की अन्य शर्तों का सुव्यवस्थीकरण ) स्कीम, 1976 के पैरा 2 के खण्ड ( 9 ) में यथा परिभाषित विकास कर्मचारिवृन्द में के व्यक्ति अभिप्रेत हैं ;
( छ) " अधिकारी" से साधारण बीमा ( अधिकारियों के वेतनमानों और सेवा की अन्य शतौं का सुव्यवस्थीकरण ) स्कीम , 1975 के पैरा 3 के खण्ड ( 1 ) में यथा परिभाषित और निगम या कम्पनी में कार्य कर रहा अधिकारी श्रभिप्रेत है ,
(ज) "सेवा" से अभिप्रेत है , यथास्थिति, निगम या कम्पनी के अधीन सेवा ;
( क्ष ) " अन्तति विकास कर्मचारिवृन्द" से वे व्यक्ति अभिप्रेत हैं जो 1 जनवरी , 1973 से पूर्व किसी भारतीय बीमा कम्पनी की सेवा में थे और साधारण बीमा कारबार उपाप्त मारने के प्रयोजन के लिए नियोजित किए गए थे , और जो साधारन बीमा ( विकास कर्मचारिवृन्द के वेतनमानों और सेवा की अन्य शर्तों का सुव्यवस्थीकरण ) स्कीम, 1976 के अन्तर्गत " विकास अधीक्षक" या "निरीक्षक श्रेणी 1 " या " निरीक्षक श्रेणी 2" या "फील्ड कार्यकर्ता" के रुप में प्रवगोष्कृत या पदाभिहित किए गए हैं ;
(ञ) ' अन्तरित श्रधिकारी' से अभिप्रेत है, ऐसा कोई अधिकारी जिस के बारे में यह समझा जाता था कि वह , 1 जनवरी 1973 से पूर्व निगम या किसी भारतीय बीमा कम्पनी का अधिकारी हो गया है या ऐसा कोई कर्मचारी जिसकी परिभाषा साधारण बीमा ( पर्यवेक्षी, लिपिकीय और अधीनस्थ कर्मचारिवृन्द वेतनमान तथा सेवा की अन्य शर्तों का सुव्यवस्थीकरण और पुनरीक्षण ) स्कीम, 1974 केके पैरा 3 ( ग ) के अधीन की गई है जो 1 जनवरी , 1973 से पूर्व निगम या किसी भारतीय बीभा कम्पनी की सेवा में श्राया हो और तत्पश्चात् उसे अधिकारी केके रुप में प्रोप्नत किया गया हो ।
4. अधिवषिता पर निवृत्ति और सेवा निवृत्ति ( 1 ) अन्तरित अधिकारी या अन्तरित विकास कर्मचारिबून्द में का कोई व्यक्ति साठ वर्ष की आयु प्राप्त कार लेने पर सेवा निवृत हो जाएगा ।
( 2) कोई अधिकारी या विकास कर्मचारिवृन्द में का व्यक्ति , जो 1 जनवरी , 1973 को या उसके पश्चात् नियोजित किया गया हो , 58 वर्ष की आयु प्राप्त कर लेने पर सेवा निवृत हो जाएगा ।
स्पष्टीकरण-जहां किसी अधिकारी या विकास कर्मचारिवृन्द में केके व्यक्ति ने अपने जमाखाते में निगम या कम्पनी द्वारा बनाए गए नियमों के अनुसार छुट्टी उपार्जित करली है किन्तु अपनी सेवा निवृत्ति की तारीख तक उसका उपभोग नहीं किया है , तथा यदि उसने अपनी सेवा निवृत्ति की तारीख से पर्याप्त समय पूर्व ऐसी छुट्टी के लिए आवेदन किया था और सक्षम प्राधिकारी ने छुट्टी से इन्कार कर दिया था , तो उसे , यथास्थिति , 60 वर्ष था 58 वर्ष की भायु का होने पर छुट्टी का उपभोग वारने की छानुशा दो जा सकती है, और ऐसी दशा में सम्बन्धित अधिकारी या व्यक्ति इस प्रदार इन्कार की गई छुट्टी की सभाप्ति पर सेवा से सेवा निवृत्ति हुना समझा जाएगा ।

(3) पैरा ( 1 ) या पैरा ( 2 ) में किसी बात के होते हुए भी, --
(क) साधारण बीमा (अधिकारियों के वेतनमानों और सेवा की अन्य शर्तों का सुव्य- वस्थीकरण ) स्कीम , 1975 से उपाबद्ध प्रथम अनुसूची में निदिष्ट अधिकारी के सम्बन्ध में , केन्द्रीय सरकार ;
(ख) खण्ड (क ) में निर्दिष्ट स्कीम से उपाबद्ध द्वितीय अनुसूची में निर्दिष्ट साधारण प्रबन्धक या सहायक साधारण प्रबंधक के सम्बन्ध में , निगम का बोर्ड;
(ग) खण्ड ( क ) या खण्ड ( ख ) में निदिष्ट अधिकारी से भिन्न अधिकारी के सम्बन्ध में, या विकास कर्मचारीवृन्द में के किसी व्यक्ति के सम्बन्ध में , कम्पनी का बोर्ड;
सम्बन्धित अधिकारी या व्यक्ति को तीन मास की सूचना देकर या उसके बदले में वेतन देकर,
( i ) यदि यह व्यक्ति अन्तरित अधिकारी या अन्तरित विकास कर्मचारिवृन्द में से कोई व्यक्ति है तो 55 वर्ष की आयु प्राप्त कर लेने के पश्चात् ; या
( ii ) यदि वह व्यक्ति 1 जनवरी , 1973 को या उसके पश्चात् नियुक्त किया गया है तो, 50 वर्ष की आयु प्राप्त कर लेने के पश्चात्,
उसकी सेवा समाप्त कर सकती है या कर सकता है ।
(4 ) पूर्ववर्ती उप पैरा में की कोई बात नियुक्ति प्राधिकारी के निम्नलिखित अधिकारों पर प्रभाव नही डालेगी, -
(क ) कर्मचारियों के सम्बन्ध में , यथास्थिति, निगम या कम्पनी द्वारा तैयार किए गए आचरण , अनुशासन और अपील नियमों के उपबन्धों के अनुसरण में कर्मचारि- वृन्द में के किसी व्यक्ति को सेवानिवृत करने , हटाने या पदच्युत करने का अधिकार;
(ख) साधारण श्रीमा ( विकास कर्मचारिवृन्द के वेतनमानों और सेवा की अन्य शर्तों का सुव्यवस्थीकरण ) स्कीम , 1976 के पैरा 5 के उप पैरा ( 3 ) या पैरा 11 के उपबन्धोंके अनुसरण में विकास कर्मचारिवृन्द में के किसी व्यक्ति की सेवा समाप्त करने का अधिकार ;
(ग ) किसी अधिकारी या विकास कर्मच। रिवृन्द में के व्यक्ति को बिना सूचना दिए या उसके बदले में वेतन देकर उस दशा में सेवानिवृत्त करने का अधिकार जब कोई स्वास्थ्यपरीक्षक , जो नियुक्ति प्राधिकारी द्वारा उस प्रयोजन के लिए नामनिर्दिष्ट किया जाए , ऐसा प्रमाणित करे कि वह व्यक्ति लम्बी बीमारी या दुर्घटना में से किसी के कारण आगे और सेवा करने के योग्य नहीं रहा है :
परन्तु यदि किमी अधिकारी या कर्मचारिवृन्द में के किसी व्यक्ति के जमाखाते में छुट्टी उपार्जित है और वह ऐसी उपार्जित छुट्टी उस तारीख से जिसको इस उप पैरा के अधीन उसे सेवानिवृत्त करने का विनिश्चय उसे संसूचित किया जाता है , ले लेता है तो वह अपने जमाखाते में की कुल उपार्जित छुट्टी का उपभोग करने के लिये अनुज्ञात होगा और ऐसी स्थिति में उसकी सेवा निवृत्ति ऐसी छुट्टी की समाप्ति की तारीख से प्रभावी होगी ।

5. सेवा की समाप्ति ( 1 ) परिवीक्षाधीन से भिन्न अधिकारी या विकास कर्मचारित्रुन्द में का कोई व्यक्ति नियुक्ति प्राधिकाी को सेवा छोड़ने या विच्छिन्न करने के अपने आशय की सूचना लिखित में पहले से दिए बिना सेवा नही छोड़ेगा या विच्छिन्न करेगा तथा अपेक्षित सूचना की अवधि तीन मास होगी:
परन्तु ऐसी सूचना नियुक्ति प्राधिकारी के विवेकानुसार भागतः या पूर्णतया अधित्यक्त की जा सकती है ।
स्पष्टीकरण 1--इस स्कीम में , भास की गणना अंग्रेजी कलैण्डर के प्रनुसार की जाएगी और मास उस तारीख से श्रारम्भ होगा जिसको सूचना , यथास्थिति , निगम या कम्पनि द्वारा प्राप्त की जाती है ।
स्पष्टीकरण 2 --अधिकारी या विकास कर्मचारिवृन्द में के किसी व्यक्ति द्वारा इस पैरा के अधीन दी गई सूचना केवल तब ही समुचित समझी जाएगी जब ऐसा अधिकारी या व्यक्ति सूचना की अवधि के दौरान कर्तव्य पर रहा आता है तथा ऐसा अधिकारी या व्यक्ति कोई भी उपार्जित छुट्टी ऐसी सूचना की अवधि में से मुजरा करने का हकदार नहीं होगा ।
( 2 ) उापैरा ( 1 ) के उपबन्धों का किसी अधिकारी या विकास कर्मचारिवृन्द में के किसी व्यक्ति द्वारा उल्लंघन किए जाने की दशा में वह , यथास्थिति, निगम या सम्बन्धित कम्पनी को , उससे अपेक्षित सूचना को अवधि के लिए अपने वेतन के बराबर राशि , प्रतिकर के रुप में देने का जिम्मेदार होगा और ऐसी राशि की कटौती उसे शोध्य किसी धन में से की जा सकती है ।
